It is submitted that in 205th meeting of the F&CC held on 21.3.2011, against agenda
item No. 10 regarding recovery of ground rent from the Cable Operators, Mayor desired that a detailed
agenda be prepared and brought before the House for information and taking policy decision.
In this connection, it is submitted that as per office record presently 115 cable operators
are running their business in various sectors in the city of Chandigarh. As per policy of the Municipal
Corporation, Chandigarh each cable operator is required to deposit ground rent @ Rs. 1000/- per
month per sector and Rs. 500/- per month per Sub- Sector for the area in which cable operator is
operating up to two Sub-Sectors.
Proper record of the Cable Operators is being maintained. Regular notices are being
issued to them for recovery of pending dues from time to time.
The detail of sector wise cable operators and the pending dues is also annexed as
Annexure ‘A’. for perusal.
A number of the cable operators are not depositing the ground rent in time, which
causes revenue loss to the Municipal Corporation, Chandigarh. It is proposed that policy may kindly be
framed on the following points:1.
That all the cable operators should deposit the ground rent quarterly in advance by 10 th of the
month on the start of each quarter, failing which cable operators shall be liable to interest @
15% per annum from the first day of the month in which the payment falls dues up to the date
of actual payment.
2.
That the Road Wing of Municipal Corporation, Chandigarh may kindly be associated for
identifying cable operators in their respective jurisdiction so that necessary action against the
defaulter cable operators can effectively be taken.
3.
That the cable operators, who are found defaulter on three occasions, should not be permitted to

The above said CWP No.5144 of 2007 was disposed off by the Hon’ble High Court vide order dated
15.05.2009 with following observations.
“Suffice it to say that the Sejah Safai Kendra is one of the essential services need to be
provided to the residents of every sector in Chandigarh as that is the only place where
the entire garbage, collected from different houses is dumped temporarily before it is
taken to the dumping ground outside the city on the same day. The Sehaj Safai Kendra
has to be, therefore, essentially located within the sector only to maintain the hygienic
conditions in the city. The Petitioner’s prayer for shifting of Sehaj Safai Kendra away
from the school, when no other suitable alternative site has been pointed out, cannot be
entertained.”
The writ petition is accordingly disposed of with a direction to the respondent –
Corporation to meticulously comply with the order dated 01.04.2009, referred to above.
The petitioner has also made some grievance regarding construction of wall of the
Sehaj Safai Kendra. It is directed that the wall, if any, be constructed/raised as per the

Hon’ble Mr. Justice Surya Kant, wherein it has been observed by the Hon’ble Court that
the petitioner’s prayer for shifting of Sehaj Safai Kendra away from school, when no
other suitable alternative site has been pointed out, cannot be entertained. Apart from
this, the other prayers to remove 2feet high wall which has been raised against the natural
flow of the rain water and regarding construction of pucca road in front of petitioner’s
school as per the lay out plan, have not been discussed.
OR
To issue any other writ, order or direction, which this court may deem, fit in the facts and
circumstances of the case.”
During the hearing of above said case on 31.01.2011, the Hon’ble High Court of Punjab
& Haryana passed orders to submit such alternative methods of garbage disposal that may be
considered feasible by the Corporation in the form of Status report.
By complying the orders of Hon’ble High Court of Punjab & Haryana, a status report was submitted
on dated 11.03.2011. A copy of status report submitted in Hon’ble High Court of Punjab & Haryana on
dated 11.03.2011 is annexed at X-1 and Hon’ble High Court of Punjab & Haryana passed the orders on
dated 11.03.2011 which are reproduced as under:
“We have perused the status report filed by the Municipal Corporation containing the
perceptions of the Corporation with regard to garbage disposal in the city of Chandigarh.
The Chandigarh is a small city having a minimum population compared to other cities of
the country and over and above all that it is an organized city having well planned
sectors.
It is inconceivable that in a city like Chandigarh, citizens should be heard to
complain about inadequacies in system of garbage disposal. Such problems arise due to
the present method of maintaining collection centres where garbage is deposited by the
resident at any time of the day and the night and collection and removal thereof from
such collection centres though sought to be regulated takes place several hours after the
garbage is deposited. The consequential decay in the sort of garbage poses a health
hazard towards residents, particularly those residing in the immediate vicinity of the
collection centres. We have also perused the measures suggested by the Corporation
which have been taken on record by the learned Single Judge and marked with the letter
‘A’. We are not entirely satisfied that what is being recorded in the said document is
containing effective methods of garbage disposal.
In the aforesaid circumstances, the Municipal Corporation is directed to seriously
reconsider what would be immediate effective measures that can be implemented without
bringing in other agencies/departments into picture which is what has been suggested in
the status report. Though it is for the Corporation and the residents themselves to provide
a solution to the problem of garbage disposal and the role of the Court in such matters
has to be avoided unless absolutely necessary, we are of the view that the Corporation
should seriously consider implementation of a method by which each resident is made
responsible for how the garbage of his household which can be emptied to the garbage
disposal trucks has to be operated in specified hours instead of emptying the same into the
garbage collection centres that are now in existence. What has been suggested above need
not be the final word in the matter and if more effective methods of garbage disposal can
be received by the Corporation, it will always be open for the Corporation to adopt such
methods. We would expect necessary action in terms of the present directions to be taken
by the Corporation and the result thereof be laid before the Court at the end of four
weeks from today.”
The said case is fixed for hearing on 30.5.2011.
In view of above, the Agenda is placed before the General House of Municipal
Corporation, Chandigarh for its consideration and directions please.

SUPPLEMENTARY AGENDA ITEM NO. 3
Subject:
Construction of RCC box for channalization of open nallah passing through
Manimajra town Chandigarh.
This storm water nallah/choe emanates from Indira Colony at Chandigarh Kalka
railway track. The railway authorities have already constructed culvert below the railway track of
approx. size 10’ x 10’ to dispose off the upstream water of I.T. park and part of Mansa Devi Complex
in this choe. The terrain on the upstream of Indira Colony is at higher altitude. The storm water from
these areas rushes towards Indira Colony and Darshani Bagh through this culvert and open nallah.
This open nallah enters the Darshani Bagh and further in the Old Abadi of Manimajra.
The said nallah is meant for disposal of storm water but people dispose off solid waste and bio medical
waste in this nallah. This is not only unhygienic for the public but also an eyesore. With the passage of
time the section of the nallah has widened which has occupied valuable land of Town.
In rainy season, this nallah runs full because water from nearby area of I.T. park, Mansa
Devi Complex enters in Manimajra being at low altitude. There are number of buildings constructed by
private house owners on both sides of nallah in Old Abadi. It is always risky due to erosion of earth/
foundation during the rainy period in the absence of any retaining wall.
In order to overcome this problem and to create hygienic condition in the town, it has
been proposed to channalize this nallah/ Choe by providing RCC box with the provision of manhole/
chutes. This will also help to reclaim the Govt./ MC land occupied by nallah due to un-necessary
widening because of erosion. The detailed estimate amounting to Rs. 11.81 Crore has been prepared to
accord the administrative approval of competent authority.
The house of Municipal Corporation has already approved budget of 21.00 Crore for
Storm water Drainage. The part of the expenditure will be met from budget approved by the house for
the year 2011-12.
As such detail estimate amounting to Rs. 11.81 Crore duly allowed by competent
authority, is hereby placed before house of the Corporation for consideration and approval.
