XYZ Caravan Park Dwelling Sale Agreement THIS AGREEMENT is made this BETWEEN: day of 20 (“the vendor”) of the one part; And (“the purchaser”) of the other part. WHEREAS: A. The vendors are the owners of a RMD (registrable moveable dwelling - caravan and solid annexe) or UMD (Unregistrable moveable dwelling –cabin/mobile home ) (“the dwelling”)located on site number (refer Schedule 1 of this agreement) at XYZ Caravan Park B. The purchaser wishes to purchase the dwelling from the vendor. C. The parties hereto have agreed for the sale of the dwelling by the vendor to the purchaser upon the terms and conditions hereinafter appearing. NOW THIS AGREEMENT WITNESSES in consideration of these presents the parties hereto do mutually agree and covenant as follows:1. That the vendor hereby agrees to sell to the purchaser the dwelling for the price as detailed in Schedule 1 of this agreement (“the purchase price”). 2. The purchaser shall pay the purchase price by cheque payable to the vendor upon the signing hereof, to XYZ Caravan Park. 3. Upon payment of the purchase price in full, the vendor shall deliver up to the purchaser possession of the dwelling together with the following chattels located therein as detailed in Schedule 1 of this agreement. 4. This agreement is conditional upon the owners of XYZ Caravan Park (or their agents), approving the purchase and issuing the purchaser a Long Term Holiday Site / Annual Site Agreement. 5. The vendor shall deliver the dwelling to the purchaser on the settlement date in the same state of repair (fair wear and tear accepted) as at the date hereof and in proper working order unless otherwise agreed. 6. The vendor agrees to pay $500 or 5% of the sale price (whichever is greater), which includes chattels described in Schedule 1, to XYZ Caravan Park at settlement. 7. The vendor and purchaser acknowledge that the land on which the dwelling is situated is not included in any sale. 8. The vendor and purchaser acknowledge that XYZ Caravan Park is not a party to the contract of sale and indemnify XYZ Caravan Park from any legal proceedings arising from the contract of sale. The purchaser acknowledges that he/she is purchasing only a caravan and annexe / cabin / mobile home, together with any agreed chattels as detailed in Schedule 1, for the purchase price and agrees and accepts that none of the purchase money is for payment of the site which remains the property of XYZ Caravan Park The purchaser acknowledges that the current Long Term Holiday Site / Annual Site Schedule and Agreement (including tariffs) and Park Rules has been given to them and they have read and understood the information contained therein and will comply with the Park Rules. They expressly acknowledge that their occupancy rights are season to season only and entirely at the discretion of the park operator.
