1.
What is Marketing Services?
This Framework Agreement is for the supply of Marketing Services and the
Contractors will be required to provide the services listed under the following 14
categories:















Digital Marketing;
Digital Technical Services;
Search Engine Optimisation;
Usability;
Mobile;
Research;
Design;

What is a Framework Agreement?
A Framework Agreement is a mechanism that permits purchasers to order goods or
services under the terms and conditions specified within the Framework Agreement.

Who can access the Framework Agreement?
The Framework Agreement is being awarded by Scottish Ministers on behalf of the
Scottish Ministers (including Agencies), Department of UK Government Facilities
operating in Scotland, Scottish Non-Departmental Public Bodies, offices in the
Scottish Administration which are not ministerial offices. Cross-border public
authorities within the meaning of section 88(5) of the Scotland Act 1998. The
Scotland Office, the Scottish Parliamentary Corporate Body. Councils constituted
under section 2 of the Local Government etc. (Scotland) Act 1994. Scottish fire &
rescue authorities, Scottish joint fire and rescue boards, Scottish police authorities,
Scottish joint police boards. Student Loans Company Limited, Business Stream Ltd,
the Business Gateway National Unit at the Convention of Scottish Local Authorities.
Forestry Commission, the Commissioner of Northern Lighthouse operating as the
Northern Lighthouse Board, Royal National Lifeboat Institute, British Waterways
Scotland, Scottish National Park authorities, Cycling Scotland Ltd. Bodies registered
as social landlords under the Housing (Scotland) Act 2001. Scottish health boards or
special health boards, further or higher education institutions being fundable bodies
within the meaning of section 6 of the further and Higher Education (Scotland) Act
2005.
Also, any public body established by or under the Scotland Act 1998 or any Act of
the Scottish Parliament, any association of, or, formed by one or more of the
foregoing bodies financed wholly or mainly by one or more of the foregoing bodies

subject to management supervision by one or more of the foregoing and bodies
more than half of the board of directors or members of which, or, in the case of a
group of individuals, more than half of those individuals, being appointed by one or
more of the foregoing.

Is the Framework Agreement suitable for your needs?
The answer is likely to be yes if the requirement is for Marketing Services. The
scope of this Framework covers the following:
Advertising
Advertising services* are delivered on a project basis and may include, either
individually or in combination:






Strategic marketing planning;
Target audience insight, this may be derived from bespoke research
conducted from the research lot or through mini-competition;
Development of the creative strategy and brief against Collaborative Partner
objectives;
Development of clear, succinct creative proposition;
Development, production and delivery of effective public information
advertising campaigns;
Development, production and delivery of effective social marketing
campaigns, designed to generate measurable behavioural change;
Advertising services refers to fulfilment of paid-for media, for example, print,
television, poster, radio, cinema, digital media, and ambient media.
NOTE: Recruitment advertising and Public Information Notices are not included.
*excludes media planning and buying. Successful agencies will be required to work
closely with the current media planning & buying agency.
Field Marketing
Field Marketing services may include, either individually or in combination:
 Auditing;
 Sampling/Demonstrating;
 Merchandising;
 Sales;
 Roadshows / Events / Experiential Marketing, including preparing creative
work
 based on agreed strategy, and in some instances joint activity with partners;
 Mystery Shopping;
 Data & IT;
 Support Services.

Partnership Marketing
Field Marketing services may include, either individually or in combination:





Partner identification and selection;
Contracting of partnership activity;
Brand licensing;
Campaign co-ordination;
Evaluation, – including negotiating access to partnership data relevant to
marketing activity.
Public Relations
Public relations requirements may include, either individually or in combination:
















Strategic planning;
Media relations and briefing;
Media partnerships;
Digital & social media relations;
Partnerships and promotions;
Sponsorship activation;
Stakeholder engagement and liaison;
Crisis & issues management;
Internal communications;
Corporate Communications;
Events + exhibition support;
Media training for spokespeople;
Evaluation and media monitoring;
Press trip organisation;
Media Intelligence;
Implementation of media events and stunts;
Direct Marketing
Services include the provision of strategic, creative, production and account
management services in the delivery of the Direct Marketing function.
Services may range from the understanding and management of data and partner
databases. The development of a strategic campaign designed to achieve maximum
return of investment and consumer response. The creative and design work
required, including where relevant, copywriting and image sourcing, the sourcing and
management of the print process and online delivery and, the account management
of the delivery process.
Segmentation
Segmentation services will include the identification and development of quantified
audience segmentation against an identified marketing strategy to include;


defining the scope and structure of audiences of relevance to specific
Collaborative Partners;
providing segmentation analysis and data which will form the basis for
marketing activity e.g. direct marketing.

Such activities will be delivered by the Contractor as briefed by the Collaborative
Partner on a project basis, including all relevant background information and access
to existent information as relevant, appropriate and available.
Segmentation may draw on the following activities, either individually or in
combination 









A-priori segmentation;
Decile analysis;
Gap analysis;
Attitudinal/behavioural research;
Cluster analysis;
Conjoint analysis;
Qualitative research/typologies;
Preparation of mailing lists, household identifiers;
Data analysis and list provision;
Scottish Government longitudinal studies and tracking.
Digital Marketing
Digital Marketing will include the development, creation and delivery of digital
marketing programmes as required by the particular Collaborative Partner.
Such activities will be delivered by the Contractor as briefed by the Collaborative
Partner on a project basis, including all relevant background information and access
to existent information as relevant, appropriate and available.
Suppliers of Digital Marketing will provide detailed specification for individual
projects.
Digital Marketing may include, either individually or in combination:





Digital Marketing;
Digital Strategy;
Digital Development;
Analytics, including online segmentation;
Evaluation.
Digital Technical
Provision of Digital Technical Services as required by the Collaborative Partner who
will provide detailed specification for individual projects.
Digital Technical Services may include, either individually or in combination technical
support in the pursuit of the following activities:





Website design and build;
Metrics analysis;
Accessibility;
Potential to deliver online advertisements;
Social media

The scope of Digital Technical Services covers the appropriate technical
development of online materials which will include responsibility for format,
presentation, functionality, usability and analysis of content suitable during
development and additionally during amendment within commissioned websites. It
further includes the creation, collation, and maintenance of online content.
* Hosting is not a requirement under this framework.
Search Engine Optimisation
The scope of the service covers the planning, development, project delivery and
evaluation of Search Engine Optimisation activity in support of marketing online
activity.
The Contractor will provide Search Engine Optimisation services as required by
individual Collaborative Partners who will provide detailed specification for projects.
Search Engine Optimisation (SEO) requirements may include, either individually or
in combination:







Integrated SEO strategy development;
Contributing SEO requirement for brief to build-agency including marketing
and social marketing/behaviour change approaches, as appropriate;
Ethical SEO delivery on-going as required;
Links analysis;
Affiliate marketing;
Contribution to AdWord marketing activity;
Evaluation of topic websites
Usability
The scope of the service covers the usability planning, development, and testing of
activity in support of marketing online activity.
The Contractor must provide Usability Services as required by individual
Collaborative Partners who will provide detailed specification for projects.
Usability requirements may include, user testing at all stages of development
including:







Quantitative testing (benchmarking);
Qualitative user testing;
Heuristic evaluation of usability;
Surveys and interviews;
Accessibility testing (with representative user groups);
Designing or proposing appropriate solutions;
Create prototype solutions for comparative testing
Mobile Services
Mobile marketing will include the development, creation and delivery of mobile
marketing programmes as required by the particular partners.

Such activities will be delivered by the Contractor as briefed by the Collaborative
Partner on a project basis, including all relevant background information and access
to existent information as relevant, appropriate and available.
The scope of Mobile marketing covers the format, presentation, functionality and
analysis of content suitable for use on all mobile platforms, where the primary
channel is mobile phones, handheld or other devices. It further extends to the
creation, collation, and maintenance of appropriate content.
Suppliers of Mobile marketing as required by the partner who will provide detailed
specification for individual projects.
Mobile marketing may include, either individually or in combination:





Mobile Marketing;
Mobile Strategy;
Mobile Development;
Analytics;
Evaluation.
Research
The Collaborative Partners may engage market research specialists to advise and
implement a range of market and customer research activities covering many
aspects of work.
Contractors must be able to design and implement research involving a range of
qualitative and quantitative methods to deliver insight, testing evidence and tracking
against public information and social marketing/behaviour change strategies –
advertising, field and creative. Research may include one-to-one interviews either
face to face or by telephone; insight gathering, focus groups; preparing or
implementing telephone, personal and online surveys or other tools as appropriate.
Longer term tracking studies (quantitative), which may lead to segmentation
analysis, tracking of customer satisfaction with services delivered, omnibus, and
panels, may also be requirements for specific campaigns or activities. An important
feature will be appropriate robust analysis of results with clear and transparent
reporting, including evidence to measure behaviour change.
Each Collaborative Partner will have their own market research requirements and
will commission the work directly with the successful Contractor. The Contractor will
be required to demonstrate specialist capacity and experience in collecting and
analysing data, reporting findings and conclusions and making recommendations
regarding research conducted.
The Contractor must be able to demonstrate expertise, resources and capacity as
well as best practice in the pursuit of this service. They must also be knowledgeable
about contemporary developments and innovation as well as being compliant with
industry standards e.g. Code of Conduct of the Market Research Society, UK Data
Protection Act 1998.

The Contractor must also demonstrate their Quality Control procedures and ability to
deliver cost-effective solutions.
Many of the specific research briefs arising from the Framework will require outputs
that can be published. The Contractor must be able to demonstrate that these can
be prepared in a clear, accessible and concise manner and format.
Design
The Public sector in Scotland delivers a wide range of products, services and
information, to a variety of audiences including businesses, stakeholders, industries
and members of the public.
To carry this out effectively the public sector draws on the support of a range of
design services. These services will include brand development and the design of a
wide variety of branded materials including numerous printed and online
publications.
Please note that the Design Services will not include core Scottish Government
publications as these are covered by a separate, print and publishing Framework.
The Contractor shall be required to work collaboratively with the other contractor
providing this service, where appropriate, to ensure consistency of materials, end-toend service and timely delivery.
Events
The requirement is to provide services in the areas of event management, exhibition
Management, and technical audio visual services for such events.









Delivery of high quality professionally managed events;
Maximising income generation opportunities through sponsorship provision;
Responsibility and delivery of all project management tasks associated with
the events including liaison with key stakeholders, Partners and staff where
appropriate;
Project manage the design, build and life cycle management of Collaborative
Partner’s exhibition displays;
To protect and enhance the Collaborative Partner’s brand and corporate
image in large scale events;
To assist in meeting Collaborative Partner’s exhibition objectives and
opportunities;
Ensure Corporate image is protected and maintained across all audio visual
content (presentations, video, podcasts etc.);
Provide audio visual support services to key events and exhibitions either in a
main contractor or sub-contractor role; and Professionally produced and
delivered audio visual support
Calling off from the Multi-lot Marketing Services Framework Agreement
Collaborative Partners must first agree in writing to operate the Framework
Agreement in accordance with the procedures set out within this document. This
takes the form of the attached Collaborative Partner Participation Form. This form is
required to be completed by each Collaborative Partner and lodged with the Scottish

Procurement at the address noted on the document. It governs all future call offs by
them. Please note that a Partner will be unable to access the Framework
Agreement without this form being completed. Following receipt of the completed
participation form the partner will be given access to the Entire Agreement document
(Specifications/Pricing & Conditions).

6.
Process for making a Direct award or undertaking a Mini Competition
Depending on the value of the requirement a partner can either make a direct award
or undertake a mini-competition. A mini-competition involves issuing an Invitation to
Tender (ITT), to all the Contractors listed in the lot. The ITT must be returned within
a specified timescale. Details of the threshold levels applicable to each lot and
the processes to be followed are detailed in the attached document.

7.
Issuing an Invitation to Tender (ITT) for mini competitions
Partners must be able to define their requirement and ensure that the resulting
contract award(s) does not amount to the creation of a subordinate multi-supplier
framework i.e. a framework within a framework. When setting the tender return date,
Partners should consider the complexity of their requirement and should allow as
much time as possible for tenderers to complete and return their tender proposals.

8.
Bid Evaluation and Award Criteria when issuing a full Tender Proposal
It is important that any mini competitions resulting from the Framework Agreement
where you are using the Invitation To Tender (ITT) template includes the following
award criteria as specified in the Framework Agreement Conditions.
Technical Criteria (…..%): 
General understanding of the requirement, demonstrable capacity
and availability to meet the Ordered Services outputs (overall
weighting …. %)

Demonstrable experience and expertise of the proposed personnel
(including holding interviews where appropriate) to meet the Ordered
Services outputs (overall weighting …. %)

Operational proposals with particular emphasis on quality and
performance measurements, and customer satisfaction (overall
weighting …. %) and
Financial Criteria (….%): 
Total tender cost ex VAT (i.e. number of days x contracted day rate
for all work less any applicable discounts) (overall weighting …. %).
Following evaluation of all submissions, an award can then be made to the
Contractor submitting the most economically advantageous tender for the service
required.

9.
Awarding an Order (call off contract)
A call off contract must be concluded by an award letter and letters must also be
issued to all unsuccessful tenderers. Please note that public bodies do not have to
follow the standstill rules when awarding a call-off contract under a Framework
Agreement. However, where above-threshold level contract is awarded by minicompetition, following the standstill rules on a voluntary basis (including summary
reasons) can protect the contract from ineffectiveness, if challenged in court.
