ELIGIHILITY CRITERIA Enlisted contractors of BSNL (Electrical Wing) whose financial limit is more
than the estimated cost. OR
For Sr. No. 1 Authorised Dealer or Firms who have completed 3 works of similar nature in last one
year from the date reckoned from issue of NIT.
The contractor shall submit & confirm1) Documentary
proof of satisfying above conditions with attested copies of Chartered
Accountant Certificates , photocopy of PAN Card issued by Income Tax department & valid
Maharashtra Sales Tax registration, Service tax registration, VAT registration,EPF
registration/Declaration regarding EPF to be furnished along with application .
2) The rates offered by the firm shall be excusive of service tax as applicable.The firm shall
claim service tax with the bill clearly funishing the complete details of service tax .BSNL under
no circumstances will consider any claim of service tax not claim along with the bill. It will be
firms responsibility to settle service tax with service tax authority.
3) The tenderer shall submit the tender in 2 sealed covers marked as cover 1 st & 2nd. The first
cover should contain the earnest money deposited in the shape of Demand draft / Pay order of
a scheduled Bank OR Nationalised Bank / State Bank Guaranteed by Reserve Bank of India
drawn in favour of as above in column no 4 (a) & 4(b).second cover should contain the Tender
documents. In case 1st cover is not annexed EMD is not in proper form the 2 nd cover
containing tender will not be opened at all . In case holiday is declared on proposed date of
opening same shall be opened on next working day . Conditions & tender form can be had
from sub-Division on payment as per column no 6 ( non refundable) OR can be down loaded
from below mentioned web site.

ii)
Second envelope shall contain duly filled tender document.
The same shall be clearly written on the envelopes.
1. The 1 st envelope containing Tender fee (Non refundable), documents proving fulfillment of

In case :(I) Tender fee is not submitted in proper form.

Agreement shall be drawn with the successful tenderer on prescribed Form No. CPWD 8
which is available as a Government of India Publication. Tenderer shall quote his rates as
per various terms and conditions of the said form which will form part of the agreement.

The time allowed for carrying out the work will be One month
Day after award of work indicated in the tender documents.

Tender documents consisting of specifications, the schedule of quantities of the various
classes of works to be done and the set of terms and conditions of contract to be
complied with by the contractor whose tender may be accepted and other necessary
documents can be seen in the office of The Sub-Divisional Engineer (E), BSNL Electrical
Sub-Division, Gr. Floor, Telephone exchange bldg.,Jalgaon. invites on behalf of Bharat
Sanchar Nigam Limited between hours of 11.00 AM and 04.00 P.M. everyday except on

Sundays and Public Holidays. Tender documents, excluding standard form, will be issued
from his office, during the hours specified above, on payment of Rs. 150 + VAT as
applicable in form of D.D.of Scheduled Bank.( i.e.Rs.169/-)

The tenderer must produce a Chartered Accountants Certificate showing details of
Income-tax returns duly filed and no dues are outstanding towards Income-tax, certificate
before tender papers can be sold to him.

Tenders, which should always be placed in sealed envelope, with the name of work and
due date written on the envelopes, will be received by the The Sub Divisional Engineer
(E), BSNL electrical Sub-Division Gr floor T.E. Bldg.,Jalgaon. upto 03.00 P.M. on
18/07/2012 and will be opened by him or his authorised representative in his office on the
same day at 03.30 P.M.
The tender shall be accompanied by earnest money (unless exempted), of Rs. 874/- in
cash/Receipt Treasury Challan/Deposit at Call receipt of a Scheduled Bank/Fixed Deposit
Receipt of a Scheduled Bank/Demand Draft of a Scheduled Bank issued in favour of A.O.
BSNL, Civil Division,Akola, payable at A.O. BSNL, Civil Division, Akola.The Fixed Deposit
Receipt shall be accepted only if it is valid for six months or more after the last date of
receipt of tenders and is pledged in favour of A.O. BSNL,Civil Division, Akola, payable at
Akola.
A contractor exempted from depositing earnest money in individual cases, shall enclose
with the tender an attested copy of the letter exempting him from depositing earnest
money, in a manner described for earnest money in condition No. 8.2 below, and shall
produce the original when called upon to do so.
8.2
The tender and the earnest money shall be placed in separate sealed envelopes each
marked 'Tender' and Earnest Money' respectively. In cases where earnest money in cash is
acceptable, the same shall be deposited with the Cashier of the concerned SSA and the
receipt placed in the envelope meant for earnest money. Both the envelopes shall be
submitted together in another sealed envelope. The envelope marked "Tender” of only
those tenderers shall be opened; whose earnest money placed in the other envelope
isfound to be in order.

Copies of other drawings and documents pertaining to the works will be open for
inspection by the tenderers at the office of the above mentioned officer.
9.0
Tenderers are advised to inspect and examine the site and its surroundings and satisfy
themselves before submitting their tenders as to the nature of the ground and sub-soil. (so
far as is practicable), the form and nature of the site, the means of access to the site, the
accommodation they may require and in general shall themselves obtain all necessary
information as to risks, contingencies and other circumstances which may influence or
affect their tender. A tenderer shall be deemed to have full knowledge of the site whether
he inspects it or not and no extra charges consequent on any misunderstanding or
otherwise shall be allowed. The tenderer shall be responsible for arranging and
maintaining at his own cost all materials, tools and plants, water, electricity access,
facilities for workers and all other services required for executing the work unless
otherwise specifically provided for in the contract documents. Submission of a tender by a
tenderer implies that he has read this notice and all other contract documents and has
made himself aware of the scope and specifications of the work to be done and of
conditions and rates at which stores, tools and plant, etc. will be issued to him by the
Government and local conditions and other factors having a bearing on the execution, of
the work.

The competent authority on behalf of the BSNL does not bind himself to accept the
lowest or any other tender and reserves to himself the authority to reject any or all the
tenders received without the assignment of any reason. All tenders in which any of the
prescribed condition is not fulfilled or any condition including that of conditional rebate is
put forth by the tenderer shall be summarily rejected.
The Public enterprises that avail benefits of the purchase preference should be subjected
to adequate penalties for cost overruns etc.
Canvassing whether directly or indirectly, in connection with tenders is strictly prohibited
and the tenders submitted by the contractors who resort to canvassing will be liable to
rejection.
12.0
The competent authority on behalf of BSNL reserves to himself the right of accepting the
whole or any part of the tender and the tenderer shall be bound to perform the same at
the rate quoted.
13.0
The contractor shall not be permitted to tender for works in the
Telecommunication/Postal (responsible for award and execution of contracts) in which his
near relative is posted as Divisional Accountant or as an officer in any capacity between
the grades of Superintending Engineer and. Junior Engineer (both inclusive). He shall also
intimate the names of persons who are working with him in any capacity or are
subsequently employed by him and who are near relatives to any gazetted officer in the
BSNL or in the Ministry of Communication. Any breach of this condition by the contractor
would render him liable to be removed from the approved list of contractors of this
Department.
14.0
No Engineer of gazetted rank or other gazetted officer employed in Engineering or
Administrative duties in an Engineering Department of the Government of India is allowed
to work as a contractor for a period of two years after his retirement from Government
service, without the previous permission of the Government of India in writing. This
contract is liable to be cancelled if either the contractor or any of his employees is found
any time to be such a person who had not obtained the permission of the Government of
India as aforesaid before submission of the tender or engagement in the contractor’s
service.
15.0
The tender for the works shall remain open for acceptance for a period of ninety (90) days
from the date of opening of tenders. If any tenderer withdraws his tender before the said
period or makes any notifications in the terms and conditions of the tender which are not
acceptable to the department, then the Government shall, without prejudice to any other
right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid.
16.0 This Notice Inviting Tender shall form a part of the contract document. The successful
tenderer/contractor, on acceptance of his tender by the Accepting Authority, shall, within
15 days from the stipulated date of start of the work sign the contract consisting of:a) The notice inviting tender, all the documents including additional conditions,
specifications and drawings, if any, forming the tender as issued at the time of invitation
of tender and acceptance thereof together with any correspondence leading thereto.

The work shall be done as per current CPWD and BSNL specifications for Electric
works as amended from time to time and Indian Electricity Rules as amended up
to date.
A qualified supervisor shall supervise the work.
The layout of the work will be given by the Engineer-in-charge or his duly
authorised representative at site of work.
All the materials not mentioned in the list of approved makes shall be got
approved from engineer-in-charge before bringing them to site.
After completion of work, the contractor will have to submit the completion
plan in triplicate.
The quantity of item shall vary as per site requirement.
Bill shall be produced for the items purchased if required/demanded.
INSPECTION OF SITE:
For the purpose of inspection of site and relevant documents the contractor is
required to contact E.E. (Elect) concerned and shall give reasonable facilities for
inspection of the same. The contractor shall inspect and examine the site and its
surroundings and shall satisfy himself, before commencement of work, to the form and
nature of the site, the nature of work, and the quantities of materials necessary for
completion of the work, the means of access to the site etc. and in general shall
obtain all necessary information as to risks, contingencies and other circumstances
which may influence or affect his work. No extra charges consequent on any
misunderstanding or otherwise will be allowed.
SCHEDULE “B”
“IMPORTANT NOTE FOR CONTRACTORS”
The firm shall read carefully the following conditions and shall quote accordingly
confirming all the points
in their offer.
1)
TAXES AND DUTIES:
The firm shall quote rates for all items inclusive of all taxes, duties, octroi and
except service tax. No any confessional form will be issued by the BSNL. SERVICE TAX
WILL BE REIMBUERSED ONLY ON SUBMISSION OF DOCUMENTORY PROOF OF
REGISTRATION WITH EXCISE DEPARTMENT AND RECEIPT OF PAYMENT.
2)
WORKS CONTRACT TAX: -
a)
The rates offered by the firm shall be inclusive of works contract tax
as applicable in the state. The BSNL shall deduct work contract tax
from payments due to the firm as per rules of the state Government.
Certificate for such deductions shall be issued to the firm by the
Accounts officers of the concern division/SSA.
b)
In case the work is awarded for the sites in Goa state where less WC tax has been
levied by the State Govt., there will be a reduction of 1 (One) % in the total
contract value. The decision of SE (E) in this regard shall be final and binding to
the agency.

3)
SERVICE TAX:SERVICE TAX at the prevailing rate together with Education Cess shall be paid
by the contractor to the Excise Department, The firm shall claim Service tax with the
bill clearly furnishing the complete details of Service tax so included. BSNL, under no
circumstances, will consider any claim of Service tax not included in the bill. It will be
the firm’s responsibility to settle Service tax with Service tax authorities.
a) Tendered rates are inclusive of taxes and levies except Service Tax payable
under the respective statutes. However, pursuant to the Constitution (Forty Sixth
amendment) Act 1982, if any further tax or levy is imposed by statute after the
date of receipt of tenders and the contractor(s) thereupon necessarily and
properly pays taxes or levies the contractor(s) shall be reimbursed the amount so
paid provided such payment if any is not in the opinion of SE (E) whose decision
shall be final and binding) attributable to delay in execution of work within the
control of the contractor(s).
b) The contractor(s) shall keep necessary books of accounts and other documents
for the purpose of this condition as may be necessary and shall allow inspection of
the same by a duly authorized representative of Government and shall furnish
such other information's /documents as the Engineer-in-Charge may require.
c) The contractor(s) shall within a period of 30 days of imposition of any further
tax or levy pursuant to the Constitution (Forty Sixth amendments)
Act 1982 give a written notice thereof to the Engineer-in-Charge that the same is
given pursuant to this condition together with all necessary information relating
thereto.
NOTE :- No additional condition whatsoever will be accepted for turnover
tax/sales tax on works contract. In case of additional conditions for the
payment of such taxes by the contractor the tender may be liable to be
summarily rejected by the accepting authority. No conditional offer shall be
entertained and rejected.

Subject :-compensation to be levied in cases of use of duplicate /spurious material BSNL
reserves the right to get material inspected any components thereof by the manufacturer
/ their authorized representative , whose report as regards to the genuineness of
component shall be final & binding . In case any component upon such inspection is found
to be duplicate / spurious ,double the cost of such component based on price list (
without any discount whatsoever ) effective on date of aforesaid inspection shall be
recoverable .
In case contractor agrees to replace the components so found spurious / duplicate at his
cost , within 15 days of the said report compensation of Rs 1000/- per component found
spurious /duplicate shall be levied against the contractor .
Besides the above the BSNL reserves the right to take disclipanry action against the
contractor .
Decision of S.E. in such case shall be final & shall be out of purview of clause –25 of
arbitration.

5. Certificates to be furnished by the contractor about relative working in the BSNL.
The Format of the certificates is :I ------------------------------ S/O ------------------ r/o--------------------Hereby certified that none of my relative ( s ) as defined in the tender document is/are
employed in the BSNL units as per details given in the tender documents .In case at any
stage , it is found that information given by me is false /incorrect. BSNL shall have the
absolute right to take any action as deemed fit / without any prior intimation to me.
Note :- The relatives for this purpose are defined as :Members of Hindu Undivided Family ,

SPECIFICATION
1.
The work is to be carried out as per CPWD specification Part I.E. Rule amended
up to date.
2.
Good workmanship is an essential requirement to be complied with. The entire
work of manufacture, fabrication, assembly and installation shall confirm to sound
engineering practice.
3.
The work shall be treated as on works contract basis and the Rates tendered shall
be for complete item of work inclusive of All taxes, duties and levies.
4.
Being an indivisible works contract, sales tax, excise duty are not payable
separately.
5.
Works contract tax, if any, for the work shall be included. The works contract tax
shall be deducted from the bill of contractor, if applicable in the state in which
the work in carried out.
6.
Octroi duty shall not be paid separately for the materials supplied by the
contractor Unless specially specified. However the department is not liable to
reimburse the octroi duty production of proof.
7.
Rates quoted shall be inclusive of packing, forwarding, Insurance, freight and
delivery at site watch and ward of all materials.

8.
All sundry fittings, assemblies, accessories, hardware items, Foundation bolts,
termination lugs for electrical connection as required and other sundry items
which are useful and necessary for proper assembly and efficient working of the
various components of the works shall be deemed to have been included in the
tender.
9.
Following works shall be carried out by the contractor and therefore their cost
shall be deemed to be included in their tendered cost.
The contractor shall be responsible for repairing all damages and restoring the
same to their Original finish.He shall also remove at his cost all unwanted and
waste materials arising out of his work from the site
All chases required in connection with the electrical works shall be provided and
filled by the contractor to the original finish.
Temporary shed if required over the storage space and locking arrangement,
watch and ward the material shall be provided by firm till completion of the
work and final taking over of the installation by the department.
Water and power as required for installation and testing shall be provided by
department.

The contractor shall employ qualified engineer/supervisor as required and
intimate names of such persons to the Enginner-In-Charge on commencement of
work. Failure to employ will attract penalty as per agreement.

ADDITIONAL SPECIFICATION FOR THE WORK :1. The work shall be done as per current CPWD specification for electrical works as
amended from time to time and Indian Electricity rules as amended upto date.
2.The work shall be supervised by a qualified overseas.
3.The layout of the work will be given by the Engineer-in-charge to his duly authorized
representative at site of work.
4.The tenderer should submit the sealed samples of materials to be used on work
alongwith the tender. The
sample of the successful tenderer will be retained by the Engineer-in-charge while the
samples of others will be returned after the tender is decided, unapproved materials,
if used on the work shall have to removed immediately at the cost and risk of
contractor.
5. The contractor will have to submit the following tests at his cost & intimate test result
before final bill is paid nothing extra will be paid to him on this account.Earth Test,
(2) Polarity Test, (3) Insulation test, (4) Earth continuity test of the recessed conduit.

6. Any damage done to the building by the contractor during execute of work shall have
to be made got done at his own cost and risk. If he does not do it himself within a
reasonable time determined by the Engineer-in-charge then the same will be got done
at his cost by the Department after giving a notice to him.
7. Under ground cables both of 1.1KV and of 1.1 KV grade should be subjected to
pressure/insulationTests before and after laying the same in the ducts and in case of
unsatisfactory test and the cost of all repair & replacement and all extra work of
removal and relaying will have to be made good by the contractor his own cost and
risk. The following points may be taken into consideration while laying conduits for the
fire alarms/clock wiring the opening of the conduits will be approximately at the
height of 4.00 and shall be different for clocks indicators and bells in case only a single
conduit is used through there no objection if they are made side by side. Generally
clocks in the switch room shall be at the two concern gangways and at a distance of
500mm from the wall. Fire alarms indications and below shall aware from the MDF
rocks/verticals and may fade the test desk. Indicators may preferable be placed the
exists A/N and power room clocks shall be places generally on side wall and if possible
opposite entrance, indicators and bell shall be located near the door.
8. Termination of all connections on main board and sub main distribution boards will be
done by crimping and nothing extra will be paid on this account.
9. All instruments shall be arranged by the contractor, Deptt. Instrument may also
be is used, if available @ Rs._______ per day/instruments.
10.All cable having more than one strand should be invariable crimped with dowells
lugs/ferrules of approximate Six crimping tools is to be arranged by the contractor at
no extra cost. In case contractor fails to bring crimping tool, Deptt. may supply
crimping tool, subject to availability, at an extra cost of Rs.________ per day,
responsibility on account of delay shall be rest entirely with the contractor.
11.Inter connections will be done thimble/ferrule and nothing extra will be paid on
account of this.
12. The Agency will have to make his own arrangement for temp. lighting and nothing
extra will be paid on account of this.
