The United States Occupational Safety and
Health Administration (OSHA) is an agency of the United States Department of Labor. It was created by Congress under the
Occupational Safety and Health Act, signed by President Richard M. Nixon, on December
29, 1970.
Extends to most nongovernmental workplaces where there are employees.
State and local government workers are excluded from Federal coverage, however, states operating their own workplace safety and health programs under plans approved by the US
Department of Labor are required to extend their coverage to state and local government employees.

29 CFR 1910.134(c)(1) In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respirator protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include the program the following provisions of this section as applicable
