Argument The prosecution will seek an indictment for the conviction of Frankenstein’s
Creature for three counts of third degree murder for the deaths of Henry Clerval, William
Frankenstein, and Elizabeth Lavenza Frankenstein; and two counts of involuntary
manslaughter for the deaths of Justine and Dr. Frankenstein.
1. The death of Henry Clerval is attributable to The Creature solely because of the
relationship between Clerval and Victor Frankenstein.
a. Statement of fact concerning the murder of Henry Clerval.
i. The evidence can attest that the Creature while in search for Frankenstein,
crossed paths with Clerval in Frankenstein’s boat and was killed out of rage.
1. The neck was found with fingerprints and injuries from a monster like
creature. A creature that befits the size and composition of
Frankenstein’s creation.
2. “I am malicious because I am miserable.” The Creature states his
malice and loneliness to Victor when they run into each other and he
pleads his case to Victor.
ii. The prosecution will prove malice aforethought in that the Creature killed
Henry Clerval as revenge against Victor Frankenstein because he knew how
important Clerval was to Frankenstein.

1. Henry Clerval was the best friend of Dr. Victor Frankenstein, the
creator of the Creature.
a. Henry Clerval cared for and comforted Victor after his
brother’s death because they are so close. His father reached
out to Clerval to ask he would not tell Victor until we felt
better because he did not want to upset his son any further.
Clerval gladly obliged out of love and respect for both Mr.
Frankenstein and Victor. Friends since their childhood, Mr.
Frankenstein loves Henry like his own son.
2. The death of Henry Clerval is attributable to The Creature solely because of the
relationship between Victor Frankenstein and the Creature.
a.
Witnesses of the pair (the Creature and Dr. Frankenstein) have eye witnessed the
contentious relationship and its ongoing complications between the two.
i. Creature left all alone to fend for himself, ditched by his creator leading to
issues concerning requests by the Creature to Frankenstein, which he did not
fulfill.
1. The Creature lived in the woods, fending for himself, only aware that
Victor Frankenstein is his creator.
2. “My daily vows rose for revenge, a deep and deadly revenge, such as
would alone compensate for the outrages and anguish I had
endured.”(Shelley 101)

ii. Henry Clerval’s body was found in the Creature’s creator’s boat, noting the
connection between the Creature and murder.
3. William:
a. William- William was the brother of the Creature’s creator, and also was found with
marks on his neck that mimic the markings found on the body of Henry Clerval.
b. Same injuries, confirms the suspicion that the murderer was the same.
c. The closeness between Victor and his brother made him a target for the Creature’s
revenge plan. The Creature killed William, knowing the loss would have a deep
impact on Victor.
4. Elizabetha. Dr. Frankenstein’s wife was murdered in their home, strangled by a monster like
creature. Identical injuries found on her body as those of William Frankenstein and
Henry Clerval.
b.
Her husband found her pale and breathless in their bedroom, we believe, not
coincidentally during an altercation between the Creature and his creator.
c.
The Creature demanded a companion/female from Victor. After Victor changed his
mind, The Creature was very angry and threatened to kill Victor’s companion. Out of
spite, The Creature killed Victor’s companion because he wanted him to join him in
his loneliness.

Involuntary manslaughter
1. Justine Moritza.
Justine was charged for the death of William, Dr. Frankenstein’s brother
because she was found with one of William’s most prized possessions.
b. The jury did not have quality evidence but she was still accused.
c. She was falsely accused for this murder which resulted in her death,
despite the lack of worthwhile evidence.
d. The injuries William suffered to his neck were not capable of the human
hand. Following William’s murder, many other counts were discovered
with the same severe strangulation after Justine was already executed.
e. This information proves the innocence of Justine Moritz because it is
impossible for her to commit these murders because of her execution
prior.
2. Dr. Frankensteina.
After the many deaths in his family, Dr. Frankenstein died of sadness in
his family. The Creature murdered three of his closest loved ones.
b. Unable to withstand the grief, he passed away shortly after Elizabeth’s
death.
c. Also, he could not bare to see his son in such sorrow.
