General rule - asylum seekers are not detained
Possible exceptions:
asylum seeker shall be detained if he/she:

- crossed the border illegally
•
- posses no documents confirming his identity
•
- behaves dangerously or states a threat for public health/order

Aliens’ duties:

To keep quiet from 22 to 6 o’clock (on Sunday to 7)
To obey the rules of social life

dangerous situation
Aliens’ rights:

The right to contact the Polish administrative authorities, Polish and
international non-government organisations, diplomatic missions
The right to be visited by close relatives (if permission is given by BG
or the Police)
The right to medical help
The right to quiet hours (22.00 – 6.00; in holidays until 7.00)
The right to one hour walk outside the building (in arrests)
The right to keep the contact with other aliens in the detention centre
The right to use equipment in the day room
The right to religious practises
The right to buy newspapers, books, food articles, personal belongings
The right to smoke and buy cigarettes (in pointed places)
The right to receive post packages and to correspondence
The right to submit requests, complaints and demands
Medical treatment
• The alien admitted to a guarded centre or an
expulsion arrest is without delay medical
examined and if it is necessary he/she is
exposed to sanitary treatment
• The costs of medical treatment are
reimbursed from national budget (from the
part of Minister of Interior)
• The alien has a right to medical care and to
stay in medical facility if necessary
Medical treatment
• The pregnant woman may stay in an
expulsion arrest up to the 7th month of
pregnancy, then she must be placed in a
guarded centre
• In the case, there is a threat to life or health
the alien may not be put in any detention
centre, and if he/she stayes in such a centre,
he/she must be released
