“INSTRUCTIONS TO THE TENDERER”
Tender complete will all prescribed particulars duly filled-in together with description enclosed and
same should be submitted in two sealed envelopes with addressed to Executive Engineer, (O&M)
Division, M.S.E.Dist. Co.Ltd., Vidyut Bhavan, 1st Floor, Ratanlal Plots, Akola, must be delivered at
the above address on or before 11/04/08 up to 16.00 Hrs. The sealed envelop should be clearly
subscribed with following information.

Work contract for erection of outdoor circuit breaker and switch gear, and other related
works with renovation of 33 KV Dabki Sub – Station Under O&M Division M.S.E.D.C.Ltd.
Akola(U).
1. The detail specification with general Terms & Conditions of the tender and prescribed format
will be available in the office of Executive Engineer O&M Division MSEDCL Akola (U) on
non refundable payment of Rs. 500/-(Five Hundreds) in cost or Rs. 600/- if desired by Post
of during office Hrs. on any working day from 08.04.08 to 11.04.08.
2. The due date of acceptance of tender is 11.04.08 up to 15.00 Hrs. and will be opened on next
day at 11..00Hrs. if possible at the office of undersigned in presence of such tenderer who
are willing to be present at that time opening of tender.
3. Receipt of the payment of earnest money of Rs. 10,000/- in respect of this tender should be
attached along with tender.
However the payment of earnest money should be made
separately with our cashier latest by 15.00 hrs. on dt.11.04.08 or by D.D. payable on Bank
at Akola in favour of Executive Engineer, O&M Division, Akola(U). The Payment by
cheque or by I.P.O. will not be accepted.
4. No. E.M.D. in cash will be accepted after 15.00 Hrs. and tender box will be sealed at 17.00
Hrs. Sharply and no tender will be accepted after 15.00 Hrs. on dt.11.04.08.
5. Validity of tender should be at least 60 days from the date of opening of tender.
6. The tenderer should carefully read the terms and conditions of the Tender and follow the
instructions contained therein scrupulously before submission of Tender. In case of any
omission in the tender, the tender shall be liable for rejection. If the tenderer has any doubts
in respect of any matter same should be got clarified in writing from the office of the
undersigned before submitting the Tender.
7. The tenderer should quote exact specification details in this tender.
8. All correction in the tender and particularly in rates must be initiated and dated by the tenders
and all pages should bear the initials of tenderer at the bottom of each page.
9. The tenders which do not fulfill any of the above conditions or in complete in any respect are
liable to be summarily rejected.

10. Experience certificate about erection of at least one 33 KV S/Stn. or above capacity S/Stn.
and attested copies of all relevant documents shall be furnished with tender along with the
details of work orders etc. of past and future.
11. The photocopies of Nationalized & Scheduled bank solvency certificate of Rs.10.00/- lakhs
(Ten lakhs) must be submitted while submitting the tender and should be able to produce the
original while finalizing the tender.
12. Tenderer should follow all the Terms & Conditions & attached all the required documents
duly attested along with tender / offer & employer will examine all the documents and if the
required documents are not attached with the tender, Employer decision will be final for
rejection & acceptance of tender.
13) The employer reserves the right to accept or reject any or a tender or any bids and to cancel the
bidding process and reject all bids at any time prior to award of contract, without thereby incoming
any liability of the affected bidder or bidders or any obligation to inform the affected bidder or
bidders on the grounds for the employers action.
14) The employer does not bind himself to accept the lowest or any bid, neither will any reason be
assigned for the rejection.
15) The employer reserves the right to split up the order, if in its opinion felt necessary in the interest of
the MSEDCL
16) If the other Bidder accept to work at lowest Rate received in offer the company may allot the work
splitting the work to such bidder. How ever the company reserves the rights to accept or reject the
offer.
17) Please don’ts tear multipliable scratch, smudge, scratch, stain the page of tender copy.
18) Tender should be submitted in 2 bids in separate sealed envelopes, super scribing detail i.e. No. of
bid, & name of bid, I st. bid i.e. qualifying bid. & II nd bid i.e. Rate bid.
19) 1 st bid e. qualifying bid should have following document.
1) Experience Certificate issued not below the rank of Ex-Engineer MSEDCL regarding of
erection of at least 3 nos. 33 KV or EHV sub station satisfactory.
2) Copy of Valid Electrical contractor License.
3) Copy of VAT registration.
4) Copy of Service Tax registration.
5) Valid copy of insurance under workman compensation act.
6) Copy of Registration under employee provident fund.
7) Solvency Cetificate issued by schedule Bank of Tender Amount.
8) Document regarding E.M.D. Payment.
20) II nd bid i.e. Rate bid should have tender document duly filled in & signed. With offer rate in

GENERAL TERMS AND CONDITIONS OF TENDER FOR WORK CONTRACT FOR

WORKS WITH RENOVATION OF 33KV DABKI SUB – STATION
UNDER O & M SUB
DIVISION NO. I, M.S.E.D.C.LTD. AKOLA (U)
1. The rate for item no.1 as per schedule “A” should be quoted on percentage basis of SE Akola’s
latest schedule of rate.
2. The rates for item no. 2 to 7 shall be quoted as per units prescribed in schedule “A”.
3. The rates inclusive or exclusive of Service Tax , VAT, Octroi or other Taxes should be clearely mentioned .
4. Quantity mentioned in schedule “A” for item no. 2 to 7 are approximate estimated quantity and
may vary while execution of work. Bill will be paid on the basis of actual work done and
measurement recorded by our site Engineer.
5. If supply of raw material like fabrication, Nut Bolts, Earthing material is made available by the
company for item no. 2to7 then contractor will have no rights claims bill as per item no. 2 to 5
and only labour charges will be paid as per SE Akola’s latest schedule of rates.
6. Order for the item no. 1 to 7 as per schedule “A” attached will be placed to one contractor and no
piece meal order will be placed item wise. Order will be finalized on overall rate quoted for item
no. 1 to 7. Decision of the undersigned for spilt of the order several bidder
7. The work which are not cover in the schedule A and in SE Akola’s schedule of rate, The
permission for carry out the such work should be sort before execution from the undersigned.
8. Contractors must have at least experience for erection of at least 1 no. 33 KV S/Stn. & complete
knowledge for the work of renovation & erection of 33 KV S/Stn. and all its equipment in
MSEDCL and other semi organization.
9. The eligible agency shall have to pay 5 % as Security Deposit in cash to MSEDCL. On the
demand against the letter of indent issued by this office. The same will be refunded after
completion of contract period.
10. On deposit of such amount only, the detailed order will be issued to the firm. If security deposit is not
paid by firm before stipulated period then the decision of Tender accepting authority i.e. Executive
Engineer, O&M Division Akola (U) will be final and binding on you. It will be presume that the agency
is not interested in execution of contract and work contract will be issued to other agency.
11. An agreement on appropriate value of stamp paper i.e. contract bond on stamp of Rs.100/- (Rs.
Hundred) only shall have to be executed with the MSEDCL to before commencement of the
work. The stamp fees will be borne by the agency.
12. The final amount of this Tender will be limited to Rs.10.00/- lakhs (Rs. Ten lakh only).
13. Agency shall make his own arrangements for this staff for attending the duties in time.
14. Each employees Provided by agency (a) Within the age of 18 to 45 year (with proof) (b)
Physically fit and without and disabilities or handicap. (c) While on duty, the employees should
not be intoxication of liquor.
15. Bio-data of each employees must be submitted to the S.D.O. concerned & in charge concerned &
this office before joining the duties, along with the police verification letter of each employees
16. The Electrical Contractor should be registered under –(i) Bombay shops and establishment Act,
1948 ii) Provident Fund Act of Commissioner of PF iii) Registered Establishment license
under section XII (2) of the contract labour (regulation and abolition) Act 1970 & Maharashtra
Labour Contract regulation & Abolition Act,1971.iv) Service Tax Act, Professional Tax act, v)
income tax vi)Copy of valid licensed of Electrical Contractor vii) solvency certificate of
Rs.10.00 Lakhs of scheduled bank along with tendered documents. and contractor should
attached attested copy’s of registration of this documents along with tender. The renewal of the
same will have to be done by the agency before their expiry dates
17. The Electrical Contractor will be responsible for compliance of all statutory obligations under
the factory Act, Contract Labour Act, Minimum wages Act, Contribution under the C.P.F.,
E.F.P.S. and ESIS Act in respect of his employees the rules and regulation of Contract Labour
Act shall be binding on the agency. The MSEDCL will not be responsible for violation of by the
Agency / Contractor / societies of these statutory rules and regulations.

18. It is the sole responsibility of Agency / Contractor / societies to observe all above acts and
regulations framed by the Government time to time along with amendments thereto. MSEDCL
will not be responsible for violation of the above stated regulations/Acts etc. by the agency. The
payment towards P.F. of each labour to the office of P.F. Commissioner is the agency’s
responsibility. The company will not be responsible for the same
19. The employees of Agency / Contractor / societies will not be bound by MSEDCL, Service
regulation as such they will not be entitled to for payment holidays and other facilities.
20. MSEDCL will not be responsible for any fatal or non fatal accident to the person/Employees of
the Agency / Contractor / societies.
21. If any type of misconduct or adverse report against the performance of the Agency / Contractor /
societies is reported to this office, the undersigned reserves rights to cancel the contract at any
stage. The decision of the undersigned in this regard will be final and binding on the agency.
22. The general terms and conditions of MSEDCL for tender & work contract will be binding on the
Agency / Contractor / societies.
23. The joining report along with list of employees of the contractor must be submitted to
Incharge concern or to S.D.O. concern under intimation to this office.
24. All photocopies of relevant documents should be at the bottom of each page and all corrections,
over writing must be duly initiated
25. The work shall be carried out strictly as per the instructions of the Engineer in charge of work.
26. The monthly payment of wages to employee shall be made in presence of company’s
representative before Tenth of next month.
27. After receipt of duly recorded & certified bills & M.B. from the S.D.O/In charge concerned, the
payment will be done by O&M Division, Akola (U) subject to availability of funds.
28. You will have to submit duty chart along with monthly bills and certificate to that effect that the
wages are paid to the employees as per prevailing act and provisions of minimum wages act.
29. Sub letting of contract will not be allowed other wise the contract will be terminated forthwith
and the security deposit will be forfeited.
30. Income tax and other applicable taxes will be deducted from the bills as per prevailing rules.
31. In case of failure to carry out the works during the contract period, MSEDCL will be at liberty to
get the work done departmentally or from any other agency at agency’s cost and risk and amount
will be deducted through the monthly bills.
32. Undersigned reserve the right to terminate the Tender/Contract at any stage without assigning
any reasons there of. Moreover merely. Tender Submission eligibility criteria, does not entitle
the bidder to claim the contract and no claims in this regard will be entertained.
33. All disputes differences arising out of or in connection with this awarding finalization of contract
of contract, if concluded, shall be subject to the exclusive jurisdiction Akola court only.
34. Insurance to cover the accident risk of all of contractors labors/ workers be done by the
contractor and copy of the insurance cover should be submitted to this office. In case of any
accident/ injury to contractor worker while caring out the work at work site the entire
responsibility will be of contractor and he will have to pay compensation as per workman’s
compensation act 1963 as amended up to date and / or any other application in such cases.
35. In order to judge the contractors ability, performance, capacity, Reliability, Quality of work etc.
M.S.E.D.C. Ltd may place the order in phases and contractor if fails in first phases the order for
next phases can be placed with the next higher offer.
36. General Discipline:
The Agency / contractor / Society & his employees shall maintain good character and decent
behaviors with all concerned. They will not allow indulge in drinking liquor, entry of
unauthorized persons and unscrupulous elements in the sub-stations and company’s
premises. Any person behaving in a manner controversy to the above will be replaced forth
with by the contractors

trench complete as directed.

150 MM dia, 3000MM long and 10MM thick with flat and

INSTRUCTIONS
WHILE PUBLISHING THE SHORT TENDER NOTICE THE FOLLOWING MAY BE
FOLLOWED CAREFULLY
1. The MSEDCL emblem should invariable published on the right had corner the top and it
should be of size supplied by publicity department (15x15)
2. The Vacant space on the left had size of the emblem at the top should be utilized to display
heading in this case Tender Notice.
3. The advertisement should not occupy more than tow column minimum space.
4. “Spacing Loading” while printing the matter should be kept minimum.
5. Spacing between tow lines of test mater should be kept minimum.
6. Matter should be printed in these points.
7. The word “MAHARASHTRA STATE DISTRIBUTION CO. LIMITED” should not
repeated at the bottom, as the same is inserted emblem.
8. Telegraphic address & telephonic numbers date on which advertisement is issued should not
be given in Adv.
9. At the end of advertisement only designation of the office is to be printed in “BOLD TYPE”
lettering.
10. The language of the advertisement should be the same as that of newspaper.
11. One copy of the news paper in which tender notice is published may be send immediately to
