VENDOR RULES AND REGULATIONS

Vendors with stands must be located in an area zoned for business purposes. No
vendors are allowed to set up on a public street, sidewalk, alley, or park without
the consent of the City. A vendor must obtain written consent from the property
owner to use the premises, and proof of such permission must accompany the
application form.
Vendor activities shall be limited to the following hours: 8:00 a.m. to 10:00
p.m.
Vendors using portable or movable carts or platforms to display merchandise or
wares, and vendors walking with their merchandise or wares attached to items
being held or otherwise contained on the vendor, shall not interfere with ordinary
pedestrian or vehicular traffic, and shall continue moving, stopping only to
complete sales.
Motor vehicle vendors should keep moving, stopping only to make sales and not
to draw crowds, and must not obstruct other traffic.
Food sales are subject to all rules and regulations of the County Health
Department, and require prior County Health Department approval.
No vendor may use noise generated items or obtrusive lighting to attract
attention to his vending activities.
No vendor shall sell any goods, wares, merchandise or food other than those
disclosed in his application.
No vendor shall enter upon or remain upon any private residence, retail
establishment, or other business place if directed to depart by the owner,
occupant, or other authorized person in charge of the premises. Violation of this
provision is declared to be a nuisance subject to fine and abatement by municipal
law enforcement officers.
REVOATION OF PERMIT: If the holder of a permit, or any agent or representative
thereof, shall make any false statements or representations in the application, or
conceal any fact material to the operation of vending activities; or conducts vending
activities in a manner detrimental to the public health, safety or welfare, or contrary to
the provisions of this Ordinance, the Mayor may direct the City Clerk to revoke the
permit without prior notice and with immediate effect.
RIGHT TO APPEAL: If an applicant is denied a permit or a permit is revoked as
provided herein, the person may appeal the decision of the City Clerk (denying the
application) or the Mayor (directing the revocation of the permit) to the City Council at
its next regularly scheduled meeting. By a majority vote, the City Council may override
the decision of the City Clerk or Mayor.
