Responses to Written Questions Q1) A1) Q2) A2) Q3) A3) Q4) A4) Q5) A5) Page 21 of the RFP, Paragraph P (Pricing), Item 4., states: All prices quoted shall be in United States dollars and "whole cent," no cent fractions shall be used. There are no exceptions. Pricing requested in the bid is often, “per impression,” “per image,” and “per sheet” and is for hundreds to thousands of impressions, images or sheets. One half cent difference per unit is significant. Does this require a vendor not to charge one half cent per unit or that invoicing must be done in whole cents? All prices quoted, including those for “per impression,” “per image,” and “per sheet,” should be quoted in whole cents, not fractions of cents. If a vendor has two (2) other divisions within California but not within the County of Alameda, can the vendor use these other divisions to perform services under this contract? It is the intent of this bid to contract with Small Local Emerging Businesses who will use products, labor and materials available in Alameda County to meet the contract deliverables. If a bidder has three (3) other divisions located out of state, can a vendor use these out of state divisions to perform services under this bid? See response to Q2 above. Will pending orders with fulfillment scheduled after the end of the current contract be honored under the current [previously issued Blanket Purchase Order (BPO)]? All orders pending prior to the expiration of the contract (August 31, 2010) will be honored. Can two or more SLEB vendors “partner” or submit a bid as a “joint venture”? If so, is there special form that needs to be submitted with the bid? Per page 19, Section K (SUBMITTAL OF BIDS), item 9: Only one bid response will be accepted from any one person, partnership, corporation, or other entity; however, several alternatives may be included in one response. For purposes of this requirement, “partnership” shall mean, and is limited to, a legal partnership formed under one or more of the provisions of the California or other state’s Corporations Code or an equivalent statute. (b) In connection with any discount offered, time will be computed from date of complete, satisfactory delivery of the supplies, equipment or services specified in the RFQ, or from date correct invoices are received by the County at the billing address specified, if the latter date is later than the date of delivery. Payment is deemed to be made, for the purpose of earning the discount, on the date of mailing the County warrant check. 9. California Government Code Section 4552: In submitting a bid to a public purchasing body, the bidder offers and agrees that if the bid is accepted, it will assign to the purchasing body all rights, title, and interest in and to all causes of action it may have under Section 4 of the Clayton Act (15 U.S.C.
