XX – ESTABLISHING FEES
XX.X – Methods for Determining Fair Market Value
The following schedule should be used to compute the fee for land-use authorizations where the
fee is based on land-only value. This schedule is based on typical prices of land for each acreage
category and defined market area. This includes all new uses, re-issuances for existing uses, and
authorizations that include or can be amended to include terms and conditions that allow
adjustment of fees. This schedule shall not be used for authorizations which already are covered
by another fee system or schedule; such as linear rights-of-way, recreation residences,
concessionaire or ski area, government owned facilities, seismic exploration, commercial
filming, communication sites, outfitter-guide permits and recreational events. Market areas
identified as being excluded in the schedule, or properties with a unique highest and best use
require an actual appraisal. Questions to this regard should be made to the Forest Service Review
Appraiser assigned to that unit or the Regional Appraiser.

Explanation of boundary delineations for each area on the San Juan National Forest map in
Colorado:
A. The Pagosa area includes all that portion of the San Juan National Forest that includes all
the southern portions of Hinsdale and Mineral Counties; all of Archuleta County (except
for a small section just east of Montezuma Peak which is in the Rio Grande National
Forest) and portions of four sections in the very southwest corner of Rio Grande County.
The area includes a very small portion within the very west boundary of Conejos County.
B. The La Plata area is all that area within La Plata County with exception to the Electra
neighborhood which is described in more detailed in area F.
C. The Montezuma area is all that area within the Montezuma County boundary.
D. The San Juan area is all that area in San Juan County with the exception of the small
portion of the Electra neighborhood described in more detail in area F.
E. The Dolores area includes all that area within the Dolores County boundary with the
exception of the Rico area described in greater detail under item G below.
F. The Electra Area is described as a seperate neighborhood because of its resort influences
on prices. The neighborhood starts at the common corners of Sections 31, 32, Township
38 North, and Sections 6, 5, Township 37 North, both being in Range 8 West. From this
corner the line travels straight north along the common section lines and through the
Animas River 12 miles to US Highway 550 and common Section corners 31, 32, 5 and 6.
The line then travels due west along the common Township line to 39 North and 40 North
four miles to the NW corner of Section 3, and the NE corner of Section 4, Township 39
North, Range 9 West. Then this line travels due south along the common section lines
exactly 12 miles to the common Section corners to 33, 34, 3 and 4. Then boundary travels
due east along the common section lines exactly four miles to the point of beginning.
G. The Rico area is described as starting at a common corner of Sections 17, 18, 19, and 20 in
Township 39 North, Range 11 West. Sections 17 and 18 are in Dolores County and 19 and
20 are in Montezuma County. This line travels due east 6.5 miles along said common
county line to the point that San Juan, La Plata, Montezuma and Dolores County provide a
common corner. The line follows the Mancos-Dolores and Columbine Ranger District line
up to a section point in Section 27, Township 40 North, Range 10 West. The line then
travels at a 45 degree angle northwest through Section 27, 21, 17 and 7 to Truby Creek.
The boundary then travels due west along the common line between section 6 and 7, 1 and
12, and 2 and 11 to the middle of the common line to Sections 2 and 11. The line then
traverses southwest diagonally across Sections 10, 16, and 17 to the common section
corners 17, 18, 19 and 20, Township 40 North, Range 11 West. This same boundary
travels due south along the common line to Sections 19 and 20, 29 and 30, 31 and 32, 5
and 6, 7 and 8, and 17 and 18 to the point of beginning.

The previous schedule is based upon current vacant land comparable sales data. Unique or
extremely special land uses may warrant an actual appraisal. It is expected that the previous
schedules shall apply to virtually all land-use authorization fee determinations where the fee is
based upon land value and the use is not covered by an alternative fee system.
The permitted area should be multiplied times the appropriate land value per acre shown in the
schedule. This figure is then multiplied times 8 percent (non-agricultural uses) or 5 percent
(agricultural uses). The result should then be rounded to the nearest whole dollar. In no case shall the
fee be less than the minimum established for Region 2.
EXAMPLE: Speculation Cattle Company, Inc has applied for a land-use authorization for
a small non-agricultural use on the Dolores Ranger District. This use is located near the
Meadows up near Navajo Lake Trailhead. This is located in the Dolores County
described neighborhood under Area E. The District Ranger determines the authorization
serves the public interest and an area of 2.30 acres will be permitted. In the absence of
sales for similar uses, land suitable for this particular use would typically be sales in the
same neighborhood. The proposed permitted use is located in an area of small ownerships
of 2 to 5 acres. The fee is calculated by multiplying the permit area of 2.30 acres times
$15,000 per acre as indicated in the fee schedule under the Supplement. This indicates a
tyical price for these type of lands at $34,500 times the 8 percent for non-agricultural uses
= $2,760. This is typically rounded to the next whole dollar amount. In this case the
figure of $2,760 needs no rounding. Therefore, the annual fee for this proposed use
would be charged at $2,760.
The fee determination statement required to be included in each special-use file should reference
this supplement and contain calculations similar to the above example.
