In fact, over 80 percent of the population under the age of 34 has played a game, and the average age of the gamer continues to rise-28 in 2003, 29 in 2004, and 35 in 2007. Gaming has become ubiquitous: it’s something most people do, from 97 percent of teenagers to 26 percent of adults over 50. Video games have become a permanent part of mainstream culture for all ages, classes, races, and genders. VIDEO GAME RATINGS HOW TO DETERMINE AGE LEVEL AND APPROPRIATE CONTENT SUPREME COURT PROTECTION RECENTLY, THE UNITED STATES SUPREME COURT CONSIDERED ARGUMENTS ABOUT THE NATURE AND POSSIBLE EFFECTS OF VIDEO GAMES. THE COURT APPLIED FIRST AMENDMENT PROTECTION TO VIDEO GAMES: “LIKE PROTECTED BOOKS, PLAYS, AND MOVIES, THEY COMMUNICATE IDEAS THROUGH FAMILIAR LITERARY DEVICES AND FEATURES DISTINCTIVE TO THE MEDIUM.” THE COURT PREVENTED CALIFORNIA FROM RESTRICTING THE SALE OF VIDEO GAMES TO MINORS. THEIR DECISION EFFECTIVELY HALTED SIMILAR EFFORTS IN OTHER STATES. HOWEVER, JUSTICES WRITING BOTH IN THE MAJORITY AND MINORITY ACKNOWLEDGED THAT THE NATURE AND POSSIBLE EFFECTS OF A NEW MEDIUM LIKE VIDEO GAMES CAN BE POORLY UNDERSTOOD. FOR EXAMPLE, JUSTICE SCALIA RECOUNTED OUR NATION’S PAST CONFUSION AND ALARM ABOUT THE POSSIBLE HARM TO MINORS CAUSED BY PENNY DREADFULS, MOVIES, AND COMIC BOOKS.
