Whereas the Owner wishes to engage WWKC and WWKC agrees to undertake the services under the terms and provisions defined in this Dog Care Service Agreement as well as the Owner's Information sheet, Pet Information sheet(s) and the Veterinary Release Form which shall all become part of this Contract. Any reference to dogs or pets in this contract shall refer to those specified on the Pet Information sheet(s). Working Walks, K-9 Care, LLC provides loving at home pet care while owners are away. Whether you go on vacation, a business trip, need midday visit to walk, feed or cuddle your pet Working Walks, K-9 Care, LLC will be there when you can’t be. 1. Relationship and Responsibilities 1.1. The Owner retains the services of WWKC to provide the dog care services listed on Exhibit A (Schedule of Services and Costs). 1.2. WWKC undertakes to perform the agreed upon services in a professional, attentive, reliable and caring manner and the Owner undertakes to provide all necessary information to assist in this performance. WWKC and Owner each undertakes to notify the other of any occurrence or condition pertaining to the dog which may be relevant to the care and well-being of the dog. 1.4. WWKC reserves the right to walk other compatible dogs at the same time but undertakes to limit the number of dogs walked with one person to no more than 6 (six) dogs. 1.5. The Owner will provide suitable harnesses, collars and leads as approved by WWKC as well as coats or muzzles if required. 1.6. 2. WWKC shall not be obliged to perform any other duties except those specified on Exhibit A. Compensation 2.1. WWKC shall be paid according to the schedule of available services attached as Exhibit A. Owner and WWKC shall agree upon the scope of services which shall continue on a week-to-week basis unless the parties agree otherwise. 2.2. Owner shall pay WWKC in advance for all services to be performed by WWKC under this agreement, or at the discretion of WWKC, every two weeks (biweekly). 2.3 Late Payments: Late payments can and will result in either a $2.00 a day charge and/or delay of service or cancelation of contract. 2.4. Holidays: Holiday seasons are hectic for everyone - make your reservations early! There is an additional fee of $10.00 charged on these holidays - New Years Eve, New Years Day, Easter, Memorial Day, Fourth of July, Labor Day, Thanksgiving, Christmas Eve, and Christmas Day. WWKC accepts cash and personal checks as payment. There is a $35.00 “Return Check Fee”, for each and every check that is returned. 3. Duration; Termination 3.1. This Dog Walking Contract shall come into effect on the ___ day of ___________, 2013 and shall: A. Terminate on the __N/A____ day of _____N/A__________ 2014, unless either party gives 7 (seven) days written notice of termination, however, this agreement is terminable by either party immediately for cause. B. Be on going until a “Termination Notice” has been submitted by either party, with at least 24 (twenty four) hour notification. 3.2. Should any dog become aggressive or dangerous, WWKC may terminate this dog walking contract with immediate effect. 3.3. Any wrongful or misleading information in the Owner's Information or Pet Information sheets may constitute a breach of terms of this Agreement and be grounds for instant termination thereof. 3.4. Termination under the circumstances described in 3.3 or 3.4 above, shall not entitle the Owner to any refunds nor relief of any outstanding payments due. Cancellation of Service Visits 4.1. Either party may cancel a schedule service visit a minimum of 24 (twenty four) hours prior to the scheduled visit without incurring penalties or damages. 4.2. Cancellation by the Owner of scheduled service visit with less than 24 hrs notice may be charged at the full rate or rescheduled at the discretion of WWKC. 5. Insurance, Liability 5.1. Upon Owner’s request, WWKC will provide a copy of a certificate of insurance covering WWKC and WWKC’s employees and agents. Owner acknowledges that Owner is not covered by WWKC’s insurance policy and Owner is responsible for obtaining Owner’s own insurance coverage. 5.2. WWKC accepts no liability for any breach of security or loss of or damage to the Owner's property if any other person has access to the property during the term of this agreement. 5.3. WWKC shall not be liable for any mishap of whatsoever nature which may befall a dog or be caused by a dog that has unsupervised access to the outdoors, and WWKC shall not be liable for the injury, disappearance, death or fines of any pet with unsupervised access to the outdoors. 5.4. The Owner shall be liable for all medical expenses and damages resulting from an injury to WWKC or any employee, agent caused by the dog as well as damage to the Owner’s property or any other person or property. 5.5. WWKC is released from all liability related to transporting dog(s) to and from any veterinary clinic or kennel, the medical treatment of the dog(s) and the expense thereof. 6. Indemnification Owner acknowledges and agrees that all animals are cared for by WWKC without liability on WWKC’s part for any loss or damage inflicted upon or caused by Owner’s pet(s) including, without limitation, disease, death, running away, theft, automobile accidents, fire, injury to persons or other animals, or damage to property or other unavoidable circumstances. Owner agrees to indemnify and hold harmless WWKC from any claims, causes of action, obligations, costs, judgments, attorney fees and attachments arising from or in any way connected with services rendered to Owner, except to the extent caused the gross negligence or willful conduct of WWKC or its employees or agents. 7. Emergencies In the event of an emergency, WWKC shall attempt to contact the Owner at the numbers provided to confirm the Owner's choice of action. If the Owner (or alternate contact) cannot be reached in a timely manner, WWKC is authorized to: 7.1. Transport dog(s) to the listed veterinarian; 7.2. Request on-site treatment from a veterinarian; 7.3. Transport the dog(s) to an emergency clinic or another veterinarian if the previous two options are not feasible. Overnights 8.1. Reservations: It is best to plan a couple of weeks in advance in order to obtain services on the dates you desire. An in-home interview is required, prior to reservations, for all new clients. While we can tentatively pencil in your dates we must meet you and your pets and assess your needs before we make a commitment to providing for your pets’ care. During this initial meeting we will also review and complete forms and sign agreements. Please have client and pet profiles completed for this initial visit, in the event you received a Welcome Kit in advance of this visit. 8.2. Reservation confirmation: Always directly confirm your reservation with WWKC. This ensures that we won't miss your message and your pets’ care will continue uninterrupted. 8.3. Extended Absence: In the event you have to be away longer than planned it is mandatory that we hear from you! We will only accept extensions of service by direct confirmation. Your pets’ well-being depends on our communication 8.4. “Comfort Calls”: You may call WWKC between 10 a.m. and 10 p.m. _ET daily to check on your pet during your absence. Since I’m often out of the office, please leave a message and your call will be returned promptly. 8.5. “Honey, I’m Home” calls: Please remember to call when you have returned home safely! Otherwise, I will need to continue visiting to assure the safety and well-being of your pets. Additional trips will be added to your bill at the regular rate. Please call at ANY hour and leave a voice message that you have returned. 9. Security 9.1. WWKC warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Owner and to return same to the Owner at the end of the contract period or immediately upon demand. 9.2. Additional Pet Care Assistance And Other Scheduled Services: We all want our pets to have all the love and attention they deserve, but please be advised that if there are other persons entering and leaving your home, WWKC can not be held liable for any damages or problems that may arise as a result. Please inform us at the time of the consultation of anyone who may have access to your home while you are away. This includes cleaning services, repairpersons, friends, family and neighbors. WWKC does not accept liability for other persons who will be in your home during pet care and health services. 10. Relaxation of Terms No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms. 11. Dog Licenses and Vaccinations Owner is solely responsible for all required pet licenses and vaccinations and certifies that all required licenses and vaccinations are current and up to date. Owner agrees to immediately inform WWKC of any illness contracted by Owner’s dog and Owner agrees to indemnify and hold harmless WWKC for Owner’s breach of this provision. Pet Visits 12.1. Visit times: WWKC will visit at the requested times as closely as possible. However, if we are caring for multiple pets, the times may be shifted a little to accommodate our clients. We will do our very best to arrive at the appointed times 12.2. Working Walks, K-9 Care, LLC agrees to provide: administration of oral medications, litter box cleaning/changing, feedings and change of water bowl services for you and your pet(s). The services will be start on the ___ day of, ____________ 2013. The total number of visits will be _________________ each week. 12.3. You will be charged ___$15__per _1/2 hr mid-day walks__ (M-F), unless otherwise specified. Payment for the Dog Walking & Exercising services is due upon the first day of service. So as to not be charged, all cancellations must be made twenty-four (24) hours in advance and must be acknowledged by the Company. 12.4. You will be charged $____N/A___ as a deposit fee; these monies represent two weeks of services rendered in accordance with our bi-monthly billing cycle. All deposited funds will be applied to your final invoice. 12.5. Services will be performed in accordance with the instructions contained herein. Inclement Weather: In the event of inclement weather, WWKC has requested on your contract the name and phone number of a person living nearby. If WWKC is physically unable to reach your home due to impassable roads, please provide us with this information so that we can contact this person to request assistance. Your pets’ health and well-being is our utmost concern and we will contact you as soon as possible to keep you informed of these events. 14. General 14.1. House Cleanliness: WWKC will clean up after your pets to the best of our ability. Please inform us of the designated area for the appropriate cleaning supplies. If there are accidents above and beyond the normal amount anticipated, (Provider) will charge a reasonable fee for clean up time. 14.2. Fences: Fenced yards are great play spaces for pets, however, no fence system is totally secure for your pet’s safety and WWKC does not accept responsibility or liability for any customer’s pet that escapes, is injured or becomes lost, fatal or otherwise, when pets are left out or given access to a fenced in area. This includes electric, wood, metal or any other fence type. We need and want to know of any changes in the health and behavior of your pet. The parties agree that any or all parts of this agreement may be submitted to the other party in electronic form (such as e-mail or facsimile) and upon receipt by the receiving party shall become valid parts of the agreement.
