LOCAL CIVIL REGISTRY SERVICES Registration of Birth and Marriage Certificates ABOUT THE SERVICE The Local Civil Registry Office of Lapuyan, Zamboanga del Sur, became a mandatory and separate office as mandated by R.A. 7160, otherwise known as the Local Government Code of 1991, and existed to functioned under R.A. 3753, the Civil Registration Law. There are three (3) major vital and registrable events affecting the status of a person, namely: birth, death and marriage and the registration of the same were guided by the established laws addressing hereto. The LGU have came up for a free civil registration of these three (3) major events, provided that the said vital events were registered within the reglamentary period prescribed, i.e., thirty (30) days after the occurrence in case of birth, death and marriages solemnized under special provisions/laws and fifteen (15) days after occurrence in case of a marriage solemnized by virtue of a marriage license issued. Civil Registration is classified into two (2) major statuses – timely and delayed registration and the place occurrence of any of this vital event is the place of registration. Meaning, the place of registration of every birth, death and marriage could only be done where it happened. REQUIREMENTS For timely registration of birth: Attendant at Birth, Parents or any person having personal knowledge of the said birth serving as informant of the same. Marriage Certificate of the parents of the child to be registered (if any). For the timely registration of marriage: Certificate of Marriage and authority of the solemnizing officer. (The NSO-OCRG has required a black colored ink and carbon paper in accomplishing all the prescribed forms of civil registration.) The Municipal Health Officer shall examine and sign the Certificate of Death and direct the registration of the same before the Office of the Local Civil Registrar within the reglamentary period of 30 days. In the absence of the Municipal Health Officer, a local official designated to sign the certification of death shall sign the document for burial purposes only. Present the Barangay Certification duly signed by the Barangay Captain where the particular death occurred. The staff-in-charge prepares the death certificate per data supplied by the informant. If the death occurred in the hospital, informant must secure the death certificate from that hospital duly signed by the attending physician. 2. Examination of Document The staff-in-charge examines the documents the document presented whether it is timely or delayed and entries are properly filled up. 3. Payment of Fees Client is advised to pay the corresponding fees to the Municipal Treasurer’s Office (MTO) and must secure the official receipt which shall be attached to the death certificate. 4. Administrative Order No. 1 series of 1993 – The Implementing Rules and Regulations of Act 3753 and Other Laws on Civil Registration have provided among others the person and entity authorized to secure certified copy of civil registry documents, to wit: The concerned person himself, or any person authorized by him; His spouse, parents, guardian or institution legally in-charge of him, if he is a minor; The court or other public offices authorized by law; and The nearest kin, in case of the person’s death. Aide III (detailed) LOCAL CIVIL REGISTRY SERVICES Delayed Registration of Civil Registry Records ABOUT THE SERVICE Civil Registration of Vital Events affecting status of a person is classified into two (2) major statuses, namely: TIMELY and DELAYED REGISTRATION. Act 3753 provides that all vital events, i.e. birth, death and marriages shall be reported and registered before the Office of the Local Civil Registrar concerned within thirty (30) days from the date of its occurrence and the lapse of the same shall be considered delayed registration. The process defers to that of timely registration where processing and releasing can be done while the clients wait. For marriages that occurred before the approval of the New Family Code of the Philippines on August 3, 1988, the same shall be first reconstructed after the requirements supporting the registration of the said marriage are being presented. A Marriage Reconstruction Fee of Ph p 150.00 shall be collected therefrom. There are instances that the NSO cannot issue copy/copies to the interested party because there are no records available in their archives, or the current document is still with the NSO Provincial Office being processed. A certification on the negative result of the particular document being requested will be issued by NSO-OCRG when record/s requested is/are not available in their archives. To facilitate the issuance of requested documents, the concerned Provincial Statistics Officer (PSO) or Local Civil Registrar is required to submit or indorse the needed document on a piecemeal basis to the NSO. LOCAL CIVIL REGISTRY SERVICES Request for an Annotated Civil Registry Records by virtue of Court Orders/Decrees ABOUT THE SERVICE Court Orders/Decrees concerning the status of a person, like any other civil registry documents, shall be registered in the Civil Registrar’s Office where the court is functioning, within 10 days after such order/decree became final. In the case of the Municipality of Lapuyan where no court is functioning, the Office of the Local Civil Registrar will only receive and enters into archives the complete set of documents previously registered in the concerned LCR Office where the said court is functioning. Aide III (detailed) LOCAL CIVIL REGISTRY SERVICES Filing for Petition for Correction of Clerical Error (CCE) and Petition for Change of First Name (CFN) in the Certificate of Live Birth ABOUT THE SERVICE REPUBLIC ACT No. 9048 authorizes every City/Municipal Civil Registrar or the Consul General to correct a Clerical or Typographical Error in an Entry and/or Change of First Name or Nickname in the Civil Register without need of a Judicial Order. This Act provides the City/Municipal Civil Registrar or the Consul General a quasi-judicial power to act on petitions for corrections or change of entry in the civil register. It is an administrative remedy in nature and the transfer of particular judicial process or correcting clerical errors and changing of an entry in the civil register from the court to the Local Civil Registrars. The application for a Marriage License is a sworn declaration of interested parties, preferably Male and Female, who wish to enter into a permanent union, before the Local Civil Registrar of either or both of the contracting party resides. Upon issuance, the Marriage License is valid for 120 days in any part of the country. The lapse of this period, the Marriage License is deemed automatically expired and cancelled when the contracting parties have not make use of it. LOCAL CIVIL REGISTRY SERVICES Registration of Foundling/Abandoned Child/Children ABOUT THE SERVICE A FOUNDLING is an abandoned or deserted infant or child found with parents, guardians or relatives being unknown, or a child committed in an orphanage or charitable or similar institution with unknown facts of birth and parentage. Prescribed Period and Place of Registration The Municipality of Lapuyan Citizens Charter– A guidebook on Municipal Government Services MCR Office The finder/charitable institution within thirty (30) days shall make registration of the foundling in the Office of the Civil Registrar of the city/municipality where the child was found commencing from the date of finding/commitment of the child. Any report made beyond the reglementary period of 30 days shall be considered late, and the concerned party-registrant shall be required to state in a sworn statement the circumstances that caused the late reporting to the civil registrar. Person/s Responsible to Report the Event Immediately after finding a foundling, the finder shall report the case to the barangay captain of the place where the foundling was found, or to the police headquarters, whichever is nearer or convenient to the finder. When the report is duly noted, either by the barangay captain or by the police authority, the finder shall commit the child to the care of the Department of Social Welfare and Development or to a duly licensed orphanage or charitable or similar institution. Upon commitment, the finder shall give to the charitable institution his copy of the Certificate of Foundling, if he had registered the foundling. In case the finder is awarded the custody of the foundling by the proper authority, he shall give a name for the child and shall report the same to the civil registrar of the city/municipality where the child was found. Otherwise, the giving of name to the child and its registration as foundling shall be the responsibility of the Department of Social Welfare and Development or of the orphanage or charitable or similar institution where the child was committed.
