The following special condition shall be read in condition with General condition of contract IAFW – 2249 (2009 Print and IAFW – 2160) (Revised 1955) including agenda there to. Any provision in these special conditions, if at conflict with the provisions in the above mentioned documents should be deemed to take procedure there over. 1.2. The terms “General specification” used in any of the documents following part of this contract refer to the specification contained in the MES schedule of rates 2010 issued from time to time. 1.3. Water will be charged @ Rs. 7.00 per Rs. 1000 /- worth of value of work done of the contract. 1.5 Supply of electricity for the work will be provided against payment @ Rs. 4.25 per unit OR as applicable. Tested meter shall be provided by the firm. 2. Condition of Working: 2.1 The factory does not take responsibility for safe custody of contractor’s materials collected at the site in connection with the execution of work. Contractor should take care for his materials during the execution. 2.2. The factory buildings are under production. The contractor should carry out the work in co-ordination with production activities of buildings & with other agencies thereon. 2.3 In case of residential buildings/quarters, contractors shall arrange with the occupants in advance about the portion or portions of the buildings in which they prepared to work. 2.4 Contractor shall not leave the work incomplete, scattered in piece-meal stages on any place or any particular portion of the work not having been particularly sanctioned etc. The finished work shall be given a clearance of completeness. 3. Identity Cards passes : 3.1 The contractor, his agent and representative are required individually to be in possession of an identity cards of pass duly verified by the police Department., the identify card of pass will be examined by the security staff at the time of entry into or exist from the restricted area (s) and also at any time or any number of times inside the restricted area (s). 3.2 Every workman shall be in possession of an identity card. The identity cards shall be issued after the search, investigation of the Coincident of workmen by the contractor and attested by the security In – Charge of the area in accordance with the standing rules and regulation of the factory authority. Contractor shall be responsible for the conduct and action of his work agency or representatives passes will be issued by factory authorities for the entry and exit of contractor labour through a particular Gate only. 4. Wearing of Identification Jackets by Contractor’s Labourers: The contractor’s labourers & their supervisors entering the Factory shall be required to wear the “MAROON COLOURED JACKET” and the cost of the jacket shall be borne by the contractor only. If the required condition is not followed, the Security officer will have the right to stop the entry of contractor’s labour / Supervisor inside the factory for working. 5. Search: Thorough search of all person and transport shall be carried out of each date of exist as many times as a gate is used for entry & exit and may also be carrying of any time of any number of time at the work site within the restricted area. 6. Working hours : Even though the work is in restricted area, contractor and his workmen shall be allowed to work from 8.00 a.m. to 4.30 p.m. at the work site within the restricted area. 7. Working in Holidays: The contractor shall not carry out work on Gazetted Holidays. Weekly holidays and other working day except when especially authorized in writing to do so by the General Manager may at also discretion declare any day as holiday of Non – Working day without assigning any reason for such declaration. 8. Returning of passes identity cards after completion of the work: All identity cards and passes shall be returned by the contractor, to the factory authority after the completion of work under this contract, in case of issue of identity cards, the contractor will have to pay penalty as per requisite on the subject. 9. Date of Completion: The duration of contract period contract. will be 05 months from the date of award of 10. Earnest Money Deposit : Tenderers shall be required to deposit Earnest Money amounting to sum of Rs. 30600=00/- in the form of Receipted Treasury Challan or Fixed Deposit Receipt / Term Deposit Receipt issued by SBI or any other nationalized bank in favour of ‘The General Manager, Ordnance Equipment Factory, Hazratpur’. The date of EMD should not be prior to the date of publication of this tender. The tender not accompanied with the Earnest Money Deposit as prescribed above will be summarily REJECTED BY THE ACCEPTING OFFICER. 11. Female Labour : If the contractor desired to employee female labour on work to be carried out inside area of the factory and female searcher is not borne on the authorized strength of the factory at the time of submission of the tender, he shall be deemed to have allowed in the tender for pay & allowance etc. For the search of female labour is employed by him inside the area. If more than one contractor employ female labour during any month and female searcher have to be employed in addition to the authorized strength of the factory the salary and allowances so paid to the additional female searcher shall be distributed on equal basis between the contractor employing female labour taking into account the value and period of completion of their contract. 12. Security : Contractors attention is drawn to official section Act particularly section 5 thereof. The contractor should bring the material inside the factory after obtaining due permission and following the procedure laid down by factory authorities strictly, the surplus material after the work is over, shall be allowed to be taking out after due verification as per the security standing instruction of this factory. 13. Fair Wages Payment to the labourers : The contractor shall have no claim whatever if an account of any local regulation or otherwise he is required to pay wages in excess of the minimum wages shown in the Schedule of minimum fair wages. 14. Visit to Site of Works : Tenderer is advised to visit site of work with prior permission of Jt.GM/WM Or Engg.- inCharge, in Ordnance Equipment Factory, Hazratpur and make himself familiar with the working condition acceptability which effect the execution and completion of work. 15. Store and Material (Refer condition 11 of IAFW- 2249) : The contractor shall, after the approval of the samples by Engineer- in- charge, obtain stores, material and equipment from the approved firms or through their authorized agents only. As a proof that the materials are obtained from the approved firms/ their authorized agents, the contractor shall produce such evidence to the satisfaction of Engineer – in – Charge as regards to the quality of the materials. 16. Signing of Contract Document : The person signing the tender on behalf of another or on behalf of a firm shall attach with the tender a proper power of attorney duly executed in his favour by such other person or by all the partners stating that he has authority to bind such other person or including the arbitration clause. 17. Nationality of Personnel / Labour : 17.1 Tenderer at action is drown to condition 25 on page 14 and 15 of IAFW- 2249 (2009) print. 17.2 Contractor shall engage Indian Nationals after verifying their antecedent and Liability. 18. Damage or Loss of inventory items borne on the list of CE/ EM Section : In course of execution of the different items of work is any inventory items are damaged or broken or lost by contractor or his men the appropriate cost of the same will be recovered from the contractor. The decision of the General Manager in this regard will be final and binding to this contractor. 19. The contractor is required to take the shut down of electric supply, day – to day basis, before commencement of work for the purpose, he has to obtain a permit from factory, EM section every day in prescribed Performa and discharge the same after the end of the day work (The shut down can be given between 8.00 A.M. to 5.00 P.M. on all working days.) All Safety precaution will be taken by the contractor with regard to safety of workmen working at height on the poles to avoid any electric or other accidents. 20. Safety Condition: The following Safety precaution to be observed while carrying out the work :(i) (ii) (iii) The contractor man should be well equipped with protective items like hand gloves, safety goggles, safety shoes, helmet, safety belt etc. While doing work at height, Scaffolding must be rigidly tied and adequate. Platform also must be specious – safe for movement of men over it. The opening should be avoided so that there is no chance of man falling through it. Ropes are to be fixed to vertical pillar or cross beams as necessary wherein the end of safety belt can be tied. (iv) Ladder used for painting must be tied by rope at the top of beams where it is leaned for white washing in nearby area. It should be also held by the helper on the platform. (v) White washer and helper must have adequate experience of work at such height. (vi) Supervisor of contractor must be efficient, technically sound and experience enough to ensure full safety measures before start the work. (vii) Contractor himself inspects the site and gives clearance prior to start the work. (viii) Unless Site-In-Charge gives the clearance about adequate safety measures takes by contractor, no work should be started. (ix) They should not be under influence of any drinking /drug. (x) They should be in good health and sound mental condition. (xi) Their movement should be restricted to only in the working area and they should not go any un-authorized place. (xii) They should not block the road/gantry/area by dumping the Bldg. materials/boxes. (xiii) They should observe general safety precautions by applying common sense to avoid any incident while working. (xiv) First aid box for immediate use in case of accident should be made available by them. (xv) They should carry the load in accordance with the factory Act 1948 & U.P. Factory Rule. (xvi) They should use safety belt, Helmet while working in height. (xvii) Proper work Permit system mentioning all necessary safety precautions, while working at height. (xviii) Barricading the portion on ground beneath working Zone at top. There should not be any movement of the personnel in this area if there is a constant risk of fall of any object from height. (xix) The shut down of furnace or machines may be essential in some cases. (xx) Suitable Safety Precautions/ Work instructions may be displayed for all workmen/Supervisor/ Fy. Worker/Visitors who are likely to encroach in that area. (xxi) Further, to make any essential movement in the aforesaid area, the individual (s) must wear Helmet and other PPEs safe guard themselves fully, due to likely fall of any object from the height (xxii) FIRM SHOULD ABIDE ALL SAFETY RULES. VIOLATION OF RULES, FACTORY MAY IMPOSE PENALTY TO THE CONTRACTOR AS DEEMED FIT. 21. Other Conditions : i) Ordnance Equipment Factory, Hazratpur – 283 103 (U.P.) is an ISO certified unit. Hence, the contractors / Suppliers are required to comply with various statutory and regulatory provisions related to quality while delivering their products and services at Ordnance Equipment Factory, Hazratpur – 283 103 (U.P.). Failing which, they shall be responsible for contravening the relevant legislative & regulatory provision(s). ii) In case of an accident caused to a contractor’s worker while working, the provision of medical treatment and compensation for the period of his absence shall be ensured by the firm and they should be covered under Employee’s State Insurance Scheme or the Workmen Compensation act.
