Your key to information on your Legal Rights:
We, at the University of Delhi, recognized that women safety is a growing concern across Delhi.
Endlessly we have discussed that it is a deep rooted problem but what we have for you is a
comprehensive solution to tackle this problem. According to a survey reported in The Indian Express
dated 9th July, 2010, almost 80% of women in Delhi fear for their safety and shockingly two out of
three women in Delhi have suffered sexual harassment at least two to five times with only 0.8%
reporting such incidents to the authorities. This data puts a glaring question mark on the
competence and trust in police in safeguarding women’s rights and the role of the governing
agencies in various forms of gender related harassment. What is also under question are societal
perceptions and attitudes towards crime against women which deters the victim to confront the
perpetrators who lurk in the dark and boldly garb as conductors, shopkeepers, auto drivers or even
staff at the workplace.
Delhi in particular has reported an unparalleled spurt in the crime against women in the current year
2014. With an abnormal increase in molestations, rapes, kidnappings and eve- teasing cases per day
the situation seems to be alarming and calls for immediate action. The need of the hour is not more
legislations and laws to decorate the pages of our constitution but to ensure implementation of these
laws. An increase of nearly 250% in rape cases, over 500% in molestation cases, a fivefold increase in
cases of eve teasing, is a clear indication and reflection of the rampant lawlessness and need for
immediate action. The sad part of these shocking statistics is that the numbers of cases that go
unreported is even greater and speak volumes about the lack of confidence of women in institutions
that are expected to ensure safely. A 70% increase in crime against women in 2013 as compared to
2012, has sounded a clarion call for women not to suffer in silence anymore and fight for themselves
instead of letting these cases pass as mere bad memories. Although the police claim to have solved
48.8% of the cases registered under Indian Penal Code in 2013, the real change will be ushered in
only if each one of us recognizes the value of self-empowerment.
National Crime Records Bureau reported in 2011 a total of 2,28,650 incidents of crime against
women in India both under IPC (Indian Penal Code) and SLL (Special and Local Laws, like Immoral
Traffic Prevention Act, 1956 and Dowry Prohibition Act). The Pie Chart below shows Crime against
women percent distribution during 2011.
A random scan of daily newspapers stares at the growing insecurity of women at home, at the
workplace, in public transport or even on roads. Having police vans on streets, in colleges & offices
is neither a possibility nor a solution. So here is your self-defence kit!
Feel Empowered: Know your rights. You have a right to a life free of violence, harassment
and discrimination. Recognise it!!
The aim of compiling the important information contained in this booklet is to empower you to
stand up against any form of behaviour that is unfair, unwanted, unacceptable and unlawful. It
intends to boast up your confidence level by making you aware of your rights and inform you of the
modalities for administering the laws that are framed to guarantee a safe and healthy atmosphere
for women in society. This handbook will help you to understand what you can expect and demand
from society. The phone numbers, email id’s and addresses of concerned police officials, NGO’s,
Shelter Homes and National Commission for Women will come in handy in the hour of need. The
sections under which the offender can be booked for the crime committed will help you to nail the
culprit.

WHAT TO DO IF YOU EXPERIENCE SEXUAL HARASSMENT IN COLLEGE?
If you experience any form of sexual harassment in college there is an Internal Complaint Committee
(ICC) in college. You can make your complaint here and an enquiry will be made by this committee.
This committee has been constituted under The Sexual Harassment of Women at Workplace
(Prevention, Prohibition And Redressal) ACT, 2013
Under this law "sexual harassment" includes any one or more of the following unwelcome
acts or behaviour (whether directly or by implication) namely:-(i) physical contact and advances; or
(ii) a demand or request for sexual favours; or
(iii) making sexually coloured remarks; or
(iv) showing pornography; or
(v) any other unwelcome physical, verbal or non-verbal conduct of sexual nature


Section 294 of the IPC makes it punishable to make obscene acts and play obscene songs in
public place.

Section 354 of the IPC makes it an offence to assault or use criminal force to a woman with
intent to outrage her modesty

Section 509 of the IPC makes it an offence to utter any word, gesture or act intended to
insult the modesty of a woman.

The indecent Representation of Women (Prohibition) Act, 1986 makes it punishable to
represent woman in derogatory way.
Rape :
Are you being forced to have sex without your consent?
Did you give your consent based on false promise?
How can the Police help you?
The police is equipped and trained to keep the emotional sanctity of a rape victim. Social and
psychological support is kept in mind by the police while providing help to rape victims. Police will
investigate and prosecute the guilty.
Are you facing Ragging?
Ragging is defined as:
Any disorderly conduct by words spoken or written or by an act

That has the effect of treating or handling with rudeness any other student including in
ruddy or indiscipline activities.

Which cause or is likely to cause annoyance, hardship or psychological harm or to raise fear
or apprehension in a fresher or a junior student ;

Asking the students to do any act or perform something which student will not do in the
ordinary course.
These are the duties of the educational institutions to safeguard your rights as a women as per the
Supreme Court Judgment

The prospectus issued at the time of admission must mention clearly that ragging is banned
in the institution and that anyone who indulges in ragging is likely to be punished.

The punishment may be expulsion from such institution or class for a limited period or fine
or public apology, withholding of scholarship, debarring from representation in events,
withholding results, suspension or expulsion from hostel mess etc.

The application form shall have printed undertaking to be filled up and signed by the student
and the parents/guardians.

Students who are already studying in the institution and their parents/guardians shall also
give such an undertaking before the commencement of the next education year/session.

The Management, the Principal and the Teaching Staff should interact with freshers and take
them in confidence by apprising them of their rights as well as obligations to fight against
ragging and to generate confidence in their mind that they should report any incident of
ragging.

The student must be made aware of the dehumanizing effects of ragging.

Migration Certificate issued by the institutions should have an entry whether the student
had participated in ragging and the punishment given.

If the individual committing or abetting ragging is not identified, then collective punishment
could be resorted to act as deterrent punishment and to ensure collective pressure on the
potential raggers.

The failure to prevent ragging shall be construed as an act of negligence in maintaining
discipline in the institutions on the part of the management, the principal and the hostel
wardens/superintendents.

If the institutions fail to curb ragging, UGC/Funding Agency may consider stoppage of
financial assistance to such an institution.
Are you experiencing Domestic Violence?
If you’re being abused mentally, verbally, physically, sexually or financially by any male member at
home or with whom you live, you are a victim of Domestic Violence.
Remember:
You can take recourse in Protection of Women from Domestic Violence Act, 2005, PWDVA or 498-A
of IPC if violence is inflicted by husband or his relatives and it is to an extend to cause you grave
mental and physically injury, the law can help you fight for your rights.
Under the Protection of Women from Domestic Violence Act, 2005, you can file a case in the Court
directly or take help of Delhi Legal Service Authority (DLSA) or any other legal practitioner and get:

Protection Order, where a Protection Officer is assigned to you under section 18 D.V. Act.

Residence Order, where no-one can throw you out of your home under section 19 D.V. Act.

Monetary Relief, where you get maintenance and compensation for expenses incurred due
to violence, including medical under section 20 D.V. Act.

Temporary custody of your children under section 21 D. V. Act.
The Police can help you:

The complaint under the PWDVA can be lodged directly with the Police, who have to record
a Direct Information Report (DIR).

The DIR has to be forwarded to a Protection Officer and the Local Magistrate

Police has to assist you in making sure all court orders are enforced.

The Police have to continue all investigations of cognizable offences under the Indian Penal
Code such as Rape, Dowry, 498A, hurt, etc.
Not interested in long term criminal procedure? Don’t want to file an FIR? : Go in for Civil Remedy
Sometimes, women due to personal reasons may not like to go for criminal remedy i.e., registration
of FIR or filing the Criminal Complaint. In the said circumstances, there are certain Civil Remedies
available in the Case of Domestic Violence:

You can file suit under Order VII Rule I of the Code of Civil Procedure in the Family Court or
where there is no Family Court in a Civil Court against the husband or relatives who are
harassing you to seek any of the following orders :

That the spouse or/and his relatives are restrained from ousting you and your
children from the matrimonial house.

That exclusive possession of the matrimonial house should be granted to you and to
your children.

That the spouse or/and his relatives may be restrained from entering the premises
or any part of it, which is in your occupation.

That your personal property be restored to you.

That spouse or/and his relatives be restrained from alienating/transferring the
matrimonial house by way of sale, rent or inducting any third party in to the
matrimonial house.

That the spouse or/and his relatives be restrained from further abusing/molesting
you and your children.

In case of a Hindu woman, she can seek for separate residence under Section 18 of
the Hindu Adoption and Maintenance Act.
Are you being asked Dowry?
Giving or taking dowry is punishable under Law. If you are being harassed by your husband or his
family for money, property, gifts or any goods from you or your family during or after your marriage
as a consideration for marriage, if you are being ridiculed for insufficient dowry, you are a victim of
Dowry harassment.
Remember:
You can take recourse in prevention of Dowry Prohibition of Dowry Prohibition Act 1961 by writing a
complaint to the Police authority. The Law can help you fight for your rights.

To give or to demand; Dowry is dealt with under sections of Dowry Prohibition Act 1961.
The Police can help you:
 File a First Information Report (FIR) against the offenders.
Cruelty by husband & in-laws
Are you being subjected to mental and physical violence which is causing or is likely to cause you
grave (serious) mental and physical injury ? If so, you are a victim of Cruelty.
What can you do ?
You can complaint to your Police Station, District Crime Against Women Cell or at Special Police Unit
for Women & Children (SPUW&C), Nanakpura. In case of immediate help call ‘100’ or Women
Helpline ‘1091’ and say no to abuse. You can take protection under PWDVA and 498-A IPC. Section
498-A IPC makes it punishable for husband and in-laws for harassing woman for dowry or for
inflicting cruelty on her. At Women Cell you will negotiate a violence free life, to punish the abusers.
The Law can help you to fight for your rights.
You can get a case registered under Section 498-A of IPC. You and your family can also take recourse
in counselling and mediation services free of cost at SPUWC.
How can the Police help you ?
On receipt of your complaint, you and your spouse, will be offered counselling so as to help you
negotiate violence free life. If that fails, you can take help of mediators at SPUWC to have amicable
separation. Failing these, police will register a criminal case against the abusers.
What is your right to property?
The Inheritance Law now gives equality to women. The Hindu Succession (Amendment)
Act, 2005 gives equal rights to daughters to the family property in a Hindu family.
