CHAPTER 10.00 - FOOD SERVICES
10.01* - General Food Service Requirements
POLICY:
(1)
The school food service program shall operate according to requirements
set forth in Sections 1006.06 and 1001.42 (16), Florida Statutes, and State
Board of Education Rules 6A-7.040 through 6A-7.045. The school food
service program shall include the federally reimbursed lunch program, ala
carte food, beverage offerings, and sale of food and beverage items
offered through vending machines or other methods to students at all
school facilities during the school day and may include the federally
reimbursed breakfast program and/or as required by law.
(2)
The school food service program shall be an integral part of the District’s
educational program, offering nutritional and educational opportunities to
students.
(3)
Foods and beverages available in schools shall be only those which meet
the nutritional needs of students and contribute to the development of
desirable health habits unless provided otherwise in School Board rules.
(4)
The school food service program shall meet the standards for Food
Service and Sanitation and Safety as provided by the Florida State Board
of Health and Florida State Department of Education.

10.02 - Meal Patterns
POLICY:
(1)
All schools with grades K-12 shall participate in the National School Lunch
Program and shall serve student lunches according to meal patterns
established by the United States Department of Agriculture. Schools may
participate in the National School Breakfast Program; breakfast shall be
served to students according to meal patterns established by the United
States Department of Agriculture.
(2)
Breakfast shall be available to all students in elementary, middle and high
schools.
(3)
Breakfast programs shall be implemented at an alternative educational
site when feasible. Alternative breakfast options may be served at such
sites.
(4)
Students who arrive at school on a school bus less than fifteen (15)
minutes prior to the start of school shall be allowed a minimum of ten (10)
minutes to eat breakfast.
(5)
Annually, all students and parents shall be notified about the school
breakfast program. Parental notification shall be in writing.

10.03 - Free and Reduced Price Meals
POLICY:
Free or reduced price meals shall be served to all students who qualify based on
eligibility criteria approved by the School Board.
(1)
The income Eligibility Guidelines for free or reduced price meals shall be
in accordance with the scales provided by the Florida Department of
Education as adopted by the State Board of Education based upon
income guidelines prescribed by the United States Secretary of
Agriculture.
(2)
Eligibility criteria shall be applicable to all District schools and shall provide
that all students from a family meeting the eligibility criteria and attending
any District school are offered the same benefits.
(3)
Procedures for implementing the free and reduced price meal services
shall be reviewed annually and shall be in accordance with procedures
and guidelines published by the Florida Department of Education and the
United States Department of Agriculture.
(4)
Beginning with the 2010-2011 school year, a breakfast meal shall be
offered in schools in which eighty percent (80%) or more of the students
are eligible for free or reduced price meals.

10.04 - Purposes and Basic Aims of the School Food and Nutrition
Service Program
POLICY:
(1)
The School Food and Nutrition Service Program is an integral part of the
district education program, offering nutritional and educational
opportunities to the pupil as a positive experience in his/her school day.
The program is governed by the same principles and types of control as
any other department of the school.
(2)
The School Food and Nutrition Service is operated under the general
supervision of the Board. The program is for the benefit of pupils and
shall be operated on a nonprofit basis. Prices of lunches shall be
established by the Board and will be subject to change as conditions may
require.
(3)
The facilities for the School Food and Nutrition Service shall, in so far as
possible, be adequate for efficient operation and sound sanitary and
safety practices.
(4)
Foods and beverages available in the school shall be only those which
contribute to the nutritional needs of pupils and to the development of
desirable food habits. Items classified as having "minimum nutritional
value," listed in Federal Regulations 210, may be sold in secondary
schools only, with Board approval, one (1) hour following the close of the
last lunch period. The principal is responsible for enforcement of this rule.
(5)
The School Food Service Program shall provide for "offer vs. serve" [three
(3) of five (5) items offered] for students above grade four (4) where
feasible as determined by the Coordinator of School Food Service.
(6)
The school has the responsibility of providing a good environment school
lunch; the lunch period should contribute to the social education of the
pupil.

10.05 - District School Food and Nutrition Program
POLICY:
(1)
The Board will adopt written policies relating to the School Food and
Nutrition Service Program from time to time as it deems necessary. A
copy of such policies and any subsequent amendments thereto shall be
filed with the Commissioner of Education as required.
(2)
The Board will provide uniform record forms. Complete and accurate
records shall be maintained of all aspects of the program, including
agreements, applications, and claims for federal reimbursement. The
Superintendent shall see that all reports are submitted to the State
Department of Education as required. All funds and records shall be
properly protected and secured. The Board will designate bank depositories.
(3)
The general control, administration, supervision, and operation of the
program will be under the Board and Superintendent as provided by law;
however, responsibilities shall be as delegated and prescribed by these
regulations and as assigned by the Superintendent.
(4)
The Board will provide adequate administrative, supervisory, and clerical
assistance for an effective program.
(5)
School Food and Nutrition Service income from sales and federal funds
shall be limited to expenditures allowable under State Board regulations
and the Food Service Operations Manual.
(6)
The sale price of lunches shall be within the paying ability of a majority of
the pupils in each school, with free or reduced price lunches being
provided for economically needy students throughout the district. The
Board will establish the price or prices of lunches annually and at such
other times as deemed necessary.
(7)
The Board will enter into a written annual agreement with the State
Department of Education relating to the program.
(8)
The Board will enter into an annual written agreement with the Commodity
Division of the Department of Agriculture.
(9)
A copy of the policy relating to free and reduced price lunches shall be
filed with the State Department of Education.
(10)
There shall be a program of in-service training for personnel with
participation therein required.

(11)
The Board will provide the facilities and equipment necessary for the
operation of the program.
(12)
All purchases of food (except produce) and all nonfood supplies made
from the School Food and Nutrition Service internal funds shall be subject
to the requirements of Section 7.06 of these regulations and regulations of
the State Board.
All food purchases shall conform to the federal and state safeguards
relating to wholesomeness of the items purchased.
(13)
Acting on the recommendations of the Superintendent, the Board will
establish positions and prescribe the qualifications therefore. Personnel
may be appointed only upon the written recommendation of the
Superintendent and the approval of the Board. All appointments shall be
made as provided in Chapter 6 of these regulations.
(14)
Under no conditions may a School Food and Nutrition Service Program be
operated under a fee, concession or contract agreement with a food
service management company or under any similar arrangement.

10.06 - Purchases for School Food and Nutrition Services
POLICY:
School Food and Nutrition Services purchases shall be classified into two general
categories:
(1)
Supply Items
Supply items are both food and nonfood items and shall be further classified as
to bid requirements.
(a)
Recurring Common Use Items
The item shall be essential and used daily and the annual consumption
can be predicted with reasonable accuracy and bid where the purchase
can be normally made from a supplier. Bids using a formal contract shall
be obtained on the following recurring common items; milk and bread.
(2)
(b)
Staple groceries and canned goods shall be purchased on bid basis.
(c)
Frozen processed foods shall be purchased on a bid basis.
(d)
Fresh produce and eggs shall be purchased by the individual school and
shall be governed by the Federal Food, Drug and Cosmetic Act and the
Federal Meat Inspection Act. All meats shall be purchased from stateinspected suppliers.
Equipment Items
(a)
Nonexpendable items shall be purchased from Board funds and shall be
bid according to Board requirements.
(b)
Expendable items shall be purchased from either Board funds or School
Food and Nutrition Service funds and shall be bid according to Board
requirements.
(c)
The requirements for bids shall not apply if economic conditions make
purchases by bids impossible and bid requirements are waived by the
State Board.

10.07 - Responsibilities of the Principal
POLICY:
(1)
The responsibilities of the lunchroom remain with the principal even
though he/she may delegate responsibilities to teachers and the
lunchroom manager for specific categories of the program.
(2)
He/she shall inform the faculty and lunchroom staff of the local school
policy regarding pupil control and discipline. All matters relating to
discipline shall be handled by the principal or a member of the staff.
(3)
The principal or designee shall identify and approve those pupils entitled
to free or reduced price lunches and shall maintain a current list of free
and reduced students for the lunchroom manager.
(4)
He/she shall recommend to the Superintendent personnel to be employed
in the school food service program of the school.
(5)
He/she shall maintain proper records of receipts and disbursements and
make such records available for an annual audit. Receipts shall be
deposited daily.

10.08 - School Food and Nutrition Service Personnel
POLICY:
(1)
(2)
Qualifications
(a)
A manager shall be a high school graduate or hold an equivalency
certificate. He/she should have one (1) year of experience in food
service or related work.
(b)
An employee should be at least a high school graduate. The
employee shall attend school food service training programs
scheduled within the regular work year.
(c)
The employee must be physically able to meet necessary
requirements for the position.
(d)
A substitute worker shall meet all requirements of a regular school
food service employee.
Conditions of Employment
(a)
Managers are employed for one hundred ninty-seven (197) days.
These days may vary with the annual school calendar. Other
employees are employed for one hundred and eighty-nine (189)
days.
(b)
All employees are under the Federal Minimum Wage and Hour
Law.
(c)
Food service personnel shall work those hours as specified by the
board or applicable collective bargaining agreement.
(d)
Temporary employees may be hired in the fall due to more meals
being served than the labor hours allotted. Should meals served
warrant additional labor hours, these temporary employees may be
employed as regular employees. Adjustments may be made
following the first month of school.

10.09 - Adult Lunches
POLICY:
(1)
All employees shall pay for lunches.
(2)
Only those adults in the school on official business at lunch time are
permitted to eat lunch at the school. The guest or his/her host shall pay
for any lunch purchased. Sales personnel shall not infringe on the
employee lunch hour.
(3)
Parents may visit the lunchroom department to become acquainted with
the program. The principal shall determine that adult privileges are not
abused, because the lunchroom program is a nonprofit operation and is
not to be in competition with private business establishments.

10.10 - Admission to Work Areas; Use and Protection of Equipment
and Supplies
POLICY:
(1)
A child is to be allowed into the kitchen only if:
(a)
He/she is employed in accordance with the Child Labor Laws and
(b)
He/she is on tour with a group as part of a nutrition project
prearranged with the principal and manager.
(2)
Teachers will be served from the serving lines. Special items for adults,
such as coffee and tea, will be served, when available, from a table at a
designated place in the dining room.
(3)
Only members of the School Food and Nutrition Service staff and adults
on official school food service business are allowed behind serving
counters.
(4)
School food service refrigeration shall be used only for storage and
preservation of food to be used on the school premises or in connection
with Board approved activities.
(5)
Foods or equipment shall not be removed from the school premises
except in connection with Board approved activities. Any employee who
violates this rule shall be subject to suspension and subsequent dismissal
from employment.
(6)
Relatives of School Food and Nutrition Service employees shall be
granted no privileges denied other children and adults.
