OHIO CONCEALED CARRY Laws ORC 2923.12 • Not a concealed weapons license; a concealed handgun license. • Must notify any LE Officer if stopped • Must keep hands in plain sight. • Must do as LE Officer says. • Doesn’t apply to anyone carrying as part of their job. • Or in your own home. ORC 2923.12 • Must carry license on their person. • Practice traffic stop. ORC 2923.121 • Possession of a firearm in a liquor permit premises: – No D permits; any place where alcohol is served by the glass, for consumption there. – Unless you are the owner and not drinking. – Doesn’t apply to convention centers, vets halls, etc… • Current law under way… ORC 2923.122 • School Zones: – Doesn’t affect those authorized for their job, or homeschool – Doesn’t apply if: • Don’t enter school building ORC 2923.123 • Don’t take into a government building without additional authorization. ORC 2923.16 • How to carry a firearm in a vehicle. • Difference if you have a concealed carry license. – Must have the gun in a holster. – In a container in plain sight that has a zipper, snap, buckle, etc… – In a locked glove box or other compartment. Requirements • Pass a NRA or OPOTC course that meets Ohio’s requirements. • At least 10 hours of instruction and 2 hours range time. • Pass a written test. • Muskingum or Fairfield Counties? Application Process • Apply with Sheriff in county of residence or surrounding county. • Minimum fee of $67. • Provide them with certificate of training and fingerprints. • Sheriff’s office will complete a background check and issue license if appropriate. Further Qualifications • Residency: 45 days in Ohio; in county of application for 30 days. • Criminal Record: No felonies, either convicted or currently charged; no drug offenses, misdemeanor charges of violence, no domestic violence, no falsification of a handgun license. Further Qualifications • Mental Competency: must not have been found mentally incompetent, have been committed to a mental institution, etc… • Must not be the subject of a restraining order, either CPO or TPO. • As long as you meet these requirements the Sheriff must issue the license within 45 days. Apartments/Work • Private employers may ban guns from the work and parking lots. • Not a criminal act, may be cause for civil action. • Landlords can’t prohibit residents from lawfully carrying or possessing on their premises. • Ohio is a “print” state. Signs • No standard sign • Must be conspicuous • Not a criminal activity, civil Open Carry • Ohio IS an open carry state, but should be done with caution. Reciprocity • Current Agreements: Alaska, Arizona, Arkansas, Delaware, Florida, Idaho, Kentucky, Michigan, Missouri, North Carolina, Oklahoma, South Carolina, Tennessee, Utah, Virginia, Washington, West Virginia, Wyoming • Indiana honors Ohio, not vice versa • Must conform to the laws of those states while there. Castle Doctrine • You do not have a duty to retreat from your home or vehicle. • “A man’s home is his castle.” • “Rebuttable presumption” means that the prosecution has the burden to produce evidence to the contrary. • Must still have reason to use deadly force.
