This course is an introduction to the legal influences upon and within businesses, including statutory, executive,
administrative, and case law. Included are the roles and influences of contracts and regulations upon business

jurisprudence.
Identify common workplace torts, evaluate the standards of care required by law, and explain
how courts determine damages to aggrieved parties.

more duties, such as the duty of loyalty, to its shareholders, although there are
many other areas where business ethics are at the center of a case.
Describe the facts of the case briefly and describe the legal issue. Discuss also the
effect of the case on the business world and on society generally.
Incorporate the legal terminology from your textbook where appropriate, in both
your original post and in your responses to your classmates. Use academic or
legitimate news sources, such as The New York Times, the Los Angeles Times, the

In a well-written paper, relate your professional or personal experience in the
business world as an employee or employer and an ethical issue you confronted
that falls within the realm of employment law. For example, a student could write
about his or her experience working long hours as a minor in violation of federal
wage and hour laws.
If you have not personally or professionally confronted an issue, consider an issue
that could arise within the realm of employment law and discuss. Be sure that
your focus is two fold: first, on an area of employment law and second, on a
potential ethical issue within that area of law.
Address the following in your paper:





Identify and clearly define the relevant law, either defining a legal
doctrine, provisions of a law, or elements of a specific cause of action.
Apply facts from your situation to the applicable law, doctrine or cause of
action studied.
Clearly summarize lessons learned from the week as they apply to your
fact pattern and make links to the readings and/or module.
Include new thoughts or ideas based on the module information-this is
your reflection/insight which logically would flow from each information

Contract law permeates society and daily life. Think of a personal or professional
contract in your life into which you’ve entered or describe a contract dispute
you may have had. In a well-written paper, relate your professional or personal
experience in the business world to the readings for the week.
In your paper, consider and address the following questions:




Were there any issues, legal or otherwise, faced when entering into the
contract?
What was the offer, acceptance and consideration? Be sure to define
these legal concepts before identifying them in your specific example.
Would you have a different point of view entering into the contract now
with your increased knowledge of contract law? Why or why not?
Identify ethical issues that exist in your example, if any. If your scenario
did not present any ethical issues, provide support indicating as such.
Do not feel compelled to disclose more information than you are comfortable
discussing. There are many contracts we enter into which are fairly neutral, so
you should be able to discuss something without feeling an invasion of privacy.

For discussion this week, we will answer questions similar to the questions in
Week 3, except in the tort context. This week, please do two things:
1. Using the Internet, research a case where a tort was the cause of action in a
business case. Use some of the terminology from the textbook to help you
search. Describe the facts of the case briefly and describe the legal issue.
Incorporate the legal terminology from your textbook where appropriate, in
both your original post and in your responses to your classmates. Use academic
or legitimate news sources, such as The New York Times, the Los Angeles Times,
The Washington Post, CNN, MSNBC, etc. Please include in your post any links
used for your research for your fellow classmates to review and to comment on.
Make sure to identify the law at issue or the elements of the cause of action. Do
not repeat cases discussed by another classmate.
2. Tort law permeates society and daily life. Think of a tort issue in your life or
someone close to you. Describe the issue. Perhaps you did not pursue litigation,
but after your knowledge in this class, do you think you should have? Perhaps
you pursued litigation and lost. Is it clear why you lost? Do not feel compelled to
tell more information than you are comfortable discussing. Please try to
incorporate legal terminology where relevant. Specifically, identify the elements
of the tort cause of action and apply facts to each element. If the case is not
clear cut, it will be where an element is not clearly met. If an element of a cause
of action is clearly not met, there is not a legitimate cause of action.
Please make sure to comment on at least two classmates' posts. Make sure your
comment is a relevant, informative comment. It is imperative that you
demonstrate critical thinking in your own post as well as your responses to
classmates. You must answer both questions to receive credit. Do not repeat
researched cases.** Please remember to log into class throughout the week to

**In theory, two students could log on to class at the same time and begin
researching the same case, then post their researched case not realizing another
student researched the same issue. Should you find yourself in this unlikely

Torts (70 Points)
In a well-written paper, relate your professional or personal experience in the
business world to the readings for the week.





Identify and clearly define the relevant law, either defining a legal
doctrine, provisions of a law, or elements of a specific cause of action.
Apply facts from your situation to the applicable law, doctrine or cause
of action studied.
Clearly summarize lessons learned from the week as they apply to your
fact pattern and make links to the readings and/or module.
Include new thoughts or ideas based on the module information. This is
your reflection/insight which logically would flow from each information
point presented.
Make sure your experience actually relates back to the material for the
week.
In the area of torts, for instance, we see many causes of action that are
comprised of “elements.” Define each element and apply facts from your
situation to the law or elements. For instance, if you write about a situation
involving negligence, you would define negligence stating “Negligence occurs
where a person’s conduct falls below the standard of care, resulting in a breach
of duty which is the direct and proximate cause of injury to another person or
thing. The elements of negligence are: 1) duty; 2) breach; 3) causation; and 4)
damages.”
Your paper should be 2-3 pages in length, not including the title or references
pages. Review the grading rubric, which can be accessed from the Course
Information page, and make sure to follow CSU-Global APA guidelines. Please be

The Portfolio Project requires you to write a memorandum to a decision maker,
such as the president of the United States, a member of Congress, a chairperson
of the SEC, or a state Governor, on how to reform corporate ethics in American
business today. As we have seen, legislation such as Sarbanes-Oxley has received
considerable media attention, but has not prevented significant catastrophes
such as the global economic meltdown of 2008. You should be prepared to
propose policies that might help to ameliorate or to prevent corporate ethics
lapses that might occur in the future. You have the freedom to select any policy
avenues that you think might help to strengthen and fortify corporate ethics. Your
memo should cover the following:





Set forth why your chosen policy pathway is important
Compare and contrast to the policy it replaces
Articulate your ideas on how to remedy the issue of corporate

Please note that your prescription for change is not nearly as important as your
ability to forecast potential challenges to the corporate boardroom and to predict
possible ways the government could intervene to assist not only solid corporate
governance, but also the interests of individual shareholders. It is recommended
that you suggest at least two methods and/or policy proposals that critically
address the public policy concern. Bring in facts and other data to support the
policy issue addressed and make sure each fact is cited to relevant authority.
Demonstrate critical thinking by analyzing, evaluating, and interpreting
