GAÑGAN, Chairman Republic of the Philippines Malacañang MEMORANDUM FROM THE EXECUTIVE SECRETARY FOR : All Department Secretaries, Heads of Agencies and Government-Owned and Controlled Corporations SUBJECT : INVENTORY OF ALL REAL PROPERTIES OF GOVERNMENT LOCATED LOCALLY AND ABROAD DATE AUGUST 20, 1998 : THE PHILIPPINE Pursuant to Administrative Order No. 5 (dated July 20, 1998), on the disposition of government real properties, you are hereby directed to undertake an inventory of all real properties of the Philippine Government under the stewardship of your department, agency or GOCC. Please submit to the Office of the Executive Secretary through the Presidential Management Staff, the list of said properties including the following information, on or before 15 September 1998: 1.1 1.2 1.3 1.4 1.5 History of acquisition; Location/address; Number and total area; Book/market values; and Status of utilization, among others. ZAMORA DEFINITION OF TERMS FOR THE INVENTORY OF ALL REAL PROPERTIES OF THE PHILIPPINE GOVERNMENT LOCATED LOCALLY AND ABROAD Site Description Location - This refers to the exact location of the property being appraised situated in a certain locality by way of the technical descriptions on the land title (TCT) aside from the address mentioned where it is situated. Property Ownership - This pertains to the entity who owns the property lands as private individuals in the state. Claim to Ownership - This refers to the documents serving as bases of awarding Torrens Title, Transfer Certificate Title, Copy of Tax Declaration or Copy of Real Estate Tax Receipt. Mode of Acquisition - This pertains to the means/ways by which the government acquired the property; e.g. sale, donation, eminent domain, escheat, judgment levy and foreclosure of mortgage. Legal Document Available - This refers to the papers at hand with respect to the property. Liens/Encumbrances/Legal Problems - This refers to conditions which prevent an outright disposal of property. lien - right to take or hold property of a debtor as a payment or severity from a debt or obligation; encumbrance - legal right to hinder or impede the transfer of ownership; restrictions - conditions set forth in the usage of property. Property Limitation Hazards - This pertains to the restrictions on ownership and use of the property. This include (1) limitations imposed by law, e.g. legal easement, zoning advances; (2) limitations set by the owner such as the owner of a subdivision imposes a height requirement on all buildings to be erected; (3) limitations imposed by the owner who conveyed the property such as the conditions in the Deed of Donation; and (4) defective conveyances which represent a cloud of doubt on the validity of documents. Area - This means the size of the land or building in square meters. Market Value - This is one basis for the amount in which the property is to be disposed of. It is the amount which can be bought or sold for at the real estate market, between a willing buyer and willing seller, both having reasonable knowledge of all relevant facts and with equity to both. Property Classification - This pertains to the classification of property based on ownership. These classifications are the following: 1. public domain - properties intended for public use, public service or for the development of national wealth. 2. patrimonial property - properties owned by the state but are not intended for public use, public service or for the development of national wealth. 3. private ownership - property belonging to private persons either individually or collectively. Cost of Acquisition - This refers to the indication of the amount of outlay that the government spent or paid for acquiring the property. Physical Condition - This pertains to the tangible state of the property. Property Utilization - This refers to the usage which will be adopted for the property - whether for commercial, agricultural or residential purposes, or a mix of these
