We are particularly proud that so many of our top artists
and songwriters have agreed to renew their deals with
UMPG. Those names include some of the most successful
artists and songwriters working today, including; Mariah

U.S. Copyright Board to Decide Digital Rates This Year as Industry Shows Cooperation
By David Israelite, President and CEO of the USA’s National Music Publishers Association (NMPA)
Real progress has been made
among industry groups representing different sides of the
rate setting trial before the
Copyright Royalty Board (CRB)
this year, in what has been
the most important effort in
many years on behalf of
songwriters and music publishers.
The financial livelihood of
every songwriter and music
publisher in America is at
stake as the CRB carries out
its periodic examination and
rate setting of mechanical
royalty rates for songs. This
proceeding is historic
because the Board for the
first time is setting rates for
digital as well as physical
products.
RATES
The CRB, which is expected to issue its decisions in
October, will set the rates for
five mechanical uses of
songs: CDs and other physical
sales, digital downloads, limited downloads, interactive
streaming and ring tones.
These rates will govern the
compulsory use of musical

works under Section 115 of
the Copyright Act through the
end of 2012.
This process is enormously
important to songwriters and
music publishers because for
many of them, mechanical
royalties make up their
largest source of income.
These rates are negotiated
completely separately from
performance rights and in
these proceedings means the
publishers are on opposite
sides of the table from both
the record labels and the digital music distributors.
PROPOSAL
But in recent weeks, the
NMPA has been working with
both the Recording Industry
Association of America (RIAA)
and the Digital Media
Association (DiMA) on a settlement involving two of the
rates – limited downloads
and interactive streaming.
This proposal has been
submitted to the Board for
consideration, and the terms
will remain confidential until
the Board issues its decisions
in October. But the coopera-
tion and good faith discussions that went into this effort
are a hopeful indication of the
potential for different parties
within the industry to work
together to the benefit of all.
The proposal represents
enormous progress, as
DiMA’s opening position on
interactive streaming was
that songwriters and music
publishers should not be paid
anything, notwithstanding the
fact that many of DiMA’s
members have been operating under agreements with
publishers dating back to
2001 acknowledging that
songwriters and publishers
should in fact be compensated in this manner.
No agreement was
reached on the other rates,
and NMPA, along with the
Nashville Songwriters
Association International
(NSAI) and the Songwriters
Guild of America (SGA), has
been working vigorously
since the initial hearing in
February to make the case for
fair rates.
Notably, RIAA and DiMA
both revised their original
rate proposals following the
compelling arguments presented by the songwriters
and music publishers. These
new proposals, while a step
in the right direction, still fall
short of the fair compensation
creators and publishers
deserve for their songs.
Our efforts continued vigorously throughout the rebuttal process in May, and we
now await the Board’s decisions.

CONTRIBUTIONS
The contributions of songwriters and music publishers
to the creation of songs, and
to the music industry overall,
are significant – indeed critical – to the success of the
industry. Music publishers
make a tremendous effort to
fund, develop, support and
promote songwriters. The
results of these efforts have
been consistently innovative,
exciting and attractive to
music consumers.

Viva la Vida

RULE THE CHARTS
Coldplay’s fourth studio album Viva la Vida or Death and All His Friends had an
incredible debut, landing at No. 1 on the Billboard Top 200 album charts, and garnering a No. 1 single for the first time in the band’s career on the Billboard Hot
100 with “Viva la Vida.” The band also charted record numbers in England, hitting
No. 1 on the U.K. album chart, while “Viva la Vida” hit No. 1 on the UK singles
chart.

Atlanta-based producer
Polow Da Don is no
stranger to success, having produced hit singles
and albums for artists like
the Pussycat Dolls, Fergie,
Ciara, and Jamie Foxx.
Now he can add ‘the
award winning’ to his
moniker, after picking up his first win as “Songwriter of
the Year” at the BMI Pop Awards. Polow’s currently
breaking new ground with the hit he produced for Usher
featuring Young Jeezy “Love in This Club.” Polow was
inspired to create the beat during his weekend stay in
Las Vegas for the MTV Video Music Awards, and when
finished working on the material felt it fit for Usher and
played it for him. In the song’s third week on the Hot 100,
it skyrocketed from number fifty-one to number one,
becoming Usher's eighth chart-topping single and the
first for Young Jeezy. It is the fourth highest jump to
number one of all time on the Hot 100. Internationally, so
far the single has reached No. 1 in New Zealand, No. 4 on

UMPG Spain has signed songwriter Manuel Alejandro, who

Cómplices. The album has already reached the No. 1 spot in

Austria in the first week of release. The single has the highest
number of pre-orders of all Idol singles in Germany to date.
UMPG Sweden celebrates No. 1 albums for Duffy, E.M.D., and
Amanda Jenssen on the Swedish charts. There were Top 10
albums from Andreas Kleerup, Sten & Stanley, Charlotte
Perrelli, and Håkan Hellström. Duffy’s Rockferry was the
biggest selling album of last month and has now gone platinum in Sweden, whilst Kate Ryan’s single “Ella Elle L’a” was
the biggest selling single. Charlotte Perrelli’s single “Hero”
remains in the Top 10 and has also gone platinum whilst

In Extremo’s album Sängerkrieg hit the German album charts
at No. 1. Mark Medlock’s single “Summerlove” entered the
charts at No. 1, marking his third No. 1 of the year. Thomas
Godoj’s single “Love Is You” (co-written by UMPG Germany’s
Michelle Leonard and Christoph Masbaum and UMPG
Sweden’s Will Simms) entered the singles chart at No. 1 and
also entered the European Billboard Charts at No. 4. Ich &
Ich’s album Vom Selben Stern remains in the Top 5 of the

a hip-hop artist, Bushido manages his label Ersguterjunge, home

At the ECHO 2008 awards Bushido won
the award for Best R&B Hip-Hop Act and

Meeting Between KMPA & KOMCA CHINA
The Korea Music Copyright
Association (KOMCA) is going to
establish its China branch to enhance

with “Miles Away” with TOYOTA, who has agreed to run a spinoff automobile TV commercial of the said drama. The dual tie-up

GReeeeN’s No. 1 Song
GReeeeN’s seventh single “Kiseki” was
recently released for digital downloads. On the
day of release, digital downloads exceeded
180,000 and the song charted No. 1 on the
digital download chart. This title has been
used as the main theme song for popular TV
drama “ROOKIES” on TBS (Tokyo Broadcasting System). The
physical single has sold more then 400,000 units and continues
to sell very well. The new album was released on June 25 with
an initial pressing of approximately 500,000 units.

Two days before “Mamma Mia!" opened in theaters, the soundtrack to the ABBAinspired musical charted higher on the U.S. album charts than any ABBA album, opening at No. 7. Produced by Benny Andersson, utilizing musicians that recorded the original tracks, the album features new versions of ABBA tunes performed by the cast,
including Meryl Streep, Julie Walters, and Pierce Brosnan.
ABBA remains one of the most commercially successful groups of the 1970s. Between
1974 and 1993, 11 titles by the Swedish quartet debuted on the Billboard album chart.
The last of those was ABBA Gold, which had the longest run of any ABBA album,
remaining on the charts for 104 weeks and selling over 24 million units world-wide.
ABBA has sold over 50 million products to date, including six platinum albums. UMPG
