ORDINANCE 2010-13
AMENDING CHAPTER 71 OF
THE CODE THE TOWNSHIP OF MEDFORD
ENTITLED “FEES AND LICENSES”
TO SET RATES FOR
WATER AND SEWER SERVICES
WHEREAS, Medford Township, pursuant to N.J.S.A. 40:62-106, established the
Medford Township Sewer and Water Division in the Department of Public Works and
codified the same in Chapter 121 of The Code of the Township of Medford, entitled “Sewers
and Water”; and
WHEREAS, Section 121-5 of that Chapter creates general billing procedures and
permits the Township to establish fees for such services; and
WHEREAS, despite continual efforts by the Sewer and Water Division to control
costs associated with providing water and sewer, the increased costs of purchasing water
from outside sources and increased regulations imposed regarding proper disposal of sanitary
sewer waste continue to rise; and
WHEREAS, such costs must be appropriately levied on the users of said systems
progressively so that greater consumers of water and creators of waste bear the proportionate
responsibility for such use.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Township
Council of the Township of Medford, County of Burlington, State of New Jersey as follows
with rates becoming effective date of July 1, 2010:
Section One: §71-10 entitled Fees under Chapter 121, Sewers and Water
A. Quarter-annual sewer service rates.
(1) Residential use. The basic quarterly service charge for sewer service shall be
$141.48 per unit.

(a) If the nonresidential use is metered for water, the basic annual service
charge for sewer service shall be at the rate of $6.72 per 1,000 gallons of
water used, with a minimum charge of $141.48 per quarter per unit.
(b) If the nonresidential use is not metered for water, the basic annual service
charge for sewer service shall be calculated on the basis of $141.48 per
quarter per unit, with the following uses considered to constitute the following
number of units and billed accordingly:

B. Water Rates
(1) Metered water service rates to all residential and nonresidential users shall be as
follows:
(a) For the first 5,000 gallons or less of water used each quarter, the minimum
charge per quarter shall be:

(c) Metered irrigation service rates shall be charged for the first 5,000 gallons
or less, the minimum charge per quarter as set forth in Subsection B(1)(a)
above, and for additional water consumption as follows:

ARTICLE II. REPEALER, SEVERABILITY AND EFFECTIVE DATE.
A. Repealer. Any and all Ordinances inconsistent with the terms of this Ordinance are
hereby repealed to the extent of any such inconsistencies.
B. Severability. In the event that any clause, section, paragraph or sentence of this
Ordinance is deemed to be invalid or unenforceable for any reason, then the
Township Council hereby declares its intent that the balance of the Ordinance not
affected by said invalidity shall remain in full force and effect to the extent that it
allows the Township to meet the goals of the Ordinance.
C. Effective Date. This Ordinance shall take effect upon proper passage in accordance
with the law.
