SCUPA/PASSHE Tentative Agreement
Term

4 year agreement effective July 1, 2011
Article 5
SCUPA BUSINESS
Section 7.
When the President of a university or his/her designee appoints a search committee or
other university committee that impacts the SCUPA unit working conditions, the
President, or his/her designee, shall consider SCUPA representation on such committees.
When the President of a university or his/her designee appoints a search committee
or other University committee, President or his/her designee shall extend the
opportunity for SCUPA representation on any such committee that includes 2 or
more unions. Action or inaction by the President, or his/her designee, in accordance
with this section shall not be subject to the Grievance and Arbitration procedure provided
for in Article 13.
Article 9
WORKLOAD
Section 1
B.
A University or the Office of the Chancellor may appoint newly hired or
existing nine-month professional employees to start up to four (4) weeks before the
beginning of the fall academic semester or up to four (4) weeks after the beginning
of the fall academic semester. In either case above, the end of the spring semester of
that academic year will be adjusted accordingly to maintain a nine-month schedule
for the academic year for the nine-month professional employee.
Section 2
E. Effective with ratification of this Agreement, employees will continue to be
scheduled for a 37.5 hour week with the following amendment:
1. All employees may be required to work an additional 2.5 hours per week for 26
weeks per contract year as designated by management at each University.
During these designated weeks all compensatory time will accrue after 40 hours.
The weekly compensation for the designated week schedule will be the same as
the weekly compensation for the 37.5 hour schedule.
2. The pay rate in effect for compensatory time earned during the designated week
will be based on the 40 hour work week rate of pay. (Regular Bi-weekly
salary/80 hours)
3. Management must notify the employee, in writing, at least two weeks prior to
the implementation of the weeks noted above in #1.
4. The scheduled work week for the undesignated weeks will be based on a 37.5
hour schedule. During these undesignated weeks all compensatory time will
accrue according to Article 9, Section 2A.
5. Leave used will be based on a 37.5 hour schedule. If a full day (7.5hrs) of leave is
used in a designated week, the employee must still work 32.5 hours during the
designated week.
6. If using compensatory time, employees will notify management if they are using
time accrued during a designated or undesignated week.
This amendment will expire on June 29, 2015 at 11:59 p.m.
ARTICLE 10
SALARIES AND WAGES

Section 8
All professional employees, including Grant Funded Program Coordinators, hired
into classifications covered by this agreement shall be paid at the minimum rate of the
pay range. Above the minimum appointments may be made with the concurrence of the
Office of the Chancellor and the State College and University Professional Association
(SCUPA). This provision will not apply to bargaining unit members who move from one
PASSHE University to another.
Side Letter


During the first 2 years after ratification of the contract, the parties will
collaboratively explore redesigning the SCUPA compensation system so that it
might reflect market based concerns.
Side Letter Agreement will be shared when drafted.
ARTICLE 12
CLASSIFICATION
Section 2
4.
The determination of the Final Appeal Committee shall be controlling except that
the Chancellor may decide not to accept/implement a specific decision. In such cases,
SCUPA will be advised, in writing, as to the reason the decision is not acceptable.
Neither the decision of the Chancellor nor classification appeals shall be subject to the
Grievance and Arbitration Procedure provided for in Article 13 of this Agreement.
Effective January 1, 2015 Article 12, Section 2.A.4. the determination of the Final
Appeal Committee shall be final.
Section 4
The Employer shall provide up to $100,000 for a consultant to review the current method
used to classify positions in this bargaining unit, including the current benchmarks, and
submit recommendations for review by the Employer. SCUPA will be provided an
opportunity to review and comment on the scope of the work used to secure a consultant.
Prior to implementing any changes to the current classification method and/or
benchmarks, the Employer will review such with SCUPA. Neither SCUPA nor the
Employer waive their right to raise whether implementation of the results of the
consultant’s review is subject to mandatory bargaining.
ARTICLE 18
VACATIONS
Section 8.
Unused annual leave shall be carried over from one calendar year to the next
provided that in no case shall the amount thus carried over exceed forty-five (45) days.
However, employees will be permitted to carry over annual leave in excess of the forty-five
day limit into the first seven (7) pay periods of the next calendar year. Any days carried
over in accordance with this Section which are not schedule and used during the first seven
(7) pay periods of the next calendar year will be converted to sick leave, subject to the 300
day limitation contained in Article 19, Section 2. Scheduling of those days carried over
shall be in accordance with Section 3 above.
ARTICLE 28

Health Care Benefits for Retirees
“Me too” to what is available for management employees
A. Effective July 1, 2011, provisions of the Pennsylvania State system of Higher
Education Group Health Plan (including prescription drug), the Pennsylvania
State System of Higher Education Annuitant Health Care Program (AHCP),
and the dental, vision and hearing benefits as structured in accordance with the
management benefits program on the effective date of this Agreement and any
subsequent restructuring of the program after July 1, 2011 will apply to eligible
employees, annuitants, or future annuitants covered by this Agreement. This
section does not include the benefits extended to same-sex domestic partners as
provided for in the active employee health benefits program.
ARTICLE 29
LIFE INSURANCE
Section 3.
The Employer shall continue to provide each professional employee who is covered
under the currently existing life insurance plan with fully paid accidental death benefits
for work-related accidental deaths. The amount of coverage is $10,000, $20,000 unless
the survivor or minor children are entitled to benefits under Act 101 of 1976.
ARTICLE 31
TEMPORARY PROFESSIONAL EMPLOYEE
Section 1.
A temporary professional position, full or part-time, may be created for up to twenty-four
consecutive months. Each position shall have a starting date and an ending date. The
Employer may extend a temporary professional position for up to an additional twentyfour months only with the concurrence of the Statewide SCUPA President. The
Statewide SCUPA President will not deny an extension for arbitrary or capricious
reasons. The Statewide SCUPA President will respond to the request within 5
working days. Prior to extending any temporary professional position, the Employer
shall provide the local SCUPA representative with the reason(s), in writing, as to why the
temporary professional position must be extended and offer to meet and discuss with
SCUPA on this issue. The reason(s) for an extension of a temporary professional position
shall not be arbitrary or capricious. The Employer shall provide the Statewide SCUPA
President with the reason(s), in writing, as to why the temporary professional
position must be extended.
ARTICLE 33
FURLOUGH AND RECALL
Section 5.
The four (4) five (5) Statewide Officers, the four (4) members of the Statewide Executive
Board of SCUPA and the fourteen (14) SCUPA Campus Presidents shall have
superseniority in the event of a furlough. Such superseniority will be exercised only in
the situation where a decision has been made by the President that a professional
employee occupying one of the offices noted above possess the necessary skill and ability
to perform the job of the professional employee with greater seniority standing.
ARTICLE 34
VACANCIES
Section 1
The Employer agrees to post any vacancy in a SUA position covered by this Agreement.
No position shall be filled unless posted for a minimum of fifteen (15) days unless an
emergency requires a lesser period of time. A copy of the posted notice shall be sent to
the designated campus representative of SCUPA at the university where the vacancy
occurs and to the President of SCUPA. In addition, notice of the vacancy shall be sent to
each university by electronic mail for posting until the regular posting notice is received.
A copy of the electronic mail posting shall be sent to SCUPA at 4746 4750 Delbrook
Road, Mechanicsburg, PA. 17055 or via electronic mail to the UniServ
Representative.
ARTICLE 35
PROFESSIONAL DEVELOPMENT/OUT-SERVICE TRAINING
Section 1.
Permanent professional employees may, with the prior written approval of the
President or his/her designee for University requests or the Chancellor or her/his designee for
Office of the Chancellor requests, participate in out-service training, consistent with the
Pennsylvania State System of Higher Education Rules and Regulations. The Employer agrees to
Meet and Discuss prior to the implementation of any change in Management Directive 535.3,
Out-Service Training, dated November 16, 1999, as adopted by the Pennsylvania State System of
Higher Education and regulations regarding out-service training.
Section 2.
A.
The Professional Development Program for professional employees shall
continue in accordance with the provisions of Appendix G. PASSHE shall contribute the
following monies to support this Professional Development Program:
July 1, 2007 - $75,000
July 1, 2008 - $75,000
July 1, 2009 - $85,000
July 1, 2010 - $95,000
B.
If at the end of any given fiscal year, there is a System-wide cumulative
balance of allocated but unexpended professional development funds of $150,000 or more,
PASSHE will not be required to make the payment in the subsequent fiscal year.
C.
Any allocated but unexpended funds shall be added to the payments
referenced in 2.A above, and the cumulative amount shall be allocated to the universities in
accordance with the provisions of Appendix G.
ARTICLE 36
MISCELLANEOUS PROVISIONS
Section 12.
PASSHE/Universities shall modify their tuition waiver policy that shall supersede all prior
University and/or Board of Governor policies and shall establish a uniform policy for all
professional employees covered by this Agreement as follows:
1.
Effective Spring semester 2013, Ttotal waiver of tuition for eligible professional
employees at the University where employed any PASSHE University. This
waiver shall be applicable for undergraduate credits not to exceed 128
undergraduate credits or graduate credits not to exceed 60 graduate credits or any
combination of undergraduate or graduate credits up to 60 credits and shall be on
a "space available" basis as certified by the appropriate management authority.
The graduate credit waiver is effective beginning with the fall 2008 semester. The
total number of undergraduate and/or graduate credits that may be taken shall be
limited to a maximum of 6 credits per semester and must be taken during nonworking hours. Eligible professional employees are responsible for their
portion of the distance education incentive given to a faculty
member/instructor of their class.
3.
Total waiver of tuition for spouses/same sex domestic partner of eligible
professional employees at the University where employed. This waiver shall be
applicable to the professional employee's spouse until he/she obtains his/her first
undergraduate degree and shall be on a "space available" basis as certified by the
appropriate management authority.
6.
Effective spring semester 2013, fifty percent (50%) waiver of University
tuition for newly admitted children and spouse/domestic partner at PASSHE
Universities other than the PASSHE University where the professional
employee is employed. This waiver of tuition shall be applicable until the
children obtain the first undergraduate degree or until the children reach the
age of twenty-five (25), whichever occurs first, and shall be on a "space
available" basis as certified by the appropriate management authority.
7.
Effective spring semester 2013, fifty percent (50%) waiver of University
tuition for newly admitted spouse/same sex domestic partner at PASSHE
Universities other than the PASSHE University where the professional
employee is employed. This waiver shall be applicable to the professional
employee's spouse/same sex domestic partner until he/she obtains his/her

APPENDIX G.
PROFESSIONAL DEVELOPMENT PROGRAM FOR EMPLOYEES REPRESENTED
BY THE STATE COLLEGE AND UNIVERSITY PROFESSIONAL ASSOCIATION
1.
Purpose
The collective bargaining agreement between the Pennsylvania State System of Higher
Education (PASSHE) and the State College and University Professional Association
(SCUPA), provides funds for a professional development fund. These funds are to be
used by employees to pursue training, advancement, and study opportunities and are not
intended to be a substitute for other routinely budgeted professional development funds.
PASSHE and SCUPA agree to the funding distribution method and the establishment of
university committees, as provided for herein, and needed changes will be reviewed by
the parties prior to the expiration of the current collective bargaining agreement.
2.
Distribution of Funds
A portion of the funds provided for in Article 35 of the parties’ collective bargaining
agreement shall be distributed to each university based on the number of permanent full and
part-time employees on the payroll as of May 15 of the previous academic year. Each
university shall establish a separate SCUPA professional development account. Any monies
not spent in a fiscal year will remain in the SCUPA professional development account and
will be available for redistribution in the following fiscal year.

A joint committee shall be established at each university for the purpose of
reviewing and acting on requests for professional development funds. The
committee will be comprised of two members appointed by the president and two
representatives appointed by SCUPA. The committee will select a chairperson
from its membership.
The committee will announce the availability of professional development funds
by providing each employee a copy of the guidelines and the procedure for
submitting requests, which shall be transmitted using the most efficient method
available.
The committee will determine the appropriate relevance of each request and
determine the amount of funding to be provided. The committee will forward to
the appropriate university office the necessary documentation to authorize the
disbursement of professional development funds.
The committee shall advise all employees who have submitted a request of its
decision no later than 15 working days following the decision. In addition, the
committee shall provide a report to the university president and the university
SCUPA representative listing the names of all employees submitting a request, a
brief description of the request, what action was taken on the request, and the

amount of professional development funds, if any, authorized and paid out to
support the request.
E.
In the event a SCUPA appointed committee member submits a request, he/she
shall not participate in the review of his/her request and an alternate committee
member shall be named.

Professional development funds are available to permanent full and part-time
employees who are in an active pay status during the fiscal year in which the
request is submitted. Preference, however, will be granted to full-time
employees.
Employees on leave without pay may not request a salary replacement from the
professional development funds.
Requests shall be considered only in the category designated on the title page by
the employee.
Submission Requirements
A.
Each committee will determine and publish the deadline for submission of
requests; the committee will notify the local SCUPA representative if any funds
are available for the then current fiscal year on a quarterly basis, unless agreed
to otherwise at a particular university.
B.
Four copies of each funding request are to be submitted to the committee along
with one copy of the Demographic Data Form (Attachment 4). This form is
optional, but PASSHE/University appreciates having the data, which it uses in
aggregate to ascertain which categories of employees are using the programs. Do
not attach it in any way to any copies of the request.
Categories for Requests
A.
Educational Advancement. Employees seeking to complete an advanced degree
or individual courses at an accredited university in a field that is related to their
employment responsibilities may submit requests for funding through this source.
Any other university funding sources may also be sought to provide this
opportunity to SCUPA employees. Requests in this category may not exceed
$1,500 per year.
B.
Professional Conferences. Employees may apply for funding to attend national or
regional conferences. The total amount of funding per individual may not exceed
$1,500 per year.
C.
Institutional Groups. Each university may elect to support teleconferences, the
Pennsylvania State System of Higher Education Biannual Student Affairs
Conference, or other multi-university opportunities. Moneys requested for a
teleconference may not exceed $1,500 and may be used to support more than one
program. PASSHE universities encourage the participation of several universities
in promoting multi-university opportunities for professional development.

University travel funds from other sources may be applied to support this
category.

Special Programs on Research Development. Employees seeking to enhance
research skills or to promote current research projects may request funding in an
amount not to exceed $1,500 per year. Funds may be used to complete doctoral
research, individual research interests that lead to submission of articles to juried
journals pertinent to the field of student learning, student personnel, counseling,
higher education, and/or other related fields not to exceed $1,500 per year.
Preparation of a Request
A.
The title page, including the abstract, must follow the format provided herein
(Attachment 1). The request must be received by the committee in accordance
with the published deadline.
B.
The request should contain a program narrative; an outline of the purpose of the
request (including goals/objectives) not to exceed one full page; anticipated
benefit of the request not to exceed one page; and other pertinent materials that
support the request, such as endorsement from supervisor(s) as to the relevance to
the employee's current job responsibilities and impact on work schedules, if any,
timetable of research, outline of presentations, or course work to be taken. A
recommended outline for the request is included herein (Attachment 2).
C.
The budget is the final page of the request. A recommended format is included
herein (Attachment 3). This page is not applicable for requests made under 6.A. or
B. above, and is not required for those categories of request.
