Salisbury University Solicitation Policy October 1, 2015 Overview This policy was established to prevent harassment and nuisance in connection with University-related solicitation activities to Salisbury University students, employees and visitors, and to assist with the continuity of orderly business at the University. University buildings or campus spaces may not be used to raise money or to solicit commercial goods or services for any individual or organization other than by a University affiliated group. Exceptions may be permitted, as appropriate, for: 1. Sponsored or cosponsored events with merchandise or solicitations directly related to and supportive of the event’s primary purpose, such as CDs sold at a University concert or books sold in connection with a lecture series. Activity is limited to participants of the event. A solicitation permit is required from the Office of Student Affairs or designee (212 Guerrieri University Center, 410-543-6080). 2. Charitable organizations (tax deductible under the Internal Revenue Code) using University space for an event may solicit funds to invited participants in compliance with Maryland State Code for solicitation of contributions. A solicitation permit is required from the Office of Student Affairs. 3. Vendors that have contracts with Salisbury University to provide services and products on campus. Vendors who have questions should contact the appropriate University sponsoring authority associated with the vending contract. 4. Employers wishing to solicit students for off campus jobs. Those interested must register and be approved by the Career Services Office located in 133 Guerrieri University Center, 410-5436075. 5. Businesses or organizations with license agreements with Salisbury University to use University facilities. Licensees who have questions should contact the appropriate University sponsoring authority associated with the licensing agreement. Off campus firms, organizations or individuals are restricted from conducting commercial merchandising and solicitation activities on campus. Non-student affiliation groups and departments are subject to the Policy on Soliciting Personnel During Work Hours (http://www.usmh.usmd.edu/regents/bylaws/SectionVII/VII220.html) Any merchandising activity conducted on the campus by an officially recognized student organization is subject to the Policy on Student and Student Organization. When on University property and/or conducting approved solicitation activity, all University and University System of Maryland policies, including, but not limited to, policies regarding conduct (for example, the Student Code of Conduct, employee policies, and Facilities Use Policies) are in full force and effect. Electronic Solicitations Electronic solicitations using Salisbury University-sponsored electronic media (email, twitter, Facebook, etc.) is prohibited by non-University affiliated personnel. Students found to be providing unauthorized access to electronic media for the purpose of supporting a non-University commercial entity could face charges through the Code of Conduct. Staff and Faculty could face Human Resources actions. Salisbury University provides the Campus Bulletin Digest (CBD) as a framework to allow electronic solicitations within the campus community. The CBD is intended only for use by students, faculty and staff. Such solicitations, unless part of the employee’s assigned duties or approved by the University President or designee, are prohibited. “Solicitation” is defined as a request for money, goods, services, or endorsements for personal, commercial, political, governmental, or charitable purposes. The University President has approved one solicitation to employees per year for the Maryland Charity Campaign and for the Salisbury University Foundation. Otherwise, employee solicitations are generally prohibited. For More Information: See BOR VII – 2.20 Policy on Soliciting Personnel During Work Hours http://www.salisbury.edu/hr/Forms/Staff%20Employee%20Handbook%20Updated%20January %202011.pdf#page=86 SU Policy on Student and Student Organization Solicitation Solicitation by or of individual students and/or student organizations on University property, including, but not limited to, the residence halls, academic buildings, the University Center, and the Commons, is prohibited except by prior written approval from the University through the Office of Student Affairs (212 GUC). Approved solicitation, distribution, or sale of goods by, of or for students may be undertaken in the following campus areas: GUC, Dining Commons, and the University Pergola area. GUC solicitations are coordinated by the GUC Office located in 223 GUC (x36100). Commons and Pergola solicitations are coordinated by the Facilities Reservation Office, 200 Commons Building (x82208). The University maintains the right to approve the time, manner, and place of solicitation. Non-students who violate the solicitation policy may be trespassing on University property and may be subject to legal prosecution. Sanctions for students who are found to be in violation of this policy range from warning to suspension. Additionally, students who inappropriately and without authorization solicit on behalf of a non-University entity face conduct sanctions. Student organizations that wish to solicit on University property in connection with a fund-raising project or on behalf of a nonprofit charity must request and receive prior written approval from the Office of Student Activities, 125 GUC (x36125). Violations of this policy are subject to disciplinary action under the Student Code of Conduct and may affect national organization status as well. Sanctions for student organizations found to be in violation of the policy range from warning to disaffiliation with the University. Raffles are subject to restriction under Maryland law and may only be conducted consistent with the Maryland Code, Criminal Law Article, Titles 12 and 13 as may be amended or any other applicable statute or regulation. Solicitation Requests and Enforcement Student and Student Organization solicitation permit requests should be made using the appropriate Solicitation Request Form, attached hereto, at least one week in advance of the anticipated activity, should be made by forwarding the request to the Office of Student Activities, 125 GUC (x36125). Nonstudent requests of a non-commercial, free speech nature should be sent to the Office of Student Affairs as well. A copy of the approved permit must be carried by the solicitor at all times while on campus. Complaints about solicitations and merchandising activities shall be referred to the Office of Student Affairs or other designee, 212 GUC at 410 543-6080 or on campus at (x36080). For complaints about students or student organizations, the Dean of Students or designee may initiate disciplinary action, as appropriate. SU Policy on Posting The University reserves the right to limit the time, manner and place of student and non-student posting on University property. Students or student organizations should contact the Office of Student Activities and the Undergraduate Student Government Association, 125 GUC 410 543-6125 or on campus at (x36125) for permission to post materials on University property. For posting in the University residence halls, the Residence Life office must approve the posting. For general University property advertising and posting, the following policy applies: Flyers and posters advertising events on University property are to be posted on the main campus only, and only in approved and designated locations. Off campus advertising that is in violation of the Student Code of Conduct is not permitted. Materials must be posted on approved locations only, including kiosks, public bulletin boards, and display cases. Posting any material on buildings, walls, trees, sidewalks, utility poles, etc. is prohibited. Posters and flyers must not exceed 11 x 17 and are limited to two per kiosk/posting area. Advertising materials should include the name(s) of the sponsoring/advertising group, date, time and location of the event. Materials must be removed by the individuals or group posting within one week of the conclusion of the event. Posting in academic buildings should only occur on approved posting boards. Some academic buildings may not have any free posting boards, which limits the ability to post in those buildings. Taping or stapling on walls or windows is not permitted. Events may not be advertised by posting until official approval is received by the Office of Student Activities and the Undergraduate Student Government Association. A limited number of venues are available for non-University affiliated groups or individuals to post information or materials. Each of the outdoor kiosks has a location for non-University affiliated postings. The University has the right to review and remove postings that are in violation of the law or University Policy. Public Forums on University Property Salisbury University offers sites for public forums.
