CHAPTER 20 - ATTENDANCE AND LEAVE
26 - GENERAL PROVISIONS FOR ANNUAL AND SICK LEAVE.
26.1 - Annual Leave.
26.18 - Restoration of Forfeited Annual Leave.
26.18b - Due to Exigency of Business. This explains annual leave scheduling
requirements and what documentation is needed should a later exigency cause
forfeiture of an employee's annual leave.
1. Leave must be scheduled and approved in advance by the official having
authority to approve leave.
2. To be considered for restoration, the annual leave must be cancelled in
advance and in writing by the RO Director, Forest Supervisor, District Ranger,
Forest Staff Officer, or PNW Project Leader and must show the beginning date of
the exigency. The cancellation must be confirmed in writing by a line officer at the
next higher organizational level (Regional Forester, Station Director, Forest
Supervisor). All cancellations at the Forest Supervisor's Office and in the Regional
Office must be approved by the Regional Forester or his acting. All cancellations at
the Forestry Sciences Laboratories and Station Headquarters must be approved by
the Station Director. The Regional Forester and Station Director, and their
Deputies and Assistants who are required to lose annual leave because of an
exigency must have the cancellation approved in writing by the Chief.
3. When annual leave is forfeited, employees must request restoration of the
leave through the Forest Supervisor, RO Director, or Project Leader.
a. The Forest Supervisor, RO Director, or Project Leader must review the
case to determine if the cancellation meets the requirements of FSH 6109.11,
section 26.18b. If satisfied, the restoration case should be prepared and submitted
to the Regional Forester through the Director of Personnel Management no later
than April 1 of the following year. When submitting a case for approval the file
must include a leave audit from pay period 1 of the leave year in which the leave
was lost through pay period 1 of the following year in addition to those documents
listed in the FSH 6109.11, section 26.18b handbook.

b. The case will be submitted to the Deputy Regional Forester for
Administration who will make the final decision for Region 6 employees, or to the
Assistant Station director for Research Support Services who will make the final
decision for PNW employees. If the forfeited annual leave is approved for
restoration, form AD-582 will be prepared in the Regional Office and sent to the
appropriate Unit with instructions for processing. Cases requiring Washington
Office approval will be forwarded to that office for final adjudication.
26.2 - Sick Leave.
26.23 - Advancing Sick Leave. RO Directors, Forest Suprvisors, District Rangers,
and PNW Project Leaders may advance up to 240 hours of sick leave to an employee
with a serious disability or illness. Serious disability or illness is any condition
which has caused an employee to be confined to a hospital or at home under the
care of a physician. The manager must have administratively acceptable evidence
before the sick leave can be advanced. Administratively acceptable evidence is a
written statement from a physician, or other documented evidence, that specifies
the disability or illness and the seriousness of the medical condition.
In addition to the requirements of FSH 6109.11, section 26.23, sick leave cannot be
advanced:
1. When it is known, or reasonably expected, the employee will separate
from the service before the sick leave debt can be repaid.
2. After the Office of Personnel Management (OPM) has approved disability
retirement. However, sick leave may be advanced when the employee has
applied for disability retirement, but the disability retirement has not
been approved by the OPM.
