This handbook is meant to help you to adapt to a new learning environment in the shortest time possible. In this handbook, you will find useful information that will help you sort out the necessary administrative matters that are still outstanding. There are also several forms which you will need to complete and return to the various departments. Please take some time to read through the information and do feel free to clarify with our Student Services Division should you have any further queries. We hope that you are just as excited as we are to embark on a journey across an entirely new education frontier. Warmest wishes Professor Tan Chin Tiong President STUDENT HANDBOOK | AY2012/13 3 ADMINISTRATIVE INFORMATION 2 ADMINISTRATIVE INFORMATION 2.1 ADMISSION CONDITIONS Singapore Institute of Technology (SIT) made the offer of a place on the following conditions: a. SIT is satisfied that the student’s physical and mental health are good and that the student is free from organic and infectious diseases and is certified fit to study by the examining doctor. b. The information given by the student in the application form is accurate and no material has been withheld from SIT. 2.2 IMMIGRATION MATTERS FOR INTERNATIONAL STUDENTS Before arriving in Singapore, international students may enquire with the Singapore Embassy/High Commission in their home countries about visa requirements and application procedures. Students may visit the Ministry of Foreign Affairs website to locate the nearest Singapore Embassy/High Commission in their country. Upon arrival in Singapore, students will be given a Social Visit Pass for a minimum period of between two weeks to one month at the airport or point of entry. During this time, students must apply for a Student Pass (immigration visa) after they have registered and received their In-Principle Approval Letter (IPA). 2.3 STUDENT PASS APPLICATION FOR INTERNATIONAL STUDENTS All international students must hold a valid Student Pass issued by the Singapore Immigration & Checkpoints Authority (ICA) for their studies at SIT. The application for Student Pass has to be submitted online using Form 16. Go to the ICA website. Under E-Services, log in to Student Pass Online Application and Registration (SOLAR). Your SOLAR application number and other login details will be sent to you via email. When submitting your Student Pass application through SOLAR, you will need to attach a digital colour passport-sized photograph which meets the following requirements stipulated by ICA: a. the photograph must be taken within the last three months; b. the photograph must be taken against a white background with a matte or semi-matte finish; c. the image must show the full face and be taken without headgear (headgear worn in accordance with religious or racial customs is acceptable but must not hide facial features); d. the image must be in JPEG file format (file extension is .jpg); e. the image file size must be no more than 60KB and 400 x 514 pixels; f. the image must be taken with a camera resolution of at least 2.0 megapixels. A processing fee of S$30.00 is required for every application submitted to ICA. The fee is non-refundable regardless of the outcome of the application or if the application is withdrawn after submission. Payment can be made online via SOLAR/SOLAR+ with eNets, Credit/Debit Card or internet banking. Student Pass Application Register at ICA SOLAR. Log in with details sent to you by email. Log in at SOLAR. a. Complete Form 16. b. Attach photo. c. Online payment of S$30.00 processing fee. If visa to enter Singapore is required, a. Submit electronic Form 16 prior to departure. b. In-Principle Approval Letter (IPA) will be sent to student. This will act as your entry visa. c. View instructions in IPA to make Student Pass with ICA. Please refer to the ICA website for a list of countries that require a visa to enter Singapore. Students need to submit the electronic Form 16 prior to their departure should they require a visa to enter Singapore. Upon approval, students will receive the In-Principle Approval Letter (IPA) that will act as the single-journey entry visa for entry into Singapore. The IPA will also contain instructions for you to make your Student Pass with ICA. NOTE Apply at least 16 days before departure for Singapore. STUDENT HANDBOOK | AY2012/13 5 2.4 TERTIARY STUDENT CONCESSION CARD Students can enjoy travel concession privileges with the Tertiary Student Concession Card through the use of monthly concession passes such as the Bus Concession Pass, Train Concession Pass and Hybrid Concession Pass. Students who are interested to apply for the Tertiary Student Concession Card may approach any of the TransitLink Ticket Offices (TLTO) or TransitLink Concession Card Replacement Offices (CCRO) according to the schedule listed below. The list of concession schemes, TLTOs and their operation hours are available here. Students applying for the tertiary concession card must bring along their NRIC & SIT Matriculation Card for verification purposes. International students must bring along their student pass issued by ICA and original passport. A 3-day 2-night camp which will allow you to experience first-hand the dynamism and vibrancy that is part of SIT’s growing student life. Date: Tuesday, 21 Aug 2012 – Thursday, 23 Aug 2012 More details of the SIT Student Orientation will be sent to you via your SIT email account at a later date. Matriculation card collection All students will be issued their SIT matriculation card during the SIT Student Orientation. Authorisation of representatives to collect your matriculation card In the event that students are unable to attend the SIT Student Orientation and collect their matriculation card personally, they may choose to authorise a parent or representative to do so on their behalf within three working days from SIT’s office. Parents or representatives MUST bring the following: a. a photocopy of both sides of the SIT student’s identification card b. his/her own original identification card with photo c. a signed and completed Authorisation Letter Students should contact the Academic Services Division to report the loss/replacement of matriculation card. A replacement fee of S$25.00 (exclusive of GST) will be charged. 2.6 SIT WELCOME CEREMONY 2012 The Welcome Ceremony 2012 is organised to welcome you to SIT and involve your parents in your learning journey with us. You will also have the opportunity to meet SIT management and faculty from our overseas university partners. An email notification will be sent out by each overseas university with instructions on how to access and navigate its online registration system. Certain degree programmes and overseas universities may require their students to register for their courses online using the university’s online portal. 3.3 MAXIMUM CANDIDATURE The maximum candidature period refers to the normal candidature period and one extended year of study. For example, a student enrolled in a two-year programme has a maximum candidature period of three years. Tuition grant is not available for the extended year of study and students are subject to full tuition fees. 3.4 LEAVE OF ABSENCE/MEDICAL LEAVE OF ABSENCE Students may choose to apply for leave due to medical or personal reasons, subject to the maximum candidature period allowed by SIT. Students must complete the Leave of Absence/ Withdrawal of Programme Online Application in the Student Portal. Only leave of absence taken for personal reasons is counted towards the maximum candidature period. SIT will review all applications on a case-by-case basis. SIT and the overseas university partner will then conduct an exit interview with the student. A letter confirming the student’s withdrawal from SIT will be sent to the student within three weeks from the date of the exit interview. Students must return their matriculation card to the Academic Services Division. Students with a tertiary student concession card will not be eligible for concessionary travel upon withdrawal from SIT. However, the card can still be used to pay for transportation needs at adult fares for a period of four months before expiry. Students may request for a refund of any remaining value when they surrender the card at any TransitLink Ticket Office or TransitLink Card Replacement Office. Students holding a Student Pass issued by the Immigration & Checkpoints Authority (ICA) must surrender it to the ICA within seven days upon termination of study. STUDENT HANDBOOK | AY2012/13 9 Students who decide to leave SIT after the start of the programme (excluding the orientation programmes organised by the overseas university partners in Semester 1) will be liable to pay fees for the entire semester. Any requests for partial payment will not be considered. Students who have not matriculated Students who have not completed matriculation and wish to withdraw from SIT must state the reason(s) for withdrawal in an email to the Admissions Division. Withdrawal and refund policy SIT’s policy on refund of tuition fees is as follows: a. Students who withdraw before their matriculation date will receive a full refund less a S$107.00 (inclusive of GST) administrative fee; b. Students who choose to withdraw between their matriculation date and the start of their programme will receive a refund of 50% tuition fees less a S$107.00 (inclusive of GST) administrative fee; c. NO refund will be given for withdrawals after commencement of the programme or subsequent semesters. 3.6 COMPUTER ACCOUNT, IT USER AGREEMENT POLICY AND USAGE AGREEMENT Students are given access to the Student Portal, email accounts and their online community portal, SITizen. Students are encouraged to change their passwords monthly. All views stated through the use of any of the above channels do not represent SIT’s views. All formal correspondences about student academic matters must be communicated through SIT email accounts. Where applicable, matters relating to course curriculum may be communicated via email accounts issued by the respective overseas university partners. Students are encouraged to check their SIT email accounts regularly to avoid missing out on important information. Any material protected by copyright must not be copied except as specifically stipulated by the owner of the copyright or otherwise permitted by copyright law. Please download and read the Acceptable Use Policy for IT Resources Form and return a signed copy to SIT. For any enquiries, please email the Communications and Information Technology (CIT) Division. 3.7 SOFTWARE LICENSES All students will be offered the following Microsoft products during their time of study with SIT. a. Microsoft Office 2010 b. Microsoft Office 2011 for Mac c. Microsoft Windows 7 Instructions for download are available here. Please note: a. Prior to downloading any of the Microsoft Products, all students are required to read and familiarise themselves with the Microsoft Product List and Product Use Rights. b. A specific product key will be emailed to you during the downloading process. Please retain the product key email for future reference as you will be required to pay a fee to Microsoft to retrieve lost product keys. c. Upon registration on the download page, you will be given a period of one month to complete the download. Please keep the downloaded installation package for future re-installation. You will be required to purchase the Extended Access Guarantee at USD4.95 if you fail to safekeep the installation package. d. Upon completion of your studies in SIT, you may continue to keep the software. However, should you terminate your studies prematurely, you are to uninstall all applications downloaded from your personal computer according to the Microsoft student license agreement. e. For any technical issues, please email your queries to: IThelpdesk@SingaporeTech.edu.sg To start downloading, log in to the Student Portal, under “My Files” and choose “Microsoft Products” to continue the downloading process. STUDENT HANDBOOK | AY2012/13 10 3.8 STUDENT UNDERTAKING FORM Students are required to download the Student Undertaking Form. The signed and completed form should be submitted to SIT. Students who are under the age of 21 are required to submit a photocopy of their Birth Certificate along with their Student Undertaking Form. 3.9 STUDENT DISCIPLINE AND DISCIPLINARY PROCEEDINGS SIT has the right to take appropriate disciplinary action warranted by a student’s misconduct. The specific provisions as to offences, penalties, and disciplinary procedures set out should not be construed as limiting the general authority of SIT. SIT wishes to highlight the following points: a. The proceedings and procedures indicated here apply to non-academic offences committed by students of SIT. b. Academic offences will be governed by the regulations and policies of the respective overseas university which the student is enrolled in. c. Students will also be governed by the polytechnic’s regulations and policies for the use of the polytechnic’s facilities in which the programme of study is being conducted. Students are strongly encouraged to familiarise themselves with the regulations applicable to them during their enrolment with SIT. Offences Any student who commits or causes any other student to commit the offences listed below shall be subject to disciplinary proceedings: a. An offence involving or resulting in the breach of any laws of Singapore or the country of a partner university of SIT; b. Theft, fraud or misapplication in connection with SIT funds or property of any kind; c. Damage to or defacement of any property within or without SIT or any employee or student of SIT; d. Falsification or tampering with academic documents or records, such as certificates in connection with degrees and other academic distinctions (transcripts, testimonials/ references, examination scripts, graded assessments or reports, including medical certificates); e. Fraud, dishonesty, any act of bad faith, or impersonation of others, within or without SIT, in connection with the student’s academic attainments or financial awards; f. False declaration on official documents such as application forms and reports, and receipts and bills for reimbursement; g. Endangering or any attempt to endanger another student or other students or member of SIT’s student community in any of the following ways: • Acting in a manner that is detrimental to the reputation, dignity or interest of a fellow student, academic or non-academic staff; • Speaking or acting in a threatening manner; • Causing bodily harm. Disciplinary powers a. Any one or more of the following disciplinary powers may be exercised against a student in respect of any matter which may be the subject of disciplinary proceedings: • Issuance of an order including, as appropriate, a requirement to comply with specified conditions and a statement of the sanctions to be applied if such conditions are not met; • Issuance of a reprimand that shall form part of such person’s official record; • Imposition of a fine up to Singapore Dollars Ten Thousand (S$10,000); • Issuance of a public censure; • Withdrawal and/or suspension of any academic or other privileges, benefits, rights or facilities by SIT (inclusive of similar provisions from the five polytechnics and the overseas universities); STUDENT HANDBOOK | AY2012/13 11 • Withdrawal and/or suspension of the right to follow courses of instruction or attend examinations; • Expulsion from SIT/overseas university; and • Deprivation of any degree, diploma, certificate or other academic distinction to be conferred or previously conferred. b. Any of the disciplinary powers listed in point above may be exercised notwithstanding that the student who is liable to be the subject of disciplinary proceedings (the “person concerned”) has ceased to be a student of SIT at the time the disciplinary proceedings are instituted or at the time the disciplinary matters are adjudicated either in the first instance or on appeal, provided that the circumstances giving rise to the disciplinary proceedings arose while the person was a student of SIT or in connection with the person’s admission to SIT. c. Any of the disciplinary powers provided here may be exercised without prejudice to the right to exercise any other disciplinary powers or any other powers contained in the regulations, rules, policies, guidelines, codes of conduct, or procedures as may from time to time be prescribed by SIT and the overseas university which the student was enrolled in and/or the polytechnic in which the offence took place. Disciplinary proceedings The process for a disciplinary proceeding shall be as follows: a. SIT receives an incident report on an alleged student’s offence. b. SIT investigates the incident with relevant party(ies) concerned. c. Upon verification of the validity of the allegations, the student will be notified to attend a first hearing conducted by the Board of Discipline. Where necessary, there may be a second hearing by the Deputy President (Academic). d. The student will be served a notice of the action taken against him/her. Summary Action a. The Deputy President (Academic) of SIT may, by giving notice in writing to a person who is a student at the time of the notice, summarily suspend or withhold any privilege, benefit, right, or facility or take any other summary action as the Deputy President (Academic) may think fit against such student, if the Deputy President (Academic) has reason to believe that such action is necessary to: • Protect the interests of SIT or any employee or student of SIT; or • Ensure the proper functioning of SIT. b. Within seven days of the notice of the Summary Action taken against a student, the student may lodge an appeal against a decision made by the Deputy President (Academic) to the Disciplinary Appeals Board. The decision of the Disciplinary Appeals Board shall be final and binding on the student. Co-operation During the course of any disciplinary proceedings or appeals, the student concerned shall co-operate fully with the Board of Discipline, the Deputy President (Academic), the Disciplinary Appeals Board or any other body or person to whom the task of the adjudication of any disciplinary matter or consideration of any appeal may be entrusted, and shall supply to them such information and documents as any of them may require. Appeals The student may lodge an appeal against the decision stated in the notice within seven days of the date of the notice to the Disciplinary Appeals Board. The student may be required to attend another hearing conducted by the Disciplinary Appeals Board. The decision of the Disciplinary Appeals Board will be final and the student will be notified of the appeal outcome in writing. The Disciplinary Appeals Board shall not be required to provide reasons for its decision. STUDENT HANDBOOK | AY2012/13 12 Notice of decisions and publicity The Academic Services Division shall notify the student of any summary action by the Deputy President (Academic), or decision of the Board of Discipline or the Disciplinary Appeals Board, as the case may be. All such notices shall indicate the name of the offender, the nature of the offence committed, and the specific action taken by SIT. SIT has no obligations to provide reasons for the action taken against the offender. In addition, SIT may inform all students or other parties, by publication in any manner or medium or otherwise. Liability of SIT SIT, its officers, or any other person or entity associated with them shall have no liability whatsoever for any losses, damages, claims, legal costs or other expenses that a person concerned may suffer or incur, whether directly or indirectly (including any loss of profit or any damage to reputation) by reason of any disciplinary proceedings instituted or summary action or disciplinary action taken pursuant to this section and the publication or notification of any information relating thereto. 3.10 COPYRIGHT ISSUES Please refer to Annex C on the rules governing copyright issues in SIT. These fees include a registration fee and an annual fee that are payable at the beginning of each academic year. These fees are charged after a subsidy from SIT and cover matriculation, student activities, library and sports facilities, insurance, as well as academic-related services. Students who do not sign the Tuition Grant Agreement or who are not eligible for the tuition grant will have to pay non-subsidised tuition fees. b. Fees (tuition fees and compulsory miscellaneous fees) are payable by students on a semester basis regardless of whether they are on Overseas Immersion Programme etc., or otherwise during the semester. c. National Servicemen, whose enrolment in SIT is delayed by one or two years because of their National Service commitment, are allowed to enjoy a one or two year lag in the payment of their subsidised tuition fees. The fees payable will depend on the year that they had first accepted a place in SIT. For example, if they were offered admission in AY2010 and had accepted the offer, they pay the subsidised tuition fees applicable for AY2010 when they join SIT in AY2012. If they had re-applied for a new programme in AY2011, they will still pay the subsidised tuition fees applicable for AY2010 regardless of the 2nd application outcome. d. If fees are not paid, or are only partially paid by the due date indicated in the bill, a late fee will be stipulated. The current late fee is charged at S$53.50 (inclusive of GST). For students whose fees remain in arrears, SIT reserves the right to take further action as deemed necessary. e. Fee Advices/Tax Invoices will be sent to the student’s official SIT email account. f. All students are requested to pay their fees through Interbank GIRO. STUDENT HANDBOOK | AY2012/13 17 4.4 PAYMENT OF FEES Types of fees a. Tuition Fees: Students are required to make payment for tuition fees on a semester basis regardless of whether they are on Overseas Immersion Programme etc., or otherwise during the semester. b. Annual Fees: Payable by students at the beginning of each academic year. c. Registration Fees: This is a one-time, non-refundable fee payable when students first enrol in SIT. d. Late Payment Fees: All students are required to make full payment by the stipulated payment due date as per the Fee Advice. A one-time late payment fee of S$53.50 (inclusive of GST) will be imposed if fees are not paid or are only partially paid by the due date. e. Other Fees: This refers to any other fees payable other than those fees mentioned above. Students are advised to adhere to the stipulated deadlines set by the Student Services Division for application of financial assistance schemes. Any amount that is unsuccessfully deducted from the financial assistance agencies (e.g. CPF Board, PSEA, MENDAKI, Tuition Fee Loan and Study Loan accounts etc.) will be subsequently recovered from the students via GIRO deduction. Any request for refund is subject to review and approval on a case-by-case basis. The fee advices on tuition fees, registration fees and annual fees are sent electronically to the student’s SIT email account. Students are encouraged to check their SIT emails regularly to view their electronic fee advices. Any disagreement or clarification on the amount billed should be raised as soon as possible after receipt of the fee advice. The amount shall be deemed correct and final 30 days from the date of the fee advice, and no appeals for review or reimbursement of the billed amount will be entertained thereafter. For payment on tuition fees, registration fees and annual fees, students are required to pay through Interbank GIRO. STUDENT HANDBOOK | AY2012/13 19 4.5 MOE TUITION GRANT The substantial tuition subsidy from the Government of Singapore comes in the form of a Tuition Grant (TG) which is administered by the Ministry of Education (MOE) and offered to students who are Singapore Citizens or Singapore Permanent Residents only. Students who apply for and are approved for the Tuition Grants need only pay subsidised fees (also referred to as the “Subsidised Tuition Fee” portion of fees). While the Tuition Grant is not repayable, and Singapore Citizens in receipt of it will not be required to take a service bond, the following accountability measures will apply: a. Singapore Citizens on Public Service Commission (PSC) scholarships or bursaries will be required to undertake a service bond under the terms of such scholarships or bursaries. b. All Singapore Permanent Residents (except those already in receipt of a service bond from the PSC or the Ministry of Health) will be required to undertake a service bond under the terms of the Tuition Grant to work with a Singapore-registered company for three years upon completion of their degrees so as to discharge some of their obligations to the Singapore public for the high subsidy of their education. Singapore Permanent Residents should refer to the application procedure for the Tuition Grant in Annex B. Students who are scholarship-holders are advised to check with the Student Services Division if their scholarship covers the Tuition Grant. If the scholarship does not cover the Tuition Grant, an application should be made if the grant is needed. Students who do not apply for the Tuition Grant by the prescribed deadline will be charged the total tuition fees. They will also be required to pay the 7% GST for the Tuition Grant portion. Students must inform the Student Services Division before the start of the semester if they do not wish to accept the Tuition Grant. Students who do not sign the Tuition Grant Agreement or who are not eligible for the Tuition Grant will have to pay non-subsidised tuition fees. International students are not eligible for Tuition Grant subsidy from the MOE. Tuition fees are payable by students every semester while the compulsory Annual Recurring Fee is paid on a yearly basis regardless of whether students are on Overseas Immersion Programme etc. Eligibility guidelines for Tuition Grant Students with a Bachelor’s Degree or Higher Qualification Students (Singapore Citizens and Singapore Permanent Residents) who already hold a bachelor’s degree or higher qualification will be eligible for Tuition Grant if they wish to pursue a second programme of the same or lower level in SIT as long as they did not attain their bachelor’s or higher degree through any subsidy by the MOE or sponsorship by the Singapore Government (this includes the receipt of a government scholarship such as those offered by the Ministries, Public Service Commission and Statutory Boards for local or overseas study). Singapore Permanent Residents who take up the Tuition Grant will need to sign the Tuition Grant Agreement and work with a Singapore-based company for three years upon graduation. Transfer/Re-admitted Students Students (Singapore Citizens and Singapore Permanent Residents) who transfer or are re-admitted within SIT or across the Autonomous Universities1 will be eligible for the Tuition Grant up to the normal programme duration2 for the new programme after subtracting the number of semesters of Tuition Grant received for the previous programme(s). Number of semesters of Tuition Grant eligible for new programme = Normal programme duration for new programme – Number of semesters of Tuition Grant received for previous programme(s) 1 Autonomous Universities refer to National University of Singapore (NUS), Nanyang Technological University (NTU) and Singapore Management University (SMU). 2 Normal programme duration for full-time undergraduate programmes in SIT is taken to be four semesters (six semesters in the case of DigiPen Institute of Technology). Two sureties are required to execute the agreement. Sureties can be of any nationality, must be above 21 and below 65 years of age and must not be bankrupts. To help meet the educational expenses of financially needy students, financial assistance in the form of loans and bursaries is facilitated by the Student Services Division within SIT. All successful applicants are required to undergo a medical examination. SIT reserves the right to refuse admission to and/or exclude the student from any particular programme of study if the student should decline to undergo such health examinations and/or to be tested for any organic or communicable disease. The medical examination may be done by the student’s own registered physician. Please download and complete the Medical Examination Report Form available on the Student Portal and submit the report to the Academic Services Division. International students – Medical examination for Student Pass application In addition to the SIT medical examination, international students will need to complete the ICA Medical Report Form for application of Student Pass. The medical examination can be done in the country of origin or in Singapore. HIV test and chest X-ray reports, together with the ICA Medical Report form for Student Pass, must be submitted to the Immigration & Checkpoints Authority (ICA) within three months from date of issue of the reports. Note: The medical, laboratory test and X-ray reports MUST be written in English. Students may choose to consult their own physician or refer to the list of Recommended Clinics for Medical Examinations at student rates. Special medical conditions to note Epilepsy Students with this medical condition are strongly advised not to take up engineering programmes. Hepatitis B or Students are required to go for a liver function blood test, alpha-fetoprotein blood test and liver ultrasound. Hepatitis B screening results are valid only if done less than three months before the acceptance date. Where Hepatitis B immunisation is required, it has to be done within two months from the date of screening. Screening and immunisation can be done with any registered general practitioner. Hepatitis B carriers Partial Colour Blindness Students may not be eligible for certain programmes if they are unable to correctly identify red and green wires. Tuberculosis Students will need to be affirmed by our appointed doctors that they are no longer contagious. Students with other special needs (e.g. mobility issues, visual impairment, etc) should inform the Student Services Division to discuss special arrangements. Student needs to activate the account with MOE at “TGonline” b. Student applies for Tuition Grant and submits particulars of two sureties at “TGonline” Signing of Tuition Grant Agreement Sureties in Singapore a. Student and two sureties to sign Tuition Grant Agreement in SIT in the presence of an MOE Officer. b. The Ministry of Education does not allow the sending of Supplementary Tuition Grant Agreement to sureties in home country for Polytechnic students who have not been discharged or released from the Tuition Grant bond. Hence, sureties must be present for the signing on the scheduled date. Documents to bring along for the signing of the Tuition Grant Agreement: a. b. Student brings along his/her identity card. Sureties are required to bring along their identity card or passport. Sureties not in Singapore 1. Student prints a copy of the Tuition Grant Agreement at “TGonline”. The agreement must be printed single-sided on white A4 size paper. 2. Student sends Tuition Grant Agreement to sureties’ home country via courier services (e.g. DHL, FEDEX). 3. 4. Sureties to sign Tuition Grant Agreement in the presence of an acceptable overseas authority+ and return the Agreement to student as soon as possible. When a person expresses himself by creating a literary, dramatic, musical or artistic work, he has copyright in the work. Such work includes books, periodicals, magazines, compilations of information, photographs, diagrams, dances, scripts for plays, computer programmes, drawings, sculptures, musical scores, lyrics, sound recordings, cinematographic films, television broadcasts and cable programmes. The law protects the creator’s expression manifested through the work but not the information contained in the work. For example, where two persons present the same statistics in different ways, the law will allow each of them to publish their presentation and prevent others from publishing the same presentation. Others may use the same statistics to make different presentations. Copyright in literary, dramatic, musical and artistic works lasts for the lifetime of the creator and continues for 70 years after his death. Copyright in sound recordings and films lasts for 70 years from the date of first publication. Copyright in television and sound broadcasts and cable programmes lasts for 50 years from the end of the calendar year in which they were first broadcast or included in a cable programme service. Who owns copyright and what rights does the owner have? The creator of the work will own the copyright in it and so the law gives him the exclusive right to publish, reproduce, communicate and benefit from the work in other ways. Other persons cannot do so without the permission of the copyright owner. The copyright owner may permit others to publish, reproduce or communicate the work through agreements like licences. The owner may set conditions for such permission such as charging a fee. Exceptions However, the permission of the owner is not required: a. Where the work is copied for self-study or research, that is, only 1 article in a periodical publication is copied or not more than 10% is copied of a published work which consists of 10 pages or more or not more than 1 chapter is copied of a work which is divided into chapters. b. Where the work is in electronic form and not more than 10% of the total number of bytes in that edition is copied or 10% of the total number of words in that edition or of the contents of that edition is copied. c. Where a computer programme is reproduced on behalf of the owner as a back-up copy of the original computer programme. d. Where an audio visual work (such as sound recording, cinematograph film, sound broadcast, television broadcast or cable programme) is copied for research or private study, subject to certain qualifications specified in the Copyright Act. e. Where a film or recording of television or sound broadcast or cable programme is copied for private and domestic use. It should not be seen or heard in public. f. Where the recording of an audio visual work was made by, or on behalf of, SIT’s authority and is used only in the course of instruction at SIT. g. Where a literary, dramatic, musical or artistic work is copied for criticism or review, and for the reporting of current events, and sufficient acknowledgement of the work is made. h. Where a work was reproduced in the public interest. i. Where a work is copied after the copyright in the work ceases. STUDENT HANDBOOK | AY2012/13 44 What are the consequences of copyright infringement? In Singapore, copyright is protected mainly by the Copyright Act (Cap. 63). A person who publishes, reproduces or communicates a copyright work without the permission of the owner infringes his copyright. It is also an infringement to authorise others to infringe copyright, such as requesting a photocopying shop to make a copy of the book. The person who infringes copyright may be sued by the owner for monetary compensation such as profits made from the infringement. The court may also grant an injunction to prevent further infringement. Where the infringement is wilful and the infringement is significant or gives the infringer a commercial benefit, the infringer may be fined in court up to S$20,000 and/or jailed for not more than six months. Second or subsequent offences may attract the maximum fine of S$50,000 and a longer imprisonment term of not more than three years. An example of a significant infringement is the massive regular downloading of songs or movies using peer-to-peer networks. A person who is found with five or more infringing copies of any work is presumed to be in possession of them for sale and may be fined S$10,000 for each infringing article or S$100,000 whichever is lower. He may also be jailed for not longer than five years. In both cases, the infringing copies or anything used to make the infringing copies may be destroyed or surrendered to the copyright owner. Conclusion SIT takes a serious view of any infringement of copyright by students and a contravention of the provisions of the Copyright Act is deemed to be a breach of SIT’s rules and regulations, which could result in disciplinary action. SIT advises all students to respect the copyright of all copyright owners’ works and encourages the purchase of original textbooks, CDs, DVDs and/or other copyrighted materials that are required for students’ courses of study. The cost of these materials is insignificant compared to the penalties for copyright infringement.
