(a)
FOLDER NO.1
Folder No.1 should consist of the following documents wherever applicable: (i)
Service Books all parts duly numbered with up-to-date audit
enfacement by the concerned Audit Officer.(Entries in loose
sheets if any are required to be copied in the service book/page
numbered and attested).
(ii)
History of Gazetted service all sheets (where applicable) duly numbered.
(iii)
Service Record of previous Central/State Govt./authorized
autonomous body service prior to joining in MES with CDA
(Pension) Allahabad audit vetting for counting such service, for
pension in MES and PTO /entry to this effect.
(iv)
Original letter of concerned audit report regarding verification of
qualifying service, done after 25 years of service if SB centralized
after 25 yrs of service.
(v)
Up to date leave account duly audited by the concerned Audit
officer.
(vi)
A certificate from the designated SB maintaining office/head of
Record Office of Command CE as per following format:(a)
The entries regarding verification of service for the entire
period of service upto__________ have been recorded in
the service book except for the period _______ (Reason for
this gap should be given in the forwarding letter or a special
note with action taken).

That all PTO's have been entered into the service book of

Declaration of date of birth with CTC of Date of birth.

Certified true copy of order of competent authority regarding
relaxation of age, if applicable.
(iv)
Certified true copy of the order regarding change of date of birth, if
any, approved by the competent authority.
(v)
Medical Board Proceedings or Medical certificate in terms of Art 49
of CSR on initial appointment in MES.
(vi)
Certificate in support of verification of character and antecedents.
Or PTO Record entries in case of Direct recruit Officer.
(vii) Documentary proof in support of change of name, if any, adopted.
(viii) Marriage declaration.
(ix)
Oath of Allegiance to the constitution.
(x)
Oath of secrecy.
(xi)
Certificate of religion change if any.
(xii) In case officer belongs to SC/ST community, a certificate in

effect that all the documents in respect of the officer required to
be kept in Folder No. 2 have been checked and there is no
deficiency in this documentation of the service records of the
officer.

Folder No. 3 should contain the following and maintained and updated
at unit level:

Index Card of the Officer.
(b)
Unit copy of leave A/C.
(c)
Copies of all nominations for GPF, Pension, Gty, CGEIS etc.

PENSION/GRATUITY CLAIMS IN RESPECT OF PERSONS PROMOTED
AS OFFICERS WITHIN ONE YEAR OF RETIREMENT
1.
It has been experienced that pension/gratuity claims of persons promoted as offrs
during last one year of their service are being delayed due to the following reasons:(a)
Service book not centralized with CRO (O) within six months of
retirement date thus leaving no adequate time for pay fixation and pension
processing.
(b)
Pension case not initiated as subordinate as per laid down time schedule
in anticipation of promotion and higher pay fixation.
2.
To overcome this trend and to avoid delay, the following procedure will henceforth be
strictly adhered to: (a) Service book of such newly promoted officers as referred above will be sent for
centralization not less than nine months before date of retirement.
(b) Pension papers will be initiated as per time schedule in the existing pay scale
(subordinate) without waiting for promotion/pay fixation as officer. Subsequent
revision of pension etc can be carried out. In case any potion of promotion , an
undertaking for delaying PPO as per proforma attached as Appendix be obtained
and submitted.
(c) In case the service book cannot be centralized for any reason before nine
months of retirement, pension case should be initiated as subordinate by
Command Chief Engineer. The service book should be sent for centralization and
pay fixation and subsequent revision of pension as officer by the concerned
formation/Command Chief Engineer only on return of service book from paying
CDA after scrutinizing of pension case. In no case initiation of pension case will be
delayed.

Responsibility for delays in issue of PPO and subsequent claims of interest on this
account due to non-compliance of above instructions will devolve on the unit/formations
where the officer is employed during the period.
4.
These instructions be transmitted down to GE level for strict compliance.

CONDITIONS FOR CLAIMING STEPPING UP OF PAY
AND DOCUMENTORY REQUIREMENTS

Both the senior and junior officers should belong to the same cadre and the post to
which they have been promoted or appointed are identical and in the same cadre.
The scales of pay of the lower and the higher post should be identical.
Anomaly should directly arise from application of the relevant rules/orders.
The stepping up of pay is admissible with reference to the first junior (not necessarily
immediate junior) on only one occasion, but if the junior concerned gets his pay
stepped up at par with his junior then the pay of the senior may against be stepped up.
The junior officer should not have been drawing more pay than to senior officer from
time to time in the lower post.
Where the table of concordance was applied, the senior officer should not be drawing
less pay than his junior officer in the junior or Group 'A' scale on the date of his
promotion.
Advancement of date of next increment of senior officer is admissible only if he was
drawing more pay than the junior officer in the pre-revised scale and his pay in the
revised pay scale is fixed at the same stage as that of his junior.
The senior and the junior officer should have held the appointments on regular basis.
In other words, if any one of them is holding the appointment on Adhoc basis, stepping
up of pay is not permissible in such cases.
DOCUMENTARY REQUIREMENTS
The units/fmns concerned should forward the following documents invariably with respect to
the concerned officer: (i)

The period of break, if any, between the spells of previous service and the
current service in MES, is required to be regularized by grant of joining time or

temporary service, the period of break is to be regularized by grant of leave by

SUB : PROCESSING OF PENSION CLAIMS OF OFFICERS INVOLVED
IN DISCIPLINARY CASES
1.
Of late pension claims of retiring officers involving discipline angle are getting delayed
unduly, apparently, due to some confusion in determining the involvement. Observations
raised on this account and staggered response by units has been cutting into the time
schedule of TEN months for initiating the pension claim. This has a cascading effect on
delaying the issue of the PPO by PCDA(Pensions) Allahabad
2.
To avoid delays in such cases, the following clarificatory instructions are issued:(a) Determination of involvement in a disciplinary case :The following actions / events having due authority only qualify to declare a retiring officer
as involved in a ` discipline' case.
(i)
When under suspension irrespective of whether Charge memo issued or not.
(ii)
Suspension revoked due to judicial or other order but case not finalized and
suspension period not regularized.
(iii)
Formal charge sheet issue under Rule 14 of CCS (CC&A) Rules 1965. A charge
sheet under Rule 16 does not subsist as such cases have to be finalized before
date of retirement.
(iv)
Formal charge sheet not issued but a decision to serve charge sheet taken by
the Competent Authority and recorded communication to this effect to be quoted
as authy if draft charge sheet is called for by the disciplinary authy.
(v)
Case filed by CBI / Police quoting details of charge sheet filed and date.
(vi)
Convicted by a court of law in a criminal case.
(vii) Detained in Police / judicial custody for more than 48 hrs and deemed
suspended.
In all the above contingencies the offr is deemed to be involved in a `discipline' case.
In such an eventuality, references of authy / communication under which the officer is
involved in a `discipline' case should invariably be indicated in Appx `14' of the pension
claim. Without the reference of authy the provisional pension case cannot be
processed. A copy of the authy / charge memo / Intimation from Judicial / Police / CBI
as the case may be should be enclosed.

(c) When only enquiry is in progress
(i) No effect on pensionary benefits and need not be reflected.
(ii) In case charge memo is issued at a subsequent date after finalization of the
enquiry, same has to be informed to CRO (O) with copy of the memo and the appx 14
initiated afresh.
(iii) In case charge memo is issued after transmission of the PPO to the bankers, same
has to be retrieved by the unit / formation where the officer is serving / served and fwd
to this office along with documents as above to initiate provisional pension claim.
3. In short, Heads of Offices are to ensure that the retiring offrs get their correct dues.
Neither short payment due to wrong interpretation of the involvement nor overpayments be
made. Special watch of the integrity aspect is to be kept till date of retirement in respect of
retiring officers who are involved in an ongoing inquiry. Some illustrative formats of Appx 14
and Appx 15A IAFA 356 representing different types of cases are enclosed as annexure I to
III for practical guidance. The above info should be disseminated down to AGE (I) level and
acknowledgement obtained.

Submission of Pension, Gratuity/Commutation Claims
1. Reference further to CRO (O) Adm Instruction No. 4 & 5 issued vide CRO (O) letter No.
2/3/88 dated 27.9.88 and Even No. dated 1.10.88 respectively regarding processing of
Family Pension / Pension / Terminal Benefits cases and CRO (O) clarificatory letter No.
90724/INSTS/01/EIB (P&A) dated 25 Jun 2001 on the same subject
2. Appendix 16 being attached with pension claims is hereby dispensed with immediate
effect.
As a result certain modifications in the format of pension application have been carried out.
Consequently sub para (i) and (j) of para 2of this office letter No. 90724/INSTS/01/EIB (P&A)
dated 25 Jun 2001 are deleted and replaced with a new single sub para viz. (j) as under: Para 2 (j)
(replacing para 2 (I) and (j) of CRO abid letter dated 25 Jun 2001.
The existing appendix 14 format is merged with appx 15 and is redesignated
appx 15 A which is an already existing prescribed pension format of IAFA 356.
This format as modified is attached as appendix 15A forming part of IAFA 356
(The pension application). In case the Officer is involved in a disciplinary case,
the same has to be clearly mentioned with details of references of charge
memos issued, Competent Authy, and a copy of the Charge memo served etc.
It may be emphacized here that an Officer is considered to be involved in a
disciplinary only when a charge memo is served upon him or a specific decision
is recorded by the Competent Disciplinary Authority to issue a charge memo,
but the actual issue is under process. If a draft charge memo is submitted to
the Competent Authy for approval, such a fact must be clearly spelt out.
Subsequent issue of the charge memo must also be intimated to CRO (O) with
a copy and fresh appx 15A submitted. Please note that investigation of alleged
lapses by a Court of Inquiry or the recommendations of a Court are NOT the
Authy for considering involvement in disciplinary case and should not be
indicated. Appx 15 A should invariably be signed by the Head of the Office only

and NOT by any other Adm. Authy. In case of CE Command office only, if so
considered absolutely necessary due to any reason, this certificate may be
signed by ACE Command concerned for whom specific delegation for this
endorsement is given. Certificates signed by any other Adm Authy will be
rejected and delay on that account in pension process rests on the Unit
concerned. The existing appendix 14 format is modified as per attached
appendix. Appendix 16 is abolished being redundant in view of revised
Appendix 14. Appendix 14 should reflect involvement in disciplinary/judicial
proceedings / SPE Cases wherever a judicial/SPE /Police Charge Sheet is
actually issued or an officer is under deemed suspension for being detained in
Police/Judicial custody for over 48 Hrs. The certificate in appendix 14 should be
signed by HOO only. In cases where the retiring officer is the Head of the fmn /
office: - In such case, this certificate is to be signed by next superior in
Departmental chain of control where from the officer is retiring. Where the fmn
concerned is directly under E-in-C/Army HQ, this certificate will be rendered by
Command Chief Engr based on the integrity report by E-in-C EID. In this
connection a reference is invited to instructions issued vide E-in-C EIB (P&A)
letter No. E-in-C EIOB letter No. 90724/Gen/79/33/EIB (P&A) dt 12 Jan 2001.

With the issue of above amendment whereever, Appendix 14 is mentioned in our ibid
letter/Adm Instructions, this may be read as the modified Appendix 15A and whereever
appendix 16 is mentioned, this may read as the modified appendix 14.
