Minutes of Regular Meeting
December 4, 2006
The Harnett County Board of Commissioners met in regular session on Monday,
December 4, 2006, in the County Commissioners Meeting Room, County Administration
Building, 102 East Front Street, Lillington, North Carolina.

Chairman Byrd called the meeting to order at 9:00 a.m. and Commissioner Andrews led
the pledge of allegiance and prayer.
Commissioner Titchener moved to approve the agenda as published with the following
additions:
Consent agenda:
- Reimbursement resolution Cops 2007
- Resolutions adopting text amendments to Zoning and Subdivision Ordinances
- Additional budget amendment
Regular agenda:
- Resolution honoring outgoing Commissioner Walt Titchener
Commissioner Andrews seconded the motion and it passed unanimously.
Upon motion by Vice Chairman Hill and seconded by Commissioner McNeill, the Board
unanimously approved the following items on the consent agenda:

3. Tax refunds and releases (Attachment 1)
4. Lease renewal between the County and Richard W. Gregory for 39.73 acres off
Matthews Mill Pond Road, SR 1510, formerly known as the Harnett County Landfill.
The property is leased by Mr. Gregory for hunting purposes. Lease term is December 1,
2006 to December 1, 2007. Lease rent is $198.75.
5. Change orders for Harnett/Fuquay Wastewater project:
- Two increasing change orders for Park Construction for contract A1 with
combined total of $1,035,776.54. Approximately 90% of the increase is due to
excess rock excavation along the path of the sewer line.
- Two increasing change orders for Park Construction for contract A2 with
combined total of $292,126.44. Approximately 80% of this increase is due to
excess rock excavation along the path of the sewer line.
6. Reimbursement Resolution COPS 2007 for expenditures incurred in connection with
the following projects:
- Construct, furnish and equip a new elementary school to be known as Overhills
Elementary;
- Construct, furnish and equip a jail and law enforcement center;
- Construct a gymnasium at Coats Elementary School; and
- Construct a solid waste transfer station.
These expenditures will be reimbursed with proceeds of certain tax-exempt obligations to
be issued in calendar year 2007. (Attachment 2)
7. Resolutions adopting text amendments to the Zoning Ordinance and Subdivision
Ordinance regarding creation of a Development Review Board to provide a
comprehensive review of all technical aspects of the ordinances and development
proposals. (Attachment 3)
Commissioner Andrews moved to appoint Jeremy Winters, student at Triton High
School, to serve as a student representative to the Harnett County Juvenile Crime
Prevention Council. The term is for two years and will expire 12-31-08. He was
nominated by Chairman Byrd.
Jennifer Slusser, Staff Attorney, presented for the Board’s consideration, a contract and
reimbursement agreement between Harnett County and Forest Ridge Subdivision,
Incorporated and Odell A. Smith Properties, LLC for Wastewater Collection
Infrastructure including the 18” Forest Ridge Interceptor Line for the Harnett County
Regional Wastewater Initiative. Contract reimbursement amount is $183,551.60 for
infrastructure. Forest Ridge Interceptor Line will provide connection for NTA project.
Commissioner McNeill moved to approve the agreement as presented with the stipulation
of final deed as outlined by Attorney Slusser. Commissioner Andrews seconded the
motion and it passed unanimously.
Commissioner Andrews moved to designate Commissioner Tim McNeill as the voting
delegate to represent Harnett County at the NCACC Legislative Goals Conference,
January 11-12, 2007, in Pinehurst. Commissioner Titchener seconded the motion and it
passed unanimously.
Neil Emory, County Manager, noted that the Planning Department is currently working
to revise the existing 1988 Land Use Plan. Along with this revision, the Planning
Department has begun the process of writing a Land Use Plan for specific areas of the
County, such as the Neill’s Creek area. To begin this process, the Planning Department
worked with the NC Department of Community Assistance to complete a study of the
Neill’s Creek area. The Planning Department asks that the Board of Commissioners
recognize the document of the completed study of the Neill’s Creek area so that it may be
used as an official reference as the Neill’s Creek Land Use Plan is developed.
Commissioner Andrews moved to accept and recognize results of the Neill’s Creek Land
Use Plan Study. Vice Chairman Hill seconded the motion and it passed unanimously.
Mr. Emory thanked outgoing Commissioner Walt Titchener for sixteen years of support
of all County employees including the department heads present, and for his
contributions that has made the county better for all Harnett County citizens. Vice
Chairman Hill moved to adopt a resolution honoring Commissioner Titchener.
Commissioner Andrews seconded the motion and it passed unanimously. (Attachment 4)
Chairman Byrd read and presented the resolution and a plaque to Commissioner
Titchener. Board members made comments regarding Commissioner Titchener’s service
followed by Commissioner Titchener’s comments.
Chairman Byrd recessed the meeting to be reconvened for reorganization of the Board
following the 12:00 noon swearing-in ceremonies. Dedication and unveiling of a portrait
of Patrick H. Pope was held at the courthouse at 10:30 a.m.
Dwight W. Snow, County Attorney, served as master of ceremonies for the swearing-in
of newly elected County officials. The invocation was offered by Dr. Benjamin Sutton,
McLean’s Chapel Church. Honorable Resson Faircloth, District Court Judge,
administered oaths of office to the following elected officials:

Kay S. Blanchard, Clerk to the Board, reconvened the meeting at 12:40 p.m. and stated
that in accordance with N.C. General Statutes, the Board is reorganized at the first regular
meeting in December each year. Ms. Blanchard opened the floor for nominations for
chairman. Commissioner McNeill nominated Teddy J. Byrd. Commissioner McNeill
moved that the nominations be closed. Commissioner Hill seconded the motion and it
passed unanimously. Chairman Teddy J. Byrd was re-elected unanimously.
Chairman Byrd asked for nominations for vice chairman. Commissioner McNeill
nominated Beatrice B. Hill. Commissioner McNeill moved that the nominations be
closed. Commissioner Andrews seconded the motion and it passed unanimously. Vice
Chairman Beatrice B. Hill was re-elected unanimously.
Vice Chairman Hill moved to change the date of the first meeting in January from the 2nd
to the 8th. Commissioner Andrews seconded the motion and it passed unanimously.
There being no further business, Vice Chairman Hill moved to adjourn. Commissioner
McNeill seconded the motion and it passed unanimously. The Harnett County Board of
Commissioners regular meeting, December 4, 2006, adjourned at 1:00 p.m.
