FLORIDA MARIJUANA TRAFFICKING LAWS The marijuana laws of Florida are driven by the weight of the drugs. Possession of 20 grams or less of marijuana is a first degree misdemeanor which is punishable by a year or less. Possession of over 20 grams of marijuana is a Third Degree Felony which is punishable by up to 5 years in State Prison. Possession with intent to sell marijuana is a Third Degree Felony punishable by up to 5 years in State Prison. Cultivation of marijuana under 25 pounds is a Third Degree Felony punishable by up to 5 years in State Prison. Trafficking in Marijuana is weight dependent: 25 pounds to 2000 pounds of marijuana or over 300 or more marijuana plants but not more than 2000 marijuana plants is punishable by a 3 year minimum mandatory sentence. This is a First Degree Felony which is punishable by up to 30 years in State Prison. 2000 pounds to 10,000 pounds marijuana or 2000 marijuana plants to less than 10,000 marijuana plants is punishable by a 7 year minimum mandatory prison sentence. This is a First degree Felony punishable by up to 30 years in State Prison. 10,000 pounds of marijuana or more or more than 10,000 marijuana plants is punishable by a minimum mandatory prison sentence of 15 years in State Prison.
