Be cautious about using study aids. They are often inaccurate and may oversimplify complex material. A hornbook, The Law of Torts by Dan Dobbs is available in the Library. 2. You must write out briefs for EVERY case. Briefs should include the following: FACTS: ( only those necessary to understand holding of case) PROCEDURAL POSTURE : (what happened in case before it reached court delivering opinion in book) ISSUE: (what is the tort issue that this court must answer) HOLDING: (should be a yes or no in response to above-­‐ but can be more detailed) RATIONALE:(why did court reach the decision it did) NOTES: (jot down important points from cases in notes following main case) 3. A Roll Sheet will be sent around at the start of each class. Please sign your name in the appropriate spot. IT IS YOUR RESPONSIBILITY TO MAKE SURE THAT YOU SIGN THE ROLL SHEET BEFORE YOU LEAVE THE CLASSROOM. This is the ONLY proof of class attendance. 4.
