The cost of Tender Document is Rupees 5000 ( Five Thousand Only) in Indian Currency and
has to be submitted along with the EMD additionally through Electronic Clearing System.
The Scanned Copies of the requisite Appendix-I and the Counterfolio of the receipt of EMD along
with the UTR ( Unit Transaction Receipt No.) / Acknowledgement have to be submitted Online and
No Original Documents have to be submitted physically.
The Financial Bid ( Envelope N0. -C) needs to be submitted only Online.

As per the direction of Chhattisgarh Government, it is for the information of the Bidder
interested to participate in Bid process, that the whole Bid process shall be conducted Online.
The Bidding firm should follow the formalities to be completed for online bidding. It is
pertaining to note that the bid process shall be done through following portals and sub-portals:

The bidders are advised to read the complete tender document carefully. The Bidders need to
pay the Bid Submission Fee as provided in Table No- 01, Online only at the time of Bid-Hash
submission, as per the Key dates (Tender Schedule) given in the Tender document. The
Bidders shall make the relevant payment using the payment option available Online. To know
the latest available payment options, bidders may visit “List of Payments accepted Online”
Section on home page of http://cgeprocurement.gov.in. The Bidders intending to participate in
this Bid Process are required to get registered / enrolled on the e-Procurement website.
Registration / Enrolment on the e-Procurement website is mandatory.
As the online Bids / Templates are required to be digitally signed, bidders are required to
obtain Class – II Digital Signature Certificates (DSCs). The Bidders may contact the eProcurement Support Centre for getting information on acquiring a Digital Signature

The Bidders are also advised to get themselves trained on the operations of the e- Procurement
System. Bidders may get in touch with the Service Provider / e-Procurement Support Centre of
the e-Procurement System at the above address.
The bidder shall not submit any Document physically as per the detail given in section
‘Invitation of Tender’ of this Document.
Can be extended for 30 days at the discretion of Managing Director, C.G. State Warehousing
Corporation.
The Bidder should disclose that there is No pending Blacklisting or Debarment of his / their
Firm / Company during the submission of Tender Documents by any of the State / Central
Government Department including the Forfeiture of Earnest Money Deposit / Security Deposit

or adjusted in any form against any compensation payable during the last 3 years. Also the
Bidder has to submit duly filled and Notarized Affidavit, the Performa of which is given in
Appendix - I(v) along with other Appendix- I (i - iv) with Online Envelope B.

All reputed Service providers who wish to participate and qualifying all the eligibility criteria
as given in the tender Document are eligible to apply..
1.
The Bidder should note that the e-procurement procedure should be strictly
followed. Scanned copies of EMD (Counterfolio of the receipt of EMD along with the
UTR No. / Acknowledgement) and all the Documents mentioned in Appendix- I(ii)
have to be send Online.
2.
The Financial Bid ie. Envelope-C has to be quoted only Online.
It is to be noted that Financial Bid and other Documents should not be
submitted physically.
3 It is pertaining to note that the Evaluation Committee will download all the scanned
copies of proof of submission of EMD ( Counterfolio of the receipt of EMD along with
the UTR / Acknowledgement) and other Documents provided in Appendix-I (ii)
within the Scheduled Date as given in key dates and shall be evaluated thereafter.
After declaration of qualified Bidders, the Financial Bid of only qualified Bidders
shall be downloaded and evaluated and the successful Bidder will be decided
according to the lowest quoted Storage Charge Rates.

SECTION-1
APPOINTMENT OF SERVICE PROVIDERS FOR PRESERVATION,
MAINTENANCE AND SECURITY ( PMS ) SERVICES OF FOODGRAINS STORED
IN THE SPECIFIED WAREHOUSES OF CHHATTISGARH STATE
WAREHOUSING CORPORATION.
PREAMBLE
1.1. INTRODUCTION

Chhattisgarh State Warehousing Corporation was established in the year 2002 under
Agriculture Produce (Development and Warehousing) Act 1956 with 50% shareholdings of
Central Warehousing Corporation and 50% share of State Government. Later on it was
repealed by Warehousing Corporation Act 1962.

C.G. State Warehousing Corporation is an autonomous body engaged in scientific storage
of agriculture and associated produce in the State.

Due to its location and well connected Rail Network and Fourteen Inter State highways
passing through it, it is a prospective hub for storage of Food grain, Consumer and
Industrial goods.

The Corporation intends to appoint Service providers for Preservation, Maintenance and
Security ( PMS ) Services of
Foodgrains stored in the specified Warehouses of the
Chhattisgarh State Warehousing Corporation.

The work is to be carried out strictly as described in detail in the Tender Document.

The Corporation has decided to invite Online bids from eligible Service Providers for the
same for a period of Five years which can be extended for a further period of Six Months
exclusively at the discretion of Managing Director, Chhattisgarh State Warehousing
Corporation.

The parties have to quote their Storage Charge Rates / Quintal / Month taking into
account the rate of current Storage Charges in Rs / Bag / Month.

Annual increase in the Storage Charges is applicable to the Service Provider at the rate of
33 % of Percentage increase in WPI.

The Weighbridge located in the campus has to be Operated and Maintained by the
Service Provider and the revenue generated will be shared between the Service Provider

and C.G. State Warehousing Corporation on equal basis. The Service Provider has the
discretion to undertake commercial operations of the Weigh bridge provided it does not
hamper with routine operations of C. G. State Warehousing Corporation.

Besides the capacity and capability, the
Service Provider needs to display maturity,
sagacity and understanding of business to be carried out. Understanding of all regulatory &
mandatory compliances is therefore essential.

As Public Distribution System is directly or indirectly related with the Nature of Work
corresponding to C.G. State Warehousing Seven days opening of the Godowns may be
necessitated if necessary.

The criteria that can help the Corporation to ensure the entry of serious, mature and capable
Service Providers are the past experience and Work delivery capacity. Accordingly, the
eligibility criteria in the Bid Document have been made so that the Corporation can expect
a “fail-safe” delivery from the finally selected bidder (s).

This tender is a two-step tender. In the first step only Online submitted Scanned copies of
proof of submission of EMD and cost of Tender Documents (Counterfolio of the receipt of
EMD and cost of Tender Documents along with the UTR No. / Acknowledgement) &
Technical – Bids will be opened and examined according to the Tender conditions.
Financial Bid of only those Bidders will be opened if they qualify the eligibility criteria of
the Technical Bid. The venue and date of opening the Financial Bid shall be as per Key
Dates.

The Bidding Contractors shall submit their Bid as per the Terms & Conditions
given in this Document Online as per the Key dates mentioned in the Document.

The tender documents can be downloaded by the interested bidding firm from bid
portal after following the formalities as detailed in e-procurement procedure
given in tender document strictly adhering to the key dates.
The Documents as enclosed Online shall be downloaded from the Bid portal and
shall be evaluated on due date in presence of the interested participant Bidders.
If the Document are found proper in Envelope “A”, i.e. E.M.D. instrument of
requisite amount and the cost of Tender Documents, then the other scanned
Document of Appendix-1 as found in Envelope "B" will be evaluated by the
Evaluation Committee in presence of the interesting participant Bidders.
1.3.4
Those bidding firms, found to be qualified in pre-qualification on the basis of
documents submitted Online, shall be notified and the Financial Bid submitted
Online shall be opened and the Successful Bidder of the same is declared.
1.3.5
The competent authority of C.G. State Warehousing Corporation reserves the
right to qualify / disqualify any or all bidder without assigning any reason
whatsoever. The bidder, who have been declared disqualified shall not have any
claim, whatsoever, and the C.G State Warehousing Corporation shall return the
E.M.D. submitted by them after successful completion of the tender process.
1.3.6
The Appointment of the
Service providers for Preservation, Maintenance And Security ( PMS )
Services of Foodgrains Stored In the Specified Warehouses of Chhattisgarh State
Warehousing Corporation as detailed in this tender shall be carried out in
accordance with the specifications provided in this Tender document.
1.4
1.3.7
Bid shall remain valid for a period of 30 days from the last date of Bid
submission and the Corporation may extend the period of its validity if needed.
The refusal of the Bidder to extend the validity period will entail forfeiture of his
EMD.
1.3.8
Submission of any additional document shall not be allowed after the submission
of Bid up to the due date.
1.3.9
In addition to the EMD deposited by the successful Tenderer (to whom the work
will be awarded) Performance Security Deposit has to be deposited by the
Tenderer prior to undergoing agreement and the same will be released by the
Corporation only after successful completion of the entire works including
extension period under this contract as mentioned in Tender documents. Security
Deposit will be deducted from the Bills and will be returned after successful
completion of the Contract period. No interest will be paid by the Corporation
on the Earnest Money and Security Deposit to the Bidding / Service Providers.
Execution of Contract Agreement:
The successful Tenderer shall ensure to enter into a formal agreement with the
C.G. State Warehousing Corporation within 15 days of issue of award letter in the
prescribed format given in Document, on Non-judicial Stamp paper of appropriate value.

Offers, which are Pre- Conditional shall be treated as Incomplete / Invalid.
1.6
C.G. State Warehousing Corporation reserves the rights to get verify the credentials and the
documents On-Line submitted by the Tenderers along with the Tender during evaluation of
the Bids or before issue of Work Order.
1.7
Quoting of Rates in Financial Bids: The Tenderer should quote Storage Charge Rates
including all Taxes, Duties, Cess etc. During the Contract period if any additional Tax is
imposed by the Central / State Government, C.G. State Warehousing Corporation will be
liable to pay the Tax.
1.8
The Contractor have to submit the Bills well in time and the Corporation will reimburse
back the dues after it is reimbursed to the Corporation by the Depositors but maximum
within 60 days of submission of invoices along with monthly work certificate issued by
Warehouse Manager of CGSWC.
1.9
The modifications done in the Tender Documents, including rectification of Clerical Errors
will be a part of the Tender Documents and has to be fully abide by the Contractor.
Note:

Earnest Money, cost of Tender Documents and Performa as provided in Appendix01 including other Documents required as per the Check List should be submitted only
Online as Envelope "A" & Envelope "B" respectively through (e-procurement Tender
System) and the submission of original Hard copies of the Documents is restricted for the
Tender Process. As a proof of submission of EMD and cost of Tender Documents
Counterfoil of the receipt of EMD and cost of Tender Documents along with the UTR No
/ Acknowledgement should be scanned and send Online in Envelope " A".

FINANCIAL Bid Should be submitted only Online through (e-procurement Tender
System) as Online Envelope "C" .

After opening Online Envelop “A” Qualified / Disqualified list will be prepared and
the same will be notified.

Only qualified Bidders Financial Bid will be opened and considered. Disqualified
Bidders Financial Bid will not be opened and the same will be rejected.

Incomplete Documents shall be summarily rejected. Please refer the Check List provided

SECTION- 11
GENERAL TERMS AND CONDITIONS
2.1 PLACE OF OPERATION:
Offers are invited from the reputed Service Providers under two bids system i.e.
Technical Bid and Financial Bid for Preservation, Maintenance and Security of
Foodgrain Stock of FCI / CGSCSC Ltd. / MARKFED stored in CGSWC Godowns
Basna (21,600 MT & 8,350 Under Construction), Bagbahara (27,193 MT & 11,650
Under Construction ), Janjgir (33,100 MT & 20,000 Under Construction ) , Loharsingh-2
(25,430 MT) Saraipali ( 18,400MT ) , Rajnandgaon ( 35,942 MT ) , Durg ( 43,350 MT &
16,200 Under Construction ) and Mandirhasaud ( 34,800 MT), Dhamtari ( 43,060)
and Chitaud ( 32,400 ) for Five year and extendable on mutual consent of the CGSWC
and Service Provider.
The proposed godowns includes the existing Own capacity which are in the
operation of the Chhattisgarh State Warehousing Corporation and used exclusively for
the storage of Food Grains of Food Corporation Of India / Chhattisgarh State Civil
Supplies Corporation / MARKFED and the capacity under construction likely to be
completed by March 2015. The proposed work is not limited to the Increase / Decrease
or Change in location but limited to a extent of 25 % of the proposed capacity.
NOTE:
Notwithstanding the number and storage capacity of the existing godowns and those
expected to be constructed / acquired during the Contract period the description of which
is given in the Tender, the Corporation may, during the currency of the contract, takeover
/ acquire / construct more godowns for storage as and when necessary. Alternatively, it
may also be necessary for the Corporation to give up or release one or more godowns out
of those, the description of which is given in these documents or out of those, which are
constructed / acquired later during the pendency of the Contract. In such an event the
Contract shall not be rendered invalid and the Contractor shall be bound to perform all
the services / duties and execute all the work as per terms and conditions and rates of the
Contract and they shall not be entitled to make any claim whatsoever against the
Corporation for compensation / revision of rates or otherwise due to increase / decrease
in the number of godowns or the storage capacity of the godowns.
The successful tenderers shall be bound to execute all works as required under the
terms of contract and shall not be entitled to make any claim whatsoever against the
Corporation for compensation, revision of rates or otherwise on the basis of
particulars referred to above.

2.2 ABOUT THE WORK:
A. OBJECT TO THE CONTRACT :
The Service Provider shall render all or any of the services given in Tender document as
and when necessary as directed from time to time by the M.D, C. G. State Warehousing
Corporation or an Officer acting on his behalf together with such additional, ancillary
and incidental, duties, services and operations as may be instructed by the M.D, C.G.
State Warehousing Corporation or an Officer acting on his behalf and as are not
inconsistent with Terms and Conditions of this Contract.
B. BRIEF PROCEDURE AND DESCRIPTION OF WORK :
a
Tender must be accompanied with an EMD @ Rs. 25.00 lakhs for all the locations in
the shape of ECS ( NEFT / RTGS ) Gateway issued by any Nationalized or Scheduled Bank
in favour of Managing Director, Chhattisgarh State Warehousing Corporation, payable at
Raipur.
b.
The Service Provider shall submit offer for all the Locations of 3,71,475 MT for which
EMD of required amount is to be accompanied with the Online submitted documents.
c.
The tenderer must have at least two years of experience in handling, preservation and
maintenance of large volumes of Rice, Wheat & Paddy at par with the service of
SWC/CWC/FCI and other Govt. Agencies in any of the last Five financial years. He is
required to furnish the documentary proof in the Technical Bid for having such
experience.
d.
The tenderer must have experience of handling minimum 12.5 lakh MT capacity of
food grains stock and minimum 7.5 lakh MT of Rice, Wheat & Paddy of FCI / Central
/ State Govt. Agencies in any of the two financial years with in last Five financial years.
e.
Minimum Net worth of the tenderer must be INR 10.00 crores excluding residential
house / residential property.
f.
The party will have to quote the rate for PMS service for 3, 71, 475 MT foodgrain
stocks for which tender is to be submitted. The parties will quote their rates per Quintal
/ Month taking into account the current rate of storage charges in Rs./ Bag / Month.
g.
The tenderer may inspect the Warehouses prior to quoting the rates to ascertain the
type of operation to be carried out for preservation, maintenance and security of stock
stored in the warehouses.
h.
PMS charges will be paid to the service provider after receipt of monthly storage charges from
the depositors but maximum with in 60 days of submission of invoices along with monthly work
certificate issued by Warehouse Manager of CGSWC.

i.
It shall be the responsibility of the Service Provider to ensure the data entry on daily
basis in the software to be provided by the service provider for which necessary
personnel with adequate knowledge of working on computers shall be provided by the
Service Provider.
j.
In the event of failure of the Service Provider to undertake the work after execution of
PMS agreement or resiling from the contract during its currency, CGSWC shall have the
right to get the work done and the Service Provider shall be liable to make good the loss,
if any, suffered by the CGSWC on this account and the CGSWC shall also have the right
to deduct/recover the amount of such loss and to claim the balance amount from the
Service Provider without prejudice to any other remedy under the Contract / Law.
k.
The Service Provider should ensure to keep all the time adequate number of employees/
labour to cope up with the work for the purpose of preservation, maintenance and
security of the stocks.
l.
The volume of food grains in storage is likely to fluctuate (increase or decrease) and No
claim for fluctuation in the volume of work to be handled during the currency of the
contract will be entertained.
m.
The Service Provider shall have to perform all the services provided for in this Lease.
n.
The Service Provider shall be responsible for preservation of stocks in accordance with
the instruction issued by the CGSWC.
o.
The fool-proof security arrangements shall be made by the Service Provider in respect of
the stocks entrusted to it and in case of any defalcation/shortage of stocks, the Service
Provider shall be liable to compensate the CGSWC to the extent of cost of the stocks.
p.
Service Provider shall deploy its personnel to verify the correctness of the Receipt
/
dispatch of stocks and the authorized representative of Service Provider will duly verify
the entries of receipt and dispatch and correctness of weight of stocks by putting his
signatures along with the employee of the CGSWC on the weight check memo, Register /
Weighment sheets and the daily Transaction register; in addition to deploying workers
for preservation & maintenance of stocks and Watch & Ward thereof.
q.
The Service Provider shall provide all infrastructure required i.e. Dunnage polythene
sheet, High Efficiency Flooring, LDPE Covers for fumigation, Insecticides, fumigation
and spraying equipments required for application of insecticides and other chemicals,
locks, weighing scales and all other equipments as may be required for proper upkeep of
health of stocks etc., in accordance with the advice of the Technical Assistant of the
CGSWC.
r.
As Public Distribution System is directly or indirectly related with the Nature of Work
corresponding to C.G. State Warehousing Seven days opening of the Godowns may be
necessitated if necessary.

Service provider will also engage minimum one technical person ( having minimum
experience of two years in preservation and maintenance of stocks) at each location as
prescribed before.
v.
The service provider will be responsible for abnormal storage losses which are beyond
the limits prescribed by the depositor i.e. FCI/ CGSCSC Ltd / MARKFED. These losses
will be worked out at the time of issue / despatch of the stocks. The CGSWC will
investigate the reasons for the abnormal shortage if any and once established that the
losses are because of negligence of the service provider the same will be conveyed to the
service provider and the losses will be recovered from the service provider.
w.
Normal Storage Losses due to moisture loss or otherwise will be allowed as is permitted
by the FCI / CGSCSC / MARKFED for its stocks stored in CGSWC godowns. Storage
Loss over and above if any will be recovered from the Service Providers.
x.
Each successful bidder must deposit a Security in the shape of Bank Guarantee or
Demand Draft in favour of Managing Director, Chhattisgarh State Warehousing
Corporation for Rs. 10.00 per MT of the quantity tendered. Out of which Rs 4.00 per MT
must be deposited at the time of signing of agreement and acceptance of offer letter and
balance Rs 6.00 per MT would be payable from running monthly bills over a period of
one year.

It is the responsibility of the Service Provider to comply with all the Documentation and
Register Work prevalent in the Corporation with all the latest amendments during the
Contract period.
(b)
Annual increase in the Storage Charges is applicable to the Service Provider at the rate of
33 % of Percentage increase in WPI.
2.3 QUALIFICATION CONDITIONS FOR TENDER:

2.4 DISQUALIFICATION CONDITIONS.
(I)
Tenderers who have been blacklisted or otherwise debarred by CGSWC or any
department of Central or State Government or any other Public Sector Undertaking and
the bar exists during the submission of Tender will be ineligible in participating in the
Tender.
(II)
Any Tenderer whose contract with the Chhattisgarh State Warehousing Corporation or
any department of Central or State Government or any other Public Sector Undertaking
has been terminated before the expiry of the contract period at any point of time during
last Three years, will be ineligible.
(III)
Tenderer whose Earnest Money Deposit and / or Security Deposit has been forfeited by
CGSWC or any department of Central or State Government or any other Public Sector
Undertaking, during the last Three years, will be ineligible.

While considering ineligibility arising out of any of the above clauses, incurring of any
such disqualification in any capacity whatsoever (even as a proprietor, partner in another
firm, or as Director of a company etc.) will render the Tenderer disqualified.
2.5 INSTRUCTIONS FOR SUBMITTING TENDER :
The instructions to be followed for submitting the Tender are set out below:
(a)
The Tenderer must be accompanied by an proof of submission of the Earnest Money
amounting for 25.0 Lakhs for all the Locations as mentioned in Table – 01 only in the
form of Electronic Clearing System (ECS) (NEFT/RTGS) in favour of the Managing
Director, C.G. State Warehousing Corporation. For the proof of submission of the EMD
through ECS gateway, the counter folio of the receipt along with UTR (Unit Transaction
Recipt No.) has to be submitted online within Envelop – ‘A’. The Tenderer needs to fill
up and sign the Forwarding letter in the format given in Appendix- I(i) and also furnish
full, precise and accurate details in respect of information asked for in formats provided
in Appendix-I (ii,iii,iv & v) attached to the form of Tender and send the scanned copies
only Online. The tenderer have to submit the cost of Tender documents also in the form
of Electronic Clearing System.
(b)
SIGNING OF TENDER
(i)
Person or Person(s) signing the Tender shall state in what capacity he is, or they are,
signing the tender, e.g., as Sole Proprietor of the firm, or as a Secretary / Manager /
Director etc., of a Limited company or as a Partner of a Partnership firm or as a HUF. In
case of Partnership firm, the names of all partners should be disclosed and the tender
shall be signed by all the partners or by their duly constituted attorney, having authority
to bind all the partners in all matters pertaining to the contract. The original or an attested
copy, of the registered partnership deed should be furnished along with the Tender. In
case of limited company, the names of all the Directors shall be mentioned, and a copy of
the Resolution passed by the company authorizing the person signing the Tender to do so
on behalf of the Company shall be attached to the Tender along with a copy of the
Memorandum & Articles of Association of the Company.
(ii)
The person signing the tender, or any documents forming part of the Tender, on behalf of
another, or on behalf of a firm or Company shall be responsible to produce a proper
Power of Attorney duly executed in his favour, stating that he has authority to bind such
other person, or the firm, as the case may be, in all matters, pertaining to the Contract. lf
the person so signing the tender fails to produce the said Power of Attorney, his Tender
shall be summarily rejected without prejudice to any other Rights of the Corporation
under the law and the Earnest Money Deposit paid by him / her shall be forfeited.
(iii)
The Power Of Attorney should be signed by all the partners in the case of a Partnership
Concern, by the Proprietor in the case of Proprietary Concern, and by the person who by

2.6
CONSTITUTION OF SERVICE PROVIDERS:
a.
Service provider shall at the time of acceptance of offer declare, whether they are sole
proprietary concern or registered partnership firm or private limited company or a body
corporation incorporated in Indian or Hindu Undivided Family. The composition of the
partnership, names of directors of companies and names of the Karta of Hindu Undivided
Family shall also be indicated. The service provider shall also nominate a person (s) in
whose hands the management and control of the work relating to the contract during the
term and tenure of the contract would lie. The person so nominated shall be deemed to
have power of attorney from the service provider in respect of the contract and whose act
shall be binding on the service providers.
b.
The service provider shall not during the currency of the contract make without the prior
approval of the Corporation, any changes in the constitution of the firm. The service
provider shall notify to the Corporation the death / resignation / registration of the
partners / directors immediately on the occurrence of such an event. In absence of such
notice / approval the corporation shall have the right to terminate the contract. The
corporation is not liable for any action arising out of change of constitution of the firm.
2.7 SUBMISSION OF TENDER:
The Tender shall be submitted in the following manner :ENVELOPE NO. A - Only Scanned Copy of proof of submission of the Earnest Money
Deposit and cost of Tender Documents (Counterfolio of the receipt of EMD and cost of
Tender Documents along with the UTR No.) / Acknowledgement should be submitted
Online in the Online Envelope marked “A”. The EMD should only be in the form of
Electronic Clearing System ( NEFT / RTGS ) in favour of Managing Director, C.G. State
Warehousing Corporation, Raipur. Any certificate, which purports to exempt the Bidder
from payment of EMD, will not be accepted.
The Managing Director shall summarily reject any Bid not accompanied by an
acceptable EMD in the manner stated above as Non-Responsive Bid and the other

unopened Envelopes shall not be evaluated without entertaining any Correspondence
whatsoever.
Please note that single EMD of Rs 25 Lakh has to be submitted by the interested
Service Provider for all the location as provided in Table No.- 01.
ENVELOPE NO. B- The Technical and Commercial details of the Tenderer as provided
in Appendix No.- I (i to v) and the supporting Documents as mentioned in AppendixI(ii) should be submitted Online.
ENVELOPE NO. C- The Financial Bid has to be submitted only Online within the
prescribed time limit. No manual submission of Financial Bid is needed. The rates quoted
in any other form and in any other places rather than the provided Template for Financial
Bid will not be entertained at all.
The parties have to quote their Storage Charge Rates per Quintal / Bag / Month
taking into account the current storage charges.
Note:
(a).
The Templates for Financial Bid is available Online and the Tenderer doesn't
have the liberty to quote rates in any other method than expected in Template and
on violation of this , his candidature for the Tender enquiry will be out rightly
rejected.
(b).
The Envelope No.-B, containing the Technical Bid to be send only Online shall
include the following : ( Pls. refer Check List as provided before)
(i)
Appendix No- I ( i - v ) filled in all respects and duly signed by the Tenderer.
(ii)
List of Documents to be attached and duly signed by the Tenderer as given in
Appendix-I(ii).

Attested copy of Registered Deed of Partnership / Memorandum
and Articles of Association / By-laws / Certificate of Registration

Power of Attorney of person signing the Tender.

Financial Years in the last Five Financial years. Certificate of
Experience issued by the Concerned Authorities should be
attached.

Copy of Income Tax Returns of the Service provider for the last 3
years along with the copy of PAN card (Submission of PAN Card

(l)
Tenders not accompanied by the requisite Appendix and Documents
Online and duly filled in and signed may be ignored.
(m)
It should be clearly understood by the Tenderer that No opportunity
shall be given to them to alter, modify or withdraw any offer at any stage
after submission of the Tender.
(n)
If any Document in original or any proof regarding above information is
needed by the Corporation and if the Bidder is unable to produce the
required information then the Bid may be rejected.
OPENING OF BIDS AND EVALUATION:
On the date specified in the Notice, following procedure shall be adopted for the
opening of the Bids.
(a)
OPENING OF ENVELOPE NO - A & B :
1)
The Bid will be opened on the specified day and at specified time in the presence
of the Bidder either in person or through an authorized representative who wish to
be present at the time of opening, to verify its contents as per the requirement.
2)
It is imperative for all the Bidders to furnish Online all the required Documents
and evidences.
3)
The scrutiny of Technical Bid will be done on the specified Day and Time as
mentioned in the Key Dates. It is the duty of the Bidder to furnish all the required
information and if the various documents furnished by the Bidder do not meet
the requirements, the Corporation will not give additional chance to furnish the

requirements. However, the Corporation reserves the right to ask for the original
;documents for verification of the submitted documents.
4)
All Bidders whose Technical Bids meets the requirement of this Bid, will get a
chance of Opening of the Financial Bid.
(b)
FINANCIAL BID OPENING :
Financial Bid of only those Bidders who have been found qualified in Technical Bid
shall be opened On-line. The list of eligible Tenderer qualifying Technically Bid will
be displayed on the Corporations Website.
2.9.
PROCESS TO BE CONFIDENTIAL:
Any effort by the Bidder to influence the Corporation’s processing of Bids or
award decisions shall result in the rejection of their Bid.
2.10.
PRELIMINARY EXAMINATION OF BIDS AND DETERMINATION OF
RESPONSIVENESS:
Prior to the detailed evaluation of Bids, the Corporation will determine whether
each Bid:
a)
Has been properly signed.
b)
Is accompanied by the required securities.
c)
Is substantially responsive to the requirements of the Bidding Documents.
d)
For the purpose of Bid evaluation, a substantially responsive Bid is one, which
conforms to all the terms, conditions and specification of the Bidding Document
without any deviation or reservation.
A deviation or reservation is one:
i.
Which affects in any substantial way the scope, quality or performance of the
project.
Which limits in any substantial way, is inconsistent with the Bidding Document,
the Corporation rights or the Bidder’s obligations under the contract or
Whose rectification would affect unfairly the competitive position of other
Bidders presenting substantially responsive Bids.
If a Bid is not substantially responsive, it will be rejected by the Corporation, and
may not subsequently be made responsive by correction or withdrawal of the nonconforming deviation or reservation.
Check list is provided to alert the Tenderer of the Mode and the list of Documents
needed to qualify the Tender process.

2.11. CORRECTION OF ERRORS:
1. Bids determined to be substantially responsive will be checked for arithmetic errors
and where there is any discrepancy between the amount in Figures and in Words, the
lowest of the two will govern.

The rates stated in the Bid will be adjusted in accordance with the procedure for the
correction of errors and shall be binding upon the Bidder. If the Bidder does not
accept the corrected Bid, the Bid will be rejected, and the EMD shall be forfeited.
2.12. CURRENCY FOR BID EVALUATION :
The parties will quote their rates per Quintal / Bag / Month taking into account the
current rate of storage charges. Annual increase in the Storage Charges is applicable to
the Service Provider at the rate of 33 % of Percentage increase in WPI.
2.13.
EVALUATION AND COMPARISON OF BIDS:
The Corporation will evaluate and compare Bids determined to be substantially
responsive only. In evaluation of the Bids, the Corporation will determine for each Bid
the Evaluated Bid Price.
2.14.
CRITERIA FOR AWARD OF CONTRACT:
(a)
The major criteria for evaluation of the offer received will be the lowest rates
offered in Financial Bid for the Tendered Centres as shown in Table No.- 1. The
Service Provider will quote his rates per Quintal / Bag / Month taking into
account the current rate of storage charges.
(b) The Corporation will award the Contract to the successful Bidders on the basis of
aforesaid criteria subject to the substantial response to the Bidding Document and
eligibility for opening of the Price Bid.
(c) The Bidder has to bid for all the Locations and will be awarded as per his
qualification of submission of lowest Rates.
2.15. CORRUPT PRACTICES:
Any Bribe, commission, or advantage offered or promised by or on behalf of the
Tenderer to any Officer or Official of the Corporation shall (in addition to any criminal
liability which the Tenderer may incure) debar his Tender / Bid from being considered.
Canvassing on the part of, or on behalf of the Tenderer will also make his Tender liable
to rejection.
2.16. CORPORATION’S RIGHT TO ACCEPT ANY BID AND TO REJECT ANY OR
ALL BIDS:
1. The Corporation reserves the rights to reject any or all offers received from the
Bidders without assigning any reasons.
2. The decision of the Corporation regarding the evaluation, qualification, opening and
award of the Bid shall be final and binding on all the Bidders.
3. The successful Tenderer will be intimated of the acceptance of his tender by a letter
/ fax / e- mail etc.
2.17.
In case of any clear indication of cartelization, the Corporation shall reject the
Tender(s), and forfeit the EMD.
2.18.
If the information given by the Tenderer in the Appendices and the Documents attached
is found to be False / Incorrect at any stage, CGSWC shall have the right to disqualify /
summarily terminate the contract, without prejudice to any other rights that the
Corporation may have under the Contract and law.

SECTION-III
INSTRUCTION TO TENDERERS
3.1.
ADDRESS FOR CORRESPONDENCE:
The address for correspondence of Chhattisgarh State Warehousing Corporation will be
N-03, Avanti Vihar, Near Railway Crossing, Telibandha, Raipur ( C.G ) .
For all purpose of this contract, the address of the tenderer mentioned in the
tender shall be the address to which all communications to the service provider shall be
sent, unless the service provider has notified a change by a separate letter sent by
Registered Post Acknowledgement-Due.
The service provider shall be solely responsible for the consequence of an
omission to notify a change of address in the manner aforesaid.
3.2.
3.2.1.
DEFINITIONS:‘Managing Director’ shall mean the Managing Director of the Chhattisgarh State
Warehousing Corporation.
3.2. 2 ‘Service Provider’ means service provider providing services under this Contact
Agreement.
3.2.3.
‘Services’ shall mean the performance of any of the items of work enumerated in
Annexure ‘A’ including such auxiliary, additional and incidental duties, services and
operation as may be indicated by the local authorized representative of the Corporation or
any person
authorized by him in this behalf.
3.2.4.
‘Corporation’
means
the
CORPORATIONS (CGSWC).

3.2.5. ‘Stocks’ mean food grains stored in the godowns.
3.2.6.
“Warehouse” means the godown constructed/managed by the CGSWC
3.3.
OBJECT OF THE CONTRACT:
The service providers shall render all or any of the services given in enclose document as
and when necessary and as directed from time to time by the local authorized
representative of the Corporation at the Warehouse or any officer acting on his behalf,
together with such additional auxiliary and incidental duties, services and operations as

may be indicated by the local authorized representative of the Corporation at the
Warehouse or any officer acting on his behalf and are nor inconsistent with terms and
conditions.
3.3.1.
PERIOD OF CONTRACT:
The period of contract shall be Five years extendable on mutual consent of the CGSWC
and the Tenderer.
3.3.2.
EXPERIENCE:
The tenderer must have at least two years of experience in handling, preservation and
maintenance of foodgrains at par with the service of CGSWC / CWC / FCI /
MARKFED. Additionally, tenderer must have experience of handling minimum
12.5 lakh MT capacity of food grains stock, out of which minimum 7.5 lakh MT of
Rice, Wheat & Paddy of FCI / Central / State Government agencies in any of last two
financial years. He is required to furnish the documentary proof in the Technical BID as
given in Appendix – 1 for having such experience.
3.4.
PARTIES TO THE CONTRACT:
3.4.1
The persons signing the tender or any other documents forming part of the tender, on
behalf of any other person or a firm, shall be deemed to warrant that he has authority to
bind such other person or the firm as the case may be in such matters pertaining to the
contract including the arbitration clause. If on enquiry it is found that the person
concerned has no such authority, the CGSWC represented through the Managing
Director, CGSWC may without prejudice to other civil and criminal remedies terminate
the contract and hold the signatory liable for all costs and damages.
3.4.2.
Notices or any other action on behalf of the Corporation may be given / taken by the
local authorized representative of the Corporation at the Warehouse or any officer
acting on his behalf or any other officer so authorized and acting on his behalf.
3.5.
EARNEST MONEY:
Technical bid shall be accompanied by an Earnest Money of Rs. 25.00 lakh for all the
locations offered under PMS in the form of a Electronic Clearance System Gateway
issued by any Nationalized or Scheduled Bank in favour of the Chhattisgarh State
Warehousing Corporation payable at Raipur. Tenders not accompanied by Earnest
Money in the prescribed format, will be summarily rejected. The Earnest Money shall be
liable for forfeiture if the tenderer after submitting his tender, resiles from his offer and /
or modifies the terms and conditions thereof in any manner, it being understood that the
tender documents have been made available to him and he is being permitted to tender in
consideration of his agreement to this stipulation. The Earnest money is also liable to be
forfeited in the event of the tenderer’s failure after the acceptance of his tender to furnish
the requisite security deposit by the due date without prejudice to any other rights or
remedies of the Corporation under the contract and law. In the event of the Tenderer
submitting the conditional tenders, the EMD of such tenderers will be forfeited. Earnest
money will be refunded to all the unsuccessful tenderer as soon as practicable after

decision on tenders and to successful Tenderers after he has furnished a security amount
prescribed in the Tender Documents. No interest shall be payable on the amount of
earnest money in any case. Earnest money amount may be adjusted in the Security
Deposit at the time of signing of the agreement if the entrepreneur so desires.
Note: As a proof of submission of EMD through ECS gateway, then the Counterfolio
of the receipt along with UTR ( Unit Transaction Recipt No.) / Acknowledgement has
to be provided within Online Envelope- A. The evaluation committee will confirm the
deposited amount in the Accounts of the Corporation and it is the wholesome
responsibility of the Contractor to confirm transfer of the EMD amount in the provided
Account No. of the Corporation or else his Tender will be duly rejected.

3.6.
SECURITY DEPOSIT:-
3.6.1. The successful tenderer(s) shall furnish, within two week of acceptance of his
tender, Security Deposit @ Rs. 10 /- per MT for full capacity of the godown(s) in
the shape of Bank Guarantee and cash deposit at a ratio of 4 : 6 failing which the
contract shall be liable to be cancelled at his risk and cost and also subject to
such other remedies as may be available to the Corporation under the terms of the
contract. The Bank guarantee shall be in the form issued by any branch of
Nationalized / Scheduled banks. Security in form of cash shall be deducted from
monthly running bills of service providers with in contract period.
3.6.2 The Earnest Money deposit of the willing investors can be adjusted against the
Security Deposit.
3.6.3 The Security Deposit will be refunded to the service providers on due and
satisfactory performance of the services and on completion of obligations by
the service providers under the terms of contract and submission of clear “No
demand Certificates issued by the CGSWC subject to such deductions from the
security as may be necessary for making up the Corporation’s claim against
service providers.
3.6.4 It is made very clear that no interest is payable on the amount of Security Deposit
lying with CGSWC in any form under the contract.
3.6.5 The decision of the Managing Director, CGSWC as of the amount determined for
deduction from the Security Deposit will be final and binding on the service
providers.
3.7
PERIOD FOR WHICH THE OFFER WILL REMAIN OPEN:
3.7.1 The offers shall remain open for acceptance for 30 days from the date of opening
of the Technical Bid. However, the CGSWC reserves the right to extend this
period by 15 days at its discretion. Thereafter this period may be further extended
by 15 days by the parties on mutual consent.
3.7.2 Any tenderer not keeping offers open for the prescribed period shall be summarily
rejected and his EMD is liable to be forfeited.

3.8

ACCEPTENCE:
On finalization of tender, CGSWC will communicate acceptance of the tender by way of
letter of memorandum, FAX, E-mail, speed post etc. which will conclude a binding
contract between the parties and the tenderer shall act upon such acceptance letter.
3.9
SUBLETTING:
The service provider shall not sublet / transfer or assign the contract or any part thereof
except for sweepers and security guards. In the event of the service providers
contravening this condition, the Corporation shall be entitled to get the work done from
other firm on the service providers account and at the risk and cost of Service Providers
and he shall be liable for any loss or damage which the Corporation may sustain in
consequence arising out of such replacing of the contract.
3.10
LIABILITY FOR LABOUR AND / OR PERSONNEL ENGAGED BY THE
SERVICE PROVIDERS:
3.10.1 All labour and / or personnel employed by the service providers shall be engaged
by them as
their own employee / workmen in all respects implied or
expressed. The tenderer would engage only able-bodied workmen / labourer of
sound character. In case of misconduct on the part or workmen / labourer
deployed by the Service provider, the Service provider shall pay a penalty of
Rs.10,000/- per incidence of misconduct in addition to the action against the
defaulter under the law. Besides, in the event of loss of business due to any labour
employment problem the Service provider will compensate the loss(s) to the
Corporation at the panel rate to be fixed by the competent authority from time to
time. These losses are recoverable by way of liquidated damages.
3.10.2 The responsibility to comply with the provisions of the various labour laws of the
country, will be that of the Service providers.
3.10.3 The local authorized representative of the Corporation at the Warehouse or any
officer acting on his behalf shall allow the service providers, his agents,
representatives or employees to enter into the premises defined above for the sole
purpose of rendering the said services for CGSWC. The Service Providers shall
agree and undertake to make good any loss or damage caused to the premises,
goods, equipment and property by his agents, representatives or employees while
rendering the said services. However, it is clarified that the employees of service
provider shall be deployed in the operational areas only. The Service Providers
employees without assigned job shall, under no circumstances enter the premises
defined above.

3.10.4 The laminated nametags with photographs should be signed by the Service
Providers and got countersigned by the Local authorized representative of the
Corporation at the Warehouse or any officer acting on his behalf.
3.10.5 Full details about the names, addresses, both local and permanent and three
copies of their photographs will be furnished to the local authorized
representative of the Corporation at the Warehouse or any officer acting on his
behalf. They will also be provided with necessary photo identity cards by the
service providers duly certified by the local authorized representative of the
Corporation at the Warehouse or any Officer acting on his behalf for
regulating their entry into the premises for the bonafide purpose connected with
this work.
3.11. DUTIES AND RESPONSIBLITIES OF THE SERVICE PROVIDERS:
3.11.1 The service providers shall provide and maintain readily available First-Aid
boxes during all the working hours at the rates of not less than one box for 150
Contract labour or part thereof.
3.11.2 The First Aid box shall be distinctively marked with Red Cross on a white
ground and shall contain the equipment as provided for in the contract labour
(Regulation and Abolition’s) Act, 1962.
3.11.3 Adequate arrangement should be made for immediate recoupment of the
equipment, wherever necessary.
3.11.4 If the amenity is not arranged by the service providers within thirty days from the
commencement of the contract the same shall be provided by the Corporation
after the expiry of the said period and the expenses incurred shall be either
deducted from the admitted bills of the service providers or treated as debt
payable by the service providers. Nothing except the prescribed contents shall be
kept in the first aid box. The first aid box shall be kept readily available with the
in charge or person trained in first aid treatment.
3.12. PERIOD OF CONTRACT:3.12.1 The contract shall remain in force for a period of Five years and extendable on
mutual consent of the CGSWC & the Service Provider for another Six Months.
3.12.2. CGSWC has a right to terminate the contract at any time during its currency,
without assigning any reason thereof, by giving thirty days notice in writing to the
service providers at their last known place of residence / business and the Service
providers shall not be entitled to any compensation by reason of such termination.
3.12.3 The action of the Managing Director, CGSWC, under this clause shall be final,
conclusive and binding on the service providers and shall not be called into
question.
3.13. RECEIPT & WEIGHMENT IN WAREHOUSE:

3.13.1. The Depositors will send the stocks in sound bags to the godowns. In case of
receipt of cut & torn bags if any found, the same would be replaced by the Service
Provider to the respective Depositors as per the terms of agreement, with gunnies
to be supplied by the Depositors.
3.13.2. Goods will be tendered for storage by an authorized representative of Depositor
who will fill up and sign the form for deposit and other formalities.
3.13.3 Bags found wholly or partly wet at the time of deposit shall be segregated and
will be accepted for storage after the contents are properly dried, reconditioned by
the Service Provider as per the terms of the agreement and considered fit to stand
storage to be undertaken by Service Provider.
3.13.4 Stocks at the Warehouses would be received and issued on 100% weighment
basis on the lorry weighbridge available in the Warehouse. In godowns, it is the
responsibility of Service Provider to provide weighment facility already
provided by the Corporation at the Warehouse.
3.13.5 The Service Provider shall be responsible for satisfactory storage of stocks and
shall take necessary care as is expected from a tenderer. The quantum of storage
loss / gain shall be examined taking into account the condition of the stocks at the
time of receipt including infestation, if any, moisture contents at the time of
receipt and issue, storage period etc.
3.13.6 The weight of the stocks, moisture contents as well as condition of the stock at the
time of receipt and issue shall be jointly recorded by CGSWC/ representative of
the depositor and Service provider staff for authentication. Damages / down
gradation / deterioration during storage period due to negligence of Service
Provider if any, will be borne by the Service Provider.
3.13.7 An acknowledgement would be issued by the Service Provider to CGSWC
acknowledging receipt of stocks at the Warehouse. Moisture contents shall be
determined both at the time of receipt and delivery of goods and shall be recorded
in the relevant acknowledgement / Warehouse receipt and delivery order.
3.13.8 The Service Provider will operate the Weighbridge in the campus and the annual
maintenance and calibration of weighbridge will be done by the Service Provider
only and the revenue generated will be distributed between the Corporation and
the Service Provider on equal basis.
3.14.
STORAGE LOSSES / GAINS :
3.14.1 The stocks stored on account of CGSWC shall be subject to monthly / periodical
joint inspection report by the Service Provider and CGSWC.
3.14.2 Loss and gain Statement will be submitted in the prescribed Performa of the
CGSWC to the Incharge of the CGSWC after stocks in particular stack is
completely liquidated during the month which should be jointly signed by the

Service Provider or his authorized representative and CGSWC representative. The
statement will be commodity-wise, month wise and stack-wise.
3.14.3. The jointly signed above Loss and Gain Statement will be submitted by the
Service Provider or his authorized representative by 7th of succeeding month after
liquidation of stocks.
3.14.4. If the storage losses are beyond permissible limit as per norms in vogue, the
Service Provider shall be responsible for the same and recoveries for such
unjustified losses shall be deducted from the Service Provider by the CGSWC. In
addition, the agreement with Service Provider also stipulate that the Service
Provider shall be fully responsible for any loss caused to the stocks of CGSWC
while in custody of Service Provider on account of fire flood & inundation,
cyclone, riots & strikes, earthquake, malicious damages, pilferage, theft,
housebreaking, burglary, misappropriation etc for which recoveries will be made
from Service Provider on the rates fixed by the CGSWC from time to time.
3.14.5 Norms / prevalent procedure for storage loss/ gain finalized by the FCI / Govt. of
India/ CGSCSC Ltd. / MARKFED from time to time will be binding on the
Service Provider.
3.15. DELIVERY OF GOODS :
3.15.1. Instructions for delivery or transfer of goods shall be in writing and signed by the
authorized representative of CGSWC.
3.15.2 In case delivery is to be given to any other person, he shall be duly authorized and
his signatures attested by the authorized representative of CGSWC.
3.15.3 The delivery shall be given as per demand/priority given in writing to the service
provider or his authorized representative by the authorized representative of
CGSWC.
3.15.4 The condition of stocks shall be examined by the CGSWC representative, who
shall give in writing with full particulars of loss or damage / down gradation /
deterioration, if any, caused to the goods to the godown incharge or his
authorized representative forthwith or give notice within three working days of
his examining goods otherwise it may be presumed that the CGSWC has No
claim against the Service provider for loss / damage / deterioration / down
gradation while the goods are in Warehouse Godowns.
3.15.5
3.16.
For delivery of Goods before and after Office hours and on holidays, reasonable
/ prior intimation / notice shall be required to be given to the Service provider or
his authorized representative.
INITIAL FUMIGATION:
3.16.1 For stocks received in infested conditions, necessary remarks shall be recorded by
the Service Provider and intimated to CGSWC immediately and action taken to
fumigate the stocks. For such fumigation done within 03 days of receipt of the

stocks subjected to completion of all stacks within the same chambers, the Service
Provider shall claim fumigation charges at rates prescribed from time to time by
the CGSWC, duly supported by relevant documents. The same shall be payable
by the CGSWC.
3.16.2 In respect of the stocks despatched from the Warehouse, if the same are found to
be despatched in infested condition, as substantiated by records and facts, the
CGSWC shall claim fumigation charges from the service provider at the rates
prescribed from time to time by the CGSWC.
3.17.
INSURANCE:
3.17.1 The PMS Service Provider shall undertake to exercise reasonable care and
diligence as is required as per terms and conditions of this contract for keeping the
stocks of CGSWC. 100 % value of the stocks stored in the Warehouses shall be
insured / indemnified against the risk of fire, flood and theft and the whole
charges on this will be borne by Service Provider shall be the CGSWC.
3.17.2 The insurance of stocks will continue to be undertaken by Service Provider at the
estimated average acquisition cost on which Government of India has taken the
same in the costing sheet.
3.17.3 In the event of any loss, CGSWC will cooperate with the Service Provider in
furnishing necessary details for finalising the claim for compensation by the
Insurance Company.
3.17.4 The Service Provider shall get the claim settled from the Insurance Company at
the earliest and pass on the compensation so received from the Insurance
Company to the CGSWC. The Service Provider will settle the claim with
CGSWC on the declared value after occurrence of the incident.
3.17.5 If on any account Insurance cover of the centres Tendered have been procured by
the Corporation, the Service provider have to reimburse the actual amount of
premium incurred on the Tendered locations back to the Corporation.
3.18. FREE MOVEMENT OF STOCKS:
No hindrance should be there in receiving the stocks or for moving the stocks in the
Warehouse / Premises and for persons engaged by the CGSWC to oversee the Warehouse
operations. The Service Provider shall keep the Warehouse / Premises as well as
Documents pertaining to stock of CGSWC open for inspection any time to the Officers /
Staff duly authorized by the CGSWC. In case, Service Provider fails to provide such
facility, the CGSWC will have the option to terminate the agreement forthwith.
3.19. PROVISION OF FACILITIES FREE OF COST:
3.19.1 The PMS Service Provider shall provide all the Warehousing facilities at par with
CWC / SWC / FCI / MARKFED including proper stacking, scientific storage and
treatment of the stocks, round the clock security, proper prophylactic & curative
treatment, etc. (List is illustrative and not exhaustive). These facilities shall be
part & parcel of the storage charges as agreed.

3.19.2 The PMS Service Provider shall keep all the facilities available in the Warehouse
/ premises like beam scale, QC equipments, drinking water etc. and shall offer
them to Officers / Staff of the CGSWC without any additional cost.
3.19.3 If the PMS Service Provider fails to provide facilities as mentioned above, the
CGSWC shall have a right to get the facilities provided at its cost or expenses and
cost or expenses so incurred by the CGSWC shall be deducted from the monthly
charges together with element of interest thereon, and in the manner considered fit
by the CGSWC in his discretion. The cost or expenses incurred by the CGSWC
on Service Provider’s account would be treated as final, without calling them in
question.
3.20.
STATUTORY OBLIGATIONS:
3.20.1 It is the sole responsibility of PMS Service Provider during the hiring period that
he shall hold all valid licenses relating to PMS by respective competent
Authorities, valid PAN & TIN numbers etc and up to date Tax Clearance
Certificates from the concerned authorities.
3.20.2 The PMS Service Provider shall be solely responsible to fulfill all the statutory
obligations under various Central / State Acts which are in force.
3.21. PAYMENT OF TAXES :
The PMS Service Provider shall pay all existing and future increase in Municipal and
local taxes / levies and the charges related to PMS contract in warehouse / premises
excluding of Service Tax, if applicable. Any new Tax applicable during the Contract
period will be paid by the Corporation.
3.22. LIABILLITY OF SERVICE PROVIDERS FOR LOSSES ETC., SUFFERED BY
CORPORATION- RISK AND COST CLAUSE:
3.22.1. The personnel in different categories will have to be positioned by the PMS
Service Provider, preferably such people who have exposure to computerized
operations keeping in view the fact that operations at the Warehouse will be
computerized. In the event of any fault or defaults on any particular day/days on
;the part of the service providers in providing adequate equipment / manpower or
to perform any of the service mentioned herein efficiently and to the entire
satisfaction of the local authorized representative of the Corporation at the
Warehouse or any officer acting on his behalf who, in his absolute discretion,
without prejudice to other right and remedies under this contract, shall have the
right to recover by way of compensation from the up to Rs.10,000/- per a day
from the PMS service provider or a sum ( as deemed fit ), besides making
temporary alternate arrangements to cope-up with the work at risk and cost of the
service providers who will be liable to compensate the consequential damages, if
any. This decision of the Local authorized representative of the Corporation at the
Warehouse or any officer acting on his behalf on the question whether the PMS
service provider has committed such a fault or has failed to perform any of the

services efficiently and also his liability for payment of compensation and its
quantum, shall be final and binding on the Service Providers, subject to it being
confirmed by the MD, CGSWC.
3.22.2 In case of any shortage due to damage / loss etc., to goods for whatsoever reason
and cause while the same are in the custody of the PMS Service Provider, the
PMS Service Provider shall be liable to make good to the Corporation the value of
the goods including, penalties and fines as are leviable by the Managing Director
for such shortage due to damage or loss etc.,. In addition, if there is any reason for
suspicion of collusion of the PMS Service Provider or his employee in such losses
or damage, the local authorized representative of the Corporation at the
Warehouse or any Officer acting on his behalf at his discretion may levy a penalty
as deemed fit. The action taken by the Managing Director, CGSWC will be final
and binding on the PMS Service Provider.
3.22.3 The PMS Service Provider shall be responsible for any loss, destruction or
deterioration of foodgrains or any damage or delay in the performance of duties
due to any negligence or default on the part of their employees / labourers or due
to failure of equipment or due to non availability of adequate safety aids with the
labourers or due to pilferage of foodgrains by their employees / labourers also to
the carelessness, neglect, misconduct of their employees / labourers in their
employment and any liability for payment of compensation by the Corporation to
the depositors on account thereof and shall pay all claims met, and also litigation
expenses, if any, incurred by the Corporation immediately on demand without any
demur . The Corporation shall have the right to deduct the amount of such loss
from any bill (including security deposit) then due or may become due to the
Corporation under this contract. The decision of the Managing Director, CGSWC
shall be final and binding on the Service Providers in this regard.
3.22.4 In the event of failure of the Service Provider to undertake the work after award of
contract or reselling from the contract during its current the corporation shall have
the right to get the work done at his risk and cost and the Service Providers shall
be liable to make good the loss, if any, suffered by the Corporation on this
account. The Corporation shall also have the right to deduct the amount of such
loss from any sum (including Earnest Money and Security Deposit) then due or
which at any time thereafter may become due to the PMS Service Provider under
this contract and to claim the balance amount from the PMS Service Provider.
3.22.5 Adequate required labour to cope up with the work should be deployed by the
Service Provider.
3.23. SET OFF:Any sum of money due and payable to the Service Providers (including Security
Deposit refundable to him) under this contract may be appropriated by the Corporation
and set off against any claim of the Corporation for the payment of any sum of money
arising out of this contract or under any other contract made by the Service Providers
with the Corporation.

3.24. ACCOUNTS:All accounts, books, papers and documents pertaining to the operations carried out in
connection with the contract shall be open for inspections, audit by the local authorized
representative of the Corporation at the Warehouse or any Officer acting on his behalf or
an Officer acting on behalf of Managing Director, CGSWC including the accounts an
Audit Officers. The Service Providers shall be responsible to produce the same at such
time and place as may be directed by the local authorized representative of the
Corporation at the Warehouse or any Officer acting on his behalf.
3.25. VOLUME OF WORK:
The volume of Foodgrains in storage is likely to fluctuate (increase or decrease) and the
PMS Service Provider should note that No claim for fluctuation in the volume of work
to be handled during the currency of the contract should be entertained.
3.26. REMUNERATION:
The PMS Service Provider shall have to perform all the services provided for in this
contract. The PMS Service Provider shall be paid at the rates accepted by the
Corporation. The PMS Service Provider shall also provide any additional services not
specifically provided for in this contract for which the remuneration shall be payable at
the rates as may be settled by mutual negotiations. In the absence of any agreement
being reached on the rates for such additional services, the decision of the Managing
Director, CGSWC, will be final and binding. Non-settlement of the rates for additional
services will not confer a right upon the PMS Service Provider to refuse to carry out or
render such services.
3.27.
PAYMENT:
3.27.1 Payment towards PMS charge will be made by the CGSWC after receipt of
Monthly Storage Charges from the depositors but maximum with in 60 days of
submission of invoices along with monthly work certificate issued by Warehouse
Manager of CGSWC.

3.27.2 The PMS Service Provider should submit the bills (final bill) not later than Two
Months from the date of expiry of the contracts so that the refund of Security
Deposit may be speeded up. In order to facilitate early settlement of bills, the
PMS Service Provider is advised to submit his bills fortnightly.
3.28. LAWS GOVERNING THE CONTRACT:
The contract will be governed by the laws of the country in force from time to time and
all the cases will be settled legally under Raipur jurisdiction.
3.29.
AGREEMENT:
The PMS Service Provider shall execute a formal agreement with MD, CGSWC, the
form appended as Annexure-‘A’, on a non-judicial stamp paper of appropriate value.

3.30. ARBITRATION:
3.30.1 All disputes and difference arising out of or in any way touching or concerning
this contract, whatsoever shall be referred to the sole arbitrator i.e., the Managing
Director of CGSWC, or any other person authorized by him in writing. There will
be No objection to any such appointment on the ground that the person so
appointed is an employee of the Corporation and that he had deal with the matter
to which the contract relates and that in the course of his duties as employee of the
Corporation, he had expressed views on all or any of the matter in dispute. The
award of such Arbitrator shall be final and binding on the parties to this contract.
It is a term of this contract that in the event of such Arbitrator to whom the matter
is originally referred being transferred or vacating his Office or being unable to
act or resigning for any reason, the Managing Director, CGSWC, at the time of
such transfer, vacation of office or inability to act or resigning shall appoint
another person to act as Arbitrator in accordance with the terms of this contract.
Such person shall be entitled to proceed with the reference from the stage at
which his predecessor left it.
3.30.2 Provided further that any demand for arbitration in respect of any claims of the
Service providers or of the Corporation under the contract shall be in writing and
made within one year of the date of termination (expiry of the period) of the
contract and where this provision is not complied with, the claims of the Service
Providers shall be deemed to have been waived and absolutely barred and the
Corporation shall be discharged and released of the liability under the contract.
3.30.3 It is further provided that the Arbitrator may from time to time and with the
consent of the parties enlarge the time for making and publishing the award.
3.30.4 The venue of arbitration shall be Raipur
.
3.30.5 The Arbitrator shall be deemed to have entered on the reference on the date when
first hearing of the case takes place after due notice to the parties irrespective of /
whether both the parties are present on that date or not.
3.30.6 The work under the contract shall, if reasonable possible continue during the
arbitration proceedings and no payment due or payable to the Service Providers
shall be withheld on account of such proceedings.
3.30.7 The costs of arbitration shall be borne by the parties as per the decision of the
Arbitrator.
3.30.8 The Arbitrator shall give separate award in respect of each dispute-referred to
him.
3.30.9 No litigation is permissible without going through the arbitration process.
3.30.10 All litigations are limited to Raipur jurisdiction only.

3.31.

SERVICES TO BE RENDERED BY THE SERVICE PROVIDERS:3.31.1. The Service Provider to be engaged shall be reasonable for preservation of stocks
in accordance with the Technical Manual of the Corporation / FCI / CWC /
MARKFED for preservation of stocks as is in force and as may be amended from
time to time.
3.31.2 The Service Provider shall be responsible for quality cuts on account of
weevilling and living infestation in the stocks, if levied by FCI / CGSCSC /
MARKFED at the time of taking over the stocks from CGSWC.
3.31.3 The fool-proof security arrangements shall be made by the PMS Service Provider
in respect of the stocks entrusted to it and in case of any defalcation / shortage of
stocks, the PMS Service Provider shall be liable to compensate the Corporation to
the extent of economic cost of the stocks.
3.31.4 The Joint-lock and Key system will be adopted i.e. one set of keys shall be held
by the Warehouse Incharge, CGSWC or any other Official(S) authorized on this
behalf and the other set of keys shall be held by the PMS Service Provider or their
authorized representative.
;3.31.5 The PMS Service Provider shall deploy its personal to verify the correctness of
the Receipt / dispatch of stocks by deploying his work force for this purpose and
the Authorized representative of investor will duly verify the entries of receipt and
dispatch and correctness of weight of stocks by putting his signatures along with
the employee of the Corporation in the weight check memo Register / Weighment
sheets and the daily Transaction register; in addition to deploying workers for
preservation of stocks and Watch & Ward thereof.
3.31.6 The PMS Service Provider shall provide all infrastructure required i.e., Dunnage
Polythene sheet, LDPE Covers, Insecticides, fumigants and spraying equipments
required for application of insecticides and other chemicals, locks, weighing
scales and all other equipments as may be required for proper upkeep of health of
stocks etc., in accordance with the advice of the Warehouse Incharge of the
CGSWC for the purpose as (in force and as may be amended) per the instructions
from time to time.
3.31.7 The PMS Service Provider will also have to maintain the record of the
insecticides consumed from time to time and also the empty containers / tubes,
which will be disposed of with the prior approval of the MD, CGSWC or any
person / officers authorized by him and also in the presence of the authorized
representative of the Head Office, CGSWC.
3.31.8 In case of receipt of rain affected / luster loss stocks of rice, wheat & paddy, the
PMS Service Provider shall be responsible to maintain the health of such stocks
for a period of 6 Months from the date of its storage subject to condition that this
stock is accepted as per prescribed quality parameters of Government of India
only. This period could be extended by mutual consent.

3.31.9 The Weighbridge located in the campus has to be Operated and Maintained by
the Service Provider and the revenue generated will be shared between the
Service Provider and C.G. State Warehousing Corporation on equal basis. The
Service Provider has the discretion to undertake commercial operations of the
Weigh bridge provided it does not hamper with other operations of C. G. State
Warehousing Corporation.
3.32.
DERIVING OF RATES FOR EXTRA / SUBSTITUTED ITEMS:
3.32.1 The rates for any new items or substituting the existing item by a modified item
would be derived strictly in the manner given below:3.32.2 As far as possible the rates of a new item of work or part work would be derived
from the existing rate schedule and would be acceptable to the service provider. If
no such operation or its rates were available, market rate would be ascertained by
CGSWC and paid for.
3.32.3 The decision of the MD, CGSWC in this regard would be final and binding. The
tender(s) shall sign every page of the tender document under seal of the company
to ensure that they have read and understood clearly all the clauses stipulated in
the tender and submitted their offer thereafter.

3.32.4 Annual increase in the Storage Charges is applicable to the Service Provider at
the rate of 33 % of Percentage increase in WPI.

ANNEXURE-‘A’
CHHATTISGARH STATE WAREHOUSING CORPORATION
SALIENT FEATURES OF QUALITY CONTROL MANUAL AS IN FORCE AND AS BE
AMENDED FROM TIME TO TIME WHICH SHALL BE PART & PARCEL OF TERMS &
CONTIIONS OF PRESERVATION CONTRACT.
1.
PRE- STORAGE STEPS:
A well-planned work is necessary in order to avoid haphazard handling of stocks and
ensure proper accounting and preservation of custom. Therefore, before fresh stocks are
received in the godowns, QC staff of the PMS Service Provider should be fully prepared
to receive it. In this connection, the Inspector should attend to the following points.
i.
Check up the godowns to ensure that there is no leakage and drainage is in
perfect condition.
ii.
Cleanliness and disinfestations of godowns.
iii.
Estimation of capacity.
iv.
Drawing up of stack plan
v.
Dunnage
2. CHECK UP OF GODOWNS:
In order to avoid the possibility of damage to the custom to be stored, the QC Staff of the
Service Provider should check up that there will be no leakage from roof or walls during
monsoon and that godown floor does not suffer from seepage. Any such requirement for
repair and maintenance noticed by the Service Provider during the currency of the
contract will be informed to the Corporation for timely repair and maintenance of the
same. Repair and maintenance being infrastructure related, the Corporation has to ensure
that the godown should be in perfect repair all the times. All cracks and crevices should
be filled in and cement plastered. Other possible points of leakages in walls and roof
should be checked up and got closed so that water in Monsoon does not enter the
godowns through these leakages and damage the custom. If there are any rat borrows, Al
Phosphide should be introduced and holes plugged with clay. After 24 hours the clay
should be removed, openings plugged with cement mixed with pieces of broken glass.
However, the service provider shall try on best effort basis to protect foodgrain stock
stored but any damage to stock due to delay in repairs or non- repairs would be
responsibility of the CGSWC.
3. CLEANLINESS AND DISINFESTATION OF GODOWNS:
The godown should be got thoroughly swept and cleaned. If there is any suspicion of
infection, it should be disinfested with Malathion or DDVPs spray.
4.
DRAWING UP OF STACK PLAN:
The stack plan should be chalked out by bearing in mind the following, three points:
i.

Proper alleyways are left for carrying out handling operation, inspection of
stocks and their disinfestations treatment with ease and efficiency.
Maximum benefit of aeration and ventilation arrangements available in the
godowns in drawn, as far as possible, the base area of all the stacks should be
uniform as far as possible.

5. STACK LINES:
The floor area may be divided into uniformly sized and serially numbered rectangular
stack bases to build stacks. The stacks lines 2” broad drawn in white or black paint serves
to mark the boundary of the proposed stack. While marking these stack bases care should
be taken to leave 2ft. to 2.5 ft. wide alleyways and between stack and walls or pillars, for
ventilation and operational purposes. The main alleyways for the haulage purpose may be
3ft.
6. STACK SIZE:
Actual size of the stacks in godowns should not exceed the size of 30 ft.x20 ft.
7. DUNNAGE:
Use of proper dunnage of polythene sheet or High Efficiency Flooring under the stacks is
of fundamental importance to protect the stacks from moisture damage and there can be
no deviation from this rule.
8. STACK CARDS:
Prescribed stack cards in Transparent Natural Colour Polythene of proper size should be
kept ready for displaying on each stack.
9. COLLECTION OF SWEEPING:
During and after storage the loose grain/sweep will be collected cleaned, filled in
standard bags and got accounted for as per procedure in vogue. However labour for
collections of sweepings at the time of inward and outward will be provided by CGSWC
through his H&T service provider.
10. STACKWISE REGISTER:
After completion of storage prescribed stack wise register will be maintained for
inspection and disinfestations treatment.
11. CARE OF GRAIN DURING STORAGE:
A.
CLEANLINESS:
The godown should be swept regularly at least twice in a week and kept in neat tidy and
hygienic condition. All webs on the wall roof, alleyway & bags should be removed
regularly and bags should be properly brushed and cleaned. No loose grains should lie on
naked floor.

Adequate number of sample bags should be provided in each godown. All the samples
drawn from the stacks for the purpose of inspection should also be kept in these sample
bags after thorough cleaning.

DETERMINATION OF SURFACE:
The surface area of a stack should be calculated for its five sides by applying the formula
2h (L + B) + (L + B) to this 10% should be added as an allowance for inter bag space.

SEPARATE STORAGE FOR DEFFERENT COMMODITIES:
As far as possible each commodity should be stored in separate godown. This may not
always be possible. But the important rule to remember is that hazardous goods and
commodities requiring different storage and preservation methods are to be stored in
;separate godowns.
G.
BRUSHING OF BAGS BEFORE SPRAYING / FUMIGATION:
Before stocks are dusted or sprayed, bags should be brushed as this helps to remove the
collected dust, webs, cocoons, eggs etc. that might be sticking to the bags. After
fumigation the bags should also be brushed thoroughly to remove dead pest and residue
of fumigant.

FORTNIGHTLY INSPECTION:
Godowns and stocks should be thoroughly inspected at least once a fortnight: during
rains the inspection should be frequent. Inspection should consist of :a.
Check up godown walls, roof and floor.
b.
Check up peripheral, top and bottom layer bags in case of bag storage.
c.
Check up of representative sample of each stack.
d.
Check up of stocks of different depths/sides in case of bulk storage.

There is any heating etc in the stocks.
The stocks require turn over owing to heating.
There is any cake formation along walls in case of bulk storage.
The grain of bottom layer bags and other bags is dry, if not whether there is any
likely hood of damage to stocks on account of excessive moisture.
The stocks are free from infestation. If not, what is the kind and magnitude of
infestation and whether spraying/fumigation of the stocks is warranted?
There is any damage to stocks due to infestation and, if yes, to what extent.
There are any stocks warranting immediate disposal for reasons of deterioration.
The fumigation has been done in time.
The stocks have been dusted on due dates.
There is any rat trouble in the godowns.
There is any damage to stocks caused by rats.
The observations made during inspection should be recorded in the stack wise
inspection register and stack cards. Whatever action is required on above points as
a result of inspection should be taken at once. A detailed report about the action
taken and required to be taken should be sent to H.O / RM Office.
FUMIGATION:
In case of infestation, the stocks should be fumigated with Aluminum Phosphide under gas
proof covers as per following norms:Dosage-3 tablets or 9 grams per MT of stocks Exposure period: 1 week

After fumigation is carried out, it should be noticed if there are any crawling

be looked into and avoided for future operation: & stocks should be fumigated again

and after exposures period after fumigation the bags and the stacks should be cleaned
and brushed thoroughly to remove ash and dead pest & stocks should be sprayed with
Deltamethrin or with DDVP (in case of crawling infestation) to eliminate the chances
of any living pest.
The Service Provider will also require purchasing all insecticides/fumigants
required for maintenance of health of stocks during next three months well in
advance.
The Service Provider will also have to maintain the record of the insecticides
consumed from time to time and also the empty container / tubes, which will be
disposed of with the prior approval of the Corporation / Federation and also in the
presence of the Authorized Representatives.
K. TREATMENT FOR RAIN AFFECTED STOCKS:
In case of receipt of rain affected stocks of WHEAT, RICE OR Paddy the Service
Provider shall be responsible to maintain the health of such stocks for period of six months
from the date of storage subject to the condition that this period could be extended by mutual
consent.
L. BRIEF DESCRIPTION OF WORK:
1.
The Service Provider shall be responsible for the preservation of stocks in the C.G. State
Warehousing godowns in accordance with the Technical manual of CGSWC / FCI / CWC
/ MARKFED as is in force and as may be amended from time to time ( Annexure- A ).
2.
The Service Provider shall be responsible for quality cuts on account of Weeviling and
living infestation in the Stocks, if levied by FCI / CGSCSC / MARKFED at the time of
taking over the stocks from C. G. State Warehousing Corporation.
3.
The fool proof security arrangements shall be made by the Company in respect of the
stocks entrusted to it and in case of any defalcations / shortage of stocks, the company
shall be liable to compensate C.G. State Warehousing Corporation to the extent of
economic cost of the stocks.
4.
The Joint- lock system shall be adopted i.e. one set of Keys shall be held by Warehouse
Incharge of the CGSWC or any other Official authorized on behalf of CGSWC and the
other set of keys shall be held by the authorized representatives of the service provider.
The C.G. State Warehousing Corporation shall deploy it’s personal to verify the
correctness of the receipt / despatch of stocks by deploying his work force for this purpose
and the authorized representative of the CGSWC will duly verify the entries of receipt and
despatch and correctness of weight of stocks by putting his signatures along with the
employee of the corporation in the weight Check Memo Register / Weighment sheets and
the Daily Transaction Register.
5.
100 % weighment will be done at the Weigh bridge which is a part of the Godown
complex. The PMS Service Provider shall deploy its representative at the Weigh Bridge to
verify the correctness of the receipt / dispatch at the weigh bridge. The authorized

representative of the C.G. State Warehousing Corporation will verify the entries of the
receipt and dispatch and correctness of the weight of the stocks at the Weigh bridge and
then counter sign along with the employee of the Service Provider he Weight Check
Memo, the Register / Weighment sheets and the Daily Transaction Register.
6.
The Officials of the Service Provider will carry out 10% weighment once the stocks are
put on the platform of the godown and will draw parallel samples along with CGSWC.
However, the responsibility of the quality will be that of the PMS Service Provider.
CGSWC will have No responsibility as far as the quality of the Stocks is concerned. The
PMS Service Provider will be responsible for accepting the stocks as per permissible
moisture and other quality norms once these stocks are declared accepted by FCI /
CGSCSC / MARKFED. In case the authorized representative of the Service Provider finds
that any consignment of foodgrains which has been declared accepted by FCI / CGSCSC /
MARKFED is not up to the quality or the quality norms he will report it to the Warehouse
Incharge of the CGSWC who in turn will get the consignment replaced / rejected.
7.
The weight of the foodgrains, moisture contents as well as condition of the stock at the
time of receipt and issue shall be jointly recorded by CGSWC / FCI / CGSCSC /
MARKFED and the PMS Service Provider and duly authenticated in records.
8.
The PMS Service Provider will deploy its employees who will carry out the preservation
of the stocks inside the godowns. The PMS Service Provider will be responsible for the
timely fumigation of stocks and will be responsible for maintaining the health of the
stocks.
9.
The Service Provider will provide the required Dunnage Polythene Sheet or High
Efficiency Flooring , Polythene Covers, Nets, Tarpaulins, equipment, insecticides,
fumigants, chemicals, spraying equipment, Locks, weighing scales and other equipments
as per terms and conditions laid down in the Tender Documents as may be required for
proper upkeep of health of the stocks.

. The CGSWC will provide Office at Warehouse premises for smooth working of
employees of PMS Service Provider and also space for storage of office articles, quality
equipments, stationery and registers etc.
11.
The CGSWC may advise or issue instructions to PMS Service Provider from time to time
for the upkeep of the health of the stocks.
12.
The PMS Service Provider will purchase all insecticides required for maintenance of
health of stocks during next three months well in advance. The Service Provider will also
have to deposit the purchase bill of insecticides so purchased with the CGSWC.
13.
The PMS Service Provider will also have to maintain the record of the insecticides
consumed from time to time and also the empty containers/tubes, which will be disposed
of with the prior approval of the MD, CGSWC or any person / officers authorized by him.
14.
Apart from the manpower required for preservation and maintenance of health of the
stocks inside the godowns the PMS Service Provider will provide the Security Personnel,
the sweepers, the clerical staff and the computers as per the contract Agreement.

15.
The gunny bags for replacement of scattered grains during receipt and issue operation as
per norms of CGSWC shall be provided by the CGSWC. However, if the replacement is
more than CGSWC's norms. The Service Provider shall provide the bags at their own cost
or will bear the cost of such bags if provided by CGSWC. However, it will be the
responsibility of The Service Provider to undertake minor repair/stitching of partial
operational cut/torn in filled bags to stop spillage during storage/ transit. Similarly one
empty gunny bag per stack will also be issued to the Service Provider by CGSWC for use
as Pala Bag to collect the sweeping on daily basis, which will be delivered back to
CGSWC at the time of issue of these stacks and accounted for accordingly in Gunny
Account both by CGSWC and the Service Provider.
16.
The Service Provider shall undertake to exercise reasonable care and diligence as is
required as per terms and conditions of this contract for keeping the stocks of CGSWC.
The stocks stored in the Warehouse shall be insured / indemnified against the risk of fire,
flood and theft and the whole charges on this will be borne by the Service Provider. The
beneficiary of the insurance policy taken by the PMS Service Provider shall be CGSWC.
17.
The Insurance of stocks will continue to be undertaken by the Service Provider at the
estimated average acquisition cost on which Govt. of India has taken the same in the
costing sheet. In addition, the agreement with the Service Provider also stipulate that the
PMS service provider shall be fully responsible for any loss caused to the stocks of
CGSWC while in custody of PMS Service Provider on account of fire, flood & theft,
housebreaking, burglary, misappropriation etc. for which recoveries will be made from
PMS Service Provider on the rates fixed by CGSWC from time to time.
18.
In the event of any loss, CGSWC will cooperate with the the Service Provider in
furnishing necessary details for finalizing the claim for compensation by the Insurance
Company.
19.
The Service Provider shall get the claim settled from the Insurance Company at the
earliest and pass on the compensation so received from the Insurance Company to
CGSWC. The Service Provider will settle the claim with CGSWC on the declared value
after occurrence of the incident.
20.
The stocks stored on account of CGSWC shall be subject to monthly / periodical joint
inspection by the Service Provider, CGSWC & FCI / CGSCSC / MARKFED.
21.
Storage Loss and gain Statement will be submitted in the prescribed format of FCI /
CGSCSC / CGSWC to the Warehouse Incharge of the CGSWC after stocks in particular
stack is completely liquidated during the month which should be jointly signed by the
PMS Service Provider and CGSWC representative. The statement will be commoditywise, month wise & Stack-wise.
22.
The Jointly signed above Loss and Gain Statement will be submitted by the Service
Provider or his authorized representative by 7th of succeeding month after liquidation of
stocks.

23.
If the Storage losses are beyond permissible limit as per FCI / CGSCSC / CGSWC /
MARKFED norms in vogue, Service Provider shall be responsible for the same and
recoveries for such unjustified losses shall be affected from the Service Provider by the
CGSWC.
24.
In case of any shortage or damage / loss etc. to goods for whatsoever reason and cause
while the same are in the custody of the PMS Service Provider, the Service Provider
shall be liable to make good to the Corporation the value of the goods including penalties
and fines as are livable by the Managing Director for such shortage due to damage or loss
etc, in addition, if there is any reason for suspicion of collusion of the Service Provider or
his employee in such losses or damage, the local authorized representative of the
Corporation at the Warehouse or any Officer acting on his behalf at his discretion may
levy a penalty as deemed fit. The action taken by the Managing Director, C.G. State
Warehousing Corporation will be final and binding on the service Providers.
25.
Norms / prevalent procedure for storage loss/ gain in rice, wheat and paddy finalized by
the FCI / CGSCSC / Govt. of India from time to time will be binding on the Service
Provider. Since No storage loss norms have been fixed by either FCI or CGSWC in
paddy and the same is issued on “as is where is basis”, hence the Service Provider will
not be responsible for any storage losses in paddy. However, The Service Provider will
take all reasonable steps to preserve the paddy to its best of quality / quantity.
26.
The Service Provider will have to give storage gain in wheat as per norms fixed by FCI /
CGSCSC / MARKFED from time to time in case of Central Pool stocks and as per FCI
norms / guidelines / instructions issued from time to time. In case of lesser gain than the
norms, the cost of the same shall be recovered from the Service Provider. In case the
Service Provider fails to make the payment on this account, it will be recovered from the
rentals / or Security amount and or by invoking the Bank Guarantee.

N. COMMERCIALIZATION OF WEIGHBRIDGE:
The Weighbridge located in the campus has to be Operated and Maintained by the

AGREEMENT
The Managing Director, C.G. State Warehousing Corporation having agreed to award the
contract for providing services for preservation, maintenance and security of foodgrains in the
Warehouse(s) of CGSWC Godowns at Basna (21,600 MT & 8,350 Under Construction),
Bagbhara (27,193 MT & 11,650 Under Construction ), Janjgir (33,100 MT & 20,000 Under
Construction ) , Loharsingh-2 (25,430 MT) Saraipali ( 18,400MT ) , Rajnandgaon ( 35,942 MT )
, Durg ( 43,350 MT & 16,200 Under Construction ) and Mandirhasaud ( 34,800 MT),
Dhamtari ( 43,060) and Chitaud ( 32,400 ) for Five year and extendable on mutual consent of
the CGSWC and Service Provider for a period of Six Months and various allied operations, I /
we-------------------------------------- to be referred as---------------------- or Company) am/are
executing this agreement on ---------------- 2015 and hereby confirm that I/We have thoroughly
examined and understood the terms & conditions Governing for providing services for
preservation, maintenance and security of foodgrains at the Warehouses of the CGSWC and
other incidental services etc., and agree to abide by them. All the terms and conditions of tender
documents signed and submitted by the service provider at the time of submission of technical
and financial bids, shall also be binding and form part of this agreement.
As per letter No. Dated------------ of the CGSWC, we are executing this agreement on -----------2015. I / We am / are will fully undertaking the said work for a capacity of --------- MT
@ Rs.------------ per Quintal/month as service charges including all Taxes and Levies as
applicable but exclusive of Service Tax if applicable, which forms part of this agreement and as
per terms and conditions of the said documents.
That the above rate of Rs.---------- per Quintal / Bag / Month will be payable by CGSWC
calculated on the total storage capacity of the godowns being handled by M/s---------- ------------------and the rate is not related to the level of stocks stored in any or all the godowns.
That the contract period is of Five years and extendable on mutual consent of the
CGSWC and the Service Provider. I/We assure the CGSWC that I/We will undertake the said
work to the best of my/our ability at all stages, during the tenure of the contract. The agreement
will remain in force for a period of Five years with effect from -------------2015 and extendable
on mutual consent for another Six Months on the approved terms and conditions which are as
under:

The CGSWC may advise or issue instructions to PMS Service Provider from time to time
for the upkeep of the health of the stocks.
12.
The PMS Service Provider will purchase all insecticides required for maintenance of
health of stocks during next three months well in advance. M/S ------------------------ will
also have to deposit the purchase bill of insecticides so purchased with the CGSWC.
13.
The PMS Service Provider will also have to maintain the record of the insecticides
consumed from time to time and also the empty containers / tubes, which will be disposed
of with the prior approval of the MD, CGSWC or any person / Officers authorized by him.
14.
Apart from the manpower required for preservation and maintenance of health of the
stocks inside the godowns the PMS Service Provider will provide the Security personnel,
the sweepers, the clerical staff and the computers as per the contract Agreement.
15.
The gunny bags for replacement of scattered grains during receipt and issue operation as
per norms of CGSWC shall be provided by the CGSWC. However, if the replacement is
more than CGSWC's norms, M/S.--------------------------------- shall provide the bags at
their own cost or will bear the cost of such bags if provided by CGSWC. However, it will
be the responsibility of M/S ------------------------ to undertake minor repair/stitching of
partial operational cut/torn in filled bags to stop spillage during storage/ transit. Similarly
one empty gunny bag per stack will also be issued to M/S ------------------------by CGSWC
for use as Pala Bag to collect the sweeping on daily basis, which will be delivered back to
CGSWC at the time of issue of these stacks and accounted for accordingly in Gunny
Account both by CGSWC and M/S ------------------------.
16.
M/s------------------------------------------------ shall undertake to exercise reasonable care
and diligence as is required as per terms and conditions of this contract for keeping the
stocks of CGSWC. The stocks stored in the Warehouse shall be insured / indemnified
against the risk of fire, flood and theft and the whole charges on this will be borne by
M/S-----------. The beneficiary of the insurance policy taken by the PMS Service Provider
shall be CGSWC. ;
17.
The Insurance of stocks will continue to be undertaken by M/S------------------------at the
estimated average acquisition cost on which Govt. of India has taken the same in the
costing sheet. In addition, the agreement with M/S------------------------also stipulate that
the PMS Service Provider shall be fully responsible for any loss caused to the stocks of
CGSWC while in custody of PMS Service Provider on account of fire, flood & theft,
housebreaking, burglary, misappropriation etc. for which recoveries will be made from
PMS Service Provider on the rates fixed by CGSWC from time to time.
18.
In the event of any loss, CGSWC will cooperate with the M/S ------------------------in
furnishing necessary details for finalizing the claim for compensation by the Insurance
Company.

19.
M/S ------------------------shall get the claim settled from the Insurance Company at the
earliest and pass on the compensation so received from the Insurance Company to
CGSWC. M/S ------------------------will settle the claim with CGSWC on the declared
value after occurrence of the incident.
20.
The stocks stored on account of CGSWC shall be subject to monthly / periodical joint
inspection by M/s ------------------------, CGSWC & FCI / CGSCSC.
21.
Storage Loss and gain Statement will be submitted in the prescribed format of FCI /
CGSCSC / CGSWC to the Warehouse Incharge of the CGSWC after stocks in particular
stack is completely liquidated during the month which should be jointly signed by the
PMS Service Provider and CGSWC representative. The statement will be commoditywise, month wise & Stack-wise.
22.
The Jointly signed above Loss and Gain Statement will be submitted by the -----------------------or his authorized representative by 7th of succeeding month after liquidation of
stocks.
23.
If the Storage losses are beyond permissible limit as per FCI / CGSCSC / CGSWC norms
in vogue, service provider shall be responsible for the same and recoveries for such
unjustified losses shall be affected from the service provider by the CGSWC.
;
24.
Norms / prevalent procedure for storage loss/ gain in rice, wheat and paddy finalized by
the FCI / CGSCSC/ Govt. of India from time to time will be binding on the M/S-----------------------. Since No storage loss norms have been fixed by either FCI or CGSWC in
paddy and the same is issued on “as is where is basis”, hence M/S -----------------------will not be responsible for any storage losses in paddy. However, M/S ---------------------will take all reasonable steps to preserve the paddy to its best of quality / quantity.
25.
M/S .------------------------------will have to give storage gain in wheat as per norms fixed
by FCI / CGSCSC from time to time in case of Central Pool stocks and as per FCI
norms/ guidelines/ instructions issued from time to time. In case of lesser gain than the
norms, the cost of the same shall be recovered from M/S ------------------------. In case
M/S.----------------------- fails to make the payment on this account, it will be recovered
from the rentals / or Security Amount and or by invoking the Bank Guarantee.
26.
ARBITRATION
In case of any dispute/differences arising out of any manner, the same shall be referred to
the sole arbitration of M.D, CGSWC or his authorized representative and there will be no
objection that the person so authorized is/was the employee of CGSWC. The decision of
MD CGSWC/ Authorized person shall be final and binding on both the parties.
27. The Weighbridge located in the campus has to be Operated and Maintained by the
Service Provider and the revenue generated will be shared between the Service Provider
and C.G. State Warehousing Corporation on equal basis. The Service Provider has the
discretion to undertake commercial operations of the Weigh bridge provided it does not
hamper with other operations of C. G. State Warehousing Corporation.

this provision, have effect of so relieving us.
5. This guarantee will not discharged due to the change in the constitution of the Bank or the
Service Provider(s) / Supplier(s).

GENERAL
1.1.
This Prebid Contract Agreement (herein after called the Integrity Pact) is made

1.2.
WHEREAS the SERVICE PROVIDER is a Private Company / Public Company /
Government Undertaking/ Partnership / Registered Export Agency, constituted in
accordance with the relevant law in the matter and the CORPORATION is a Ministry /
Department of the Government, performing its function on behalf of the Government of
Chhattisgarh.
2.
OBJECTIVES
NOW, THEREFORE, the CORPORATION and the SERVICE PROVIDER agree to enter
into this pre-contract agreement, hereinafter referred to as Integrity Pact, to avoid all
forms of corruption by following a system that is fair, transparent and free from any
influence/prejudiced dealings prior to, during and subsequent to the Contract to be
entered into with a view to:-
2.1.
Enabling the CORPORATION to obtain the desired Stores / Equipment / Work / Service
at a competitive price in conformity with the defined specifications by avoiding the high
cost and the distortionary impact of corruption on public procurement, and

2.2.

Enabling SERVICE PROVIDER to abstain from bribing or indulging in any corrupt
practices in order to secure the contract by providing assurance to them that their
competitors will also abstain from bribing any corrupt practices and the
CORPORATION will commit to prevent corruption, in any form, by its official by
following transparent procedures.
3.
COMMITMENTS OF THE CORPORATION
The CORPORATION commits itself to the following:-
3.1.
The CORPORATION undertakes that No Official of the CORPORATION, connected
directly or indirectly with the contract, will demand, take promise for or accept, directly
or through intermediaries, any bribe, consideration, gift, reward, favour or any material
or immaterial benefit or any other advantage from the SERVICE PROVIDER, either for
themselves or for any person, organization or third party related to the contract in
exchange for an advantage in the bidding process, bid evaluation, contracting or
implementation process related to the contract.
3.2.
The CORPORATION will, during the Precontract Stage, treat SERVICE PROVIDER
alike, and will provide to all SERVICE PROVIDER the same information and will not
provide any such information to any particular SERVICE PROVIDER which could
afford an advantage to that particular BIDDER in comparison to the other SERVICE
PROVIDER.
3.3.
All the officials of the CORPORATION will report the appropriate Government office
any attempted or completed breaches of the above commitments as well as any
substantial suspicion of such a breach.
In case any such preceding misconduct on the part of such Official(s) is reported
by the SERVICE PROVIDER to the CORPORATION with the full and verifiable facts
and the same prima facie found to be correct by the CORPORATION, necessary
disciplinary proceedings, or any other action as deemed fit, including criminal
proceedings may be initiated by the CORPORATION and such a person shall be
debarred from further dealings related to the contract process. In such a case while an
enquiry is being conducted by the CORPORATION the proceedings under the contract
would not be stalled.
4.
COMMITMENTS OF BIDDERS
The SERVICE PROVIDER commits itself to take all measures necessary to prevent
corrupt practices, unfair means an illegal activities during any stage of its Bid or during

any pre-contract or post-contract stage in order to secure the contract or in furtherance to
secure it and in particular commit itself to the following :4.1.
The SERVICE PROVIDER will not offer, directly or through intermediaries, any bribe,
gift, consideration, reward, favour, any material or immaterial benefit or other advantage,
commission, fees, brokerage or inducement to any Official of the CORPORATION,
connected directly or indirectly with the biding process, or to any person, organization or
third party related to the contract in exchange for any advantage in the bidding,
evaluation, contracting and implementation of the contract.
4.2.
The SERVICE PROVIDER further undertakes that it has not given, offered or promised to
give, directly or indirectly any bribe, gift, consideration, reward, favour, any material or
immaterial benefit or other advantage, commission, fees, brokerage, or inducement to
any official of the CORPORATION or otherwise in procuring the Contract of forbearing
to do or having done any act in relation to the obtaining or execution of the contract or
any other contract with the Government for showing or forbearing to show favour or
disfavour to any person in relation to the contract or any other contract with the
Government.
4.3.
The SERVICE PROVIDER further confirms and declares to the CORPORATION that the
SERVICE PROVIDER is the original Manufacture / Integrator / Authorized government
sponsored export entity of the stores and has not engaged any individual or firm or
company whether Indian or foreign to intercede, facilitate or in any way to recommend
to the CORPORATION or any of its functionaries, whether officially or unofficially to
the award of the contract to the SERVICE PROVIDER, nor has any amount been paid,
promised or intended to be paid to any such individual, firm or company in respect of
any such intercession, facilitation or recommendation.
4.4.
The SERVICE PROVIDER, either while presenting the bid or during pre-contract
negotiations or before signing the contract, shall disclose any payment he has made, is
committed to or intends to make to officials of the CORPORATION or their family
members, agents, brokers or any other intermediaries in connection with the Contract and
the details of services agreed upon for such payments.
4.5.
The SERVICE PROVIDER will not collude with other parties interested in the contract to
impair the transparency, fairness and progress of the Bidding process, Bid evaluation,
contracting and implementation of the Contract.
4.6.
The SERVICE PROVIDER will not accept any advantage in exchange for any corrupt
practice, unfair means and illegal activities.

4.7.

The SERVICE PROVIDER shall not use improperly, for purpose of competition or
personal gain, or pass on to others, any information provided by the CORPORATION as
part of the business relationship, regarding plans, technical proposal and business details,
including information contained in any electronic data carrier. The SERVICE PROVIDER
also undertakes to exercise due and adequate care least any such information is divulged.
4.8.
The SERVICE PROVIDER commits to refrain from giving any complaint directly or
through any other manner without supporting it with full and verifiable facts.
4.9.
The SERVICE PROVIDER shall not instigate or cause to instigate any third person to
commit any of the acts mentioned above.
5.
PREVIOUS TRANSGRESSION
5.1.
The SERVICE PROVIDER declares that no previous transgression occurred in the last
three years immediately before signing of this Integrity Pact with any other company in
any country in respect of any corrupt practices envisaged hereunder or with any Public
Sector Enterprise in India or any Government Department in India that could justify
SERVICE PROVIDER exclusion from the Tender process.
5.2.
If the SERVICE PROVIDER makes incorrect statement on this subject, SERVICE
PROVIDER can be disqualified from the tender process or the Contract, if already
awarded, can be terminated for such reason.
6.
EARNEST MONEY (SECURITY DEPOSIT)
6.1.
Every BIDDER while submitting commercial bid, shall deposit an amount as specified in
RFP as Earnest Money / Security Deposit, with the CORPORATION through any of the
following instruments:
(i)
Bank Draft or a Pay Order in favour of..................................
(ii)
A confirmed guarantee by an Indian Nationalised Bank, promising payment of the
guaranteed sum to the....................... (CORPORATION) on demand within three
working days without any demur whatsoever and without seeking any reasons
whatsoever. The demand for payment by the CORPORATION shall be treated as
conclusive proof of payment.
(iii) Any other mode or through any other instrument (to be specified in the RFP).

6.2.

The Earnest Money / Security Deposit shall be valid upto a period of five years or the
complete conclusion of the contractual obligations to the complete satisfaction of both
the SERVICE PROVIDER and CORPORATION, including warranty period, whichever
is later.
6.3.
In the case of successful SERVICE PROVIDER a clause would also be incorporated in
the Article pertaining to Performance Bond in the Purchase Contract that the provisions
of Sanctions for violation shall be applicable for forfeiture of Performance Bond in case
of a decision by the CORPORATION to forfeit the same without assigning any reason
for imposing sanction for violation of this Pact.
6.4.
No interest shall be payable by the CORPORATION to the SERVICE PROVIDER on
Earnest Money / Security Deposit for the period of its currency.
7.
SANCTIONS FOR VIOLATIONS
7.1. Any breach of the aforesaid provisions by the SERVICE PROVIDER or any one employed
by it or acting on its behalf (whether with or without the knowledge of the SERVICE
PROVIDER) shall entitle the CORPORATION to take all or any one of the following
actions, wherever required:(i)
To immediately call off the pre contract negotiations without assigning any reason or
giving any compensation to the SERVICE PROVIDER. However, the proceedings
with the other SERVICE PROVIDER (s) would continue.
(ii)
To forfeit fully or partially the Earnest Money Deposit (in pre-contract stage) and / or
Security Deposit / Performance Bond (after the contract is signed), as decided by the
CORPORATION and the CORPORATION shall not be required to assign any
reason therefore.
(iii) To immediately cancel the contract, if already signed, without giving any
compensation to the SERVICE PROVIDER.
(iv) To recover all sums already paid by the CORPORATION, and in case of the Indian
SERVICE PROVIDER with interest thereon at 2% higher than the prevailing Prime
Lending Rate while in case of a SERVICE PROVIDER from a country other than India
with Interest thereon at 2% higher than the LIBOR. If any outstanding payment is due
to the SERVICE PROVIDER from the CORPORATION in connection with any other
contract such outstanding payment could also be utilized to recover the aforesaid sum
and interest.

(v) To encash the advance bank guarantee and performance bond / warranty bond, if
furnished by the SERVICE PROVIDER, in order to recover the payments, already
made by the CORPORATION, along with interest.
(vi) To cancel all or any other contracts with the SERVICE PROVIDER and the
SERVICE PROVIDER shall be liable to pay compensation for any loss or damage to
the CORPORATION resulting from such cancellation / rescission and the
CORPORATION shall be entitled to deduct the amount so payable from the
money(s) due to the SERVICE PROVIDER.
(vii) To debar the SERVICE PROVIDER from participating in future bidding processes of
the Government of Chhattisgarh for a minimum period of Five years, which may be
further extended at the discretion of the CORPORATION.
(viii) To recover all sums paid in violation of this Pact by SERVICE PROVIDER (s) to any
middlemen or agent or broken with a view to securing the contract.
(ix) In cases where irrevocable Letters of Credit have been received in respect of any
contract signed by the CORPORATION with the SERVICE PROVIDER, the same
shall not be opened.
(x)
If the SERVICE PROVIDER or any employee of the SERVICE PROVIDER or any
person acting on behalf of the SERVICE PROVIDER, either directly or indirectly, is
closely related to any of the officers of the CORPORATION, or alternatively, if any
close relative of an Officer of the CORPORATION has financial interest / stake in
the BIDDER'S firm, the same shall be disclosed by the BIDDER at the time of
filling of tender. Any failure to disclose the interest involved shall entitle the
CORPORATION to rescind the contract without payment of any compensation to
the SERVICE PROVIDER.
The term 'close relative' for this purpose would mean spouse whether residing
with the Government servant or not, but not include a spouse separated from the
Government servant by a decree or order of a competent court; son or daughter or
step son or step daughter and wholly dependent upon Government servant, but does
not include a child or step child who is no longer in any way dependent upon the
Government servant or of whose custody the Government servant has been deprived
of by or under any law; any other person related, whether by blood or marriage, to
the Government servant or to the Government servant's wife or husband and wholly
dependent upon Government servant.

(xi) The SERVICE PROVIDER shall not lend to or borrow any money from or enter into
any monetary dealings or transactions, directly or indirectly, with any employee of
the CORPORATION, and if he does so, the CORPORATION shall be entitled
forthwith to rescind the contract and all other contracts with the SERVICE
PROVIDER. The BIDDER shall be liable to pay compensation for any loss or
damage to the CORPORATION resulting from such rescission and the
CORPORATION shall be entitled to deduct the amount so payable from the
money(s) due to the SERVICE PROVIDER.
7.2. The decision of the CORPORATION to the effect that a breach of the provisions of this
pact has been committed by the SERVICE PROVIDER shall be final and conclusive on the
SERVICE PROVIDER. However, the SERVICE PROVIDER can approach the Monitor(s)
appointed for the purposes of this Pact.
8.
FALL CLAUSE
8.1.
The SERVICE PROVIDER undertakes that if has not supplied / is not supplying similar
product / systems or subsystems at a price lower than that offered in the present bid in
respect of any other Department or PSU of the Government of Chhattisgarh and if it is
found at any stage that similar product/systems or sub systems was supplied by the
SERVICE PROVIDER to any other Department or a PSU of the Government of
Chhattisgarh at a lower price, then that very price, with due allowance for elapsed time,
will be applicable to the present case and the difference in the cost would be refunded by
the SERVICE PROVIDER to the CORPORATION, if the contract has already been
concluded.
9.
INDEPENDENT MONITORS
9.1.
The CORPORATION will appoint Independent Monitors (hereinafter referred to as
Monitors) for this Pact.
9.2.
The task of the Monitors shall be to review independently and objectively, whether and
to what extent the parties comply with the obligations under this Pact.
9.3.
The Monitors shall not be subject to instructions by the representatives of the parties and
perform their functions neutrally and independently.
9.4.
Both the parties accept that the Monitors have the right to access all the documents
relating to the project / procurement, including minutes of meetings. The Monitor shall
be under contractual obligation to treat the information and documents of the SERVICE
PROVIDER / Subcontractor(s) with confidentiality.

9.5.
As soon as the Monitor notices, or has reason to believe, a violation of this Pact, he will
so inform the Authority designated by the CORPORATION.
9.6.
The Monitor will submit a written report to the designated Authority of
CORPORATION / Secretary in the Department/within 8 to 10 weeks from the date of
reference or intimation to him by the CORPORATION / SERVICE PROVIDER and,
should the occasion arise, submit proposals for correcting problematic situations.
10.
FACILITATION OF INVESTIGATION
In case of any allegation of violation of any provisions of this Pact or payment of
commission, the CORPORATION or its agencies shall be entitled to examine all the
documents including the Books of Accounts of the SERVICE PROVIDER and the
SERVICE PROVIDER shall provide necessary information of the relevant documents and
shall extend all possible help for the purpose of such examination.
11.
LAW AND PLACE OF JURISDICTION
This Pact is subject to Indian Law, the place of performance and jurisdiction shall be the
seat of the CORPORATION
12.
OTHER LEGAL ACTIONS
The actions stipulated in this Integrity Pact are without prejudice to any other legal action
that may follow in accordance with the provisions of the any other law in force relating
to any civil or criminal proceedings.
13.
VALIDITY
13.1. The validity of this Integrity Pact shall be from the date of its signing and extend up to 5
years or the complete execution of the contract to the satisfaction of both the
CORPORATION and the SERVICE PROVIDER / Seller whichever is later. In case
SERVICE PROVIDER is unsuccessful, this Integrity Pact shall expire after Six months
from the date of the signing of the contract.
13.2. If one or several provisions of this Pact turn out to be invalid; the remainder of this Pact
shall remain valid. In such case, the parties will strive to come to an agreement to their
original intentions.

and security of foodgrains at par with CWC / FCI to the CGSWC at the aforesaid
locations given in the Tender Documents.
