Corn. 2 5 r e s p e c t a b l e number o f t h e Seminole c h i e f s and a m i n o r i t y of t h e braves were d e c i d e d l y i n f a v o r of e m i g r a t i o n , n o t s i m p l y a s an u n a v o i d a b l e a l t e r n a t i v e , b u t a s a c l e a r m a t t e r o f s e l f - i n t e r e s t and s e l f - p r e s e r v a t i o n . In t h e autumn of 1835, n e g o t i a t i o n s w i t'n t h e Seminoles d i r e c t e d t o w a r d t h e i r p e a c e f u l removal t o t h e West were b r o u g h t t o a c r i s i s . One o f t h e p r i n c i p a l a d v o c a t e s f o r removal, Chief Amathla, was a s s a s s i n a t e d on November 2 6 , 1835, by a l a r g e band of d i s s i d e n t Seminoles o p p o s e d t o w h a t t h e y c o n s i d e r e d t o be a f o r c e d . m i g r a t i o n . The murder of A m a t h l a p r e c i p i t a t e d open h o s t i l i t i e s on December 28, 1835, w i t h the n e a r - t o t a l d e s t r u c t i o n o f a m i l i t a r y column l e d b y Major Dade. War The S e c o n d Seminole commenced on t h i s d a t e . 5. 1838. The Seminole war proceeded w i t h u n r e l e n t i n g f e r o c i t y u n t i l e a r l y The widespread u n p o p u l a r i t y of t h e war, b o t h i n C o n g r e s s and w i t h t h e g e n e r a l p u b l i c , l e d t h e Government t o s e e k more p e a c e f u l means t o t e r m i n a t e t h e con£ l i c t and t o u r g e t h e r e m a i n i n g Seminoles t o e m i g r a t e . General, Thomas S. J e s s u p , Commander i n F l o r i d a , and a number of h i s senior o f f i c e r s o p e n l y advocated a p o l i c y t h a t would p e r m i t t h e S e m i n o l e s t o remain p e r m a n e n t l y i n F l o r i d a . The S e c r e t a r y o f War a d v i s e d G e n e r a l J e s s u p , however, t h a t t h e removal p o l i c y of t h e Govaxm-~& i n the face o f a r a t i f i e d t r e a t y precluded a n y p o s s i b i l i t y o f a n y permanent a r r a n g e m e n t f o r t h e Scrninoles. On May 18, 1838, G e n e r a l J e s s u p was Succeeded i n t h e command o f t h e army i n F l o r i d a by B r i g . Gen. Z a c h a r y Taylor. General Armistead ' s s u c c e s s r e l a t i n g t o n e g o t i a t i o n s ~ ~ i tth eh I n d i a n s was acknowledged on J a n u a r y 9 , 1 8 4 1 , i n a l e t t e r from t h e S e c r e t a r y of War t o General Armistead, which l e t t e r a l s o r e a f f i r m e d t h e Government's s t a n d o n I n d i a n removal: I have r e c e i v e d your l e t t e r o f t h e 2 0 t h u l t i m o , Sir. and am much g r a t i f i e d t o l e a r n t h a t t h e I n d i a n s c o n t i n u e t o come i n a t t h e d i f f e r e n t p o s t s . A s a r e s u l t of t h e aforementioned Congressionally s a n c t i o n e d a c t s of t h e S e c r e t a r y of I n t e r i o r , i n c o n c e r t with s i m i l a r a c t i o n s taken by the S t a t e of F l o r i d a i n a c q u i r i n g l a n d s for t h e p r o p o s e d f e d e r a l l y o p e r a t e d Everglades National P a r k , t h e 99,200 a c r e Seminole Indian R e s e r v a t i o n i n Monroe County, F l o r i d a , was exchanged f o r o t h e r lands i n n e a r b y Broward County, F l o r i d a . T h i s exchange of p l a i n t i f f ' s l a n d s , i n which i t h e l d a cornpensable i n t e r e s t , was accomplished f o r t h e u l t i m a t e b e n e f i t of t h e United S t a t e s and w i t h i t s knowledge and c o n s e n t .
