1 Minutes of the 67th meeting of State Environment Impact Assessment Authority held on 28th Feb. & 1st March 2014, under the Chairpersonship Mrs. Saroj Siwatch IAS (Retd.), Chairperson, SEIAA held in the meeting room of office of SEIAA Haryana, Sector-2 Panchkula, regarding Environmental Clearance under EIA Notification dated 14.9.2006. The full Authority is present. The 13 Cases recommended by SEAC/EAC for Environmental Clearance or otherwise, 15 no. of deferred cases as listed in the Agenda item circulated vide letter No. 270-272 dated 18.02.2014 were discussed. Following decisions were taken:Item No. [1] Environment Clearance for expansion of captive Power Plant by 13.5 MW at Maruti Suzuki India Ltd. at Plot no. 1, Sector-33B-33C, IMT, Rohtak by M/s Maruti Suzuki India Ltd. The recommendation of SEAC to accord Environmental Clearance was earlier considered in the 51st meeting of SEIAA held on 15.05.2013, wherein it was decided to refer back this case to SEAC with the advice to get the revised EIA on the updated data from the project proponent and after receipt of the same, appraise and send the recommendation. The SEAC in its 98th meeting held on 08.01.2014, appraised the revised EIA on the updated data submitted by the project proponent and compared the same with the earlier baseline data. The SEAC observed that there is insignificant variation in the values and are within permissible tolerance limits the SEAC was of the view that the mitigation measures already provided by the project proponent are in order and again recommended to accord environmental clearance by imposing stipulations. The above recommendation of SEAC along with the project details was considered in the today’s meeting in the presence of representative of the project proponent. The project is for expansion of captive power plant from 4.8 MW capacity to 13.5 MW total capacity. The total capacity of captive power plant is 13.5 MW which is based on ultra low sulphur HSD. The fuel requirement is 400 Lt /hr and project proponent shall provide 200 KL HSD tank for storage of fuel. The requisite clearance from Petroleum and Explosives Safety Organization (PESO) for HSD shall be taken. The project proponent has proposed to develop 30% of plant area as green belt. Acoustic noise curtain shall be provided to reduce noise pollution. The stack height shall be 30 mtrs. The system is based on air cooled technology and closed circuit air cool condenser will be used. The water requirement shall be 2 KLD which will be met from HSIIDC. It was noticed that project is covered under item no.1 (d) of EIA notification dated 14.9.06 and SEAC has appraised this project as category B-I project. The TOR’s were approved on 28.06.2012. The public hearing in this case was exempted as the proposed project is located in Notified Industrial Estate. The project proponent on the basis on approved TOR’s submitted EIA/EMP on 12.11.2013. 2 In the meeting today the recommendation of SEAC and the above project details were considered in the presence of representative of the project proponent. The representative of the project proponent submitted NOC from Forest department. The representative of the project proponent also submitted latest monitoring reports of drinking water, soil and ambient air quality. After detailed deliberations, the Authority decided to accept the recommendations of SEAC and to accord Environmental Clearance to this project by imposing the following conditions in addition to stipulations recommended by SEAC and usual conditions in practice. [1] The project proponent shall take adequate preparation for fire and other kinds of disaster including chemical disaster. On-site, off-site emergency plan should be prepared and rehearsed in regular mock drills. [2] The project Proponent shall initiate a long term study through a reputed institution to assess the cumulative impact of the power plants on the AAQ of the area. The study shall in particular assess the impact of emission of the HSD based power plant on the chemistry of upper atmosphere and on concentration of PM10, PM2.5. It shall be ensured that the worst seasonal atmospheric conditions are taken into account in the above said study. [3] The Project Proponent shall ensure that all possible hazards due to the power plant are contained within the plant premises. [4] An Environmental Cell shall be created at the project site itself and shall be headed by qualified officer, who is well versed with the environmental aspects of gas based power plant. It shall be ensured that the Head of the Cell shall directly report to the Head of the Organization. [5] Ultra low sulphur HSD shall only be used as fuel. [6] Standards for discharge of environmental pollutants as enshrined in various schedules of rule 3 of environment protection rule 1986 shall be complied with. [7] The project proponent shall use only treated water for cooling system. [8] The project proponent shall appoint well qualified fire supervisor. [9] The project proponent shall develop 3 meter wide green belt as buffer zone around the plant boundary as sound barrier. [10] The project proponent shall set up continuous online AAQ monitoring system (supervisory control & data acquisition) in the project area to monitor the parameters viz PM2.5, PM10, NOx, SOx and CO. The project proponent shall ensure that the values of these parameters are within CPCB/HSPCB. . the prescribed limits of 3 [11] The project proponent shall display Material Safety Data Sheet (MSDS) of fuel in big fonts at suitable locations within project site. One copy of MSDS shall be supplied to DC Rohtak also. Item No. [2] Environment Clearance for the Proposed Residential Plotted Colony “SONI PALM CITY” located at Village: Budda Khera, Sector- 32, 32A, District- karnal, Haryana by M/s Soni Realtors Pvt. Ltd. The SEAC has forwarded this case for taking necessary action as the project proponent is not responding to the communication of SEAC dated 14.10.2013 satisfactorily. The case was taken up in the today’s meeting. It was informed that the project proponent vide letter 274 dated 18.02.2014 was asked to appear to the Authority for making presentation but the project proponent failed to appear before the Authority. The detail of the case was examined and it was noticed that the project proponent vide letter dated 18.07.2011 submitted application under item no. 8 (a) for development of Residential plotted colony having permissible built up area 22913.5 sqmt. The SEAC in its 92nd meeting held in 08.10.2013 decided that the project proponent should give the permissible FAR for all the plots. The project proponent vide letter dated 21.10.2013 submitted the details of permissible built up area as 139682 sqmt. It was found that the project proponent has given the incomplete figures of proposed built up area as the proposed built up area of commercial area and basements were not indicated in the given built up area. After detailed deliberation it was decided to refer back this case SEAC with the advice to visit the site in order to assess the latest status of construction and exact proposed built up area of the proposed residential plotted colony and thereafter, to send its recommendations within stipulated period as prescribed in the EIA notification. Item No. [3] Environment Clearance for Commercial Complex namely “Skyline 109” at Sector-109, Village- Pawal Khusurpur, Dwarka Expressway, Distt. Gurgaon. Haryana by M/s Ish Realtors Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the construction of Commercial Complex namely “Skyline 109” at Sector-109, Village- Pawal Khusurpur, Dwarka Expressway, Distt. Gurgaon. The total plot area is 15048.928 sqmt (3.7187 Acre). The total built up area shall be 45000 sqmt. The proposed project shall have 01 Block having 2 basements + GF + maximum 16 Floors. The project shall comprise of 275 nos. of shops and 273 nos. of offices. The maximum height of the building shall be 55.9 meters. The total water requirement shall be 297 KLD. The fresh water requirement shall be 172 KLD. The waste water generation shall be 153 KLD, which will be treated in the STP of 200 KLD capacity. The total power requirement shall be 3627 KW which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 26.34% of project area (15% tree plantation + 11.34% landscaping). The Project Proponent proposed to construct 04 rain water harvesting pits. The solid waste generation 4 will be 600 kg/day. The bio-degradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 630 ECS. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation etc. The representative of the project proponent submitted the assurance of HUDA for supply of water along with proof of EDC/IDC paid to HUDA for the services for supply of water, sewerage connection and drainage system, NOC of airport Authority regarding height clearance and NOC from DC Gurgaon regarding non applicability of a Aravalli Notification. It was noticed that the project proponent has proposed to use 213 KLD of fresh water for HVAC makeup. The representative of the project proponent was directed to use treated water for cooling and should adopt air base cooling system. The representative of the project proponent agreed to use treated water for HVAC cooking and submitted revised water balance diagram. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice.. [1] Vertical fenestration shall not exceed 40% of total wall area. [2] The project proponent shall ensure that the plinth level of the building block to be 1.5 meter above 100 years flood level of the said Najafgarh Jheel. [3] The project proponent shall obtain NOC from HUDA as well as Irrigation Department before the start of construction, regarding possible adverse effect of project proposal on the said Najafgarh Jheel. [4] The project proponent shall not use fresh water for HVAC and DG cooling. Air based HVAC system should be adopted and only treated water shall be used by project proponent for cooling, if it is at all needed. Item No. [4] Extension of validity of EC letter issued for “Raheja Winterwoods”, at Panchkula, Haryana by M/s Odyssey Developers Pvt. Ltd. The SEAC has recommended that the project proponent is required to seek fresh environment clearance as per present applicability of norms on the grounds that the project proponent has not started any construction activity and the environmental clearance granted has automatically elapsed and question of further extension does not arise and the project proponent is required to seek fresh environmental clearance as per present applicability of norms. The above recommendation of SEAC was taken up for consideration in the today’s meeting. It was informed that the SEIAA vide letter no. 276 dated 18.02.2014 advised the project proponent to depute authorized person to appear before the Authority 5 for giving reply to the queries of the Authority, if any. But the project proponent failed to appear. It was observed that on the receipt of application for extension of environmental clearance the SEAC, vide letter no. 207 dated 22.05.2013 advised the project proponent to submit information which was vital for consideration to the case within 30 days but the project proponent failed to submit the desired information to the SEAC. Finding no reason to disagree with the above recommendation of SEAC the Authority decided that the project proponent may be advised to seek fresh environmental clearance at per present applicability of norms. Item No. [5] Environment Clearance for Extension of validity of EC letter issued for proposed commercial complex at Sector-62, Gurgaon, Haryana by M/s Pioneer Urban Land & Infrastructure Ltd. The SEAC has recommended that the project proponent is required to seek fresh environment clearance as per present applicability of norms on the grounds that the project proponent has not started any construction activity and the environmental clearance granted has automatically elapsed and question of further extension does not arise and the project proponent is required to seek fresh environmental clearance as per present applicability of norms. The above recommendation of SEAC was taken up for consideration in the today’s meeting. It was informed that the SEIAA vide letter no. 271 dated 18.02.2014 advised the project proponent to depute authorized person to appear before the Authority for giving reply to the queries of the Authority, if any. But the project proponent failed to appear. It was observed that on the receipt of application for extension of environmental clearance, the SEAC vide letter no. 295 dated 03.06.2013 advised the project proponent to supply the copies of all documents to the members of SEAC for examination but the project proponent failed to supply the same. Finding no reason to disagree with the above recommendation of SEAC, the Authority decided that the project proponent may be advised to seek fresh environmental clearance at per present applicability of norms. Item No. [6] Environment Clearance for Expansion of Group Housing Colony (SRS Royal Hills) measuring 19.73+3.32 Acres at Sector-87, Faridabad by M/s SRS Real Estate Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the construction of Expansion of Group Housing Colony (SRS Royal Hills) measuring 19.73+3.32 Acres at Sector-87, Faridabad on a plot area of 87068.115 sqmt (23.05 Acre). The total built up area shall be 212685.433 sqmt. The recommendation of SEAC was taken up for consideration in the presence of representative of the project proponent and consultant Dr. Yash Paul Sharma. On a query regarding status of Court case/accreditation of consultant the representative of the project proponent informed that the court case filed has been dismissed and they have engaged 6 International Testing Centre (ITC) Panchkula, as their consultant. It was observed that the ITC is accredited by QCI/NABET for category 8 (a) project whereas this particular project is of category 8 (b). Accordingly, the representative of the project proponent was informed that the ITC consultant is also not eligible as the consultant is accredited for 8 (a) category and not 8 (b). The representative of the project proponent requested to defer their case to the next meeting and assured that they will engaged the consultant accredited for 8 (b) category projects and shall submit the documents duly certified by the consultant. After detailed deliberation it was decided to defer this case to the next meeting as per the request of the project proponent with the decision that the project proponent shall resubmit all the documents duly certified by accredited consultant for category 8 (b) projects within 15 days or before the next meeting. Item No. [7] Environment Clearance for the Construction of “Office Building” at Institutional Plot, 1-4, City Center, Sector-29, Gurgaon, Haryana by M/s Rural Electrification Corporation Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the Construction of “Office Building” at Institutional Plot, 1-4, City Center, Sector-29, Gurgaon on a total plot area of 16890.25 sqmt (4.17 acres). The total built up area shall be 36981.11 sqmt. The building shall have 2 basements +GF+ maximum 05 Floors. The maximum height of the building shall be 26.55 meter. The total water requirement shall be 60 KLD. The fresh water requirement shall be 21 KLD. The waste water generation shall be 44 KLD which will be treated in the STP of 89 KLD capacity. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. The representative of the project proponent submitted copy of zoning plan, copy of allotment letter, approved building plan, assurance of water supply etc. It was noticed that the proposed office building is located in Institutional sector. Detailed discussions were held regarding water requirement; recycle reuse of water, traffic circulation plan, parking requirement, green belt development plan etc. It was observed that the proposed parking is inadequate considering regular office population of 715 and Auditorium population of 400. The representative of the project proponent was directed to provide one additional basement to accommodate more vehicles for parking. It was also noticed that the project proponent has given list of 21 species of plants to be planted in the green belt area the representative of the project proponent was directed to give a detailed map showing which species are to be planted in which area of the green belt and submit revised green belt development plan. The representative of the project proponent agreed to submit the same. The representative of the project proponent was also advised to adopt latest technology for STP which doesn’t require filter back wash. The 7 representative of the project proponent was also directed to appoint Nodal officer of the department (by designation) who shall be responsible for implementation of condition of environmental clearance letter and shall submit a letter in this regard. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall provide one additional basement for parking and shall submit revised parking plan. [2] The project proponent shall give a detailed map showing which spices are to be planted in which area of the green belt and submit revised green belt development. [3] The project proponent shall submit a letter regarding appointment of Nodal officer responsible for implementation of conditions of environment clearance letter. [4] The project proponent shall not use fresh water for filter back wash and shall submit revised water balance diagram. [5] The project proponent shall give corrected U value of various building materials. Item No. [8] Environment Clearance for the Proposed Commercial Colony of 2.181 acres at Village-Nakhnaula, Sector-81, Gurgaon, Haryana by M/s Bestech India Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the construction of Commercial Colony of 2.181acres at Village-Nakhnaula, Sector-81, Gurgaon on a plot area of 8826.192 sqmt (2.181 Acre). The total built up area shall be 24763.256 sqmt. The proposed project shall have 3 basements + GF + maximum 11 Floors. The maximum height of the building shall be 53.30 meters. The total water requirement shall be 110 KLD. The fresh water requirement shall be 46 KLD. The waste water generation shall be 67 KLD, which will be treated in the STP of 90 KLD capacity. The total power requirement shall be 3049.6 KVA which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 30.43% of project area (20% tree plantation + 10.43% landscaping). The Project Proponent proposed to construct 03 rain water harvesting pits. The solid waste generation will be 211.04 kg/day. The biodegradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 345 ECS. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation etc. The representative of the project proponent submitted the assurance of 8 HUDA for supply of water along with copies of EDC/IDC paid to HUDA for the services for supply of water, sewerage connection and drainage system, NOC from DC Gurgaon regarding non applicability of Aravalli Notification, NOC from AAI and clarification from DWLW that the project area does not fall in eco sensitive zone. It was observed that the project proponent has proposed surface parking across the revenue rasta existing in the project area. The representative of the project proponent further assured that no service lines will be laid beneath the revenue rasta and submitted an undertaking that the revenue rasta will not be encroached. It was observed that the project proponent has proposed to use 14.4 KLD of fresh water for HVAC cooling and the representative of the project proponent was asked not to use fresh water for cooling and submit revised water balance diagram. The representative of the project proponent agreed and submitted the same. It was observed that the width of the internal road is not sufficient for smooth movement of vehicles and trucks. The representative of the project proponent was advised to provide internal roads of sufficient width for smooth movement of vehicles. The representative of the project proponent agreed and informed the Authority that the increase in the width of internal road will result into reduction in surface parking/green area of the project. The representative of the project proponent was directed to provide additional basement to accommodate parking of vehicles. The representative of the project proponent agreed and submitted the revised traffic circulation plan, parking plan of 4th basement and revised built up area 28004.166 sqmt due to addition of 4th basement. The representative of the project proponent also submitted revised green belt development plan After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] Vertical fenestration shall not exceed 40% of total wall area. [2] The project proponent shall provide green area on terrace and roof top. [3] The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. [4] The project proponent shall indicate the width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta further project proponent shall not encroach revenue rasta and shall not cross internal roads over revenue rasta. 9 [5] The project proponent shall not use fresh water for HVAC and DG cooling. Air based HVAC system should be adopted and only treated water shall be used by project proponent for cooling, if it is at all needed. [6] The project proponent shall install solar panel for energy conservation. [7] The project proponent shall provide parking in the pocket across the revenue rasta and shall not raise any construction in that particular pocket. Item No. [9] Environment Clearance for development of Group Housing Colony (10.443 Acres) in the revenue Estate of village Dhanwapur, Sector-104, Gurgaoon- Manesar Urban Complex by M/s Florentine Estates of India Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the Construction of Group Housing Colony (10.443 Acres) in the revenue Estate of village Dhanwapur, Sector-104, Gurgaoon- Manesar Urban Complex on a total plot area of 42261.254 sqmt (10.443 acres). The total built up area shall be 133404 sqmt. The Group Housing project shall have 07 Residential Towers having 2 basements + Stilt + Podium + maximum 30 Floors, community building, convenient shopping, EWS, School etc. The maximum height of the building shall be 108 meter. The total water requirement shall be 524 KLD. The fresh water requirement shall be 285 KLD. The waste water generation shall be 331 KLD which will be treated in the STP of 400 KLD capacity. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. The representative of the project proponent submitted copy of zoning plan, assurance of water supply, NOC from DC Gurgaon regarding non applicability of Aravalli Notification, NOC from AAI, copies of EDC/IDC submitted to HUDA, provision for helipad etc. Detailed discussions were held regarding water requirement; recycle/reuse of water, traffic circulation plan, parking requirement, green belt development plan and existence of revenue rasta etc. It was observed that the project proponent has submitted an undertaking that the revenue rasta shall not be encroached and also submitted service lines plan showing that the revenue rasta is not intercepted. The representative of the project proponent was directed to revise the water calculation @ 135 lpcd instead of @ 111 lpcd and revised water balance diagram. The representative of the project proponent was agreed to supply the same. It was noticed that the maximum height of the building is 108 meter and as per approved zoning plan the maximum height of the building shall not be more than as allowed by National Airport Authority and shall not exceed 1.5 times (the width of the road abutting) plus the front open space. It was noticed that the AAI has granted NOC for 135 meter but the height of the proposed building is not in accordance in the condition laid down in the approved zoning plan. The representative of the project proponent was asked to submit copy of approved building plan. The representative of the project proponent was also asked to seek clarification 10 from Town and Country Planning Department regarding height of building with respect to condition laid in the present approved zoning plan; it was also noticed that the U Values given for building material were not correct. The representative of the project proponent was advised the corrected U Values. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall revise the water calculation @ 135 lpcd instead of @ 111 lpcd and shall submit revised water calculation and water balance diagram. [2] The project proponent shall submit copy of approved building plan and also clarification from Town and Country Planning Department regarding height of the building with respect to the condition no. 4 (a) of the approved zoning plan. [3] The project proponent shall give corrected U value of various building materials. Item No. [10] Environment Clearance for proposed Commercial Colony located at Village Bajghera, Sector-114, District Gurgaon, Haryana by M/s Candeo Projects Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the Construction of Commercial Colony located at Village Bajghera, Sector-114, District Gurgaon on a total plot area of 49925.26 sqmt (12.33 acres). The total built up area shall be 197594.39 sqmt. The proposed project shall have of 4 basements + GF + maximum 13 Floors. The maximum height of the building shall be 62.8 meter. The total water requirement shall be 496 KLD. The fresh water requirement shall be 166 KLD. The waste water generation shall be 367 KLD which will be treated in the STP of 460 KLD capacity. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. The representative of the project proponent submitted copy of zoning plan, assurance of water supply, NOC from DC Gurgaon regarding non applicability of Aravalli Notification, copies of EDC/IDC submitted to HUDA etc. Detailed discussions were held regarding existence of revenue rasta, water requirement; recycle reuse of water, traffic circulation plan, parking requirement and green belt development plan etc. It was observed the service lines plan submitted by the project proponent shows interception of revenue rasta. The representative of the project proponent was directed to revise the service line plan showing revenue rasta is not intercepted or seek permission of competent Authority to use the revenue rasta. No basement is proposed below revenue rasta without permission of competent Authority. It was observed that the project proponent has not obtained NOC from Airport Authority regarding height clearance. The 11 solar path analysis submitted by the project proponent was also not found in order. He was advised to revise the same. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall submit permission of competent Authority for use of revenue rasta or revise service line plan showing that revenue rasta is not intercepted. [2] The project proponent shall submit NOC from Airport Authority regarding height clearance. [3] The project proponent shall submit revised solar path analysis of the proposed building. Item No. [11] Environment Clearance for the Proposed Commercial Colony of 3.9875 acres at Village-Nakhnaula, Sector-81, Gurgaon, Haryana by M/s Bestech India Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the construction of Commercial Colony of 3.9875 acres at Village-Nakhnaula, Sector-81, Gurgaon on a plot area of 16136.7146 sqmt (3.9875 Acre). The total built up area shall be 46868.457 sqmt. The proposed project shall have 2 basements + GF + maximum 11 Floors. The maximum height of the building shall be 53.30 meters. The total water requirement shall be 201 KLD. The fresh water requirement shall be 87 KLD. The waste water generation shall be 120 KLD, which will be treated in the STP of 160 KLD capacity. The total power requirement shall be 4538 KW which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 30.11% of project area (20% tree plantation + 10.11% landscaping). The Project Proponent proposed to construct 04 rain water harvesting pits. The solid waste generation will be 229.65 kg/day. The biodegradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 674 ECS. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation etc. The representative of the project proponent submitted the assurance of HUDA for supply of water along with copies of EDC/IDC paid to HUDA for the services for supply of water, sewerage connection and drainage system, NOC from DC Gurgaon regarding non applicability of Aravalli Notification, NOC from AAI and clarification from DWLW that the project area does not fall in eco sensitive zone. It was observed that 12 the project proponent has proposed to use 28.8 KLD of fresh water for HVAC cooling and the representative of the project proponent was asked not to use fresh water for cooling and submit revised water balance diagram. The representative of the project proponent agreed and submitted the same. It was observed that the width of the internal road is not sufficient for smooth movement of vehicles and trucks. The representative of the project proponent was advised to provide internal roads of sufficient width for smooth movement of vehicles. The representative of the project proponent agreed and informed the Authority that the increase in the width of internal road will result into reduction in surface parking/green area of the project. The representative of the project proponent was directed to provide additional basement to accommodate parking of vehicles. The representative of the project proponent agreed and submitted the revised traffic circulation plan, parking plan of 3rd basement and revised built up area of 50930.057 sqmt due to addition of 3rd basement. The representative of the project proponent also submitted revised green belt development plan. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] Vertical fenestration shall not exceed 40% of total wall area. [2] The project proponent shall provide green area on terrace and roof top. The project proponent shall not use fresh water for HVAC and DG cooling. Air based HVAC system should be adopted and only treated water shall be used by project proponent for cooling, if it is at all needed. [3] The project proponent shall install solar panel, for energy conservation. Item No. [12] Environment Clearance for the Construction of Group Housing Project at Village Behrampur, Sector-59, Gurgaon, Haryana by M/s Mahindra Homes Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the Construction of Group Housing Project at Village Behrampur, Sector-59, Gurgaon on a total plot area of 71022.33 sqmt (5.79 acres). The total built up area shall be 121750 sqmt. The Group Housing project shall comprise 03 Residential Towers having 4 basements + GF + maximum 28 Floors. The maximum height of the building shall be 108 meter. The total water requirement shall be 330 KLD. The fresh water requirement shall be 197 KLD. The waste water generation shall be 240 KLD which will be treated in the STP of 300 KLD capacity. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. The representative of the project proponent submitted copy of zoning plan, assurance of water supply, NOC from DC Gurgaon regarding non applicability of 13 Aravalli Notification, copies of EDC/IDC submitted to HUDA etc. Detailed discussions were held regarding existence of revenue rasta, water requirement; recycle reuse of water, traffic circulation plan, parking requirement and green belt development plan etc. It was noticed that the license no. 16 of 2008 dated 30.01.2008 has been granted for development of Group Housing on 17.55 acres in sector-59 Gugraon and the project proponent has entered into development agreement with the licensee for development of only 23453 sqmt of licensed area which is part of total licensed area 71022.33 sqmt. It was observed the FAR has been calculated @ 1.75 of the total plot area and it was not clear whether this particular project proponent can avail the FAR of total plot area whereas in this particular case the project proponent has submitted application for 23453 sqmt of plot area which is part of total plot area. The representative of the project proponent informed the Authority that the FAR is calculated on the total plot area. The Authority was of the view that the FAR of the total plot area can only be considered in case the project proposal is for the total licensed area of 17.55 acres. The representative of the project proponent was directed to seek clarification of Town and Country Planning Department in this regard or submit revised FAR calculation of the proposed plot area i.e. 23453 sqmt. to be developed by the project proponent. It was also noticed that the validity of license has already lapsed on 30.01.2014. The representative of the project proponent informed that they have already submitted application for revalidation of license. The representative of the project proponent was directed to give specific detail about species to be planted in the green belt area and submit revised green belt development plan. The representative of the project proponent was advised the corrected U Values. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall seek clarification of Town and Country Planning Department regarding calculation of FAR for the part of licensed area to be developed or submit the revised FAR calculation of the proposed plot area i.e. 23453sqmt. [2] The project proponent shall submit copy of validated license. [3] The project proponent shall give corrected U value of the building material. [4] The project proponent shall submit revised green belt development plan specifically giving details of species proposed to be planted in the green belt development. [5] The project proponent shall also provide the status of construct in rest of the part of licensed area for which development agreement is not done. 14 Item No. [13] Environment Clearance for Ware House Project located at the revenue estate of Village-Silani Keso, District Jhajjar, Haryana by M/s AAIFA Logistics LLP. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the construction of Ware House Project located at the revenue estate of Village-Silani Keso, District Jhajjar on a plot area of 45743.15 sqmt (11.30 Acres). The total built up area shall be 25142.968 sqmt. The proposed Ware House Complex shall have 3 shed, office and staff residence. The maximum height of the building shall be 17 meters. The total water requirement shall be 48 KLD. The fresh water requirement shall be 20.66 KLD. The waste water generation shall be 34 KLD, which will be treated in the STP of 40 KLD capacity. The total power requirement shall be 50 KVA which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 22% of project area (15% tree plantation + 7% landscaping). The Project Proponent proposed to construct 11 rain water harvesting pits. The solid waste generation will be 50.5 kg/day. The bio-degradable waste will be treated in the project area by adopting appropriate technology. The total parking area proposed is 7590.94 samt. In the today’s meeting the recommendation of SEAC and the project details were taken up for consideration in the presence of representative of the project proponent and consultant. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-involvement of Forest land, recycle and reuse of water, parking plan, traffic circulation etc. The representative of the project proponent was directed to provide STP instead of proposed soak pit. It was noticed that the calculations of water, solid waste has been calculated for the total population of 48 and it was observed that the project proponent has given wrong figures of population. After detailed discussions it was found that the total population comes out to be 220 in case of this project. Accordingly the representative of the project proponent was directed to revise the total water requirement, fresh water requirement, solid waste generation on the basis of 220 person’s population. The representative of the project proponent submitted the same. It was also noticed that the entry and exit points of each shed are not of sufficient width. The representative of the project proponent was advised to submit revised traffic circulation plan, green belt development plan. The representative of the project proponent was also directed to provide sufficient no. of toilets in the project area. The representative of the project proponent submitted all the plans/documents during the meeting. On query regarding items to be stored in the Ware House, the representative of the project proponent informed that only non agro and non hazardous items will be stored in the proposed Ware House which are likely to be electronic products viz washing machines, T.V Items etc. 15 After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall install STP of 40 KLD for treatment of waste water. [2] Pollution control measures for oil/diesel waste due to large no of Trucks involved in transportation shall be made. [3] The project proponent shall get approval of scheme for firefighting from the concerned Authority before commissioning the project. [4] The project proponent shall install RO plant for purification of water for drinking/domestic purposes. [5] The project proponent shall submit assurance from HUDA for supply of water or permission from CGWA for abstraction of ground water, before the start of construction. [6] The project proponent shall control fugitive emission due to loading, unloading and other operations. In no case any truck/other vehicle should be parked on the road side. [7] The project proponent shall dispose of excess of Sewage/storm water during rains at appropriate place after taking prior approval of competent authority. Item No. [14] Environment Clearance for Industrial Building for testing of Vehicles and Construction Project at plot no. 1, Sector 33-B- 33-C IMT Rohtak Maruti Suzuki India Ltd. Rohtak by M/s Maruti Suzuki India Ltd. This case was considered in the 62nd meeting of the SEIAA held on 19.12.2013 wherein, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The Project Proponent shall submit the complete details of the proposed project along with the details of infrastructure required as submitted in HSIIDC. In the today’s meeting the reply dated 13.02.2014 submitted by project proponent was taken up for consideration in the presence of representative of the project proponent. It was noticed that the project proponent has submitted application for construction of R&D centre on a plot area of 200516 sqmt allotted by HSIIDC in IMT Rohtak. The paper submitted to the HSIIDC shows that the total built up area of the project shall be 85115 sqmt and as per application the project proponent has already constructed 18000 sqmt of area. It was observed that the project proponent has violated the provisions of EIA Notification, dated 14.09.2006 by commencing construction of proposed 85115 sqmt of area without obtaining prior Environmental Clearance and the construction of 18000 sqmt has already been achieved. This case was examined in the light of MoEF, GoI OM no. J-11013/41/2006-IA.II (1) dated 12-12-2012. After detailed deliberations it was decided that:- 16 [1] The Principal Secretary Environment may be requested to initiate credible action on the violation by invoking powers under Section 19 of the Environment (Protection) Act 1986, for taking necessary legal action under Section 15 of the Act for the period for which the violation has taken place, against the M/s Maruti Suzuki India Ltd., EMG Department, Palam Gurgaon Road, Gurgaon, Haryana for commencing construction of “Industrial Building for testing of Vehicles” at plot no. 1, Sector 33-B, 33-C IMT, Rohtak Maruti Suzuki India Ltd. Rohtak without obtaining prior Environmental Clearance under EIA notification 14-092006. The Principal Secretary Environment may also be requested to provide the evidence of credible action taken against the project proponent. [2] The matter relating to violation shall be put up by the project proponent to the board of Directors for consideration of its environmental related policy/plan of action as also a written commitment in the form of a formal resolution to be submitted to SEIAA Haryana within a period of 60 days from the date of issuance of this letter ensuring that violations will not be repeated; failing which it will be presumed that the project proponent is no longer interested in pursuing the project further and the project file will be closed. [3] To delist the case. Item No. [15] Environment Clearance for expansion of Factory Building at plot No. 1, Sector-14, Phase-II, Growth Centre, Bawal by M/S Polylace India Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the construction of expansion of Factory Building at plot No. 1, Sector-14, Phase-II, Growth Centre, Bawal on a total plot area is 22.8 Acres (92335.335 sqmt) for manufacturing of Zip Fasteners. The total built up area after expansion of the Industrial building shall be 41110.79 sqmt (Existing 33321 sqmt + Expansion 7789.79 sqmt). The project proponent shall construct further area exceeding 41110.79 sqmt after taking prior environmental clearance from SEIAA. The building shall comprise of Basement + GF + 3 Floors. The maximum height of the building shall be 18 meters. The total water requirement shall be 341 KLD. The fresh water shall be 121 KLD. The waste water generation shall be 241 KLD. The 16 KLD of waste water shall be treated in the STP of 20 KLD capacity and 255 KLD of process waste water shall be treated in the ETP of 300 KLD capacity. The treated waste water shall be reused and recycled. The total power requirement shall be 5228 KW which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 29.6% of project area (20% tree plantation + 9.6% landscaping). The Project Proponent proposed to construct 13 rain water harvesting pits. The solid waste generation will be 488 kg/day. The bio-degradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 370 ECS. 17 In the today’s meeting the recommendation of SEAC along with project details were taken up for consideration in the presence of representative of the project proponent. It was noticed that Principal Secretary, Govt. of Haryana Environment Department vide Memo No. 16/17/2010-3E dated 28.01.2014 informed that complaint against the project proponent has been filed under EPA 1986 in the Special Environment Court, Faridabad on 08.01.2014. Detailed discussions were held regarding process involved in manufacturing of Zip Fasteners, requirement of raw material and process involved. The representative of the project proponent clarified that no dyeing process is involved in manufacturing of Zips. The representative of the project proponent submitted NOC from Forest Department and assurance of HSIIDC for supply of water. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The environmental clearance is granted for construction of building of industrial project under item no. 8(a) of schedule of MoEF notification only and this environmental clearance letter in no way implies that the clearance has been granted for process involved in the industrial activity. [2] The project proponent shall dispose of Hazardous waste generated from the site as per Hazardous Waste (Management and Handling) Rules. [3] The project proponent shall ensure that all the chemicals shall be handled as per the standard operating procedure for chemical handling. [4] The project proponent shall ensure that all the chemicals shall be stored within the threshold limit of “The Manufacture, Storage and import of Hazardous Chemical Rules, 1989”. [5] The project proponent shall treat the ETP sludge at the site and shall dispose the same for incineration through MoEF/HSBCB authorized common incinerator and shall submit MOU within 15 days. [6] The site for solid waste management plant be earmarked on the layout plan and the detailed project for setting up the solid waste management plant shall be submitted to the Authority within one month. [7] The Effluent Treatment Plant of 300 KLD capacity shall be installed for treatment of non sewage liquid (effluent). The project proponent shall ensure that the waste water generation as well as values of different parameters of effluents should conform to the standards as prescribed under a Rule 3 of Environment (Protection) Rules, 1986. The project proponent shall not discharge the effluents in the public sewer/drain. 18 Item No. [16] Environment Clearance for Revision of Environmental Clearance for “DLF Cyber Park” in Udyog Vihar, Sector-20, Gurgaon, Haryana by M/s DLF CYBER CITY Developers Limited The recommendation of SEAC to accord Environmental Clearance was considered in the 55th meeting of SEIAA held on 05.08.2013, wherein it was observed that the validity of license has already been elapsed and the representative of the project proponent informed the Authority that they have applied for renewal of license which is awaited. The representative of the project proponent further requested to keep this case of Environmental Clearance pending till the submission of revalidated license. The representative of the project proponent also submitted an undertaking in this regard. Accordingly the Authority agreed to the request of project proponent and decided to keep this case pending till the submission of revalidated license by the project proponent. In the today’s meeting the representative of the project proponent informed the Authority that the revalidation of license is under process and they will submit the copy of revalidated license within a month and requested to grant one month period for submission of validated license. The Authority agreed and decided to defer this case with the decision that the project proponent shall submit copy of validated license within one month failing which the case of environmental clearance will be filed without any further notice. Item No. [17] Environment Clearance for Group Housing complex” at Sector-23, Dharuhera, District- Rewari, Haryana by M/S Ashiana Realtech Pvt. Ltd. This case was considered in the 57st meeting of the SEIAA held on 25.11.2013 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within a week or before the next meeting. [1] The project proponent shall submit assurance of HUDA for supply of water during operational phase. [2] The project proponent shall submit NOC from Deputy Commissioner, concerned regarding non applicability of Aravalli notification. [3] The project proponent shall submit permission for disposal of excess of treated waste water/storm water in the main sewer/storm sewerage system laid/to be laid by HUDA/Local authority. In the today’s meeting the reply dated 12.02.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. In the meeting the representative of the project proponent submitted copies of EDC/IDC paid to HUDA for the services for supply of water, sewerage connection and drainage system. The representative of the project proponent also advised to submit the revised water calculation for EWS @ 5 persons instead of @ 2 persons. 19 After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. [2] The project proponent shall indicate the width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta. [3] All system of water supply, sewerage system, STP etc. shall be provided based on revised requirement of @135 lpcd no. of persons for EWS shall be taken as 5 per flat instead of two per flat. [4] The project proponent shall ensure drinking/ domestic water supply as per prescribed standards till treated water supply is made available by HUDA. Item No. [18] Environment Clearance for development of Commercial Complex at Sec-66, Village Badshahpur, District Gurgaon, Haryana by M/s NCR Business park Pvt. Ltd. This case was considered in the 62nd meeting of the SEIAA held on 18.12.2013 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit revised parking plan with calculations making provision of Mechanical parking only for 20% additional proposed parking. In the today’s meeting the reply dated 24.01.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. It was observed that the revised parking plan submitted by the project proponent is not clear. The representative or the project proponent they have provided additional basement for Tower no. 04 to accommodate parking of vehicles. The calculation of parking was not clear as the proposed mechanical parking was exceeding 20% of total parking. The representative of the project proponent was directed to show exact no. of vehicles to be parked in each basement and on surface and submit plan and details accordingly. It was also noticed that the services lines are intercepting the revenue rasta existing in the project area. The representative of the project proponent assured the Authority to submit the revised service line plan or permission of competent Authority for use of revenue rasta for the purpose of laying of services lines. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. 20 [1] The project proponent shall submit revised parking plan giving details about no. of vehicles to be parked in each basement and on surface. [2] The project proponent shall seek permission of competent Authority for interception of revenue rasta for laying down services lines or revised the layout plan so that while laying the services line the revenue rasta is not intercepted. Item No. [19] Environment Clearance for proposed Residential Plotted Colony “Emerald Hills”, Village Badshahpur, Maidawas, Nangli Umarpur, Sector-62 & 65, Gurgaon, Haryana by M/s Emaar MGF Land Ltd. This case was considered in the 60th meeting of the SEIAA held on 06.11.2013 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit copy of revalidated license. [2] The project proponent shall submit permission of competent Authority for crossing over the Nallahs and permission for construction of culvert over the Nallah. [3] The project proponent shall submit an undertaking with the declaration that (i) The project will have the provision for infrastructure services (water supply, sewer, storm water lines etc) to accommodate the additional load arising from population residing in other lands falling within the project limits/vicinity. (ii) That no construction activity shall be undertaken either on surface or below or above surface of revenue rasta passing through the project area. (iii) The project proponent shall indicate the width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta. [4] The project proponent shall submit revised water calculation @135 lpcd and water balance diagram. Sewerage and STP capacity shall also be revised accordingly. [5] The project proponent shall submit revised rain water harvesting calculation @45 mm/hr. [6] The project proponent shall plan, design and provide separate system of infrastructure facilities such as water supply, sewerage, storm drainage, STP and power supply etc. for different sectors of the project area. In the today’s meeting the reply dated 11.02.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. It was observed that the project proponent has revised the lay out plan showing that revenue rasta is not intercepted due to laying of services line. The representative of the project proponent was directed to revise the water balance diagram by reducing the water requirement for 21 horticulture use. It was noticed that the project proponent has not submitted permission of competent Authority for crossing over the nallah. The representative of the project proponent informed the Authority that the competent Authority is not granting permission for crossing over the nallah as the matter is sub-judice and is lying pending in the court. The Authority directed the representative of the project proponent to get the permission for crossing over the nallah and also submit an undertaking that no solid waste or untreated waste water will be discharged in the nallah. It was also noticed that the validity of license has already lapsed and the project proponent has submitted application for renewal of the same. After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall submit permission of competent Authority for crossing over the nallah and an undertaking that no solid waste and untreated waste water will be discharged in the nallah. The project proponent shall submit proof of proposed approved future planning to shift the Nallahs along the road and ownership of the land covering the Nallahs. [2] The project proponent shall submit copy of revalidated license. Item No. [20] Environment Clearance for w.r.t. Group Housng Prloject at Sec-25, Village Sahbajpur Khalsa, Rewari, Haryana by M/s Jai Buildwell Pvt. Ltd. This case was considered in the 60th meeting of the SEIAA held on 06.11.2013 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within a week or before the next meeting and also to appear before the Authority for necessary clarifications. [1] The project proponent shall submit revised parking plan with adequate parking. [2] The project proponent shall submit a plan earmarking space for solid waste management. [3] The project proponent shall submit an undertaking with the declaration that: (i) The project proponent shall not raise any construction activity in the ROW reserved for gas pipeline. (ii) The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. (iii) The project proponent shall indicate the width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta. 22 (iv) No construction has been raised till date at the site. [4] Latest photograph of the site duly attested by the authorized person. In the today’s meeting the reply dated 11.02.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. It was observed that the project proponent has provided additional basement for parking. It was also noticed that the basement has been proposed under the revenue rasta passing through the project area which was not acceptable of the Authority. The representative of the project proponent agreed to revise the basement parking plan. It was also noticed that on page no. 31 of presentation the height of the stack is shown 78.67 meter and NOC granted by AAI is for the building height of 71.60. The representative of the project proponent was directed to reduce some floors or get the revised NOC from Airport Authority India for 79 meters. The representative of the project proponent informed that they will get the revised NOC from AAI. After detailed deliberations it was decided to consider the reply of the project proponent only after the receipt of the following information within a period of 15 days or before next meeting. [1] The project proponent shall submit revised NOC from Airport Authority. [2] The project proponent shall submit revised basement plan showing that the revenue rasta is not intercepted. Item No. [21] Environment Clearance for development of residential plotted colony in Sec-37, Gohana Road, Village Rohtak, Haryana by M/s One Point Realty Pvt. Ltd. This case was considered in the 63rd meeting of the SEIAA held on 23.12.2013 wherein, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit NOC from forest department. [2] The project proponent shall seek the permission of competent Authority for crossing over revenue rasta for laying of services lines or revise the service line plan showing that revenue rasta is not intercepted. In the today’s meeting the reply dated 22.01.2014 was taken up for consideration in the presence of representative of the project proponent. It was noticed that the project proponent has submitted the copy of approved lay out plan showing access to the plotted colony from 24 meter wide road instead of NH-71 A; Gohana Road, (60 meter) therefore permission from forest department for access to the plotted colony is not required. It was noticed that the project proponent has submitted permission from PWD (B & R) for crossing over revenue rasta in the project area for laying of services. The representative of the project proponent was directed to submit proof of ownership of revenue rasta with the PWD (B & R). 23 After detailed deliberations it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall submit ownership of revenue rasta with the PWD (B & R). Item No. [22] Environment Clearance for proposed Cement Grinding Unit (1.8 MTPA capacity) along with D.G.Set (2x6 MW) at Village Jharli, Tehsil Matanhail, District Jhajjar (Haryana) by M/s Ultratech Cement Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proposal has proposed Cement Grinding Unit (1.8 MTPA capacity) along with D.G.Set (2x6 MW) at Village Jharli, Tehsil Matanhail, District Jhajjar (Haryana) on a plot area of 113.56 Acre. The total built up area will be 21000 sqmt. The project will have various equipments and storage facilities like Gypsum Crusher, Cement Mill, Cement Packing Machines, Clinker Silo, Gypsum Stock Pile (Covered), Fly Ash Silo, Cement Silo etc. The fresh water requirement will be 257 KLD. No Clinker manufacturing is involved, use of energy efficient technology, no sensitive area within 10 km radius, ‘zero’ effluent discharge, utilization of all the solid waste in the process itself including utilization of fly ash etc. The recommendation of SEAC and detail of project were taken up in the 63rd meeting of SEIAA held on 23.12.2013 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days. [1] The project proponent shall submit an undertaking that the Clinker and finished goods shall be transported by rail only. [2] The project proponent shall submit permission of CGWA for abstraction of ground water. [3] The project proponent shall submit copy resolution passed by Village Gram Panchayat stating that they have no objection for setting up of this unit. In the 65th meeting held on 24.01.2014. It was noticed that in the light of MoEF, GoI guidelines issued for categorisation of projects in B1 & B2 issued vide OM no. J13012/12/2013-IA-II (I) dated 24.12.2013 the project proponent vide letter dated 24.12.2013 was directed to submit an affidavit stating that the Raw material; and finished goods will be transported through Rail mode, whereas the affidavit submitted by the project proponent was not found in order. The Authority noted that in order to consider the project proposal under category B2, the Project proponent is required to submit an undertaking declaring that 90% of the Raw material and finished products shall be transported through Rail mode only. The representative of the project proponent informed the Authority that they will transport the raw material and finished products through Rail and shall submit revised affidavit in this respect. It was also noticed that the Hydrologist, 24 Ground water cell, Agriculture Department Rohtak has given permission for withdrawal of 250 KLD of water from the existing bore wells. The representative of the project proponent was directed to submit proof of registration of the existing bore wells with the CGWB. Accordingly, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within a week or before next meeting. [1] The project proponent shall submit proof of registration of the existing bore wells with the CGWB. [2] The project proponent shall submit an undertaking with the declaration that they will transport 90% of the material (raw material and finished products) through Rail. In the meeting today the representative of the project proponent submitted proof of documentation of existing bore-wells and also submitted an undertaking that transportation of all raw materials and finished products by railway mode shall not be less than 90% of the traffic (inward and outward put together). After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall take adequate preparation for fire and other kinds of disaster including chemical disaster. On-site, off-site emergency plan should be prepared and rehearsed in regular mock drills. [2] The project Proponent shall initiate a long term study through a reputed institution to assess the cumulative impact of the power plants on the AAQ of the area. The study shall in particular assess the impact of emission of the HSD based DG sets on the chemistry of upper atmosphere and on concentration of PM10, PM2.5. It shall be ensured that the worst seasonal atmospheric conditions are taken into account in the above said study. [3] An Environmental Cell shall be created at the project site itself and shall be headed by qualified officer, who is well versed with the environmental aspects of the plant. It shall be ensured that the Head of the Cell shall directly report to the Board of Directors. [4] Standards for discharge of environmental pollutants as enshrined in various schedules of rule 3 of environment protection rule 1986 shall be complied with. [5] The project proponent shall appoint well qualified fire supervisor. [6] The project proponent shall develop 3 meter wide green belt as buffer zone around the plant boundary as sound barrier. [7] The project proponent shall set up continuous online AAQ monitoring system (supervisory control & data acquisition) in the project area to monitor the 25 parameters viz PM2.5, PM10, NOx, SOx and CO. The project proponent shall ensure that the values of these parameters are within the prescribed limits of CPCB/HSPCB. [8] The project proponent shall ensure that transportation of all raw materials as well as finished goods by railway mode; never falls below 90% of the traffic (both inward and outward) on any single month of operation of plant. [9] All connecting roads from plant to National highway shall be maintained by project proponent so that it can withstand heavy traffic caused by the plant. [10] The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. [11] The project proponent shall indicate the width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta further project proponent shall not encroach revenue rasta and shall not cross internal roads over revenue rasta. [12] The project proponent shall obtain electricity connection for operation of plant and shall ensure that the plant is not operated on DG sets only. Item No. [23] Environment Clearance for construction of Residential Group Housing of “Aura” at Sector – 110-A, Gurgaon, Haryana by M/S Mahindra Life spaces. The case was considered in the 65th meeting of SEIAA held on 24.01.2014 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the following observations within a week or before next meeting. [1] The project proponent shall submit details of no. of floors, no. of dwelling units on each floor of each tower as proposed under revision. [2] The project proponent shall submit copy of compliance report duly certified by RO, MoEF, GoI Chandigarh. [3] The project proponent shall submit half yearly status of construction of project from the date of start of construction. In the meeting today the reply dated 27.02.2013 was taken up for consideration in the presence of representative of the project proponent and consultant. The representative of the project proponent was directed to submit an undertaking on affidavit that they have not violated the conditions imposed in the environment clearance granted to their unit by MoEF GoI on 16.06.2008 and revision as per proposal will be undertaken only after the due environmental clearance. The authorized person submitted the undertaking on affidavit. 26 After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall ensure that the plinth level of the building block to be 1.5 meter above 100 years flood level of the said Najafgarh Jheel. [2] The project proponent shall obtain NOC from HUDA as well as Irrigation Department before the start of construction, regarding possible adverse effect of project proposal on the said Najafgarh Jheel. [3] The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. [4] The project proponent shall indicate the width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta further project proponent shall not encroach revenue rasta and shall not cross internal roads over revenue rasta. [5] All system of water supply, sewerage system, STP etc. shall be provided based on revised requirement of @135lpcd. Item No. [24] Environment Clearance for Group Housing Project (Residential Colony) located at Village- Mullahera, Sector-22, Distt. Gurgaon, Haryana by M/s Ambience Projects & Infrastructure Pvt. Ltd. The case was considered in the 65th meeting of SEIAA held on 24.01.2014 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall submit permission of HUDA for disposal of excess of treated water in the main trunk line of HUDA. [2] The project proponent shall revise water requirement for EWS @ of 5 persons and shall submit revised water calculation and water balance diagram. [3] The project proponent shall submit photocopies of EDC/IDC paid to HUDA. [4] The project proponent shall submit an undertaking with the declaration for making provision for 50 % power back up. In the today’s meeting the reply dated 28.01.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. The representative of the project proponent submitted copy of bank guarantee submitted to HUDA in lieu of EDC/IDC. The representative of the project proponent was directed to modify the traffic circulation plan for smooth movement of vehicle in the Group Housing Colony. The representative of the project proponent submitted the modified plan. The 27 representative of the project proponent was also directed to submit the solar path analysis as the same was not in records. The representative of the project proponent submitted the solar path analysis. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] All system of water supply, sewerage system, STP etc. shall be provided based on revised requirement of @135lpcd no. of persons for EWS shall be taken as 5 per flat instead of two. [2] The power back up shall not be more than 50%. Item No. [25] Environment Clearance for the Proposed Residential Group Housing, (12.153 acres) located at Village-Hayatpur, Sector-93, Gurgaon, Haryana by M/s DLF New Gurgaon Homes Developers Pvt. Ltd. The case was considered in the 65th meeting of SEIAA held on 24.01.2014 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall seek permission of competent Authority for interception of revenue rasta for laying down services lines or revised the layout plan to the extent that while laying the services line the revenue rasta is not intercepted. In the today’s meeting the reply dated 10.02.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. The representative of the project proponent submitted the revised service line plan showing that the revenue rasta is not intercepted. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall ensure that no construction activity is undertaken either on surface or below or above surface of revenue rasta passing through the project area. [2] The project proponent shall indicate the width and length of revenue rasta passing through the project area on sign board and shall display the same at both the ends of revenue rasta stretch, for awareness of public. Sign board shall also display the message that this is public rasta/road and any citizen can use it. There shall not be any gate with or without guards on revenue rasta further project proponent shall not encroach revenue rasta and shall not cross internal roads over revenue rasta. 28 Item No. [26] Revision in Environment Clearance for the proposed Residential Group Housing (10.00 acres) located at Village Naurangpur, Sector79, Gurgaon, Haryana by M/s DLF New Gurgaon Homes Developers Pvt. Ltd. The case was considered in the 65th meeting of SEIAA held on 24.01.2014 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall submit NOC from DC Gurgaon regarding nonapplicability of Aravalli Notification. In the today’s meeting the reply dated 10.02.2014 was taken up for consideration in the presence of representative of the project proponent and consultant. It was noticed that the Tehsildar has reported that award under-section for has been issued for Killa no. 51-12/1, 12/2 min, 13/1 min, 13/2 min, 13/3 min and 18 min. The representative of the project proponent submitted a plan showing location of the area awarded under-section 4. It was noticed that no construction is proposed on that area and there will be no reduction in FAR due to that area. The representative of the project proponent was also directed to submit an undertaking that the height of the building has been kept in accordance with the condition no 4 of approved zoning plan and no violation has been carried out. The representative of the project proponent agreed to submit the same. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall not raise any construction on the area for which award has been issued under-section 4 as per report of Tehsildar. [2] The project proponent shall submit an undertaking with the declaration that the height of the proposed buildings has been kept in accordance with the condition no 4 of approved zoning plan and no violation has been carried out before the start of construction. [3] The project proponent shall provide helipad facility as required under NBC norms and shall seek permission of helipad from AAI accordingly Item No. [27] Environment Clearance for development of the Commercial Colony (3.89 Acre) at Village Chouma, Sector-110 A, Gurgaon, Haryana by M/s Puri Constructions Pvt. Ltd. The case was considered in the 65th meeting of SEIAA held on 24.01.2014 wherein it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within a week or before next meeting. [1] The project proponent shall explain/clarify about the award issued for the one marla of the licensed area vide mutation dated 23.12.2013 as has been reported by Tehsildar in the DC certificate and also earmark this area on the layout plan. 29 In the today’s meeting the reply dated 11.02.2014 was taken up for consideration in the presence of representative of the project proponent. The representative of the project proponent was not prepared and was not able to show the complete record of the case and requested for deferment of the case. It was decided to defer the case. Item No. [28] Environment Clearance for “Expansion of Industrial Building Project” at plot no 7, Sec-8, Phase-III, Growth Centre, Bawal, Distt. Gurgaon by M/s EEL India Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed “Expansion of Industrial Building Project” at plot no 7, Sec-8, Phase-III, Growth Centre, Bawal, Distt. Gurgaon on a total plot area is 31.815 Acres for Manufacture and Assembly of Machinery for Cement and Allied Industries i.e. Bag Packing and Bag Loading System and other material handling equipments for cement, sugar, chemical, fertilizer and other industries. The total built up area shall be 67354.86 sqmt (16981.68 + 49486.22 sqmt). The maximum height of the building shall be 16 meters. The total water requirement shall be 136 KLD. The fresh water shall be 73 KLD. The waste water generation shall be 66 KLD which shall be treated in the STP of 80 KLD capacity. The treated waste water shall be reused and recycled. The total power requirement shall be 3000 KVA which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 30% of project area (20% tree plantation + 10% landscaping). The Project Proponent proposed to construct 12 rain water harvesting pits. The solid waste generation will be 380 kg/day. The bio-degradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 800 ECS. In the today’s meeting the recommendation of SEAC along with project details were taken up for consideration in the presence of representative of the project proponent. It was noticed that Principal Secretary, Govt. of Haryana Environment Department vide Memo No. 16/3/2014-3E dated 19.02.2014 informed that complaint against the project proponent has been filed under EPA 1986 in the Special Environment Court, Faridabad on 06.02.2014. Detailed discussions were held regarding the products to be manufactured. The representative of the project proponent submitted NOC from Forest Department and assurance of HSIIDC for supply of water. After detailed deliberations, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The environmental clearance is granted for construction of building of Industrial project under item no. 8(a) of schedule of MoEF notification only and this environmental clearance letter in no way implies that the clearance has been granted for process involved in the Industrial activity. [2] The project proponent shall not setup electroplating unit in the industrial building. ********
