are already experiencing when they are separating. Do you know what other
alternatives are available to you when you and your partner have to deal with the
split of your assets and matters that concern your children? Lengthy, costly and
emotionally draining court proceedings should be a last resort. You now have the
option of using Collaborative Family Law to achieve your goals based on mutual
respect. To read the complete article please click on My Family Law.
New qualification requirements for Child Safety CSOs
In its final report, the Queensland Child Protection Commission of Inquiry
identified the need to develop the child protection workforce. The Inquiry
recommended child safety officers (CSOs) have tertiary qualifications that
demonstrate the core competencies required for this important role. The
Department of Communities, Child Safety and Disability Services has introduced
new mandatory qualification requirements for all new CSOs. The new
requirements will strengthen the good practice that is already occurring while
ensuring Queensland has a highly skilled, professional workforce able to support
the safety, wellbeing and best interests of vulnerable children and families.

Epidemic, but no domestic violence royal commission: Judith Ireland. Sydney
Morning Herald. 27th Jan.
Michaelia Cash, Minister Assisting the Prime Minister for Women, has said a royal
commission into domestic violence is unnecessary.
The national peak body for victims of domestic violence is calling on the Abbott
government to establish a royal commission into domestic violence, arguing a
national inquiry is needed to focus on prevention measures. This comes as Minister
Assisting the Prime Minister for Women Michaelia Cash downplayed the idea,
suggesting it was unnecessary. When asked if the federal government would follow
the Victorian government and establish a royal commission into domestic violence,
Senator Cash told Radio National on Tuesday that while "you should always be open
to considering new ideas ... in relation to a royal commission, this government
already accepts the evidence that we have an epidemic when it comes to violence
against women and children." To read the complete article please click on Sydney

Australian of the Year Rosie Batty calls on PM Tony Abbott to reinstate
community services. Jenna Price: Sydney Morning Herald. 1st Feb.
Australian of the Year Rosie Batty has called on Prime Minister Tony Abbott to
reinstate lost funding to community services after cuts made in last year's budget.
Ms Batty, whose son Luke was murdered by his father in February last year, has
questioned why the government would announce a national scheme for domestic
violence orders at the same time as legal services that help victims prepare to shut
their doors because of the cuts. To read the complete article please click on Sydney

Tony Abbott fundamentally misunderstands the violence against women
epidemic: Phil Cleary. Brisbane Times. 15th Feb.
Comment. Political life might look profoundly different for Tony Abbott had he not stood
smiling in front of those misogynist banners "Ditch the Witch" and "Julia – Bob
Browns (sic) Bitch" during his push to become Australia's 28th prime minister. Imagine
if he'd shown genuine leadership and courage and torn asunder the hatred of women
that bristled in those banners. Instead, he and Bronwyn Bishop revelled in the attention
while campaigners against the epidemic of violence wondered how he could not grasp
the deeper significance of his complicity in the banners. To read the complete article

Full Court (Appeals Judgments)
Tedja & Sony [2015] FamCAFC 13 – 16/02/2015 - View PDF
FAMILY LAW – APPEAL – NOTICE OF APPEAL – DIVORCE ORDER - FORUM –
Where the husband seeks that a divorce order be set aside on the basis of Australia
being an inappropriate forum – Where many of the grounds of appeal are either not
grounds of appeal or not proper grounds of appeal – Where some of the grounds of
appeal read generously and at their highest can be treated as challenging the
exercise of discretion by the trial judge – Where the trial judge was cognisant of the
factors that needed to be addressed – Where the trial judge appropriately took into
account the stage the proceedings had reached in each forum – Where there was no
justification to suggest that the trial judge did anything other than he was required to
in accordance with the law – Where the trial judge was not “plainly wrong” in the
exercise of his discretion – Where there is no merit in the grounds of appeal –
Appeal dismissed.
FAMILY LAW – APPEAL – APPLICATION IN AN APPEAL – FURTHER EVIDENCE
– Where the husband seeks to admit further evidence – Where the husband has not
demonstrated how the updating evidence would render “erroneous” the orders under
appeal or how it would have “produced a different result if it had been available at
the trial” – Where the trial judge was well aware of the overseas proceedings and the
husband’s intention to pursue those proceedings regardless – Where there is no
basis to receive the further evidence – Application dismissed.
FAMILY LAW – APPEAL – NOTICE OF APPEAL – COSTS – Where the wife seeks
an order for costs – Where there are clear circumstances justifying an order for costs
in the wife’s favour – Husband to pay the wife’s costs of the appeal as assessed in
default of agreement.
Herold & Herold [2015] FamCAFC 5 – 21/01/2015 - View PDF
FAMILY LAW – APPEAL – UNDEFENDED HEARING – PROCEDURAL FAIRNESS
– Where the husband appeals against orders dismissing his application for property
settlement and giving leave to the wife to proceed on an undefended basis – Where
the husband also appeals the orders for property settlement that were subsequently
made – Where the gravamen of the husband’s complaint on appeal was that the trial
judge failed to accord him procedural fairness by dismissing his application for
property settlement and excluding him from the proceedings which were part-heard –
Where the Full Court found that at the point the husband’s application was dismissed
he had material before the court and had not failed to comply with any relevant
procedural orders – Where the Full Court held that there had been a denial of
procedural fairness – Where the Full Court further held that a rehearing would be
likely to provide a more favourable result to the husband – Appeal allowed –
Remitted for rehearing – Costs certificates granted.

FAMILY LAW – CHILDREN – Best interests – with whom the child shall live and spend
time – where the child has meaningful relationships with both parents – where the child
has been exposed to family violence and there is a need to protect him from both
physical harm and psychological harm arising from that situation – where the child is
frightened of the mother’s partner – where the mother is unable to reconcile the need
to protect the child by giving up the ongoing partnership with the father of her two
younger children – sibling relationships – child to live with the father – mother
restrained from bringing the child into contact with her partner – child to spend
extended weekends with the mother whilst ever the mother’s partner is away working
– where in the event that the mother’s partner returns to form a relationship, weekend
time will reduce but still remain, provided the mother does not bring the child into
contact with her partner – where this outcome represents a balance between the
child’s emotional needs and his physical and psychological safety.
FAMILY LAW – CHILDREN – Parental responsibility – the presumption of equal
shared parental responsibility does not apply – where both parties engaged in family
violence – where whoever the child lives with is to have parental responsibility – father
to have sole parental responsibility – father to report to, and consult with, the mother.
Matthews & Matthews [2014] FamCA 842 – 02/10/2014 - View PDF
FAMILY LAW – PROPERTY SETTLEMENT – Where the initial financial position of
the husband was vastly stronger than that of the wife and should be acknowledged as
a significant contribution by him – where the husband was responsible for the financial
contributions – where the contribution by the wife to the welfare of the husband, his
four children and their two children is regarded as highly significant – where the
husband has made inadequate disclosure – where the husband, benefiting from an
inheritance and Trust fund, made no contributions to the wife or their children – where
the inference arises that the husband, given his attitude to disclosure, allowed the
property to run down deliberately for the purpose of these proceedings – where, with
particular reference to care and control of the children, an adjustment is made in favour
of the wife – wife entitled to 60 percent of the assets – Husband entitled to 40 per cent
of the assets – no superannuation splitting order sought.

– YouTube by psychosislinks
Childhood trauma isn’t something you just get over as you grow up. Pediatrician
Nadine Burke Harris explains that the repeated stress of abuse, neglect and parents
struggling with mental health or substance abuse issues has real, tangible effects on
the development of the brain. This unfolds across a lifetime, to the point where those
who’ve experienced high levels of trauma are at triple the risk for heart disease and
lung cancer. An impassioned plea for pediatric medicine to confront the prevention
and treatment of trauma, head-on.

Recovering from relationship breakdown: Public policy and repartnering:
Dr Hayley Fisher explores the interaction between institutional support, repartnering
and the economic impact of relationship breakdown.
Relationship breakdown has economic costs: one household is split into two, and its
income is also divided. The costs are disproportionately borne by women (Fisher &
Low, 2009; de Vaus et al., 2014), who often lose more than half the household’s
income yet retain the majority of the financial responsibility for children. The negative
financial shock of relationship breakdown is, however, rarely permanent. In the short
term, separated women may benefit from social welfare policies and receive private
transfer payments including child support. As time passes, if repartnering occurs this
can aid the economic recovery process. To read the complete report please click on
