DRAFT [date] President Re: Agreement on Dual Admission and Transfer of Credits Dear: University of Maryland University College (“UMUC”) is pleased to work with [Community College] (“__CC”) to offer dual admission to students and transfer credits from one institution to the other on the terms and conditions of this Letter of Agreement (“Agreement”). I. Dual Admission. [CC] and UMUC agree to allow simultaneous admission to [CC] and UMUC through a single admission process using the procedures set forth in Exhibit 1 (“Dual Admission Program”). II. Acceptance of Degrees. In order to transfer to UMUC, a [CC] student must satisfy UMUC’s admissions criteria and other applicable requirements at the time the student applies for admission to UMUC. a. Articulated Programs—Students graduating from [CC] with those associate’s degrees identified in Exhibit 2 may transfer into the parallel bachelor’s degree programs at UMUC identified in Exhibit 2 (“Articulated Programs”). UMUC shall accept up to 70 transfer credits as a block and that will also satisfy General Education Requirements at UMUC. b. Other Programs—A [CC] student who has earned an Associate of Art (AA) or Associate of Science (AS) degree other than those included in the Articulated Programs may also transfer to UMUC. If the student is applying to a parallel program, UMUC shall accept up to 70 transfer credits as a block and that will also satisfy UMUC’s General Education Requirements. A student with an Associate of Applied Science (AAS) degree may transfer up to 60 credits to UMUC, if the student is applying to a parallel program. III. Transfer of [CC] Credits to UMUC. A [CC] student who has not earned an associate’s degree may transfer up to 60 credits in accordance with UMUC policy and procedures. An [CC] student must meet UMUC’s admission criteria and other applicable requirements for the transfer of credits at the time the student applies for admission to UMUC. IV. Transfer of UMUC Credits to [CC]. An [CC] student enrolled through the Dual Admission Program without a degree from [CC] may transfer UMUC credits back to [CC] in accordance with [CC]’s academic polices and procedures to complete a degree at [CC]. The parties will direct students who wish to apply UMUC credits toward obtaining a [CC] degree to consult an [CC] advisor. V. Applicability. The status afforded to students as contemplated in this Agreement applies only to the Articulated Programs, courses in the Articulated Programs, transfer of credits and credentials, and credential requirements in effect as of the Effective Date (as defined in Section VIII). The Dual Admission Program and use of the dual application are not limited to Articulated Programs. UMUC and [CC] agree that students enrolled in the Dual Admission Program are subject to the respective laws, regulations, practices and policies in effect at the institution the student is attending. VI. Promotion/Publicity. a. During the term of this Agreement, [CC] and UMUC shall develop and agree upon a mutually acceptable marketing and student recruitment plan to promote the [CC]-UMUC alliance and inform students of the opportunities available at both institutions under this Agreement. [CC] will provide to UMUC its student directory information for promotion of the alliance. b. Any and all marketing, promotional, or other materials developed by one party to publicize this Agreement must be reviewed and approved in writing by the other party prior to use of any such materials. Neither party shall use the name or marks of the other party in connection with any product, service, promotion, news release or other publicity, without the prior written consent of the party whose name or marks is under consideration. VII. Changes in Programs. a. Notwithstanding anything in this Agreement to the contrary, UMUC and [CC] retain the right and the authority to make changes in their respective courses, programs, and credential requirements. The parties shall give each other reasonable notice of changes in their respective courses, programs, and/or credential requirements that may materially affect a student’s status, acceptance of degrees, or the transfer of credit as contemplated in this Agreement. A student who is already enrolled in the Dual Admission Program at the time of such changes will have the option to choose whether to follow the existing or new requirements. b. The parties shall meet, at least once a year, to review their respective courses, programs, and credential requirements to determine whether this Agreement should be amended to reflect the courses, programs, and credential requirements then in effect at each institution. VIII. Term and Termination. a. The term of this Agreement is one year commencing as of [date] (the “Effective Date”) and ending on [date]. The term will extend automatically for successive one-year periods. 2 b. Either party may terminate this Agreement by providing 90 days prior written notice to the other party. c. Provided neither UMUC’s nor [CC]’s programs, courses, or credential requirements have changed such that articulation or the transfer of credit is no longer academically appropriate, UMUC shall accept the transfer of [CC] credits and afford the students the status on the terms and conditions of this Agreement for those students who have enrolled in UMUC and remained continuously enrolled at or before termination of this Agreement. Continuous enrollment means enrollment in at least one course within a two-year period (i.e. six semesters including summer). IX. General Provisions. a. This Agreement is subject to applicable polices and procedures promulgated by the Maryland Higher Education Commission regarding the transfer of credits. b. This Agreement integrates the entire agreement of the parties and supersedes any and all prior and/or contemporaneous agreements between the parties, written or oral, with respect to the subject matter of this Agreement. This Agreement may be modified only by a writing signed by both parties. d. The laws of the State of Maryland govern interpretation of this Agreement. e. Neither party may assign this Agreement, its interest herein, or its rights or obligations hereunder without the prior written consent of the other. f. Nothing in this Agreement is intended to constitute a partnership or joint venture between the parties. Allen, DPA Acting President (printed) 4 EXHIBIT 1 DUAL ADMISSIONS PROCEDURES I. Admissions A student must apply for dual admission prior to completing his/her lower division coursework at [CC]. UMUC and [CC] shall develop and use a joint application form (“Dual Application”). A student must complete and submit the Dual Application to [CC]. [CC] shall forward the application to the Office of Admissions at UMUC. UMUC shall waive the application fee for [CC] students applying to the Dual Admission Program. Both UMUC and [CC] shall identify students enrolled in the Dual Admission Program in their respective student databases. II. Registration A student must register through the institution offering the course and pay the appropriate tuition and fees to the institution where registered. The UMUC Undergraduate Catalog and Schedule of Classes will be available at [CC]. III. Residency for Tuition Purposes Residency requirements for each institution shall apply to courses taken at that institution. Determination of residency will be made at the time of admission. Verification of residency is the responsibility of each institution. IV. Advising General advising for degrees available through the Dual Admission Program will be provided by [CC] academic advisors while a student is at [CC] and by UMUC while a student is at UMUC. V. Disabled Student Services If a student submits in writing an accommodation for a disability, [CC] will forward a copy of the request to UMUC. VI. Financial Aid While a student is at [CC], [CC] will issue the student’s financial aid. When the student plans to register for his/her first course at UMUC, the student must reapply for financial aid through UMUC. From then on, the student’s aid will be issued from UMUC only, even if the student takes more courses at [CC]. In such a case, the student must pay tuition costs at [CC]. However, the amount of financial aid disbursed to the student at UMUC will be based on the student’s enrollment at both schools if the student has completed a financial aid consortium agreement between [CC] and UMUC. If a student is taking courses concurrently at [CC] and UMUC, the student should be directed to contact the appropriate financial aid office to complete the consortium agreement. VII. Veteran’s Benefits The student can use his/her veteran’s benefits at either [CC] or UMUC. While the student is enrolled only at [CC], [CC] will process the student’s veterans benefits. When the student plans to register for his/her first course at UMUC, the student must complete a Request for Change of Program or Place of Training and a UMUC Veterans Certification Form for benefits through UMUC.
