CUSTOMS REGULATIONS
(AMENDMENT)
Regulations No. 1 of 1985

I, Raymond Edward Trebilco, Administrator of Norfolk Island, acting in
accordance with the advice of the Executive Council of Norfolk Island,
hereby make the following Regulations under the Customs Act 1913.

New Regulation
1.
The Customs Regulations are amended by adding after
regulation 6 the following:
Working days and hours
“ 7.
For the purposes of subsection 5F(1) of the Act —
(a)
the working days of the Customs are each day of
the year except those days appointed to be
public holidays in accordance with section 40 of
the Public Service Act 1979; and
(b)
the working hours of Customs on working days
are from 8.54 a.m. to 5 p.m.

Payment for attendance other than on working day
“ 8.
(1)
For the purposes of subsection 5G(1) of the
Act, where the attendance of an officer is required at a ship or
aircraft on a day that is not a working day or during hours that
are not prescribed under regulation 7, the owner of that ship or
aircraft shall pay to the Collector in respect of that attendance
the amount specified in column 3 of the Table in subregulation
(2) opposite the classification of a ship or aircraft specified in
column 2 of the Table.

Where a classification of an aircraft is not
specified in column 2 of Part 2 of the Table the amount referred
to in subregulation (1) is the amount payable in respect of the
classification in that Part of an aircraft of similar length.

Exemptions
“ 9.
Regulation 8 does not apply to a ship or aircraft that
is —
(a)
carrying the head of state of a country;
(b)
in or apparently is in, the service of the defence
force of a country; or
(c)
engaged for the purpose of —
(i)
medical evacuation; or
(ii)
search and rescue operations.”.

This instrument amends Regulations made on 28 September 1936 as previously amended
by Regulations No. 1 of 1961, 2 of 1969, 4 of 1980, 3 of 1981 and Act No. 9 of 1982.
