PRESIDENT HARRY S. TRUMAN'S ADDRESS BEFORE A JOINT SESSION OF CONGRESS,
MARCH 12, 1947
 At the present moment in world history nearly every nation must choose between
alternative ways of life. The choice is too often not a free one. One way of life is based
upon the will of the majority, and is distinguished by free institutions, representative
government, free elections, guarantees of individual liberty, freedom of speech and
religion, and freedom from political oppression. The second way of life is based upon
the will of a minority forcibly imposed upon the majority. It relies upon terror and
oppression, a controlled press and radio; fixed elections, and the suppression of
personal freedoms.
 I believe that it must be the policy of the United States to support free peoples who are
resisting attempted subjugation by armed minorities or by outside pressures. I believe
that we must assist free peoples to work out their own destinies in their own way. I
believe that our help should be primarily through economic and financial aid which is
essential to economic stability and orderly political processes.

Who Cares What Truman Thinks, Congress Declares War, Right?

Article I Section 8
Congress shall have the power…
To declare War, grant Letters of Marque and Reprisal, and make Rules concerning
Captures on Land and Water;
To raise and support Armies, but no Appropriation of Money to that Use shall be for a
longer Term than two Years;
To provide and maintain a Navy;
To make Rules for the Government and Regulation of the land and naval Forces;
To provide for calling forth the Militia to execute the Laws of the Union, suppress
Insurrections and repel Invasions;
To provide for organizing, arming, and disciplining the Militia, and for governing such
Part of them as may be employed in the Service of the United States, reserving to the
States respectively, the Appointment of the Officers, and the Authority of training the
Militia according to the discipline prescribed by Congress;
Article II, Section 2
The President shall be Commander in Chief of the Army and Navy of the United States,
and of the Militia of the several States, when called into the actual Service of the United
States;

The War Powers Act
Congress has not used its constitutional power to declare war since 1941
Criticism of the President’s role in Vietnam led to the War Powers Act of 1973
The President may only commit troops abroad for a period of 60 days, (90 if including
withdrawal)
Congress must approve a longer period
Nixon vetoed it, they over-rode the veto
Presidents don’t like it, but tend to go for some sort of authorizing resolution from
Congress
Remember, no matter what, Congress still funds things!
