Public Sector Industrial Relations Fundamentals
—Forums 2003—
This forum has been designed to provide human resource practitioners and line
managers with an introduction to the industrial relations system and framework. The
forum will be held in the Australia/Asia Water Centre, (Level 4, 77 Grenfell Street). The
forum is designed to be interactive, covering key concept areas and will discuss recent
cases and workplace examples. The forum will be led by experienced public sector
industrial relations practitioners, and a nominal fee will apply.

Will explore the employment types and the nature and characteristics of public sector

Employment Legislation
(a) Employment Acts
This session will give an overview of the employment legislation relevant to public
sector employment, with emphasis on the types of employment facilitated by the
Public Sector Management Act.
The role and powers of the Commissioner for Public Employment and Chief
Executives will also be discussed, along with reference to Determinations and
Directions issued by the OCPE.
(b) Federal and State Industrial Acts
The Industrial and Employee Relations Act and the Workplace Relations Act will be
examined and their relevance to public sector employment explained.
This session will also discuss the role of the industrial courts and commissions, and
explain what powers they have. Conciliation, arbitration and enterprise bargaining
will also be explored.
Awards and Agreements
The different types of awards and agreements, and how they operate will be canvassed.
Employee Relations in Practice
This session will review the concepts, and provide a forum to discuss recent topical
cases and current issues.

APPEAL RIGHTS
Public Sector Management Act vacancies to be filled on an ongoing basis are subject to appeal pursuant to
Section 43 of the Act, unless shown otherwise.
With effect from 17/07/95 appeal rights exist for all ongoing positions at or below Executive Level 1 ie for
positions with a salary or maximum salary limit less than $75,716 pa.
No appeal rights exist for vacancies designated contract (including casual, temporary and longer term
contracts).
Appeal rights are only available to all employees of administrative units under the Public Sector Management Act
with the exception of those employees employed on temporary, casual or longer term contracts who have 12 months
or less continuous employment within the Public Service. Appeal rights are also available to:
 officers appointed under the Parliament (Joint Services) Act, 1985, including officers of either House of
Parliament or a person under the separate control of the President of the Legislative Council or the Speaker of
the House of Assembly;
 employees of the MFP Development Corporation to whom such rights have been extended by a proclamation of
the Governor under Section 71 of the Public Sector Management Act and who retain such rights.
