2. Tender document can be purchased on written request from the office of Sr. Divisional Mechanical
Engineer, ECR, Samastipur between 10.00 to 13.00 hrs. on any working day upto one day before the date
of opening of tender on payment of Rs.1000.00 (One thousand only) in cash personally and on Rs.1500.00
(One thousand five hundred only) money order for the tender form if required by post may be sent 07 days
before which is not refundable. Postal order or demand draft are not acceptable. Sale of tender paper will
be closed one day before the notified date of tender opening. Request for tender form by post will be
entertained up to 07 days before and in person one day before the due date from Sr. Divisional Mechanical
Engineer, ECR, Samastipur office. Railway administration is not responsible for any postal detention.
3. Tenders can also be sent to Senior Divisional Mechanical Engineer, East Central Railway, Samastipur848101 by registered post/speed post/courier service to reach before 15.30 hrs. of the date of opening.
However, Rly. Will not be responsible for non-receipt or delayed receipt of such tenders.
4. In case any un usual occurrence viz strike, Band, holidays etc, the dropping of tender & opening of tender
shall be done on the next working day at schedule time at scheduled place.
5. Tender shall be accompanied by earnest money along with the tender duly pledged with FA&CAO, ECR in
cash or in the form of demand draft/deposit receipt executed by any nationalized bank, bank guarantee
bond is not acceptable. Tenders not accompanied with requisite earnest money should summarily be
rejected.
6. The total earnest money will constitute as security deposit for the payment of the stipulation to keep the
offer open for a period of 90 days from the date of opening of tender or within the further period extended
by mutual agreement.
7. If the tenderer retract from his offer or modifies the terms & condition in manner not acceptable to the
Railway administration the aforesaid full earnest money shall be liable to be forfeited.
8. The successful bidder may give performance guarantee amounting to 5% of the
contract value in any of the following forms: (i)
A deposit of cash
(ii)
Irrevocable Bank Guarantee.
(iii)
Govt. Securities including state loan Bond at 5% below the market rate.
(iv)
Deposit receipts, Pay orders, Demand Drafts and Guarantee Bonds. These forms of
performance guarantee could be either of the State Bank of India or of any of the Nationalised
Banks.
(v)
Guarantee Bonds executed or deposits receipts tendered by all scheduled Banks.
(vi)
A deposit in the Post office saving Bank.
(vii)
A deposit in the National Saving Certificates.
(viii)
12 yrs. National Defence Certificates
(ix)
Ten years Defence deposits

National Defence Bonds and
(xi)
Unit Trust Certificates at 5% below market value or at the face value which ever is less.
Also FDR in favour of FA&CAO (free from any encumbrance) may be accepted.”
9. The security money: - In the event of tender being accepted, the security deposit/rate of recovery/mode
of recovery shall be as under: (a) Security money deposit for each work should be 5% of the contract value.
(b) The rate of recovery should be @ 10% of the bill amount till the full security deposit is recovered.
(c) Security deposit will be recovered only from the running bills of the contract & no other mode of
collecting SD such as SD in the form of instruments like BG, FD etc. shall be accepted towards
security deposit.
10. The tender notice is also available on web site http://www.ecr.indianrail.gov.in. The tender document can also
be down loaded from the date of publication up to one day before the date of opening of the tender. The facility
is available free of cost however demand draft for the amount as mentioned each of the work towards cost of
tender paper in favour of FA&CAO, ECR payable at Samastipur will have to be enclosed with tender document
in addition to earnest money.
In case of tender document down loaded from Internet web site if tender is not accompanied with
valid demand draft towards the cost of tender documents with the tender document, the tender will be
summarily rejected. Railway administration will not be responsible for any delay/difficulty/inaccessibility
of the downloading facility for any reason what so ever. In case of any discrepancy between the tender
document down loaded from Internet and the master copy available in the office mentioned above, the
latter shall prevail and will be binding on the tenderer. No claim on this account will be entertained.
Other terms and conditions, applicable to this tender, are incorporated in the Tender Documents.
The Railway Administration reserve the right to accept or reject the tender without assigning any
reason thereof.
