Subject: Crimes; larceny and embezzlement

Statement of purpose: This bill proposes to amend the embezzlement statute to
7
include theft of money from a cash drawer or register by an employee or
8
similar person.

AN ACT RELATING TO EMBEZZLEMENT

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1. 13 V.S.A. § 2531 is amended to read:

§ 2531. EMBEZZLEMENT GENERALLY
13
(a) An officer, agent, bailee for hire, clerk or servant of a banking
14
association or an incorporated company, or a clerk, agent, bailee for hire,
15
officer or servant of a private person, partnership, tradesunion, joint stock
16
company, unincorporated association, fraternal or benevolent association,
17
except apprentices and other persons under the age of sixteen 16 years, who
18
embezzles or fraudulently converts to his or her own use, or takes or secretes
19
with intent to embezzle or fraudulently convert to his or her own use, money or
20
other property which comes into his or her possession or is under his or her

care by virtue of such employment, notwithstanding he or she may have an

interest in such money or property, shall be guilty of embezzlement and shall
3
be imprisoned not more than ten years or fined not more than $500.00, or both.

(b) For purposes of this section, a person who has responsibility for a cash
5
drawer or register in circumstances designated in subsection (a) of this section
6
shall be considered to have lawful possession of the funds. Thus, any person
7
who, with fraudulent intent, converts funds from the cash drawer or register to
8
his or her own use is guilty of embezzlement.
