Mr. P.O., “May I request the secretary to call the roll to determine the quorum.” 2. Mr. Secretary, “Mr. P.O., majority of the members of this august body is present. We have a quorum.” 3. Mr. P.O., “As manifested to us by the secretary that majority of the SB members is present, so we have a quorum.” 4. PROOF OF NOTICE: 1. Mr. Secretary, “Mr. P.O. as proof of notice, every member of the SB received the notice for this special session.” 2. Mr. P.O, “Thank you Mr. Secretary, so next item please.” 5. BUSINESS FOR THE DAY: 5.1. AN ORDINANCE APPROPRIATING THE AMOUNT OF TWO MILLION (PHP 2,500,000.00) PESOS FOR THE IMPLEMENTATION OF THE COMMUNITY FUND FOR AGRICULTURE DEVELOPMENT (CFAD) SUB-PROJECT UNDER THE MINDANAO RURAL DEVELOPMENT PROJECT (MRDP) – ADAPTABLE PROJECT LOAN 2 (APL- 2); 1. Mr. P.O., “Who is the sponsoring councilor?” 2. Hon. Mamukid, “We are glad that the amount of Two Million (=P= 2,000,000.00) Pesos come from the National Office of MRDP and ours, as counterpart, is P500,000.00, Mr. Chairman. It is along this line that we have an Ordinance appropriating the amount of 2.5 Million. We are basing the title from the Appropriation Ordinance of San Isidro, Mr. Chairman. 1 APPROPRIATION ORDINANCE NO. 2011-02 Be it ordained by the Sangguniang Bayan in session assembled: SECTION 1. TITLE: This ordinance shall be known as Appropriation Ordinance No. 2011-02. SECTION 2. SUBJECT: An Appropriation Ordinance No. 02 series of 2011 appropriating the amount of P2,500,000.00 for the implementation of Community Fund for Agriculture Development (CFAD) sub-project under the Mindanao Rural Development Program (MRDP) – Adaptable Program Loan 2 (APL 2) year 2, round 1, this Municipality broken down as follows: P1,500,000.00 from the Loan Proceeds (LP), P500,000.00 from National Government (GOP-DA) counterpart and P500,000.00 from LGU Banaybanay. SECTION 3. REFERENCE:The Municipal Budget Officer shall prepare the corresponding statement covering the itemized outlay which shall authorize the Municipal Treasurer to disburse fund thereof. SECTION 4. EFFECTIVITY:This Appropriation Ordinance shall take effect upon its approval. - I hereby move, Mr. Chairman.” 3. Mr. P.O., “Thank you, Hon. Mamukid. Since you already have an Appropriation Ordinance of 2011 and it includes the budget this year, so are there any inquiries from the members of this august body?” 4. Hon. Teves, “Mr. Presiding Officer, I just want to know from this presentation if the 2 Million from the MRDP is a grant or a loan, Mr. Presiding Officer?” 5. Hon. Mamukid, “Based on the statement, Mr. Chairman, that is like a grant.” 6. Mr. P.O., “So, in our Appropriation Ordinance, how much is our allocated fund?” 7. Hon. Mamukid, “We allocate the amount of P500,00.00 which will be taken this coming Supplemental Budget, Mr. Chairman.” 8. Mr. P.O., “So, we appropriate for the next Supplemental Budget for the support of this project?” 9. Hon. Mamukid, “Yes, the Supplemental Budget No. 02.” 10. Mr. P.O., “We have already an amount of P500,000.00 for this project for the Mindanao Rural Development Program (MRDP).” 11. Hon. Mamukid, “Another presentation, Mr. Chairman, we have already 1 Million support to MRDP in our EIP and we will just get the P500,000.00 from the 1 Million that was already appropriated, Mr. Chairman.” 12. Mr. P.O., “Since, we have already an Appropriation Ordinance this year 2011 of 1 Million, so, we will slash that P500,000.00 to support in the Mindanao Rural Development Program in their project in GOP. Some more recommendations?” 13. Hon. Mante, “This is not an objection from the reaction, Mr. Presiding Officer, this is just a point of inquiry. Why do we need to pass an Appropriation Ordinance when the source of fund was already approved from the Annual Budget?” 14. Mr. P.O., “We have already an approved 1 Million in our MRDP and now they want to approve 2.5 Million for the implementation of the Community Fund for Agricultural Development (CFAD) under the Mindanao Rural Development Program and it’s an Adaptable Project Loan.” 15. Hon. Mante, “Mr. Presiding Officer, my understanding with regard to annual budget since it was approved, the work of the executive is to implement that amount of One Million (1.0M) for that purpose. But the problem is, there is an Appropriation Ordinance presented today and where is the source of fund recognizing that there is a surplus and there is a need for the Appropriation Ordinance?” 16. Hon. Mamukid, “Ours is just for documentary, Mr. Chairman, so that the MRDP will see to it that we have already appropriated that said amount in which it was already appropriated in our EIP the amount of 1 Million, we will still slash the P500,000.00 so that out of 2 Million which was appropriated by the National Government to become 2.5 Million.” 17. Mr. P.O., “In other words, in 1 Million of the Local Source of Fund in this Municipality, so, we will slash P500,000.00 for the support of the said project. Now, 2 the query of Hon. Mante that it was already appropriated, so, asa man ta mangita anang 2 Million? This 2 Million is for the support of the project of the GOP-DA.” 18. Hon. Mamukid, “Ani man gud, nagkinhanglan lang sila ug documentary evidence, Mr. Chairman and then, ang ilang 2 Million ilaha na sa National Government, mocounterpart lang ta ug P500,000.00, so, nahimo ug 2.5 Million tanan.” 19. Mr. P.O., “Okay, thank you, Hon. Mamukid. This 2 Million is coming from the National Budget.” 20. Hon. Teves, “Mr. Presiding Officer, as per observation, I think most of my colleagues didn’t know about this. Since, the representative coming from the MPDO is around in the person of Edith Solana, I think, Mr. Presiding Officer, it is the right time that we need to hear the background of this said project which is coming from the MPDO representative. If my colleagues will agree, I would like to request the chairman on House Rules to suspend the House Rules so that we can accommodate and we can hear the explanation of the MPDO representative in the person of Edith Solana.” 21. Mr. P.O., “Okay, thank you Hon. Teves. I understand this kind of summarization of this project and we have 1 Million for this Municipality and now we will slash P500,000.00 and we also have funds coming from the National Government from the Department of Agriculture and the counterpart of the Local Government Unit, the total of that is 2 Million. Now, the P500,000.00 is the remaining balance that we have now as our project, Appropriation Ordinance this year in MRDP, so, naa pa tay nabilin nga P500,000.00. That 2 Million is the project of our Local Chief Executive for the fund of the Market Road.” 22. Hon. Mamukid, “I am sponsoring an Ordinance appropriating the amount of 2.5 Million, Mr. Chairman. I hereby move, Mr. Chairman.” 23. Mr. P.O., “So, there’s a motion of Hon. Mamukid to pass this Appropriation Ordinance and seconded by Hon. Mante. Are there any inquiries?” 24. Hon. Geollegue, “Mr. Chairman, I’m not opposing the proposed Ordinance but I’m questioning because there was a letter coming from Atty. Pete Mejos, in view thereof, may I respectfully request this august body to enact the Appropriation Ordinance for MRDP Sipag Project funding the amount of P500,000.00 for the LGU Counterpart to be taken from the regular MRDP project and next Supplemental Budget No. 022011. You mean to say that we need the Appropriation Ordinance, Mr. Chairman? Number 2, Mr. Chairman, I would like to ask the representative from the Office of the Mayor regarding the project mandate kung unsa nga mga proyekto ang angay gastosan aning 2.5 Million?” 25. Mr. P.O., “Thank you, Hon. Geollegue. Why do we need to approve this when there are inquiries kung unsay focus nianing 2.5 Million ug kung unsay mga project nga pagahimuon while it is stated here the kind of projects to implement on this Appropriation Ordinance.” 26. Hon. Mamukid, “There is a listing from the Secretary, Mr. Chairman and one of those is the San Vicente water system.” 27. Mr. P.O., “Thank you, Hon. Mamukid. I have seen here and I have a copy of the full list of the Sipag Project and we have here the project titles of water production with water spray allocation of Barangay Caganganan Rice Farmer Association of the Presiding Officer or Chairman Willie Habagat and the project costs P250,000.00 and the second production of the upgraded Native Chicken of Barangay Paniquian and the Chairman is Editha Pati and public costs of P100,000.00 and the third is the Cattle Production of Barangay Mahayag, Banaybanay Lumad, Mandaya, Mansaka Association (BALUMMA) by the Chairman Alfredo Mabiscay, Jr. in the amount of P250,000.00 and the fourth is the construction of the portable water system of Barangay Paniquian of Santa Cruz, Boholano, Mandaya Association (SCBMA) worth P500,000.00, the construction of the Solar Dryer and Warehouse of Barangay Calubihan, the Barangay Christian Small Farmers Association, Incorporated (BCSFAI) and the Chairman is Mr. Fidel Quisano worth of P500,000.00. Another is the construction of the portable water supply reservoir by Barangay Mahayag, Banaybanay Upland Cooperative by Mr. Allan Tautau as the Chairman worth P400,000.00 and the last construction of the portable water system level 2, again in Barangay Paniquian, the Banaybanay Lumad, Mandaya, Mansaka Association (BALUMMA)and the Chairman is Mr. Danilo Pacay, Sr. worth of P500,000. And the total is P2,500,000.00 and all of these are signed by all the Members of the MPDC Chairman, no other than Mr. Bert Undan. Now, any quiries regarding this matter?” 3 28. Hon. Alingalan, “Mr. Presiding Officer, I adhere to the opinion of Hon. Teves that we should give the floor to the representative of the MPDO so that we could immediately…” 29. Hon. Mamukid, “Mr. Chairman, you have already read that, then why do we need another representative, just to delay the time?” 30. Mr. P.O., “That’s why if there are no questions or inquiries, so don’t insert.” 31. Hon. Alingalan, “I prefer that we should give the floor to the MPDO representative so that the issue will be cleared up.” 32. Hon. Mamukid, “The issue was already cleared up as stated by the Vice Mayor.” 33. Mr. P.O., “That’s only an inquiry Hon. Mamukid, so please do not interrupt.” 34. Hon. Geollegue, “I think, no more discussion, Mr. Chairman, considering that there is an itemized Program of Work submitted to us by the Local Chief Executive and that was confirmed by the D.A. representative. So, I second to the motion for the proposed appropriation of the Barangay Water System.” 35. Mr. P.O., “It was also seconded by Hon. Geollegue and Hon. Caminero and all Members of this 12th Council for this Resolution. So, this Resolution is now approved. There will be no more observation because I already banged my gavel as I approved this said Ordinance.” 5.2. ARAW NG BANAYBANAY ACTIVITIES 1. Mr. P.O., “We are now on the item 5.2. the Araw ng Banaybanay Activities. The floor now is open for any commentaries and recommendations.” 2. Hon. Geollegue, “Mr. Chairman, I think it is proper for us to differ this item considering that the Local Chief Executive submitted already the activities on Araw ng Banaybanay Celebration this coming June 21, 2011. That’s all, Mr. Chairman.” 3. Mr. P.O., “Thank you, Hon. Geollegue.” 4. Hon. Teves, “On our part, Mr. Presiding Officer, we know pretty well that when it comes to activities like this, the in-charge is the Chairman on Tourism. So, I think we need to hear her opinion, Mr. Presiding Officer, regarding the activities this coming Araw ng Banaybanay.” 5. Mr. P.O., “Since, we discussed already with our Local Chief Executive, during the Committee Meeting last Tuesday, that the program will start on June 17 up to 21. On the Araw ng Banaybanay, the program will start with a parade. The Local Chief Executive wants that all should be present during the parade kay magpahimo daw ‘to siya ug uniporme pa nato didto daw kuhaon sa support for the activities of the LGU. So, on June 17, we will have a concert at the Crossing of Poblacion and Basketball Tournament will be on 18, 19 and 20. So, on the 21st- the Araw ng Banaybanay, we have a search for the night of Miss Banaybanay. Mao man daw ‘to ang naplanohan ni mayor. Some more inquiries?” 6. Hon. Caminero, “Mr. Presiding Officer, we are not suppose to prepare a program on this activity because during our conference with the mayor last Tuesday, he only informed us of the program. We are not suppose to make a program.” 7. Mr. P.O., “So, naay tawag nga SOMA or State of the Municipal Address. Sa dili pa ang SOMA naa pa diay mass ug ang venue diri sa covered court sa munisipyo. Pagka-ala una naay activities sa gawas. So, siguro maghulat na lang pud ta kung unsa pay lain nga mga activities nga ipahibalo sa ato-a.” 8. Hon. Garcia, “Kadtong concert bitaw nga imong gi-mention ganiha, Mr. Presiding Officer, ang venue ngano’ng didto man sa freedom park? Dili ba puwede diri na lang sa atong munisipyo ang concert?” 9. Mr. P.O., “Didto na lang kay kung diri mura’g gamay ra.” 10. Hon. Garcia, “Daghan man gud ug manan-aw unya kung sa kalsada very risky sa atong mga motan-away.” 11. Mr. P.O., “Puwede man pud diri. Okay pud diri sa munisipyo ug gabii man pud ang program, so dili kaayo kapoy. So, akong ibutang unta sa crossing kay highway unya mura’g daghang tao ang manan-aw. Kay kadtong sa naobserbahan nako adtong February diri, katag man gud ug mura’g dili kaayo makaduol ang tao. So, since gabii atong concert, naa man puy tanod nga magbantay. Ato-a lang pud obserbahan ang sitwasyon. Kung mura’g lain ang panahon, diri na lang ta sa munisipyo. So, some more announcements?” 12. Hon. Teves, “We are talking about activities this coming Araw ng Banaybanay. Mr. Presiding Officer, I just hope that those who set-up the activities will include 4 those people who gave name to our municipality and will be recognized during that day, Mr. Presiding Officer. So, I would like to appeal to the Committee in-charge on this.” 13. Mr. P.O., “Thank you, Hon. Teves, for your good suggestion that we will give an acknowledgement o pagdayeg to people here in Banaybanay. So, can you pass a Resolution for that matter?” 14. Hon. Teves, “Mr. Presiding Officer, I would like to appeal to the Chairman on House Rules that in the resolution , during the celebration , we recognize those people or any organizations who gave name to our municipality, Mr. Presiding Officer.” 15. Hon. Mamukid, “It is already stipulated in the program.” 16. Hon. Teves, “We are not yet able to see the whole activities for this coming Araw ng Banaybanay, Mr. Presiding Officer. That’s why I am appealing to this august body.” 17. Mr. P.O., “Wala pa man ta kita sa mga activities gud. According to our secretary, they will include by recognizing those people who contributed a lot sa pagmugna sa Municipality of Banaybanay.” 18. Hon. Alingalan, “Mr. Presiding Officer, may I know what will be our attire during the State of the Municipal Address? Will it be formal attire or any?” 19. Mr. P.O., “So, according to the mayor, he will give us uniforms nga gamiton nato sa SportsFest para magamit pud nato sa atong mga activities including all the employees, color coding. Sa parade mao pud siguro ang gamiton nato. Pagkatapos sa parade, activities man dayon diha sa gawas sa munisipyo. Siguro, kung pictorial kay siyempre naa man gyuy pictorial, then you will wear barong or any formal attire.” 20. Hon. Mamukid, “Kung unsay gihatag sa mayor mao na atong sundon.” 21. Mr. P.O., “Some more announcements?” 22. Hon. Mante, “This is just an announcement address to all offices- if there are cases again regarding this Appropriating Ordinance. I think, Mr. Presiding Officer all Appropriation Ordinance should be done or pass first to the Budget Office para maplastar. Kay sa ako lang pagsabot sa Appropriation Ordinance kung gi-approve ba gyud ni ug wala tay kalibutan. Pag-once mag-approve ta ug Appropriation Ordinance kailangan mag-recognize ta kung naa bay kuwarta. Once nga naay kuwarta like 2.5 Million i-recognize usa nato nang 2.5 Million bag-o nato siya i-appropriate. Maghatag ta ug appropriation nga wala tay source of funds?” 23. Mr. P.O., “Thank you for your comment Hon. Mante. That’s the work of the Chairman on Finance. So, by next appropriation ordinances, before we approve that certain Ordinance, it will be informed first to this august body. That’s why we have done it today na okay na at wala ng iba pang mga tanong pa dyan.” 24. Hon. Mamukid, “Because Mr. Chairman, I just received the invitation yesterday and I think that this is very urgent. Now, since this has been already properly discussed, I move for the adjournment of our Session.” 25. Mr. P.O., “So, put on the record that by next time if we are going to approve a certain Ordinance especially an Appropriation Ordinance, let’s do it in a required process. So, there was a pending motion of Hon. Mamukid for the adjournment of our special session and seconded by Hon. Mante, Hon. Teves and also Hon. Caminero.
