Awarded. Copies of each week’s General Gazette are available
for a cost of $1.10 each (plus postage) and are published on
a Wednesday. Copies of each week’s Special Gazettes are
available separately for a cost of $1.10 each (plus postage).
Special Gazettes are supplied with General Gazettes on a
Wednesday and they are sold at $1.10 per set (plus postage).
Annual subscription rates apply from 1 July 2001. All current
paid subscriptions will not be effected and will continue until
their expiry dates.

section 16(1) of the Notifiable Diseases Act and with reference
to section 43 of the Interpretation Act, amend the instrument

2005 and published in Gazette No. G48 dated 30 November

NOTICE OF AMENDMENT OF NT PLANNING
SCHEME AMENDMENT No. 285
I, PETER GLEN CHANDLER, the Minister for Lands,
Planning and the Environment, under section 28(1) of the
Planning Act, give notice that (a) I have, under section 25 of the Act, amended the
Northern Territory Planning Scheme by rezoning
Lot 1 (46 Noble Street) Town of Tennant Creek from
Zone SD (Single Dwelling Residential) to Zone MD
(Multiple Dwelling Residential); and
(b) copies of the amendment, (Amendment No. 285), are
available from the Offices of the Department of Lands,
Planning and the Environment, Level 1, Alice Plaza,
Todd Mall, Alice Springs.

NOTICE OF DECISION
VARIATION OF EXCEPTIONAL DEVELOPMENT PERMIT
EDP09/0004A
I, RAYMOND LOUIS SMITH, as delegate of the Minister
for Lands, Planning and the Environment in pursuance of
section 40(6) of the Planning Act give notice that:
(a) I have in pursuance of section 40(4)(a), decided to
grant a Variation of Exceptional Development Permit
EDP09/0004A for the development situated at Lot 424
(15) Lindsay Avenue, Suburb of East Side, Town of
Alice Springs;
(b) Variation of Exceptional Development Permit
EDP09/0004A varies conditions 1 and 2 of EDP09/0004
by endorsing drawing numbers PA08/0817/1A and
PA08/0817/2A to allow alterations to the floor plan of
the Pilates and Personal Training Studio (including
ancillary coffee preparation/sales area, bathroom, massage
room and mezzanine store) and changes to the car
parking layout;
(c) The land is in Zone SD (Single Dwelling Residential)
of the Northern Territory Planning Scheme. Exceptional
Development Permit EDP09/0004 granted consent for a
Pilates and Personal Training Studio which is a prohibited
use in Zone SD; and
(d) Copies of the Variation of Exceptional Development
Permit EDP09/0004A and the Reasons for the Decision
are available from the Offices of the Department of Lands,
Planning and the Environment, 1st Floor Alice Plaza,
12 Todd Street, Alice Springs.

BREATH ANALYSIS INSTRUMENT

the Traffic Regulations, being of the opinion that each
member of the Police Force whose name appears in the
attached Schedule is: -
(a) trained in the use of a prescribed breath analysis instrument
known as the Drager Alcotest 7110; and
(b) capable of using that prescribed breath analysis instrument
correctly,
Authorise those members of the Police Force to use that
prescribed breath analysis instrument for the purpose of the
Traffic Act.

COOMALIE SHIRE WARDS
I, Alison Anderson, Minister for Local Government,
under section 9(2) of the Local Government Act and with
reference to section 9(1)(f), (g), (h) and (i) of that Act and
section 42(1) of the Interpretation Act.
(a) abolish the existing wards within the Coomalie Shire; and
(b) create 3 new wards within the Coomalie Shire; and
(c) assign the names Adelaide River ward, Batchelor
Township ward and Coomalie Rural ward to the new
wards; and
(d) define the boundaries of the new wards as those shown
on Compiled Plan CP 5430 in the Schedule; and
(e) determine the number of members to be elected for each
new ward to be 2 members; and
(f) take the action mentioned in paragraphs (a) to (e) for
the purpose of conducting the next general election for
the Coomalie Shire and determining the composition
of the Coomalie Community Government Council and
the Coomalie Shire after that election.

ORDER FOR MAXIMUM DAMAGES AMOUNT
FOR NON-ECONOMIC LOSS IN
DEFAMATION PROCEEDINGS
I, Johan Wessel Elferink, Attorney-General and
Minister for Justice, under section 32(3) of the Defamation
Act, declare, for the purposes of section 32(1) of that Act,
that from 1 July 2013 the maximum amount of damages
for non-economic loss that may be awarded in defamation
proceedings is $355 500.
