Greenhouse and energy audit Introduction and Register of Greenhouse and Energy Auditors The information in this document is designed to provide general guidance to assist a prospective applicant to become a registered greenhouse and energy auditor. It also assists the applicant in understanding his/her obligations under the relevant legislation. Various schemes within the Clean Energy Regulator require the conduct of greenhouse and energy audits. These include National Greenhouse and Energy Reporting, Jobs and Competitiveness Program, Carbon Farming Initiative and the Renewable Energy Target. Divisions 6.4 to 6.6 of the National Greenhouse and Energy Reporting Regulations 2008 (the NGER Regulations) set out the eligibility criteria, which applicants for registration must satisfy. The National Greenhouse and Energy Reporting (Auditor Registration) Instrument 2012 (the Instrument) gives substance to these criteria, specifically, qualifications, knowledge, training and experience. The Instrument is not intended to be read in isolation. It should only be read in conjunction with the relevant NGER Regulations. The legislation can be found at http://www.cleanenergyregulator.gov.au. The two types of greenhouse and energy audits are defined in Division 1.5 of the National Greenhouse and Energy Reporting (Audit) Determination 2009 (the NGER Determination). The Register of Greenhouse and Energy Auditors The National Greenhouse and Energy Reporting Act 2007 (the NGER Act) empowers the Clean Energy Regulator to register individuals as greenhouse and energy auditors and to keep a register of those individuals. Under the NGER Act, the Clean Energy Regulator may suspend or deregister greenhouse and energy auditors, or initiate a review of an auditor’s registration. The NGER Act also provides for the publication of certain information contained in the register so that registered corporations and liable entities have ready access to greenhouse and energy auditors. The published version of the register displays each registered greenhouse and energy auditor’s name, date of registration, category, employer, contact details and industry specialisation. Confidentiality Under the relevant legislation it is a criminal offence for the Clean Energy Regulator, the Clean Energy Regulator’s support staff, registered greenhouse and energy auditors and others to disclose information without appropriate authority. The offence carries a penalty of imprisonment. The unauthorised disclosure of information may also be an offence against section 70 of the Crimes Act 1914. Is there a fee for applying to become a greenhouse and energy auditor? There are no application fees for applying to register as a greenhouse and energy auditor. Providing certified true copies All documents submitted to support an application will need to be certified by a suitably qualified person as a true copy of the original. Certified true copies must: be a copy of the original onto which the ‘wet ink’ certification has been written or stamped bear a statement that the document is a true and correct copy of the original GPO Box 621 Canberra ACT 2601 1300 553 542 enquiries@cleanenergyregulator.gov.au www.cleanenergyregulator.gov.au 5 show the full name and qualifications of the person giving the certification be signed and dated, and be written in English. A suitably qualified person is an individual legally qualified to administer oaths (for example, a solicitor or a Justice of the Peace). Documents written in languages other than English Documents written in languages other than English need to be translated into English. Each translated document must be certified as a true and correct copy by an authorised translation service. Authorised translation services in Australia are listed by the National Accreditation Authority for Translators and Interpreters and can be found at http://www.naati.com.au/home_page.html. If translation services are received from another country, attach evidence that the service is from an Authorised Translator. Only hard copies of the original document can be certified as a true and correct copy by a translator. Supporting statements At Parts G (Question 16), H (Question 25) and M (Question 28) of the Application for Registration as a Greenhouse and Energy Auditor form, applicants will be asked to provide written statements which support their claims. Written statements provide an opportunity to articulate in detail the qualifications, experience, and knowledge that demonstrate eligibility for registration as a greenhouse and energy auditor. In this sense, they are very important components of an application. The applicant should consider the following principles when drafting written statements: provide accurate details such as: » details of audit engagements including corporate entity, nature of audit, audit standards applied for the engagement, dates and duration. » details of audit experience, presented in table format (at Question 24). » the means by which knowledge has been attained and applied. articulate how the details provided demonstrate the applicant’s suitability for the category/categories applied for, and think about readability so that the information provided is clear and understandable. Please limit written statements to 700 words. Third party checks The Clean Energy Regulator may seek independent confirmation of the information provided by applicants, particularly with regard to the ‘fit and proper’ person criteria at Question 14 of the Application for Registration as a Greenhouse and Energy Auditor form. For that reason, applicants need to fill in an Australian Federal Police National Police Check (NPC) Application Form, which gives permission for the Australian Federal Police to conduct a criminal records check. This consent form is available for download on the Clean Energy Regulator website. The Clean Energy Regulator will initiate and pay for these third-party checks. We cannot accept Australian criminal records checks that have been initiated by the applicant. Please note that it is an offence under Division 137 of the Criminal Code Act 1995 (the Criminal Code) to provide false or misleading information or documents. Foreign criminal records checks If an applicant has resided in a foreign country for a substantial period of time, or currently resides in a foreign country, the applicant should obtain a criminal record check from the relevant law enforcement agency in the country of residence. The criminal record check should be included with the Application for Registration as a Greenhouse and Energy Auditor form. 2. Completing the application form The Application for Registration as a Greenhouse and Energy Auditor form is available for download from the Clean Energy Regulator website. Once completed, applications should be submitted by post to the Clean Energy Regulator. The explanatory notes below are not exhaustive and only address questions that may require clarification. If applicants require further information to assist with submitting an application, telephone or email the Clean Energy Regulator. Contact details are at Part 4 of these guidelines, below. Part A: Personal details Questions 1–8 Insert personal details as required. Part B: Category of greenhouse and energy auditor and industry specialisation(s) Question 9: What category of auditor are you applying for? Categories There are three categories of greenhouse and energy auditors: category 1 category 2, and category 3. Category 1 applicants can apply to register as: category 1–NGER technical, or category 1–CFI technical, or category 1–non-technical. Applicants should give consideration to the category of auditor for which they apply. Assessment of applications will involve matching skill sets and experience/knowledge to the appropriate category. GPO Box 621 Canberra ACT 2601 1300 553 542 enquiries@cleanenergyregulator.gov.au www.cleanenergyregulator.gov.au 7 Knowledge and experience requirements of each category Different knowledge and experience requirements apply to each of the categories of greenhouse and energy auditor. Category 1: Applicants for Category 1–NGER technical, Category 1–CFI technical and Category 1–nontechnical must demonstrate knowledge of certain provisions of the NGER legislation. In addition, applicants for Category 1–CFI technical must demonstrate knowledge of the CFI legislation and at least one approved CFI methodology. Category 2: Applicants who apply for registration as a Category 2 greenhouse and energy auditor, will need to have knowledge and experience in audit team leadership and the provision of assurance. Category 3: Applicants who apply for registration as a Category 3 greenhouse and energy auditor, will need to be currently registered as a Category 2 auditor, or have previously been registered as a Category 3 auditor. Applicants must have experience as an audit team leader or team member in at least two greenhouse and energy audits. Question 10: What is your industry specialisation? Applicants are required to select one or more of the generic specialisations from the form. If ‘Greenhouse Gas and/or Energy’ or ‘Carbon Farming Initiative’ is selected, indicate specific area(s) of specialisation, as listed on the form. Applicants may select more than one specialisation from the list. Part C: Employment Question 11: Current Occupation State current occupation. Question 12: Employment details Insert company details as required. Part D: Tertiary qualifications Question 13: Highest tertiary qualification and name of institution It is a prerequisite for registration that the applicant has a relevant Bachelor’s, Master’s, or Doctoral Degree or equivalent from an approved university or other institution of higher learning. Approved Australian institutions are listed at Table A or Table B of the Higher Education Support Act 2003 and can be viewed on the Tertiary Education Quality and Standards Agency website. Section 5 of the Instrument provides for situations where an applicant holds qualifications that were not awarded by a Table A or Table B provider, but were awarded by an Institute of Technology or equivalent at a time when such institutions offered courses which would now only be available through a university. Evidence of Australian tertiary qualification To support an application, the applicant will need to provide a certified true copy of his/her Degree, Graduate Diploma or Graduate Certificate (or equivalent) from the university or institution that awarded the qualification. GPO Box 621 Canberra ACT 2601 1300 553 542 enquiries@cleanenergyregulator.gov.au www.cleanenergyregulator.gov.au 8 If a tertiary qualification is submitted as evidence of knowledge of auditing for the purpose of NGER Regulation 6.15: Audit knowledge, a certified true copy of the statement of academic record from that university or institution should also be submitted. Overseas applicants To support an application, the applicant will need to provide a certified true copy of his/her Degree, Graduate Diploma or Graduate Certificate (or equivalent) from the university or institution that awarded the qualification. Part E: Suitability of applicant Question 14: Applicant must be a fit and proper person The NGER Regulations require that applicants meet certain criteria which confirm that they are ‘fit and proper’ for the role of registered greenhouse and energy auditor. These criteria predominantly relate to personal characteristics such as honesty, integrity and trustworthiness. The Clean Energy Regulator may seek independent confirmation of the information provided in response to Questions 14a–14h. This may involve checks with third parties such as referees or relevant government agencies. Please note that it is an offence under Division 137 of the Criminal Code to provide false or misleading information or documents. The NGER Regulations direct that the Clean Energy Regulator must have regard to the information provided at Questions 14a–14h. On that basis, it should be noted that information that is provided here may not necessarily render the applicant ineligible for registration. It is therefore in the applicant’s best interests to provide a full and accurate account of the circumstances which surround any relevant event (for example, a relevant criminal conviction or civil liability) so that the Clean Energy Regulator has all the facts at hand to enable a well-informed decision. Applicants will find a link to download the Australian Federal Police National Police Check (NPC) Application Form on the Clean Energy Regulator website. The applicant must ensure that it is filled in, signed, and submitted with the application. Part F: Membership of a professional body Question 15: Relevant memberships Insert details of relevant memberships of professional bodies. Part G: Legislation and/or technical knowledge Question 16: Statement of knowledge The NGER Regulations require knowledge of legislation relevant to the category of auditor for which the applicant is applying. Appendix B lists knowledge requirements by category of greenhouse and energy auditor. The response should be as comprehensive as possible, and include practical examples which provide clear evidence of knowledge for each element of legislation specified in the relevant column of the table at Appendix B. The statement should include details of how the knowledge was obtained, including (if relevant): GPO Box 621 Canberra ACT 2601 1300 553 542 enquiries@cleanenergyregulator.gov.au www.cleanenergyregulator.gov.au 9 previous experience in assisting a liable entity or registered corporation meet its reporting obligations under the NGER Act training in NGER or CFI legislation, and experience in participating in greenhouse and energy audits. Part H: Audit experience Questions 17–25: Explanatory notes Questions 17–25 are designed to elicit information which will help the Clean Energy Regulator form an opinion about whether the applicant has sufficient experience in the conduct of certain kinds of audits, as well as in audit team leadership. This information will assist in making a decision about whether the applicant is appropriately qualified for the category of greenhouse and energy auditor applied for. At Question 24, the applicant will be required to complete a table that includes details of audit experience and any other information which supports the claims made at Questions 17–23. Please note that at Question 27, applicants are asked to provide two written references from eligible referees to confirm competency in auditing and preparing audit reports as well as team leadership. Kinds of audit The NGER legislation requires the applicant to have a minimum amount of experience in certain kinds of audits and, for Categories 2 and 3, a minimum amount of experience in leading audit teams. The experience must have been accumulated over the past five years, in at least five audits of a kind as specified at Table 1 below. When making a case for equivalence, an applicant should clearly explain the audit experience that they possess and demonstrate how it is directly relevant to the requirements of the category of auditor for which they have applied. GPO Box 621 Canberra ACT 2601 1300 553 542 enquiries@cleanenergyregulator.gov.au www.cleanenergyregulator.gov.au 11 Questions 17–21: Total hours of audit experience Category 1 experience requirements Category 1–NGER technical and NGER–non-technical If the applicant is applying for registration as a Category 1 greenhouse and energy auditor, he/she must be able to demonstrate at least 350 individual hours of experience in: conducting audits of a kind as listed in Table 1 within the last five years, and preparing audit reports for audits of a kind as listed in Table 1. Category 1–CFI technical If the applicant is applying for registration as a Category 1–CFI technical greenhouse and energy auditor, he/she must demonstrate both audit experience and technical experience. The applicant must have accumulated at least 200 individual hours of experience as a professional member of an audit team in auditing and preparing audit reports in 1 or more of the audits listed in Table 1 in the last 5 years. The applicant must have also accumulated at least 150 individual hours of technical training and experience in the last 5 years by participating in 1 or more of the following: a CFI technical working group on methodology development a Domestic Offsets Integrity Committee technical expert review of a draft CFI methodology a technical project associated with emissions or sequestration estimation in a sector covered by the CFI legislation. Category 2 experience requirements If the applicant is applying for registration as a Category 2 greenhouse and energy auditor, he/she must be able to demonstrate that they have: completed at least 700 hours experience of auditing and preparing audit reports of the kind listed under ‘experience in preparing audit reports’ in Table 1, and completed at least 490 hours experience of audit team leadership of a kind listed under ‘audit team leadership’ in Table 1. The audit experience must be equivalent to conducting a reasonable assurance engagement or a limited assurance engagement under the NGER audit determination. Category 3 experience requirements Applicants applying for registration as a Category 3 greenhouse and energy auditor, must be a registered Category 2, or previously registered Category 3 greenhouse and energy auditor. They must have experience in at least two greenhouse and energy audits conducted under the NGER Act, as an audit team member or an audit team leader. The experience must be in conducting a reasonable assurance or limited assurance engagement. Audit team leaders must demonstrate a minimum of 20 hours of experience and audit team members must demonstrate a minimum of 60 hours of experience. This question is relevant to Category 2 applicants. The NGER Regulations require that applicants for registration as Category 2 greenhouse and energy auditors have led audit teams that have three or more other members for a total of at least 490 hours over the last five years. Questions 22–23: Number of audits The Instrument requires applicants to have participated in at least five audits of a particular kind over the previous five years. Applicants applying for registration as a Category 1–CFI technical greenhouse and energy auditor must have participated in at least two audits of a particular kind over the previous five years. Questions 24–25: Audit log and statement In response to this question, the applicant needs to provide information about his/her audit experience in the table provided. There is also provision to provide a statement, which supports the claims made at Questions 17–23. Please note that the experience must have been gained in the last five years. The applicant should include information and practical examples which demonstrate experience in: auditing preparing audit reports, and audit team leadership. To assist the Clean Energy Regulator in making future decisions to allocate particular auditors to particular audits, applicants are encouraged to include: any experience in audits related to corporate structures in general, or operational control as defined by the NGER Act, and the type(s) of industry within which audits have been conducted. Part I: Audit qualifications/training/certification Question 26: Evidence of knowledge of auditing, audit team leadership and assurance Knowledge of auditing All categories Applicants are required to provide evidence that they have knowledge of auditing. If an applicant is currently registered as an auditor under section 1280 of the Corporations Act 2001 or has been certified by a qualified body as an Environmental Auditor, a Principal Environmental Auditor, a Lead Environmental Auditor or a Business Improvement Environmental Auditor under AS/NZS 19011:2003, they meet the requirement for knowledge of auditing. If an applicant is not qualified or certified as above, then he/she must demonstrate knowledge of auditing in one of the following two ways: GPO Box 621 Canberra ACT 2601 1300 553 542 enquiries@cleanenergyregulator.gov.au www.cleanenergyregulator.gov.au 13 successful completion of a relevant training course - see Table 2 below, or participation in at least five audits of a kind listed in Table 1, totalling at least 700 hours in the past five years. Knowledge of leadership and assurance Category 2 Applicants for Category 2 registration are required to provide evidence of their knowledge of audit team leadership and assurance. An applicant is deemed to have knowledge of both audit team leadership and assurance if he/she: is currently registered as an auditor under section 1280 of the Corporations Act 2001, or has successfully completed a relevant training course - see Table 2 below. If the applicant does not satisfy one of the above criteria, he/she may present a claim for knowledge of audit team leadership and assurance separately. Knowledge of audit team leadership An applicant can demonstrate knowledge of audit team leadership in one of two ways: certification by a qualified body as a Lead Environmental Auditor or a Business Improvement Environmental Auditor under AS/NZS 19011:2003, or successful completion of a training course in leading assurance engagements in accordance with AS/NZS ISO 19011:2003 or ISO 19011:2011, delivered by a competent training provider - see Table 2. Knowledge of assurance An applicant can demonstrate knowledge of assurance in one of three ways: successful completion of a prescribed course listed in regulation 9.2.03 of the Corporations Regulations 2001, or successful completion of a training course in conducting assurance engagements in accordance with ASAE 3000, ISAE 3000, ASAE 3410 or ISAE 3410, delivered by a competent training provider, or successful completion of a training course in conducting compliance engagements in accordance with ASAE 3100, delivered by a competent training provider. For all categories of greenhouse and energy auditor, the eligible referee must provide information which confirms that the applicant audited and prepared audit reports and that these were completed competently. They must also refer to audits of a kind relevant to the category applied for. For applicants applying for registration as a Category 2 auditor, the eligible referee must provide additional information which confirms the applicant’s experience as an audit team leader and that this task was performed competently. It is a requirement that Category 3 applicants provide two written references, however, these may be provided internally by the Clean Energy Regulator. Please note that the Clean Energy Regulator may contact referees to validate information provided. Part K: Proof of identity Proof of identity Part K is based on the standard Australian ‘100-point’ identity check. Certified true copies of the identification documents listed at Part K must be submitted with the application. Please refer to the information provided at Part 1 of these guidelines, under ‘Providing certified true copies’ and ‘Documents written in languages other than English’, for guidance on certified true copies. Note: the applicant must provide two primary identification documents or a combination of one primary and one secondary identification document or their international equivalents. One of these documents must clearly state the residential address as declared at Question 5 on the application form. Part M: Other information Question 28: Other information Part M allows the applicant to provide any other information that may be relevant to an application, but which has not been specifically sought by the Clean Energy Regulator. This might include a description of courses in which the applicant is currently enrolled but has not yet completed; a description of an Australian or international qualification that could be taken into consideration; or any other information that may be relevant. By signing the declaration and undertaking, the applicant is agreeing to abide by the Greenhouse and Energy Auditor Code of Conduct. It takes up to eight weeks to process an application; this depends on the completeness and quality of the information provided. In some cases, third party checks such as the police records check may take longer than eight weeks. What happens if an application is incomplete? If the applicant has not completed all parts of the form, he/she will be contacted in writing by the Clean Energy Regulator. The NGER Regulations allow three months to resubmit a completed application before it is deemed to have lapsed. The Clean Energy Regulator is unable to process applications which are incomplete or contain errors or omissions. How will I know if my application has been successful? The Clean Energy Regulator will contact the applicant in writing to advise of the decision to register or not as a greenhouse and energy auditor. A registered greenhouse and energy auditor must abide by the principles set out in: a. subregulations (2) to (7) – while preparing for, carrying out, or assisting in carrying out, a greenhouse and energy audit and in preparing audit reports b. subregulations (8) and (9) – when the auditor is engaged in marketing or self-promotion as a registered greenhouse and energy auditor c. subregulation (10) – in relation to other audit team members if the auditor is an audit team leader, and d. subregulation (11) – in other situations not specifically mentioned above. Compliance with the law 2. The auditor must comply with laws and regulations applicable to registered greenhouse and energy auditors and the conduct of greenhouse and energy audits Integrity 3. The auditor must behave with integrity and in particular: a. must be straightforward and honest in professional and business relationships relating to the carrying out of the audit and deal fairly with persons involved in the audit, and b. must not allow his or her name to be associated with reports, returns, communications or other information relating to the carrying out of the audit (audit material) if he or she believes that the audit material: i. contains a materially false or misleading statement ii. contains statements that have been furnished recklessly, or iii. omits or obscures information required to be included where the omission or obscurity would be misleading. Objectivity 4. The auditor must behave with objectivity and in particular: a. must not compromise his or her professional judgment because of bias, conflict of interest or the undue influence of others that may arise during the audit and b. must avoid relationships that bias or unduly influence his or her professional judgment in relation to the audit. 5. The auditor must not accept gifts given by the audited body or someone associated with the audited body. 6. A reference in 5 to the auditor accepting gifts: a. includes a member of the auditor’s immediate family accepting gifts and hospitality and b. includes the auditor accepting hospitality. The auditor must behave with competence and due care and in particular: a. must act in accordance with the requirements of the Audit Determination b. must act carefully, thoroughly and on a timely basis c. must make the audited body aware of limitations inherent in the audit d. must maintain sufficient professional knowledge and skill to ensure that he or she is able to carry out the audit, and e. if the auditor is the audit team leader — must ensure that the other team members have appropriate training and supervision. Marketing and promotion 8. In marketing or self-promotion as a registered greenhouse and energy auditor, the auditor must be honest and truthful and must not: a. make exaggerated claims about: i. the audit services he or she provides ii. his or her qualifications, or iii. his or her experience gained as an auditor or b. make disparaging references or unsubstantiated comparisons to the work of other registered greenhouse and energy auditors or members of an audit team who are not registered greenhouse and energy auditors. 9. The auditor must not attempt to sell other services to the audited body to avoid impairing the independence of the auditor’s ability to provide audit services under these Regulations. Obligation on audit team leaders 10. If the auditor is an audit team leader, he or she must ensure that the other audit team members comply with the Code of Conduct when assisting in carrying out the audit. Professional behaviour 11. The auditor must avoid any action that may bring discredit to the auditor or greenhouse and energy auditors generally.
