willful misrepresentation in violation of
sections 6067, 6126 and 6127 of the
California Business & Professions Code
Greetings Regents of U.C.:
Formal NOTICE is hereby given to you that the attorneys from the
Office of the General Counsel for the Regents of the University of
California who attempted to appear on your behalf in Mitchell v. AOL
Time Warner, Inc. et al., did so without the credentials required by
section 6067 of the California Business and Professions Code (“CBPC”).
Such willful misrepresentation is a misdemeanor violation of CBPC
section 6126 and also contempt of court for violating CBPC section
6127.
Accordingly, formal DEMAND is hereby made of you to exhibit any and
all lawful powers and authorities by which said attorneys might claim
to have been authorized to make formal appearances in federal courts
without the credentials required by CBPC section 6067.
Your timely professional response must be received by us in writing no
later than 5:00 p.m. on Friday, January 17, 2003 A.D. (approximately
30 calendar days hence).
Beyond that deadline, your silence will
constitute a fraud, pursuant to the holding in U.S. v. Tweel, and your
silence will also activate estoppel, pursuant to the holding in
Carmine v. Bowen [full cites omitted].
