MINUTES OF THE REGULAR MEETING OF THE
COUNCIL OF THE CITY OF MOUNTAIN HOME, ELMORE COUNTY, IDAHO,
HELD ON April 23rd, 2012, AT 6:00 P.M.
The Council of the City of Mountain Home, Elmore County, Idaho, met at the
Mountain Home City Hall Chambers, 160 South 3rd East, Mountain Home, Idaho
on April 23, 2012. A quorum was established with Councilman Anderson,
Councilman Urquidi, Councilwoman Isaac, Councilman Schipani and Mayor Rist
being present.
AWARD PRESENTATION – Fire Department
Chief Gridley asked Casey Ferguson, the victim of a house fire, to
come forward to help make the presentation.
He also asked Ray Chiarella
and Brandon Hines, the two gentlemen who saved Casey in the house fire, to
come forward for the award presentation.
Pam Chiarella was also present
because she called 911.
Chief Gridley stated on April 1st about 3:00 a.m. the fire department
was paged to a house fire on N. 14th E. When he showed up on scene he saw
Ray coming out of the smoke filled house, Casey was lying on the ground and
Brandon was taking care of her.
He said that both men were coming home
from a friend’s house and they noticed the house was full of smoke.
He
said that Ray and Pam banged on the door trying to see if anyone was in the
house and the door felt hot. Brandon showed up and he and Ray kicked in
the rear door of the house and brought Casey out.
Chief Gridley stated
that he thought that Casey was already dead when he got there because of
how bad she looked. He said that there is no doubt in his mind that Ray
and Brandon saved her life.
Mayor Rist presented plaques to both Ray and Brandon to show the
city’s deepest appreciation for what they did for the community. He said
that it is really remarkable what they did.

RECOGINZING PERSONS IN THE AUDIENCE WHO ARE NOT ON THE AGENDA – Youth
Center Report – Helen Lambert
Helen Lambert, Youth Center Treasurer gave the council an expense
report that showed this year and last year.
Mayor Rist stated that we are just a little ways away from heading
into the budget and the Youth Center is on the agenda. He said that he is
hearing good things about what is happening there.
He said that the
council appreciates the updates.
Helen stated that if the council ever had any questions that they
could contact them anytime.
Cameron Hale, Youth Center volunteer stated that they were trying to
keep the council aware of things they are trying to change so that the
council will be aware when it comes to the budget.
Mayor Rist asked if Helen had spoken

Mayor Rist stated that she needed to stop in City Hall and speak to
her so that they know what the council is expecting.
• John Urquidi, Citizen of Mountain Home stated that he wanted to talk
to the council about the zoning issues.
Mayor Rist stated that he was going to ask the council tonight when
the Planning and Zoning Recommendation came up, to set another public

hearing on this issue. He said that he would like this to be addressed on
the record at a public hearing. He said that he understood that there were
concerns and he thinks that the council would be able to express their
concerns at the public hearing.
John thanked the council for their time and would wait to speak at
the public hearing.
HUNDRED YEAR CELEBRATION OF 4-H - Presentation
Breanna Clark, Jessica Cook and Skyler Abrahamson, members of 4-H
were here to give a presentation to the council on the 4-H Hundred Year
Celebration.
Breanna stated that she has been a member of 4-H for 13 years and 4-H
has given her the confidence to speak in public and made many lifelong
friends. She said that they would like to give the council the history of
the Elmore County 4-H.
Jessica Cook stated that this is her 10th and final year in 4-H. She
said that she hopes to get into collegiate 4-H.
She said that 4-H has
given her the opportunity to learn about different species of livestock and
helped her figure out what she wanted her career to be.
Idaho’s first 4-H club was formed in Lemhi County in 1921 and the
program expanded throughout the state in 1923.
Skyler Abrahamson stated that she has been in 4-H for 5 years. She
said that 4-H gave her the opportunity to be noticed by the University of
Idaho because she is a 4-H state officer.
Skyler showed a PowerPoint presentation to the council and gave an
explanation.
Mayor Rist asked where the celebration was going to be held.
Skyler stated that the celebration is different in every county and
in Elmore County, they sent 100 cards to US airmen and cookies to the
troops serving in Afghanistan.
Jessica said that each club is doing something different.
Skyler stated that some clubs planted 100 trees or walked 100 miles.
Jessica stated that some clubs are doing 100 community service
projects.
She said that the big celebration will be during the Elmore
County Fair after the livestock sale.
Mayor Rist stated that we have 205 4-H members in Elmore County.
Jessica stated yes.
Mayor Rist asked how many are from Mountain Home.
Jessica stated she thought it was a 60/40 split with more kids from
Glenns Ferry than Mountain Home.
Mayor Rist asked if they held regular meetings.
Skyler stated that her club holds meetings every week.
Councilman Urquidi asked how many clubs were in Mountain Home.
Jessica stated 14.
Skyler stated that the clubs have different projects.

Mayor Rist asked if they used Optimist Park.
Skyler stated yes, that she rides out there often.
Jessica stated that they have Horse
Optimist Park and Open Show is in June.

Skyler stated last year they painted fences, picked up garbage and
worked the arena at Optimist Park.
Breanna stated that they would like to give the council 4-H
memorabilia as a thank you for giving Elmore County the chance to celebrate
100 Years of Idaho 4-H.
Mayor Rist thanked the girls for their presentation and information
on 4-H.

Councilman Urquidi made a motion to approve the Consent Agenda as
printed. Councilwoman Isaac seconded the motion.
Councilman Schipani stated that he would like to pull item H.
Mayor Rist stated that he would like to pull item D.
Mayor Rist pulled items D and H and placed them under New Business.
Councilman Urquidi asked what item J – APPROVE TWO QUITCLAIM DEEDS
deeding property belonging to Willow Creek Homeowners Association, Inc., to
the City of Mountain Home and Authorize the Mayor to sign both – referred
to.
Mayor Rist stated that the property is behind Rost Funeral Home and
originally he thought that property is where the house is, but it’s not.
Wayne Shepherd, Public Works Director stated that this all started
with Kate’s place and there is a surveying bust there. Depending on which
corner section you come off of, the property line between the cemetery
annex or Willow Creek townhomes, there is a gap that no one owns. He said
that when he spoke to the owners of Willow Creek townhomes, they wanted the
City to just take all the property behind the fence. He said that they are
willing to donate that and that is why there are two deeds, one for the gap
and one for the property behind the fence. The condition of the donation
is that the City would continue to take care of the storm runoff that comes
from the parking lot.

Mayor Rist stated that the survey out there is really messed up from
18th street to the back of the property and he thinks we finally have the
survey straightened out for the City property.
Councilman Urquidi stated that he thought the storm water was the big
issue there.

DEPARTMENT HEAD REPORTS
•
Stan Franks, Parks and Recreation Director gave the council a
handout.
He said the first thing he should address is there is a
conspiracy theory about the Good Counsel Hall. He said that the hospital
actually approached the City to partner with them to offer the hall for
recreation programs.
He said this is a good partnership and we have
partnered with them before on different activities with the hospital. He
said that we weren’t trying to undermine anything the Western Elmore County
Recreation District is doing.
Stan stated that the handouts that he gave the council show some of
the classes they are planning on having at the Good Counsel Hall. He said
the Good Counsel Hall provides Parks and Recreation a place where they can
have overnight camps that promote team building. He said that they usually
have to go out of town to have those kinds of camps.
Stan explained to the council that the Parks and Recreation
department are the kings of recycling and have started a couple of classes
on reusing items that would normally be thrown away. He said that they are
making clocks out of old Idaho Power line reels and flower boxes out of
pallets. He said the flower boxes come in handy when you don’t have a lot
of space to plant flowers, like an apartment.
Mayor Rist stated that when we do these programs, we charge for them
and we are hoping to break even and if they don’t, then Parks and
Recreation will drop that program.

Bonnie Harper, City Planner stated that we are working on
ordinances to get them updated.
Mayor Rist stated that he would be having a conference call on
Thursday with Susan Buxton, Federal Attorney, Wayne Shepherd and Bonnie
Harper about our ordinances. He said that they sat in on a conference call
last week over Adult Entertainment with several attorneys located
throughout the United States. He said that if you had questions, you could
call in and ask an attorney.
•
Luise House, Librarian stated that we received an Idaho Power
Easy Upgrade grant and received $4,800.00 worth of eco-green thermostats
and they are being installed now. She said that she gave all of the old
ones to Parks and Recreation.
She said that we are in the process of
posting the library grounds as No Smoking because we have had problems with
small children picking up cigarette butts and pretending that they are
smoking.
She said we are also working on finishing the States Internet
Filtration Law because it has to be in effect by October 2012.

Shirley Batchelor, Wastewater Superintendent stated that as of
last Monday, the farm is up and running in full operation.

Ron Whitesel, Water Superintendent stated that he is in the
process of getting information put on next month’s water bills on water
conservation and information that will help people with their sprinkler
system.
Mayor Rist stated that we had information put together from the
problems that we had last year and he asked if we still had that
information.
Ron stated that we are trying to keep it down to a 2 page flyer. He
said that he also sent out information to all the local sprinkler companies
and plumbers on the ordinance changes that we’ve made in regards to
sprinkler systems because people have been putting in sprinklers without
permits.
He said that he has gotten back really good feedback from the
sprinkler companies.

Rick Harvel, Street Superintendent stated that they were doing
routine maintenance.
•
Phil Gridley, Fire Chief stated that the fireworks have been
ordered and the street walkers are out in force collecting donations and
they seem to be doing really well.
•
Wayne Shepherd, Public Works Director stated that the DEQ water
project is out to bid and he is hoping he can present it to the council
during the first council meeting in May and he anticipates that
construction will begin the first week in June. He said the construction
will take place on Haskett, North of Sunset C and Haskett across from
Airbase Road.
He said that we are about a month behind on the 8th North
storm water project and there isn’t enough money to repave both streets, so
8th North will probably be patched, except for the intersection.
• Mayor Rist stated that tomorrow morning at 9:00 a.m. he will be
meeting with Mr. Ma along with Wayne Shepherd.
He is the owner of the
trailer park on 10th South and Main and he didn’t want to sell the piece of
property that is there, but he was willing to give the City an easement.
He said that he had Jay Friedly, City Attorney draw up an easement before
he left.
He said that we want a low ground, above ground sub-service
easement on there for water lines that we might have to add in the future.
Wayne stated that the piece of property was 500 square feet.
Mayor Rist stated that he hopes we can get this squared away with Mr.
Ma tomorrow.
• Nick Schilz, Police Chief stated that he was busy putting together
a crowd control plan.
Mayor Rist asked what the date was for Roaring Thunder.
Chief Schilz stated June 3rd.

Park.
Chief Schilz stated that the route is to come in off of Exit 95 and
go down 8th street and he will publicize that information to let the public
know that they can line up by the golf course and the police department to
see the motorcycles come into town. We will have to close off 10th street
in front of Carl Miller Park so they can park all of the motorcycles there.
When they leave they will head down American Legion and turn on 2nd Street
and out to Exit 90.

Chief Schilz stated that he couldn’t remember.
Mayor Rist stated that they go to Nampa for lunch so it’s going to
have to be sometime in the morning.
• Paula Szafranski, City Treasurer stated that we are finalizing the
budget and the council should have their budget books the 1st of May. She
said that we have been looking at the revenue for next year and she went
over what to expect during the audit with Department Heads and Supervisors.
• Mayor Rist stated that we had a lady come in today and they are
having something statewide at Mountain Home Air Force Base for police
officers. She wanted to know if we could donate a couple of rounds of golf
for a raffle item. He told her that it wasn’t on the agenda, but he would
bring it up to the council tonight. He thinks this is a worthy cause.
The council approved to donate two rounds of golf only.
• Councilwoman Isaac asked Bonnie Harper, City Planner if she had
already gone to Las Vegas for her conference.
Bonnie stated no, that it’s not until
different conference in Los Angeles last week.

could get a picture frame with the names of the golf board members on it to
display at the golf course.
Mayor Rist stated absolutely and he would take care of that.
Councilman Urquidi stated that a lot of people don’t know who is on
the golf board.

Mayor Rist stated that he has received a couple of phone calls about
this and people felt that they didn’t get the opportunity to speak about
this or weren’t completely aware of what was going on and he would ask the
council to set a public hearing at the earliest date, even though we are
not required to.
Councilman Urquidi made a motion to set a Public Hearing for the
proposed Ordinance for Sexually Oriented Businesses for 6:00 P.M. on
Monday, May 28th.
Nina Patterson, City Clerk stated Monday, May 28th was Memorial Day
Holiday so it would have to be on Tuesday, May 29th.

Councilman Urquidi amended his original motion to set a Public
Hearing for the proposed Ordinance for Sexually Oriented Businesses for
6:00 P.M. on Tuesday, May 29th. Councilwoman Isaac seconded the motion.
Councilman Schipani stated that he wouldn’t be here on May 29th.
Councilman Urquidi stated that he wasn’t going to be here on May 29th
either.
Councilwoman Isaac stated that we wouldn’t have a quorum.
Nina Patterson, City Clerk stated that we would have a quorum if
someone appeared by telephone.
Councilman Schipani stated that he could appear by telephone because
his class was over at 5:00 p.m.

DENY APPLICATION FOR SOLICITORS LICENSE for Jacob Claus with
Gemtek Pest Control to sell Pest Control Services Door to Door.
Mayor Rist asked Chief Schilz to explain why he was requesting this
to be denied.
Chief Schilz explained that on the application, under criminal
history, applicants are asked to put down anything that they have been
arrested for or received a citation of any importance. He said that Jacob
Claus put down that he had a DUI in 1999 and the criminal history check
showed that he had 3 other criminal arrests.

Mayor Rist asked Jacob if he would like to explain the findings.
Jacob Claus was present and stated that as a youth he was pretty
rambunctious and made some pour choices. He said that he turned his life
around and served a mission for his church and shortly before leaving on a
mission he wrote a letter to the judge asking that his record be expunged.
The judge stated that it would be expunged and that is why he didn’t
include the other arrests because he was under the assumption that his
record had been expunged. He said since 2008 he has received a solicitor
license from Boise and Meridian every year. He also has current solicitor
licenses for Kimberly and Twin Falls. He said that he was also a volunteer
fire fighter for the City of Eagle and they ran a background check.
He
said that he is also a nationally registered paramedic and he has a
concealed weapon permit and all of those background checks came back clean.
Councilman Schipani stated that we should be willing to give him a
chance and not deny him the ability to work here.
Mayor Rist stated that this is the reason we have the police
department run background checks and when something like this comes up and
there is a good explanation that this can be reconsidered.
He said it
would be up to the council to make that determination.

Chief Schilz stated that he didn’t have any problem accepting his
application if in fact his record has been expunged.
He said that it is
not uncommon that a judge makes that decision and then it doesn’t make it
to the records department to actually have it pulled. He said that if he
has other accreditations, like the paramedic license he has to go through a
pretty good check and if in fact those are true, he recommends that we
accept his application.

Councilman Urquidi made a motion to accept the application for a
solicitor’s license and Approve the Application for Solicitors License for
Jacob Clause with Gemtek Pest Control to sell Pest Control Services door to
door. Councilwoman Isaac seconded the motion.

FINAL COMMENTS
• Councilman Anderson stated that there were quite a few holes in
the streets around town that needed to be fixed. He asked if we were going
to get well #9 and well #15 going.
Mayor Rist stated that we approved a pump for well # 9 tonight.
Ron Whitesel, Water Superintendent stated that everything for the
wells were on order except for the pump that was approved tonight and the
delivery dates for most of the items will be the middle of May. He said
the last weekend showed signs that watering of the yards is here.
Mayor Rist stated that we have been running 1 well continually and
well #11 kicked on and then we had pressure issues and that triggered well
#13 to kick on as well.
Ron stated that we had 4 wells running all day today trying to catch
the tank up.

• Councilman Schipani stated that all the kids in his neighborhood
have been playing with the soccer balls that Republic Services donated to
Parks and Recreation.
