Sam Fore, Jr. Wilson County Public Library One Library Lane Floresville, TX 78114 American with Disabilities Act Compliance Policy STATEMENT OF POLICY The Sam Fore, Jr. Wilson County Public Library (WCPL) is working to comply fully with the Americans with Disabilities Act of 1990, Public Law 101-336 (ADA), which prohibits discrimination on the basis of disability or special needs. The ADA, as applied to cities, counties, and other local governmental entities, and other local governmental entities, requires that no qualified individual with a disability shall, on the basis of a disability, be denied the benefits of local government services, programs or activities. Our library building, built in 1968, is currently not completely handicapped accessible. WCPL seeks to make its services, facility, and programs as accessible as possible to the public, including those who have special needs. To accommodate those with disabilities, the following services are offered: Accordingly, the Library WILL: Provide handicap parking that is on a level surface with a vertical sign and as close to the library entrance a possible. Have clear, large exterior signs that can be read from the street. Maintain a front entrance door that has a clear opening of 36 inches or more with a push-type handle. Strive for a glare-free and uniform indoor lighting. Make available a nearby desk for supplementary service when needed. Supply Internet stations in the seated position. The Library will also provide a mixture of standing and seated public catalog access stations. Ensure that there are armchairs available in the reading area near magazines and newspapers. Provide large print materials, videos both in VHS and DVD format and audiobooks for checkout. Offer outreach services to those individuals in residential institutions and to the homebound. Allow all service dogs and dogs in training full access to the Library. In addition the Library WILL: Take appropriate steps to ensure that communications with applicants, participants, and members of the public with special needs are as effective as communications with others. Make reasonable accommodations in policies, practices, or procedures when necessary to avoid discrimination on the basis of disability, unless a fundamental alteration in a local government program would result. Operate our programs so that, when viewed in their entirety, they are readily accessible to and usable by individuals with special needs. American Disability Act Compliance Policy and Procedure 1 GRIEVANCE PROCEDURE Enforcement of this policy is the responsibility of all Sam Fore, Jr. Wilson County Public Library staff. Persons who believe they have been discriminated against based on the disability should file a Service Delivery Discrimination Complaint Form, which is an attachment to this policy. Individuals may also file an administrative complaint with the U.S. Equal Opportunities Commission (E.E.O.C) within 180 days of the date of the alleged discrimination or may file a lawsuit for injunctive relief and damages. Any or all of these methods may be pursued at the same time. Individuals are protected from retaliation or coercion when pursuing their rights or responsibilities under the A.D.A. STEP ONE: Requests for accommodation and/or complaints about accessibility can be presented in person, by mail, email, or over the telephone. These should be addressed to the Library Director who than makes every attempt to provide accommodation(s) and/or resolve the issue without further recourse to this procedure. STEP TWO: If resolution is not achieved by Step One, a complaint can be presented in writing on a Service Delivery Discrimination Complaint Form. Assistance in completing this form is provided as needed. Completed forms are reviewed by the Library Director; a formal written response shall be made to the library user within 10 business days of the date of original submission of the form. The formal response can be a telephone call, followed by a letter confirming the telephone discussion, or directly by letter. The Library Director will make every attempt to resolve the issue through this means. STEP THREE: If resolution is not achieved by Step Two, the concerned individual can request that the complaint be presented to the Wilson County Commissioners’ Court. The Library Director will place the matter on the Commissioners’ Court agenda so that the concerned individual can present his or her concern at the next regularly scheduled session. The decision of the Wilson County Commissioners’ Court is final for the Library. If resolution still is not achieved, the concerned individual may wish to pursue other course of action as described in the ADA and related regulations.
