(It is pertinent to mention D.R.Saini ji never taught History-nor is that his core subject & cadre change is against rules totally) Private schools flout guidelines in filling top positions Avinash Singh Sudan, New Delhi, Jun 28, 2013, DHNS : DoE unable to check such wrong appointments, says RTI activist Private schools in the capital are violating rules in the appointment of principals or vice principals, and the Directorate of Education has failed to check the bungling going on in the administration of such institutions, alleged an RTI activist. Ranajit Roy had filed an RTI application seeking information on the appointment of D R Saini as the principal of Delhi Public School, RK Puram. He said when Saini was promoted to principal’s post he was a Physical Education teacher. “The Right to Information reply said that D R Saini is a Physical Education teacher. And according to the DoE’s guidelines a Physical Education teacher cannot be elevated to the post of principal or vice principal,” said Roy. But D R Saini refuted the allegations. “Yes, I teach Physical Education and I teach History also,” he said. When he was asked in which class does he teach History, Saini said, “I am busy, can’t talk right now.” According to Roy, it is the incompetence of the DoE to keep tabs on the administration of private schools. “The most reputed schools in Delhi are violating rules and the government agency — DoE — has 4 failed to check it. It is not the smartness of schools’ management committee, but it is the incompetence of the DoE,” said the RTI activist. He added that the Delhi Public School, Mathura Road, is also flouting rules. “The RTI also revealed that the vice Principal Kusum Kathuria of DPS, Mathura Road, is also a Physical Education teacher,” said Roy. The school authorities, however, refused to comment on the issue. Roy said he had approached DoE many times in this regard, but nothing has happened yet. “The authorities have a standard reply that the Delhi Public School Society is an elite organization,” he added. The DoE officials did not comment on the issue after repeated efforts. Delhi Public School Society has a large number of schools under its control in India and abroad. It is the administrative authority for all the institutions under its banner. There are over 150 Delhi Public Schools in the country. Rajkumar Sharma and Sh. K N Jha Suptt. Act Branch on behalf of PIO. The appellant has submitted that he is a PGT (Physical Education) and he is asked the information whether the PGT (Physical Education teacher) are eligible for the promotion to the post of VicePrincipal/Principal which has been verified from his application, but the PIO has furnished the information that physical education teacher are not eligible for promotion to the post of vice-principal/principal. Further the appellant has mentioned only PGT of the recognized school but actually he is asking the information pertaining to the recognized unaided school. In view of these discrepancies the PIO is directed to furnished the information in r/o eligibility of PGT (Physical education) for promotion to the post of Vice-Principal /Principal in the recognized unaided schools. Accordingly the appeal is dispose-off. From CBSE BYE LAWS CHAPTER-X 55. Exemption from Minimum Qualifications The Board has laid down minimum qualifications in respect of Heads and teachers for teaching subject/classes. Generally no exemption from minimum qualifications is considered by the Board. However, in case there is a shortage of teachers in a particular subject or qualified teachers are t available in a remote area, the Board may 19 consider requests for exemption from minimum qualifications under special circumstances for some years. e Board will consider such requests only in case of private unaided schools run by Government, autonomous bodies like K.V.S., Navodaya Vidyalaya Samiti, Sainik Schools Society etc. may take cision in this regard at their own end. Is this Relief works?? But this also doesn’t help Respected Dr. Daulat Ram Saini, because city like Delhi, capital of 1.India is not a remote location. 2. Thousands of qualified teachers are eager to join DPS RK PURAM if you give them an opportunity. Not only this, he is such a genius under the Sun and over the Earth that he completed his Doctorate PhD., L.L.B and M.Ed. during his service as a teacher/Vice-Principal. I don’t know why other esteem faculty members (rather I appeal to all school teachers) take an inspiration and guidance from such a genius to follow his path and enrich the country most reputed school. Conclusion – Respected Dr. Daulat Ram Saini may be an exceptional educationist, administrator and is a principal of DPS R.K. Puram in eyes of world but truth is shouting something else. And what he has attained, it looks like that all is on the False, manipulated, ill-legal ground. This case-study (I wish) may be totally false, but the onus to prove it wrong lie with Directorate of Education Delhi and of course Respected Dr. Daulat Ram Saini/Delhi Public School Society. The appellant has submitted that he is a PGT (Physical Education) and he is asked the information whether the PGT (Physical Education teacher ) are eligible for the promotion to the post of VicePrincipal/Principal which has been verified from his application, but the PIO has furnished the information that physical education teacher are not eligible for promotion to the post of vice-principal/principal. Further the appellant has mentioned only PGT of the recognized school but actually he is asking the information pertaining to the recognized unaided school. In view of these discrepancies the PIO is directed to furnished the information in r/o eligibility of PGT (Physical education) for promotion to the post of Vice-Principal /Principal in the recognized unaided schools. Accordingly the appeal is dispose-off. Conclusion- As the above teacher is not B.Ed which by BYE LAWS an essential qualification for VICE-Principal is Gross voilation of Land of the Law by not only India’s reputed School and It’s Management Commiitee but also the Government agency i.e. Dirtectorate of Education which has failed at each and every steps to check it. Saini, with the National Award for teachers on 5 September. However, students and teachers of the school claim that his conduct is unfit for not just the honour, but also his position as the head of a school. They accuse Saini of extremely abrasive behavior and using foul language in front of students. Speaking to The Sunday Guardian on the condition of anonymity, a senior faculty member said that Saini was in the habit of using foul language unbecoming of a teacher while interacting with students and teachers. Saini had served as the Physical Training (PT) teacher of the school before he was appointed vice-principal in 1995. He was appointed principal in 2009. "His communication skills, especially his language, are a casualty, to put it mildly. The kind of language he uses, both in Hindi and English, is unacceptable. Please read between the lines," said a senior faculty member, until recently associated with DPS RK Puram. On paper, Saini's qualifications meet the specifications for occupying such a position. "He (Dr Saini) meets all the requirements for being appointed principal as per the Delhi government rules. He has a doctorate degree and was associated as a vice-principal with the school for many years. Now he has received a National Award. He turned 60 in March, which means he was due for retirement. But because of the award, he may get an extension for two years," said a highly placed source from the school. "One has to consider if just meeting specifications on paper is enough to be appointed principal," the source added. Former students who graduated during the mid-1990s said they were surprised when Saini was appointed the vice-principal then. They said that he was appointed over other candidates considered more deserving than him. "We did not expect someone like him to be appointed vice-principal at all. We remember his being extremely abrasive with the boys in the sports teams and the band. Not so much with the girls. He would also physically hit some of the boys who were considered more unruly," said a former student. "But to give the man his due, students in one of the senior sections he taught were extremely fond of him too," the student added. But the 18-year-old had his own aspirations and seeing dark clouds hovering 28 over them he decided to take the extreme step on April 23. The class XII student of Delhi Public School, RK Puram committed suicide by hanging himself from the ceiling of his rented accommodation in Malviya Nagar area of south Delhi. His family says he was concerned about his board exam results. Yash was living with his elder sister, a student of fashion designing, for the past two years. His mother had come to meet him for a few days. Mother and daughter had gone to a nearby market for shopping when Yash took the extreme step. "At around 5 pm they came back home and found the door locked from the inside. They called Yash several times but he didn't open the door. They then called their relatives who live in south Delhi area. The relatives broke open the door and discovered Yash hanging from the ceiling of the gallery of the house. At around 8 pm, three hours after the incident, the family came to the police station to inform the cops about the suicide," said a senior police official. Cops said he was rushed to AIIMS where he was declared brought dead. Police said that according to his family member's statement Yash had planned to go Singapore for further studies. But the university he had chosen had eligibility criteria of 95 per cent marks in class XII. Yash was worried as he could not do well in one of his exams. He was worried about it and this could be the reason behind his suicide. Police officials said that a suicide note in the form of a poem was found. "He has expressed his grief in a 15-line poem. It's like the song from the Bollywood movie 3 Idiots: "Give me some Sunshine". We have recovered it from the rear pocket of his trousers," said a senior police official. Family members told the police that Yash had recently purchased a rope from the market which he used to hang himself. Yash was a bright student. He scored 91 per cent in his class X exams when he was a student of Doon School, Dehradun. He got admission at DPS RK Puram in the science stream two years ago. Yash's father Bachchan Singh is a famous businessman and owns several three-star hotels in Hrishikesh. Pushpanjali Raj, a Class 11 student in the science stream of the DPS at R.K. Puram, was taken to the Holy Angel hospital in Vasant Vihar at 3 p.m., where she was declared brought dead, hospital officials said. The police said that they were informed of the death at 4.39 p.m. The body was sent for a post-mortem examination and the police were investigating the matter. However, Deputy Commissioner of Police (Southwest) Shalini Singh refused to comment on the investigations. "According to the hostel warden, Pushpanjali Raj locked the common bathroom from inside, cut the mesh wire of the bathroom window and apparently jumped off from the window," said DPS (R.K. Puram) principal Shyama Chona. Raj, who was from Jharkhand, was staying in room number 504 on the fifth floor of the girls hostel in school premises. "The school staff brought her to the Holy Angels, the nearest medical centre. Necessary steps were taken to ensure prompt response," Chona said. "She was brought to hospital between 4.00- 4.15 p.m. However, she succumbed to her injuries. She had suffered severe head injuries," Chona said. "We at school are grieved on her death. She was a good student and a happy child. Her parents, police and the local guardian were immediately informed about the incident," Chona added. Asked if she had any problem with other students, Chona replied in negative. Holy Angels Hospital managing director D.N. Anand said: "The girl was brought to the hospital at around 3 p.m. and she was declared brought dead." The girl's local guardian Durgesh Pandey, a friend of her father, cried foul and stated that a proper and thorough investigation should be done. 30 "The girl had joined the school only a couple of months ago. She was not someone who would commit suicide," said Pandey, a scientist by profession. "She was of a short height, so it is hard to imagine that she cut the wires of the bathroom window and jumped from there. It needs to be investigated whether she committed suicide or she was killed. We have not seen the bathroom. But school authorities are for sure in doubtful position," he added. Her father Shiv Narayan Ram is the managing director of a cooperative society in Jharkhand and the family is from Hazaribagh, he added. The warden of the girls hostel, Rajbala, said she had seen Pushpanjali around 2.30 p.m. when she marked the attendance. "She had lunch and after that she went to change her uniform," said Rajbala. "She didn't seem to be tense." Shilpi, a software engineer who is a friend of Pushpanjali's brother Purushottam Raj, said: "Purushottam had returned to Hyderabad only two days ago after meeting her. Although, no officer wants to come on record, they believe that the case is indeed a suicide case as the initial investigation points in that direction only. “We have not found anything suspicious so far and all circumstantial evidence points out to suicide. However, we need to further probe the matter to say this by conviction”, said a police source. Even as the police is awaiting the postmortem report, it has requested for permission to conduct viscera test on the deceased. While the school is insisting that the girl had committed suicide, Puspanjali’s father had alleged that she had been killed and a thorough inquiry needs to be conducted. “Even if father’s allegations are belied and they seem farfetched, we need to conduct investigation so as to assure the family”, said a police official. A report by the Comptroller and Auditor General (CAG), however, said they used the Pay Commission as an alibi to fatten themselves. In a damning indictment, the auditor held that 25 elite private schools passed on the burden of implementing the recommendations of the 6th Pay Commission to parents, without drawing on the cash reserves they had accumulated by not implementing the staff salaries prescribed by the government. The money collected from parents on the ground of the Pay Commission's burden was transferred to their societies and trusts. Schools which claimed to be making losses didn't hesitate to acquire expensive cars, the report said. The indictment gets more serious as CAG found that schools paid salaries to fictitious employees and unauthorizedly collected money under various heads. The CAG report, finalized last month, also found that while some contributed to the provident fund of fewer employees (National Victor School), others such as Amity International made contribution for more employees than those actually working. Sixth Pay Commission arrears were paid to staff not enrolled as employees. Also, in clear violation of Delhi School Education Act, many of these schools did not offer 20% reservation to children from Economically Weaker Sections. CAG has also severely criticized the Directorate of Education of Delhi government for failing to monitor these lapses. CAG had audited the accounts of 25 schools -- Mount Carmel, ASN School, Sachdeva, Mother Divine, Sadhu Vaswani, Ryan International, St Mary, Birla Vidya Niketan, Air Force Bal Bharti, GD Salwan, National Victor, Amity International, DPS-RK Puram, GD Goenka, Maharaja Agrasen, Convent of 32 Jesus and Mary, JD Tytler, Sardar Patel, Vasant Valley, Ramjas Public School, St Xavier's, Frank Anthony, Presentation Convent, Modern School and Summer Fields School. As for illegal transfer of money, CAG pointed out nine cases. Sardar Patel paid Rs 2.33 crore as usage charge to Gujarat Education Society for using its assets, Birla Vidya Niketan (BVN) paid Rs 5.23 crore as rent to Birla Academy of Art and Culture and Rs 2.5 crore on repair and maintenance. CAG said it did not agree with the reply by BVN that the school paid very less user charges compared to the market rent and that the depreciation was borne by the society. CAG said the school's claim was not supported by documents and, moreover, the building was 27 years old and supposed to be fully depreciated. GD Goenka gave Rs 4.10 crore as interest-free loan to the parent society even as the school had an outstanding liability of Rs 6.33 crore as bank loans. CAG dismissed the school's explanation, making it clear that "no amount could be transferred to the society from the school funds, more so when the school itself was in need of funds and depended on interest bearing loans from banks". Sadhu Vaswani International School for Girls (SVISG) made a similar transfer of Rs 36 lakh to Sadhu Vaswani Mission as rent and Rs 33.81 lakh as depreciation charges. It told CAG that funds were needed to construct an auditorium and pre-primary school, a recovery of Rs 1 lakh per month was effected in the books and there was no outflow of funds. But CAG did not accept the contention and said Rs 36 lakh was routed through income and expenditure account. Similar "irregular transfers" were found in the case of Frank Anthony Public School, Summer Fields, GD Salwan Public School and Mount Carmel.
