The tenderers shall submit requisite documentary proof in support of their eligibility as per
the criteria laid down in the Notice Inviting Tender.
The conditions and tender documents (excluding standard form 2005 edition) can also be had from
the office of the Executive Engineer, PWD Division – M-212, Delhi, on all working days between hours 11.00
A.M. to 4.00 P.M.
As per the construction works welfare cess Act, 1996 the cess @ 1% of the total cost of
work done shall be recovered from R/A and final bills. The amount so deducted shall be remitted to
secretary “Delhi Building and other construction workers Welfare Board” Room No. 51, C- Block , 5
Sham Nath, Marg , Delhi-110054.

NOTICE INVITING TENDER
Percentage Rate Tenders are invited on the behalf of the President of India from approved
and eligible Contractor of CPWD for the work of :- Providing and fixing wire fencing & stone
pitching at rainy well no. 7 & 8 ITO Vikas Marg (SH: Providing computer services in the O/o Principal
Secretary, PWD, Chief Engineer M-2 Superintending Engineer M-21 & PWD CRM Division M-212).
The work is estimated to cost Rs 3,33,312/- This estimate, however, is given merely as
a rough guide.
2.
Agreement shall be drawn with the successful Tenderer on prescribed Form No.CPWD-7
with up to date correction slips which is available as a Govt. of India Publication 2005
edition, Tenderer shall quote his rates as per various terms and conditions of the said form
which forms part of the agreement.

Time allowed for carrying out the work will be …6……Month from the 12th day after the
date of written orders to commence the work or from the first day of handing over of the site,
whichever is later.

Receipt of applications for issue of tender forms will be stopped by 1600 hours on 14-022008
Tender documents consisting of plans, specifications, the schedule of quantities of the various
classes of work to be done and the set of terms and conditions of contract to be complied with
by the contractor whose tender may be accepted and other necessary documents can be seen
in the office of the Executive Engineer, PWD Division- M-212, between hours 11.00 A.M. &
4.00P.M. from ……….*. to…………*, everyday except on Sunday and Public Holidays.
Tender documents (excluding standard form), will be issued from his office, during the hours
specified above, on payment of the following :i)
Rs. 500/- in cash as cost of tender
AND
ii)
Earnest money of Rs. _6666/-_ in shape of Receipt of Treasury Challan / Deposit
at Receipt of a Scheduled Bank/ Fixed Deposit Receipt of Scheduled Bank/

PWD Division-M-212, Delhi.

Tenders which should always be placed in sealed envelope, with the name of work and due
date written on the envelopes, will be received by the Executive Engineer, PWD Division-M212, Delhi up to 3.00 P.M. on 18-02-2008 and will be opened by him or his authorized
representative in his office on same day at 3.30 P.M.

The details of tenders may be seen on web site No. www.delhigovt.nic.in. of Govt. of
NCT of Delhi for information only. The contractors will not be permitted to submit
downloaded tenders on the basis of documents published on the web.

8.Copies of other drawings and documents pertaining to the work will be open for Inspection
by the tenderers at the office of the above-mentioned officer at Patpar Ganj Delhi-110092.
Tenderers are advised to inspect and examine the site and its surrounding and satisfy
themselves before submitting their tenders as to the nature of the ground and sub-soil (so far
as is practicable) the form and nature of the site, the means of access to the site, the
accommodation they may require and in general shall themselves obtain all necessary
information as to risks, contingencies and other circumstances which may influence or affect
their tender. A Tenderer shall be deemed to have full knowledge of the site whether he
inspects it or not and no extra charges consequent on any misunderstanding or otherwise shall
be allowed. The tenderers shall be responsible for arranging and maintaining at his own cost
all materials, tools and plants, water, electricity, access, facilities for workers and all other
services required for executing the work unless otherwise specifically provided for in the
contract documents. Submission of a tender by a tenderers implies that he has read this notice
and all other contract documents and has made himself aware of the scope and specifications
of the work to be done and of conditions and rates at which stores, tools and plants etc. will
be issued to him by the Govt. and local conditions and other factors having a bearing on the
execution of the work.
9.The competent authority on behalf of President of India does not bind himself to accept the
lowest or any other tender, and reserves to himself the authority to reject any or all of the
tenders received without the assignment of a reason. All tenders, in which any of the
prescribed conditions is not fulfilled or any condition including that of conditional rebate is
put forth by the tenderers shall be summarily rejected.
10.Canvassing whether directly or indirectly, in connection with tenders is strictly prohibited
and tenders submitted by the contractors who resort to canvassing will be liable to rejection.
11.The competent authority on behalf of President of India reserves to himself the right of
accepting the whole or any part of the tender and the tenderers shall be bound to perform the
same at the rate quoted.
12.No Engineer of Gazetted rank or other Gazetted officer employed in Engineer or
Administrative duties in an Engineering Department of Govt. of India is allowed to work as
an contractor, for a period of two years after his retirement from Govt. service, without the
previous permission of the Govt. of India in writing. This contract is liable to be cancelled if
either the contractor or any of his employees is found any time to be such a person who had
not obtained the permission of the Govt. of India as aforesaid before submission of the tender
or engagement in the contractor’s service.
13.The tender for the work shall remain open for acceptance for a period of 60 (SIXTY) days
from the date of opening of tenders. If any tenderers withdraws his tender before the said
period or makes any modification in terms and conditions of the tender which are not
acceptable to the department, then the Govt. shall, without prejudice to any other right or
remedy, be liable to forfeit 50% of the said earnest money as aforesaid.

14.This notice inviting tender shall form a part of the contract document. The successful
Tenderer/ Contractor, on acceptance of his tender by the Accepting Authority, shall, within
15 days from the stipulated date of start of the work, sign the contract consisting of :a.The notice inviting tender, all the documents including additional conditions, specifications
and drawings, if any, forming the tender as issued at the time of invitation of tender and
acceptance thereof together with any correspondence leading to thereto.

TENDER
I/ We have read and examined the notice inviting tender, schedule A,B,C,D,E,&F
Specifications applicable, Drawings & Designs, General Rules and Directions, conditions of
contract, clauses of contract, special conditions, schedule of rate and other documents and rules
referred to in the conditions of the contract and all other contents in the tender document for the
work.
I/We hereby tender for the execution of the work specified by the Executive Engineer , PWD
Division-M-212, Delhi, on behalf of the President of India within the time specified in Schedule F
viz. schedule of quantities and in all respects with the specifications, designs, drawings and
instructions in writing referred to in Rule-1 of General Rules and Directions and in Clause –11 of the
conditions of contract and with such materials as are provided for, by, and in respects in accordance
with, such conditions so far as applicable.
I/We agree to keep the tender open for 60 (sixty) days from the due date of submission
thereof and not make any modifications in its terms and conditions.
A sum of Rs. 6666/- is hereby forwarded in Receipt Treasury Challan/ Deposit at call
Receipt of a Scheduled Bank as Earnest money. If I/we fail to commence the work specified I/we
agree that the said President of India or his successors in office shall without prejudice to any other
right or remedy, be liberty to forfeit the said earnest money absolutely otherwise the said earnest

money shall be retained by him towards security deposit to execute all the works referred to in the
tender documents upon the terms and conditions contained or referred to therein and to carry out
such derivations as may be ordered, up to maximum of the percentage mentioned in Schedule ‘F’
and those in excess of that limit at the rates to be determined in accordance with the provision
contained in clause 12.2 and 12.3 of the tender form.
I/we hereby declare that I/we shall treat the tender documents drawings and other records
connected with the work as secret/ confidential documents and shall not communicate information/
derived there from to any person other than a person to whom I/we am/ are authorized to
communicate the same or use the information in any manner prejudicial to the safety of the state.

an amount equal to the amount of the earnest money mentioned in the form of invitation of tender

GENERAL CONDITIONS OF THE CONTRACT
1.
The work in general shall be executed as per the description of the item, specification
attached, CPWD specifications 1996 Vol. I to VI with up-to-date correction slips and Revised
CPWD specifications 2002 for mortar, cement concrete and RCC with upto the date
correction slip and MORTH specifications for Road and Bridge works (4th Revision-2001).
2.
In case of any variation between different applicable specifications, the following order of
precedence will be followed:
(i).
Nomenclature of item.
(ii).
Particular specifications attached with the tender documents.
(iii).
General specifications attached with the tender documents.
(iv).
MORTH specifications for Road and Bridge works (4th Revision 2001).
(v).
CPWD specifications 1996 Vol. I to VI with up-to-date correction slips and Revised
CPWD specifications 2002 for mortar, cement concrete and RCC.
(vi).
Relevant ISI code IRC code and CPWD works manual 2003.
If there are varying or conflicting provisions made in any document forming part of
the contract, the Engineer –in-charge shall be the deciding authority with regards to the
intention / interpretation of the tender and his decision shall be final & binding on the
contractor.
3.
Unless otherwise specified FPS bricks shall be used in all items of brickwork. The
classifications of bricks brought by the contractor shall strictly conform to the CPWD
specification referred above irrespective of the classification shown on the permit (if there is
a permit system) under which the contractor might have obtained the materials. The
contractor shall have no claim as to the quality of bricks on the basis of permits to him by the
supply department.
4.
The contractor shall be required to produce samples of all road and building materials
sufficiently in advance to obtain approval of the Engineer-in-Charge. Subsequently the
material to be used in the actual execution of the work shall strictly conform to the quality of
samples approved. In case of variation, such material shall be liable to rejection.
5.
Material (if any) obtained form Govt. stores or otherwise shall be got checked by the Junior
Engineer in-charge of the works, on receipt of the same at site before use.
6.
All the materials used in the work shall comply with the requirements of Engineer-in-Charge
and shall pass all the tests and analysis required by him as per particular specifications as
applicable or such recognized specifications as acceptable to the Engineer-in-Charge.
7.
The contractor shall be required to provide appliances at site, such a weighing scale,
graduated cylinder standard sieves, thermometer, slump cones, cube moulds etc. in order to
enable the Engineer-in-Charge.
The contractor shall at his cost make all arrangements and shall provide such facilities as
the Engineer-in-Charge may require for collecting, preparing and forwarding the required
number of samples for tests and for analysis at such time and to such places, as directed by
the Engineer-in-Charge. Nothing extra shall be paid for the above and including the cost of
materials to be tested.

The necessary tests shall be conducted in the laboratory of PWD Central Road Research
Institute or IIT Delhi or any other Laboratory approved by the Engineer-in-Charge. The
sample for carrying out all or any of the tests shall be collected by the Engineer-in-Charge or
on the behalf by the officer-in-Charge of the quality control wing of Central Design Office,
CPWD and his authorized subordinate or by the officer-in-charge PWD (DA) lab. and his
authorized subordinate for carrying out the independent quality control tests and the results

will be binding on the contractor. The

The contractor or his authorized representative shall associate in collection, preparation,
forwarding and testing of such samples. In case he or his authorized representative is not
present or does not associate himself, the results of such tests and consequences thereon
shall be binding on the contractor.
11.
The contractor(s) shall make his/ their own arrangements for water required for the work and
nothing extra will be paid for the same. This will be subject to the following condition.
(i). That the water used by the contractor (s) shall be fit for construction purposes to the
satisfaction of the Engineer-in-Charge.
(ii). The Engineer-in-Charge shall make alternative arrangements for supply of water at the
risk and cost of contractor(s) if the arrangements made by the contractor(s) for
procurement of water are in the opinion of the Engineer-in-Charge unsatisfactorily.
12.
Water if available may be supplied to the contractor by the department subject to the
following conditions:-.
(i). The water charges @ 1% shall be recovered on gross amount of the work done.
(ii). The contractor(s) shall make his/their own arrangements of water connection and laying
of pipelines from existing main of source of supply.
The department do not guarantee to maintain uninterrupted supply of water and it will be
incumbent on the contractor(s) to make alternative arrangements for water at his/ their own
cost in the event of any temporary break down in the Govt., water main so that the progress
of his/ their work is not held up for want of water No. of claim damage or refund of water.
13.
The contractor shall get the water tested with regard to its suitability for use in the works and
get written approval from the Engineer-in-Charge before the proceeds with the use of same
for execution of works. Nothing extra shall be paid to the contractors on this account.
14.
Wherever any reference to any Indian Standard Specifications occur in the documents
relating to this contract same shall be inclusive of all amendments issued, there to or
revision thereof, if any, up to date of the tender notice.
15.
Any cement slurry added over base surface or for continuation of concreting for better bond
is considered to have been included in the item (unless otherwise explicitly stated) and
nothing extra shall be payable or extra cement considered in consumption on this account.
16.
The contractor shall make his own arrangement for electricity as per the requirement of
work.

ADDITIONAL CONDITIONS
1.
Before tendering, the tender shall inspect the site of work and shall fully acquaint himself
about the conditions with regard to site, nature of soil, availability of materials, suitable
location for construction of godowns, stores and labour huts, the extent of leads and lifts
involved in the work (over the entire duration of contract) including local conditions, traffic
restrictions, obstructions and other conditions, as required for satisfactory execution of
work. His rates should take into consideration all such factors and contingencies. No
claim whatsoever shall be entertained by the department on this account.
2.
The contractor must study the specifications and conditions carefully before tendering.
3.
Before start of work, the contractor shall submit the programme of execution of work, get
it approved from the Engineer-in-Charge and strictly adhere the same for the timely
completion of the project work.
4.
The contractor shall have to make approaches to the site if so required and keep them in
good condition for transportation of labour and materials as well as inspection of works
by the Engineer-in-Charge. Nothing extra shall be paid to the contractor on this account.
5.
The work of approach road in the entire stretch shall be completed to safe level in one
working season if it lies in the khadir width of river.

The contractor shall at all times, carry out the work on the highway in a manner minimum
interference in the flow of traffic as per direction of the Engineer-in-Charge.
7.
All arrangements for traffic diversion during construction including maintenance of
diversion road shall be considered as incidental to the work and contractor’s
responsibility and nothing shall be payable to him in this respect, however, if any new
diversion road is constructed by the contractor, the same will be paid separately.
8.
The work shall be carried out in such a manner so as not to interfere/ or effect or disturb
other works, being executed by other agencies, if any.
9.
Any damage done by the contractor to any existing work shall be made good by him at
his own cost.
10.
The work shall be carried out in the manner complying in all respects with the
requirements of relevant bye laws of the local bodies under the jurisdiction of which the
work is to be executed and nothing extra shall be paid on this account.
11.
For completing the work in time, the contractor might be required to work in 2 or more
shifts including night shifts and no claims whatsoever shall be entertained on this
account, not with standing the fact that the contractor will have to pay to the labourers
and other staff engaged directly or indirectly on the work according to the provisions of
the labour regulation and the agreement entered upon and / or extra amount for other
reason.
12.
The contractor shall make his own arrangements for obtaining electric connection(s) if
required, and make necessary payments directly to the department concerned. The
department will however, make all necessary recommendations to the authority
concerned in this regard.
13.
The contractor or his authorized representative should have always be available at this
site of work. No work should be done in the absence of such authorized representative.

14.
The structural and other drawings for
the work shall at all times, be
properly correlated before executing any work and no claims whatsoever shall be
entertained in this respect.
15.
The Contractor shall maintain in good condition all work executed till the completion of
entire work allotted to the contractor.
16.
No payment will be made to the contractor for damage caused by rains, or other natural
calamities during the execution of the works and no such claim on this account will be
entertained.
17.
Royalty at the prevalent rates and all others incidental expenditure shall have to be paid
by the contractor on all the boulders, metal, shingle, earth and sand bajri etc. collected
by him for the execution of the work direct to the concerned Revenue Authority of the
State or Central Govt. His rates are deemed to include all such expenditure and nothing
extra shall be paid.
18.
The contractor shall take all necessary measures for the safety of traffic during
construction and provide erect and maintain such barricades, including signs markings,
flags. Lights and flagman as necessary at either end of the excavation/ embankment and
such intermediate points as directed by the Engineer-in-Charge for the procure
identification of construction area, he shall be responsible for all damages and accidents
caused due to negligence on this part.
19.
The contractor shall provide suitable barricading with suitably pointed single row or G.I.
sheets about 3’-0 wide (90cm) nailed or bolted with wooden poles spaced 2 to 3 meter
apart and each pole 1.6 m to 2 m long, 8 cm to 10 cm diameter. The poles will be
embedded in mobile iron pedestal rings suitably framed for giving stable support without
hindering the traffic as per direction of the Engineer-in-Charge. All managements
(including watch and ward) of barricades shall be the full responsibility of the contractor.
The barricades shall be removed only after completion of the work of part of the work.
The contractor’s rates shall include all above items of work and nothing extra shall be
paid to the contactor over and above his quoted rates.
20.
The contractor may have to do dewatering for the construction of new drain or for some
other purposes as per the requirement of the work. This cost will be ancillary to the
excavation work unless otherwise specified in the schedule of work. The contractor’s
rates for excavation shall include the cost of dewatering work and nothing extra shall be
paid to the contactor over and above his quoted rates. How ever payment of excavation
in or under water and/liquid mud or in foul position including pumping out water as
required will be made as per CPWD DSR 2002 item no. 2.24.1 or 2.24.2( + / -)
percentage rates quoted for the entire work, as the case may be.
21.
The temporary warning lamps shall be installed at all barricades during the hours of
darkness and kept lit at all times during these hours.
22.
The malba/ garbage, removed from the site shall be disposed off by the contractor at
MCD authorized dumping ground or at a suitable place as directed by the Engineer-inCharge.
23.
All work and materials brought and left upon the ground by the contractor or by orders for
the purpose of forming part of the works, are to be considered to be the property of the
president of India and the same are not to be remove or taken away by the contractor or
any other person without the special license and consent in writing of the Engineer-inCharge, but the President of India is not to be in any way responsibly for any loss or
damage which may happen to or in respect of any such work or materials either by the
same being lost or damaged by weather or otherwise.

24.
The contactor will be responsible to
provide deep hand pump/ tube well at
site of work to make potable and safe drinking water to labour engaged in execution of
work.
25.
The rates for all items of work, unless clearly specified otherwise, shall include the cost
of all labour, materials, Dewatering and other inputs involved in the execution of the
items.
26.
Unless otherwise provided in the schedule of quantities the rates tendered by the
contractor shall be all- inclusive and shall apply to all heights, depths and lifts.
27.
The materials to be issued to the contractor and the places of delivery shall be as
mentioned elsewhere in the tender documents. If these are delivered at another site, the
difference in cost due to cartage will be adjusted accordingly. The contactor shall have to
cart at his cost the materials to the site of work as soon as these are issued. The
materials will be issued during the working hours and as per rules of the central stores of
CPWD or the store of PWD Delhi Administration from time to time.
28.
The contactor shall construct suitable godown at the site of work for storing the materials
safe against damage due to sun, rain, dampness, fire, theft etc. He shall also employ
necessary watch and ward establishment for the purpose and no extra claim whatsoever
shall be entertained on this account.
29.
The contractor shall bear all incidental charges, storage and safe custody of materials
issued to him by the department.
30.
MS bars and cold twisted bars etc. where stipulated, will be issued in any length in coils
or in straight length as available in the stores. No claim on this account shall be
entertained.
31.
The standard weight referred to as standard table No.4 in paras 5.33 in CPWD
Specifications for works 1991-92 Vol. II to be considered of for conversion of length of
various sizes of reinforcing bars into weights, which are reproduced as under:-

The contractor has to pay the salaries to the staff (Computer Operator) on or before last
day of every month, otherwise he/she has to give Rs. 100 (Rs. One Hundred only) as

a) Issue of steel of diameter above 10mm will be regulated on sectional weight basis,
weight being calculated with the help of above table. However, for bars MS/TMT/ Tor –
steel upto and including 10mm, the following procedure shall be adopted.
b) The average sectional weight for each diameter shall be arrived at from each lot of steel
received at site. The actual weight of steel issued shall be modified to take into account
c) the variations between the actual and the standard coefficients given above and the
contractor’s account will be adjusted by the cost of the modified quantity only. The
decision of the Engineer-in-Charge shall be final for the procedure to be followed for

33.
Cement bags shall be stored in separate godowns with pucca flooring, weather proof
and walls. Each godown shall be provided with a single door with two locks. The key of
one lock shall remain with PWD Junior Engineer-in-Charge of work and the key of the
other lock with the authorized agent of the contactor at the site of work so that the
cement is removed from the godown according to the daily requirements with the
knowledge of both the parties. The provisions para 3.1.2.4 of the CPWD specifications
1991-92 Vol.-II need not be followed in respect of construction of cement godowns for
works whose estimated cost does not exceed Rs. 25,000/-. In such cases, the contractor
shall be permitted to store cement at site inside a covered shelter providing adequate
safeguard against clotting of cement due to action of water and theft. The Engineer-inCharge shall inspect such shelter and satisfy him self that adequate to safeguards as
mentioned above exists.
34.
Contractor may be required to execute this work under foul position. The decision of the
Engineer-in-Charge whether the position is foul or not shall be final and the binding on
the contractor and nothing extra for executing the work in foul position is payable beyond
what is provided in the schedule of quantities.
35.
4% sale tax will be deducted from each bill on the gross bill of contractor as per Delhi
Sale Tax Act-1999 issued vide No.14/22/95-99/LA/367 dt. 15.10.99 issued by Under
Secretary (LA), Delhi.
36.
Demolition: Before any demolition work is commenced and also during the
progress of the work the following precautions are required the to be taken :
i)
All roads and open areas adjacent to the work site shall either be closed or
suitably protected.
ii)
No electric cable or apparatus which is liable to be a source of danger or a cable
or apparatus used by the operator shall remain electrically charged.
iii)
All practical steps shall be taken to prevent danger to persons employed from risk
of fire or explosion or flooding. No floor, roof or other part of the building / road
shall be so overloaded with debris or materials as to render it unsafe

37.
The contractor shall procure 33 grade (conforming to IS 269) or 43 grade (conforming
to IS 8112) ordinary Portland cement as required in the work from reputed
manufactures of cement having a production capacity of one million tones or more,
such ACC, L&T, J.P. Rewa, Vikram Shri Cement, Birla Jute and Cement Corporation
of India etc. i.e agencies approved by Ministry of Industry, Govt of India and holding
license to use ISI certification mark for their product. The tenderers may also submit
a list of names of cement manufactures which they propose to use in the work. The
tender accepting authority reserves right to accept or reject name (S) of cement
manufacturer(s) which the tenderers proposes to use in the work. No change in the
tendered rates will be accepted if the tender accepting authority does not accept the
list of cement manufacturers, given by the tender, fully of partially.
38.
The contractor shall procure Ready Mixed Concrete from either of the following
manufactures:
ACC or Unitech or Birla Plus (Aditya Birla Group) or AHLCON of M/S Ahluwalia

EXISTING PORTION OF CLAUSE
Contractors Superintendence, Supervision,
Technical Staff & Employees.
i.
The contractor shall provide all necessary i.
superintendence during execution of the
work and as along thereafter as may be
necessary for proper fulfilling of the
obligations under the contract.
The contractor shall immediately after
receiving letter of acceptance of the tender
and before commencement of the work,
intimate in writing to the Engineer-inCharge
the
Name,
qualifications,
experience, age, address and other
particulars along with certificates, of the
principal technical representative to be in
charge of the work. Such qualifications and
experience shall not be lower than
specified in Schedule ‘F’. The Engineer-inCharge shall within 15 days of receipt of
such communication intimate in writing his
approval or otherwise of such a
representative to the contractor. Any such
approval may at any time be withdrawn and
in case of such withdrawal, the contractor
shall appoint another such representative
according to the provisions of this clause.
Decision of the tender accepting authority
shall be final and binding on the contractor
in this respect. Such a principal technical
representative shall be appointed by the
contractor soon after receipt of the
approval from Engineer-in-charge and shall
be available at site within fifteen days of
start of work.
If the contractor (or any partner in case of
firm/ company) who himself has such
qualifications, it will not be necessary for
the said contractor to appoint such a
principal technical representative but the
contractor shall designate and appoint a
responsible agent to represent him and to
be present at the work whenever the
contractor is not in a position to be so
present. All the provisions applicable to the
principal technical representative under the
Clause will also be applicable in such a

representative in the site order book and
shall affix his signature in token of noting
down the instructions and in token of
acceptance of measurements. There shall
be no objection if the representative/agent
looks after more than one work and not
more than three works in the same station
provided these details are disclosed to the
Engineer-in-Charge and he shall be
satisfied that the provisions and the
purpose of this clause are fulfilled
satisfactorily.
