 Based in Scholarly Communication and
Licensing Unit


University affiliates
 Assist in Licensing and ERM initiatives

Disclaimer
I am not an attorney, and cannot offer legal advice.
The following information is presented to educate
about copyright law and institutional policy in
general terms. If you are unclear about your
options when confronted with a specific legal
issue related to copyright, you are urged to
consult with an attorney with a background in
copyright law.
CONSULTATIONS
Copyright issues invariably dependent upon
specific issues; available, individualized
consultation is key
 Time commitment can be substantial
 Ready with referrals to relevant campus units
and officers
 My library unit serves as liaison to eScholarship,
the UC repository and Open Access platform

The Dual Nature of my Role




One half: Key consultant on the limits of
Copyright law
One half: Champion of Fair Use and Open
Access
My work leads me to where the rubber hits the
road – the point where authors negotiate with
publishers
Continuing challenge: convincing scholars
that the virtue of Open Access publishing
should outweigh their need to submit to the
highest impact journal in their field

OBSERVATIONS FROM THE
GROUND LEVEL




Campus social movements come from students
– not faculty
Adoption of Open Access is progressing at
discipline-specific speeds
Humanities are generally behind the curve in
relation to certain hard sciences – we have
leveraged their experiences to spur progress
UCLA has more OA journals in the
Humanities than in the hard sciences
INDIVIDUAL CHOICES
Often consult with me when it’s too late
for Open Access to be a viable choice
 Education and outreach helps, but it’s
difficult to impart this message at the
key moment.
 Example: ACRL speaker agreement I
had to sign

INDIVIDUAL CHOICES
ACRL speaker agreement:
INDIVIDUAL CHOICES
ACRL speaker agreement:
“Your signature on this agreement will
constitute a warranty that all of your
material included in the program is
your original work, does not violate
copyright or the proprietary rights of
others, is factually accurate, and
contains no libelous matter.”
INSTITUTIONAL CHOICES
Of course, tenure committees endorsements of
Open Access publication as a virtue is vital (and
UCLA is not leading the way, yet)
 Advances in article-level metrics part of the
answer?
 UCLA Library is considering a fund for Open
Access fees, like the Berkeley model
 UCLA Library already committing substantial
human resources to pave to Open Access road

Some Anecdotes…
 OA
Journal editor trying to index journal
contents in a commercial database
 SPARC author addendum rejected; too
late to make an OA choice
