The legal framework of the Republic of Serbia, from the energy point of view and the point of view
of the use of renewable energy sources, entails:

 Law on planning and construction (Off. gazette RS Nr. 72/2009, 81/2009, 64/2010, 24/2011)

Strategic documents in the area of sustainable energetic development are:
Development strategy of the Republic of Serbia untill the year 2015 (Off. gazette RS, Nr.
35/05)
Programm for the realization of the energy development strategy 2007-2012 (Off.
gazette RS, Nr. 17/07 i 73/07 ) with changes and additions (Off. gazette RS 99/09)
With the enactment and acceptance of the Energy law, two organization have been created, with
the goal of the rational and sustainable use of energy and energy sources – the Energy Agency of
the Republic of Serbia and the Agency for Energy Efficiency.

LEGAL FRAMEWORK IN THE AREA OF GEOTHERMAL
ENERGY
According to recommendations of the European geothermal energy board (EGEC), the
the legal framework in the area of geothermal energy should be determined by
(Abesser, 2007):
• The use of geothermal energy in an ecological manner, with a special emphasis on
the protection of underground waters suitable for watersupply
• All-purpose and sustainable use of geothermal energy
• Issuing of investor permits for the use of geothermal energy in a specific area and in
specified quantities

USE OF GEOTHERMAL ENERGY IN THE REPUBLIC OF
SERBIA
Underground waters are treated in three ways: as a natural ressource, as a mineral raw
material and as an energy source.
According to the current legal framework, the exploitation and use of hydrogeothermal
ressources for the need of object climatization is regulated by following laws:
• Law on mining and geology
• Water law
• Energy law
Institutions in charge, which operate under the mentioned legal acts, are:

ENERGY LAW

Hydrogeothermal ressources are recognized as renewable energy sources; the
production and distribution of electrical and heat energy is conditioned by energy
permits according to this law.

According to current legal framework, an energy permit is net required for individual
users of hydrogeothermal energy.

A permit is issued for the construction of an energy object for the production of heat
energy with the power of over 1 MW, for the construction of objects as well as fo the
distribution of heat energy.

The issuing of energy permits is done according to the rulebook on the criteria for
issuing energy permits, the content of the request and the way of issuing an energy
permit
